First obtain the facts in writing, map the delay against the programme, check the signed contract and then approve—or reject—a documented solution. Keep payments tied to the contract and completed work, protect your housing plans and escalate through the authority for the location of the project if the builder will not resolve the issue.
This checklist is practical rather than a statement of universal legal rights. The strongest official guidance available for this subject is Australian and jurisdiction-specific. Contract remedies, notice periods, compensation, insurance thresholds and dispute services differ by state, territory and country, so identify where the project is located and obtain local professional advice before withholding money, accepting a disputed extension or terminating a contract.

1. Get a precise explanation before changing anything
Ask the builder to answer these questions promptly and in writing. A statement such as “the supply chain is delayed” is not enough to assess the effect on your project.

- Which exact material, product or component is late?
- Has it been ordered, and on what date?
- What does the supplier now expect as the delivery date, and is that date confirmed or only an estimate?
- Which construction activities are blocked?
- What work can continue safely while you wait?
- Is the delayed item on the project’s critical path, or can the sequence be rearranged?
- What is the current forecast completion date, and what assumptions produce it?
- What action is the builder taking to reduce the delay?
Request the supplier update or other supporting information that the builder is permitted to share, together with a revised programme showing affected activities and dates. NSW Government guidance tells homeowners to ask builders to be upfront about delays and to check the contract’s delay clauses before agreeing to an extension.

2. Work out the real schedule effect
A late delivery does not automatically equal an equal-length delay to handover. The impact depends on whether the item controls the critical path, whether another task can proceed first and whether installation requires follow-on trades.
Separate blocked work from work that can continue
Ask for two lists: activities that cannot start or finish without the material, and activities that can proceed without creating rework. For example, a delayed finish may prevent final installation but still allow preparation, inspection or work in another area. Confirm that any resequencing will not compromise quality, warranties, weather protection or safety.
Demand a dated forecast
The revised programme should show the original contractual completion date, the expected delivery date, the installation date and the resulting completion forecast. Ask the builder to identify contingency and the date on which the forecast will be reviewed if the supplier misses again. Keep every version; schedule changes are easier to understand when the original and revised dates are side by side.
3. Read the contract before accepting an extension
Locate these provisions in the signed contract and any incorporated specifications:
- the date or mechanism for calculating practical completion;
- allowances for foreseeable delays, including material availability;
- notice requirements, including how and when a delay notice must be served;
- extension-of-time procedures, evidence and response windows;
- allowances, provisional sums and clauses that permit price adjustment;
- variation procedures for changes to scope or specification; and
- the required negotiation, mediation, adjudication or court process.
Do not assume that the words “supply chain” automatically extend the completion date or permit a higher price. The effect depends on the actual clause, the reason for the delay and the law where the property is located. NSW guidance specifically advises checking the relevant clause and reason before agreeing to an extension. Victorian guidance describes local extension procedures that should not be transplanted to another state.

Before you sign an extension, ask five questions
- What contractual clause authorises the extension?
- What event caused the delay, and when did the builder become aware of it?
- How many calendar days are requested, and how was that number calculated?
- What mitigation or alternative sequencing has been considered?
- Does the proposed document change only the date, or also price, scope, liquidated damages, warranties or other rights?
If the builder cannot explain the contractual basis, pause and obtain advice from a construction lawyer or local building adviser. A negotiated date may be sensible, but it should not quietly surrender unrelated rights.
4. Evaluate a substitute as a specification change, not a favour
A substitute can avoid a long wait, but it may alter performance, appearance, maintenance, compliance, warranty or cost. Ask for the exact manufacturer, model, grade, dimensions, finish and installation system—not a generic description such as “similar product.”
| Comparison point | What to verify in writing |
|---|---|
| Code and specification compliance | Required standards, ratings, engineering requirements, approvals and compatibility with the drawings and contract specification. |
| Performance and durability | Expected service conditions, moisture or fire performance, wear resistance, maintenance requirements and the life of the warranty. |
| Appearance and finish | Colour, texture, profile, batch variation, visible joins and whether adjacent selections will still match. |
| Installed cost | Material price plus labour, freight, disposal, redesign, additional preparation and any effect on allowances or provisional sums. |
| Availability and programme | Confirmed stock or production date, installation capacity and the effect on the critical path. |
| Reversibility | Whether the decision can later be undone without demolition, and whether it affects adjoining materials or future maintenance. |
NSW guidance warns that substitute materials or project changes can affect both cost and build quality. Compare the proposed item with the original specification and retain the data sheet, sample, quotation and approval. Do not allow installation to begin on an oral promise that the difference will be “sorted out later.”
5. Put every agreed change into a signed document
If you accept a new material, revised date or changed sequence, record the complete deal:
- the original item or date and the replacement item or date;
- the reason for the change;
- delivery, installation and practical-completion dates;
- the exact price increase or saving, including tax and labour effects;
- who orders, stores and insures the material;
- any design, approval, warranty or maintenance consequences;
- what happens if the substitute is unavailable or defective; and
- that all other contract terms remain unchanged unless expressly listed.
Consumer Affairs Tasmania states: “Any variations to the contract terms must be in writing and signed by both the owner and the building contractor.” Victoria likewise advises that written changes should be signed before related work starts. Those are local requirements or guidance, not a universal rule for every project, so follow the form and notice method in your own contract and jurisdiction.

6. Treat extra charges as a contract question
Ask the builder to identify the clause or signed variation that authorises each proposed charge. Request an itemised breakdown showing the original allowance, the new quotation, labour or freight differences, credits for the omitted item and tax. A supplier’s price increase does not, by itself, prove that you owe it.

NSW guidance says many contracts restrict price changes unless a work variation or a contract-specific exception applies. That statement is NSW-specific; another jurisdiction or contract may operate differently. Do not sign a blanket “materials escalation” acknowledgement when the amount, trigger or calculation is unclear. Obtain local advice before accepting a disputed charge.
7. Keep payments aligned with the contract and completed work
Do not automatically withhold every payment because a material is late, and do not pay an unagreed extra amount merely to keep the project moving. Both responses can create a separate breach or weaken your position.
Check the payment schedule, stage definitions, retention provisions and any “as invoiced” wording. NSW guidance says to make agreed progress payments only after the relevant work is completed and to request evidence where a contract permits payment as invoiced. Victorian guidance similarly links stage payments to completion of that stage. Those instructions are jurisdiction-specific; apply the signed payment terms and obtain local advice if the stage is incomplete or disputed.

The US Consumer Financial Protection Bureau’s contractor guidance, last modified July 24, 2024, recommends written records and receipts and documenting who pays for materials, the quantity and quality, dates, total price, payment schedule and verbal promises. That is disaster-repair guidance rather than a materials-delay rule, but the record-keeping practice is useful on any project.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.9. Monitor progress without creating a safety problem
Ask for a short written update at an agreed interval—weekly during an active delay is often more useful than sporadic assurances. The update should state the latest supplier position, completed work, next activities, risks and decisions needed from you.
If you need independent assurance, a qualified building consultant can inspect completed work against the contract before a stage payment. Tell the builder in advance and agree the inspection process. Discuss site safety before visiting: an active construction site may contain restricted areas, unfinished structures and hazardous materials. Never enter an area the builder has closed or ask trades to demonstrate unfinished work unsafely.
10. Protect your move-in and household plans
If the property may not be ready, act before the original handover date. Ask your lender, landlord, storage provider, movers, utility companies, school or employer what flexibility is available. Consider extending your current accommodation or arranging temporary housing and storage, while keeping receipts for costs that may become relevant to a contract claim. Do not assume those costs are recoverable; entitlement depends on the contract and local law. NSW Government specifically recommends exploring alternative accommodation or extending existing arrangements when a new home is delayed.

Use the project’s local authority or dispute service
If the builder does not respond or the dispute remains unresolved, contact the consumer, building or fair-trading regulator and dispute-resolution service for the place where the work is occurring. Consumer Affairs Tasmania describes advice and free mediation. NSW and Victoria have their own procedures and forms. Do not import another state’s deadlines, thresholds or response periods into your case.
Get independent legal advice for high-stakes decisions
Consult a construction lawyer or suitably qualified adviser before accepting a disputed extension, withholding a payment, claiming significant damages, issuing a termination notice or approving a major specification change. Bring the contract, programme, correspondence, invoices and photographs so advice can address the actual documents.
What the market context does—and does not—tell you
Material shortages have affected Australian building projects, but broad statistics cannot decide your contractual rights. The NSW Government page reproduces Australian Bureau of Statistics figures showing a 15.4% national increase in housing-construction materials between March 2021 and March 2022 and a 13.4% increase in Sydney over the same period. Those are historical changes, not current prices or proof that a particular delay is excusable.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsThe same page displays 113,943 total dwelling approvals in NSW since 2020, a contextual figure for the period shown, and says 36% of builders reported rising material costs as a significant challenge in a Procore Builder Survey. The page does not identify that survey’s year, so the percentage should not be treated as a dated current market measure. Neither statistic replaces the evidence required for your project: the order, supplier forecast, contract clause and revised programme.
