What to Do When an Arbitral Award Rejects a Construction Cost Claim

An unfavorable construction arbitration award does not automatically create a right to appeal. Identify the seat, governing rules, receipt date and whether the claim was rejected or omitted before considering a remedy.

If an arbitral award rejects your construction cost claim, first identify the arbitration’s seat, the governing law and rules, and the date you received the award. Then determine whether the tribunal actually decided the claim or left it out. Those facts determine whether you may ask the tribunal to correct or supplement its award, have a court review it on a limited ground, or respond to enforcement proceedings. A disagreement with the tribunal’s assessment of cost evidence is not, by itself, necessarily a valid court challenge.

The seat, applicable rules, award and receipt dates, contract, and treatment of the claim are not specified here. Deadlines and remedies differ by legal regime, so do not rely on an example below as the deadline for your arbitration. Ask a lawyer qualified in the seat to review the award and procedural record promptly.

What can I do if an arbitrator rejects my construction cost claim?

There is no single remedy for an unfavorable award. The useful first question is not simply whether the result seems wrong; it is what kind of problem occurred. A claim may have been considered and rejected, presented but omitted from the award, affected by a correctable error, or connected to a procedural or jurisdictional defect. Each situation can involve a different decision-maker, remedy and time limit.

Begin by locating the arbitration’s seat, meaning the legal place of arbitration, and identifying the law and arbitration rules that govern the proceedings. The contract may identify an institution or rules, but the seat and applicable law still need to be confirmed. A construction project’s location alone does not establish which law governs the arbitration or a challenge to its award.

Have counsel compare the claim as it was pleaded and supported with the award’s reasons and operative terms. That comparison should establish whether the tribunal rejected the claim, omitted it, or addressed it but left a discrete issue unresolved. It should also identify any correction or interpretation procedure available under the governing law and rules, and whether using that procedure affects a court deadline.

Start with the claim’s status

  • Rejected: The award gives a decision against you on the claim, expressly or through its reasoning and final orders. The possible route, if any, depends on the governing law’s grounds for review or setting aside.
  • Omitted: You presented the claim in the arbitration, but the award does not decide it. Some laws or rules allow a request for an additional award. That is not the same as asking the tribunal to change a decision it did make.
  • Possibly misrecorded or unclear: A clerical or computational mistake, or an ambiguous part of the award, may call for a correction or interpretation request if the governing regime permits one.

Separate the type of problem from the desired remedy

Write down whether you want the tribunal to correct, interpret or complete its award; want a court to review or set aside some or all of it; or need to resist an effort to enforce it. These are distinct procedural tracks. A procedure for correcting an award is not automatically a court appeal, and an enforcement response is not the same as an application to set aside an award at its seat.

Can I appeal an arbitration award?

Do not assume that an arbitration award can be appealed just because you believe the tribunal misunderstood the contract, misvalued work, or gave too little weight to evidence. Whether any appeal or other court challenge is available depends on the applicable law and rules. Court intervention commonly turns on a legally specified ground, not a fresh assessment of the construction account on its merits.

For example, section 67 of the Arbitration Act 1996 in England and Wales concerns challenges to a tribunal’s substantive jurisdiction. Section 67(3) says a court may “confirm the award, vary the award, or set aside the award in whole or in part.” That wording describes the court’s powers in that statutory context; it does not make an ordinary disagreement about valuation a jurisdictional challenge.

Section 70 of the same Act sets procedural conditions for challenges within its framework, including generally requiring a party to exhaust available arbitral appeal or review procedures and recourse to correction or an additional award. It also provides a 28-day period subject to the applicable trigger-date rules. Whether these provisions apply, what action qualifies as the relevant challenge, and how the period is calculated require advice on the facts and current law.

Questions for counsel when the award rejected the claim

  • What ground for court intervention, if any, is available under the law of the seat?
  • Does the complaint concern jurisdiction or procedure, or is it a disagreement with the tribunal’s assessment of evidence, cost or contract meaning?
  • Does the governing regime require a tribunal correction, review or other step before a court application?
  • Would the proposed remedy address the part of the award that caused the loss?

Keep the distinction precise: describing an award as “wrong” or “unfair” does not establish that a statutory challenge ground exists. Counsel must map the asserted ground to the relevant provision and the procedural record.

What if the arbitrator did not decide my claim?

If a construction cost claim was presented but left undecided, check whether the applicable statute or rules authorize a request for an additional award. Confirm who must receive the request, the permitted form, the deadline, and whether the request changes or pauses any separate court deadline. Do not treat an omission as a rejection without examining the award and record.

Singapore’s Arbitration Act, section 43, provides a concrete statutory example: it addresses correction, interpretation and additional-award requests, and generally specifies 30 days from receipt for the described requests, subject to agreement and the statute’s details. In particular, its additional-award route concerns claims presented in the proceedings but omitted from the award. This is an example for a Singapore-governed case, not a universal 30-day rule.

Check whether the claim was actually presented

Assemble the relevant statement of claim or counterclaim, amended pleadings, cost schedules, submissions, hearing materials and tribunal correspondence. Identify where the claim was put forward, what relief was requested, and whether the tribunal addressed it under a different heading or incorporated it into another calculation. If the award expressly rejects the claim, a request for an additional award may not be a way to reopen that merits decision.

Do not let a tribunal request obscure another deadline

A correction, interpretation or additional-award request may have its own short window. A court challenge may have a separate window and trigger date. Ask counsel to calculate each applicable period independently and determine whether a tribunal request affects the court timetable under the governing regime. Filing one request should not be assumed to preserve every other remedy.

Could the award contain a correctable error or ambiguity?

Read the operative orders and relevant calculations carefully. A clerical slip, arithmetic mistake, or unclear wording may be different from a substantive decision to disallow a cost item. The tribunal’s authority to correct or interpret the award, the eligible kinds of error, the request procedure and the deadline all depend on the governing law and arbitration rules.

Section 43 of Singapore’s Arbitration Act is one example of a statute addressing correction, interpretation and additional awards. Its provisions should not be transplanted to an arbitration seated elsewhere. Check the actual applicable statute and rules, including whether a request must be made to the tribunal, whether another party must be notified, and how the period runs from receipt.

Be specific in any proposed request: identify the award passage or calculation, explain the alleged clerical, computational or interpretive issue, and state the correction or clarification sought. Do not present a request to correct an obvious error as if it automatically authorizes the tribunal to reconsider the merits.

How long do I have to challenge an arbitral award?

There is no safe universal deadline. The applicable period may depend on the seat, governing statute, type of application, award or receipt date, notice of a review outcome, and whether a correction or additional-award process is available. The examples below demonstrate variation; none establishes the deadline for an unspecified arbitration.

Regime and source What the cited period concerns Important qualification
England and Wales — Arbitration Act 1996, section 70 Generally 28 days for challenges within the section’s framework Subject to applicable trigger-date rules and procedural conditions, including exhaustion of relevant arbitral recourse. It is not a universal rule for all arbitration claims.
England and Wales — CPR Part 62 A 21-day rule for specified claims under provisions of the 1950 Act This specified rule is not interchangeable with the 1996 Act framework and is not a universal deadline for modern award challenges.
Singapore — Arbitration Act, section 43 Generally 30 days from receipt for the described correction, interpretation or additional-award requests Subject to agreement and statutory details; this concerns tribunal requests, not a general court-challenge period.
United States — 9 U.S.C. § 207 An application to confirm a Convention award may be made within three years This is a confirmation or enforcement period, not a deadline to challenge an award.
Canada — federal Commercial Arbitration Act framework The cited text describes a three-month period for setting aside Applicability depends on the arbitration and governing statute.
British Columbia — Arbitration Act 30 days for specified set-aside or appeal applications Applies to the specified applications under that statute, not to every arbitration or remedy.

These examples are not a menu from which to choose the most convenient period. Confirm the current statutory text and the precise trigger for the procedure that applies to your case. In particular, do not confuse a statutory confirmation period with the time to challenge an award or a tribunal-request window.

Make a deadline worksheet immediately

  1. Record dates: note the date of the award, the date and method of receipt, and any later notice of a review outcome or tribunal decision on a correction request.
  2. Identify the governing framework: confirm the seat, governing law, arbitration agreement, institution and rules with counsel qualified in the seat.
  3. List every possible route separately: record any tribunal request, court challenge, and enforcement response that may apply, along with its distinct trigger and filing requirement.
  4. Get the date confirmed: ask counsel to calculate the deadline under the applicable text, rather than relying on a general period or an informal calendar estimate.

What records should I preserve?

Keep a complete, organized copy of the award and the materials needed to show how the cost claim was put forward and decided. Preserve originals where possible, and record when the award and related communications were received. The core file should include:

  • the complete award, including its reasons, operative terms and any annexes;
  • proof of the award’s service or receipt, such as the relevant email or delivery record;
  • the arbitration agreement, construction contract and amendments;
  • the claim and counterclaim pleadings, amendments, requested relief and cost schedules;
  • the underlying cost records and supporting material relied on in the arbitration;
  • written submissions, hearing materials and relevant tribunal correspondence; and
  • any tribunal or party notices concerning correction, interpretation, review, additional awards or enforcement.

For a construction cost claim, the key exercise is to trace each disputed amount from the claim as presented, through its supporting records and submissions, to the award’s treatment of it. A lawyer can then assess whether the award decided the claim, left it out, or raises a procedural or other legally recognized issue. Preserve the record before deciding that a particular remedy is available.

What if the other party is trying to enforce the award?

Enforcement is a separate procedural question from whether the award can be corrected or challenged at the seat. If the other party seeks recognition or enforcement, obtain advice from counsel in the place where enforcement is pursued and observe the response procedure there. The available response and the relevant law depend on the enforcement forum and the award involved.

For a specific example of the distinction, 9 U.S.C. § 207 provides that an application to confirm a Convention award in the United States may be made within three years, subject to the Convention’s refusal or deferral grounds. That period concerns an application to confirm, not the time for setting aside or otherwise challenging the award. Do not use it as a substitute for determining the challenge deadline at the seat.

How do construction arbitration rules affect the issue?

Construction disputes may include claims for changes in contract cost, but the fact that a dispute concerns construction does not itself establish a post-award remedy. The governing arbitration agreement, seat, statute and rules determine the applicable procedures. The Philippines’ Construction Industry Arbitration Commission (CIAC) rules, for example, describe jurisdiction over construction disputes, including changes in contract cost, where the parties are bound by an arbitration agreement or submission. That context does not determine what a particular party may do after an award rejects a claim.

Read the arbitration agreement and applicable rules alongside the statute. They may help identify the tribunal’s correction or review powers and the required process, but do not assume an institutional procedure overrides a statutory deadline or applies to every arbitration.

What to do now

  1. Do not wait for informal discussions to resolve the deadline question. Send the award and receipt details to a lawyer qualified in the seat as soon as possible.
  2. Identify the seat, governing law and rules. Provide the arbitration agreement and contract so counsel can confirm the applicable procedural framework.
  3. Classify the problem. State whether the cost claim was omitted, rejected, affected by a possible clerical or computational error, or connected to a procedural or jurisdictional concern.
  4. Give counsel the full record. Include the pleadings, cost schedules, supporting records, submissions, hearing materials and tribunal correspondence, not just the award’s conclusion.
  5. Map remedies and dates independently. Ask which tribunal request, court route or enforcement response may apply, what each requires, and how each deadline is triggered.
  6. Make a reasoned decision on the route. Proceed only on a route supported by the applicable law and facts; a merits disagreement alone does not establish a right to appeal.
