Get a dated written explanation from the supplier, a realistic revised delivery date and a recovery plan. Then notify every project party required by the contract, measure the effect on the approved schedule and critical path, and investigate compliant alternate sourcing or resequencing. Do not promise an extension of time or compensation until the signed contract and governing law have been checked.
A late truck is not automatically a compensable project delay. The result depends on what was ordered, who was responsible for procurement, whether the affected activity had usable float, and what notice and mitigation duties your contract imposes.

Stabilize the facts in the first few hours
Confirm what was ordered and when it is needed
Pull the purchase order, approved submittal, delivery commitment, and current programme together. Confirm the exact material, quantity, specification, original promised date, and the date the site activity actually needs it. For steel, that may include the specified grade, size, finish or fabrication status. For cement, check the specified product, quantity and approved use. Use the contract and approved technical documents as the source of truth rather than an informal email or a verbal promise.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsRecord who procured the material. Owner-furnished material, contractor-procured material and a supplier’s own delay can be treated differently under the contract. A delivery slip must also be separated from late ordering, incomplete information, a rejected submittal or a transport problem caused by the project team.

Require a specific supplier update
Ask the supplier for a dated statement that covers:
- the original commitment and the latest forecast;
- the cause of the delay and when it began;
- the quantity affected and any partial shipment available;
- the expected duration and a credible delivery date; and
- the corrective measures, including expedited production, alternate transport or a recovery sequence.
One supplier contract illustrates the level of detail that may be required. ArcelorMittal’s General Conditions, section 14.3, states: “The CONTRACTOR shall immediately notify the BUYER in writing of any delay(s) which may occur with respect to the CONTRACTUAL TIME SCHEDULE and simultaneously give all information about (i) the reason and extent of said delay and (ii) the corrective actions and measures the CONTRACTOR will carry out in order to avoid, strive with or recover said delay.” That wording applies to that contract; it is not a universal rule for every steel or cement purchase.
Issue contractual notice, not just an operational message
Check the notice clause before sending anything. It may specify the recipient, delivery method, required content and a deadline. Send the notice through the stated route, such as the contract portal, formal email address or written notice process, and preserve proof of sending and receipt. Copying a site group chat may help coordination, but it does not necessarily satisfy a contractual notice requirement.
Recommended Free Tools
Include the known facts without overstating entitlement: identify the order, affected activity, current forecast, potential completion effect, immediate mitigation and the date by which further information will follow. If the cause is still being investigated, say so and update the notice when evidence arrives.
Determine whether the delivery delay moves the project
Trace the affected activity through the approved schedule
Update the programme with the supplier’s latest forecast and link the delivery to the activity that consumes the material. Check predecessors, successors, crew and equipment constraints, and the available float. Then ask whether the activity is on the current critical path and whether a contractual milestone or completion date actually moves.

NSW Government construction guidance focuses on these questions when assessing an extension of time: was the affected item on the critical path, and is completion delayed? A material can arrive late yet cause no completion delay if float remains or another planned activity can proceed. Conversely, a short delivery slip can become a critical delay when it interrupts a sequence with no available float.
Record the first day of actual work impact
Daily reports should show when the shortage first prevented planned work, which crews or equipment were affected, what work continued, and how many hours or shifts were lost. Caltrans guidance distinguishes the date a shortage first caused a work delay from the date a supplier first warned of lateness. Keep both dates. This distinction helps separate a forecast problem from demonstrable disruption.
Update the schedule as facts change rather than moving the completion date simply because a supplier revised its promise. Preserve the original approved baseline, each update, and the assumptions used in the impact analysis.
Choose a recovery plan without violating the specification
Test an alternate source against five decision points
Do not treat a different supplier or material as interchangeable merely because it can arrive sooner. Compare each proposal against the following points:
| Decision point | Questions to answer |
|---|---|
| Specification and approval | Does the source and material meet the contract specification and approved submittal, and who must approve it? |
| Credible delivery | What is the confirmed production, transport and total lead time, including any required inspection? |
| Schedule effect | Will it protect the affected critical-path activity and the contractual completion or milestone date? |
| Price and logistics | What additional purchase, transport, handling or site costs arise, and who bears them under the contract? |
| Documentation | What quotation, certificates, submittals, approvals and change records are required before use? |
Caltrans guidance recommends recording confirmation when no alternate source exists or when alternate procurement would take longer. Keep the supplier inquiries, responses and dates, including a clear written explanation if the search found no workable alternative. That evidence demonstrates mitigation without claiming that an unapproved substitute was acceptable.

Ask for partial delivery or a revised sequence
A supplier may be able to release part of the quantity or deliver components in stages. Compare a partial shipment with the work package sequence: it may allow a portion of the installation or placement to proceed while the balance is manufactured. Confirm storage, handling and inspection requirements before accepting split loads.
Resequence unaffected work when practical. A crew may be moved to an activity that does not require the missing steel or cement, but check whether that creates new access, safety, design or subcontractor conflicts. Put the revised logic and assumptions into the programme so the recovery plan can be tested rather than described only in a meeting.
Obtain technical and owner approvals before substitution
The designer, engineer or owner should approve a substitution whenever the contract requires it. Do not install an alternate grade, source or product on the strength of a procurement email. A faster delivery that later fails a specification review can create a larger delay, removal cost and dispute than the original shortage.
Analyze responsibility before discussing money or time
Separate the common delay categories
| Situation | Why it matters | Evidence to preserve |
|---|---|---|
| Owner-furnished material is late | The owner may carry a different supply risk than a contractor who selected and ordered the material. | Owner supply schedule, release instructions, purchase records and site impact dates. |
| Contractor-procured imported material is late | Some contract frameworks allow relief only when the lateness was outside the contractor’s negligence or inadvertence and notice conditions were met. | Order date, promised date, import and transport records, cause statement and mitigation attempts. |
| Supplier delay after timely ordering | The purchase terms may allocate supplier risk, but the project contract may impose separate notice and mitigation duties on the contractor. | Purchase order, supplier correspondence, revised forecasts and delivery records. |
| Late ordering or incomplete procurement information | The delay may be attributed to the party that failed to order, approve or release the material on time. | Submittal log, approvals, requisitions, release dates and meeting minutes. |
| Delivery is late but float absorbs it | There may be no completion delay even though the site team had to rearrange work. | Baseline and update schedules, float calculation, daily reports and resequencing records. |
These categories are not legal conclusions. They are a framework for tracing the facts to the risk allocation in the signed documents.
Check extension-of-time and compensation rules
Read the notice clause and remedy clause together
Look for provisions covering extensions of time, compensable delay, force majeure or exceptional events, supplier responsibility, imported materials, acceleration, changes and dispute escalation. Confirm whether the clause requires notice within a stated period, a contemporaneous schedule analysis, supporting records or a separate detailed claim.

NSW Government guidance notes that most construction contract forms contain notice requirements for extensions of time and gives 14 days as an example in one Minor Works form. That 14-day period belongs to that example and must not be applied to another contract without checking its wording. The Philippine Construction Industry Authority FAQ likewise describes circumstances and notice requirements under its referenced framework, including a possible extension for late contractor-supplied imported materials when the delay was not caused by contractor negligence or inadvertence. Neither example determines entitlement on a project governed by a different contract or jurisdiction.
Get local advice when exposure is material
If the delay threatens a contractual completion date, liquidated damages, a major cost, a safety-critical sequence or a disputed substitution, obtain advice from a qualified construction contract professional in the governing jurisdiction. Give that adviser the signed contract, purchase order, notices, programme files, supplier evidence and daily records. A general statement that “the supplier was late” is not enough to establish entitlement.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Use a disciplined record system
Create one delay file with a dated index. Include:
- purchase orders, specifications, approved submittals and release instructions;
- the original delivery promise and every revised forecast;
- supplier cause statements, transport records and partial-shipment proposals;
- formal notices, proof of receipt and responses from the owner, engineer or contractor;
- baseline and updated schedules showing the affected activity, float and critical path;
- daily reports, photographs, delivery tickets, timesheets and equipment logs; and
- alternate-source enquiries, quotations, approval documents and resequencing decisions.
Keep a simple chronology with the date, event, responsible party, evidence location, schedule effect and next action. This prevents a later claim from relying on memory and makes it easier to show what was known at each decision point.
A practical notice structure
Use the contract’s required form if it provides one. Otherwise, a clear notice can contain the following fields inside a formal letter or email:
Subject: Notice of potential delay — [project and order reference]
Material and quantity: [description]
Original delivery commitment: [date]
Current supplier forecast: [date]
Reported cause: [cause, with supplier statement attached]
Affected activities: [schedule IDs and descriptions]
Observed site impact: [first date and work affected]
Current critical-path assessment: [effect and float]
Mitigation underway: [partial shipment, alternate source, resequencing]
Approvals requested: [owner, engineer or designer action]
Further information date: [date]
Rights reserved in accordance with the contract.
Replace each bracketed field with project-specific information and send it only through the contractual notice route. The template is a communication aid, not a substitute for the contract’s prescribed wording.

If the supplier still cannot give a reliable date
Escalate procurement and schedule decisions
Set a short review point with the supplier, procurement lead, site manager, scheduler and the party responsible for approvals. Ask for a firm decision on partial shipment, alternate production, alternate sourcing or resequencing. Each option should have an owner, a due date and a recorded assumption.
Protect the site from avoidable standby
Do not keep crews or hired equipment idle without a documented reason and an approved decision to do so. Where safe and practical, move resources to work that is ready. Record any unavoidable standby separately from productive resequenced work so the cost and schedule analysis remains intelligible.
Update notices as the effect changes
A preliminary notice should be followed by factual updates when the cause, forecast, affected quantity or critical-path effect changes. Close the issue when the material arrives, the substitute is approved or the activity is no longer affected, while retaining the full record.

- Accepting a verbal promise without a dated written forecast.
- Waiting for certainty before sending a notice that has a contractual deadline.
- Calling the project delayed without checking float and the critical path.
- Ordering a substitute before the required technical or owner approval.
- Failing to record that no alternate source existed or would take longer.
- Blaming the supplier before distinguishing late ordering, owner-furnished material and supplier performance.
- Claiming an extension or compensation without proving notice, causation, schedule effect and contract entitlement.
- Replacing the baseline programme instead of preserving it alongside each update.
The reliable response is therefore factual and sequential: secure the supplier evidence, serve the contract notice, measure the real schedule effect, pursue approved mitigation, and evaluate any time or cost remedy against the governing documents and law.
