A resort may need separate development-plan, land, environmental, infrastructure, detailed-design and construction authorizations. An approved master or development plan is often a framework for later regulatory approvals, not permission to start physical construction. Resume only after the issuing authority confirms in writing that the relevant permit is issued and the stop-work restriction is lifted, varied or limited for the work and project phase in question.
Start with the notice, not assumptions
A blocked resort project can involve a stop-work order, a permit refusal, an inspection deficiency notice, a lapsed approval or a condition attached to an earlier consent. The correct response depends on the issuing authority, the law cited, the exact site and the work named in the document. There is no universal resort-construction approval list or appeal deadline.

Obtain the controlling document
Ask for the signed stop-work order, refusal, deficiency list or inspection record if you do not already have it. Record:
- the authority and officer who issued it;
- the statute, regulation, permit condition or code provision cited;
- the parcel, building, shoreline area or other location covered;
- the work that must stop, including whether the restriction is full or partial;
- the date of service and every response, cure or appeal deadline; and
- the document or decision that will release, vary or rescind the restriction.
Ask whether emergency stabilization, weather protection, security, environmental protection or other site-safety work is allowed while construction is stopped. Do not assume that “stop work” prohibits every activity, but do not perform even apparently minor construction until the authority confirms the permitted exceptions.

Preserve the site and the record
Follow the order immediately. Secure excavations, incomplete structures, materials and public interfaces in the manner required by local safety rules. Photograph the condition of the site, retain delivery and inspection records, and create a dated log of work stopped, communications and submissions. Continuing prohibited work can create new violations, weaken an appeal and complicate insurance, financing and contractor claims.
Open a written channel with the authority
Request a written meeting or call with the case officer, then confirm the discussion by email or letter. Ask the authority to state the deficiency and the restart conditions in plain language. A verbal assurance, application receipt or appeal filing is not itself permission to resume.
Build an approval map for the resort
Large resorts commonly move through several regulatory gates. The order and names differ by country, state, province and municipality, but the distinction between a development framework and a construction authorization is critical.

It explains that an MDP provides a foundation for regulatory review and that additional authorizations may be required under land, water and environmental legislation. The Maldives Ministry of Tourism’s Development Handbook for Tourist Resorts, Version 2 treats a construction permit as a separate approval issued after detailed drawings are approved; permits may be issued in phases. Its plain-language definition is: “Construction Permit is the approval issued to start the physical construction of the resort.”
| Approval or document | What it generally addresses | What to verify now |
|---|---|---|
| Development or master plan | Overall resort concept, land-use arrangement, facilities, access, infrastructure and implementation framework | Whether it is only a planning foundation or also grants any site-specific development right; approved boundaries, uses and conditions |
| Environmental assessment or approval | Environmental effects, mitigation, monitoring and consultation | Whether approval covers the current design, construction method, phase and environmental controls |
| Land, lease, shoreline or foreshore authorization | Legal right to occupy, alter or build on the relevant land, coast or water edge | Parcel and shoreline limits, term, conditions, required surveys and dependencies on other permits |
| Detailed drawings and technical approvals | Architectural, structural, civil, fire, drainage and other design particulars | Revision number, approving professional, stamped sheets and whether the work matches the approved set |
| Infrastructure, access and utility approvals | Road access, water, wastewater, power, stormwater and connections to public systems | Capacity, connection points, easements, construction sequencing and inspection prerequisites |
| Construction permit or phased permit | Legal authorization to carry out specified physical work | Issuance date, phase, buildings, site area, conditions, expiry and required inspections |
Do not treat one row as a substitute for another. A development plan may be approved while a building or construction permit is still outstanding. Conversely, a construction permit may be limited to a phase and cannot automatically authorize later buildings, shoreline work or changed drawings.

Compare the paperwork with the work in progress
Create an approval register that a project manager, designer and local permitting professional can review together. For every approval, record the issuing authority, application number, date, legal holder, approved drawings, conditions, geographic limits, project phase, inspection requirements, expiry or renewal rule and the work it authorizes.
Then walk the site and mark each activity against the register. Include foundations, grading, dredging, retaining walls, roads, utilities, temporary works, worker accommodation and shoreline activities; a restriction may apply to one of these even if other work is permitted. Flag any work that is outside the approved footprint, uses a superseded drawing, belongs to a later phase or began before a prerequisite approval took effect.

Phasing is a frequent source of error. The Maldives handbook describes full and phased construction permits tied to approved detailed drawings. If the notice concerns Phase 1, ask whether unrelated work in a separately authorized phase may continue and obtain that answer in writing. Alberta’s distinction between an MDP and later authorizations likewise means that a project can be conceptually approved while individual construction activities remain unauthorized.
Submit a complete cure package
Once the deficiency is clear, use the issuing authority’s prescribed route rather than sending an informal explanation alone. A locally qualified architect, engineer, planner, environmental consultant or construction lawyer can identify dependencies and sign documents where professional certification is required.
- Confirm the correct application path. Ask which form, portal or submission route applies; whether a new application, amendment, reapproval or renewal is required; the fee; the responsible signatory; and the review sequence.
- Collect the missing evidence. This may include revised detailed drawings, surveys, environmental reports, land or foreshore documents, utility commitments, access plans, consultation records, monitoring plans or proof that a condition has been met. Submit the version identified by the authority, not a superseded package.
- Resolve linked approvals. Ask whether the missing item depends on a land, water, environmental, access or utility authorization and which agency issues each one. Obtain written confirmation if agencies will review applications concurrently or in a particular order.
- Answer every condition. Use a response matrix listing each deficiency, the corrective document, drawing reference, responsible professional and submission date. Partial responses can leave the order in force.
- Track review and requests. Keep proof of delivery, payment receipts, meeting notes and dated agency responses. If the authority requests more information, ask whether the review clock stops and what remains outstanding.
- Request the release instrument. When the file is complete, ask exactly what written decision—permit issuance, order rescission, variation or partial release—allows the named work to restart.
A historical, jurisdiction-specific example shows why separate land approvals matter: a Philippine Supreme Court record describes a resort environmental certificate being suspended after the proponent failed to submit foreshore documentation. That example does not establish a rule for other countries, but it illustrates how an environmental approval can be affected by a missing shoreline authorization.

Address the blockers most likely to stop a resort
Environmental, water or protected-land issues
Check whether the assessment and mitigation plan cover the actual footprint, access road, borrow areas, wastewater system, dredging, beach works and construction phase. Confirm monitoring, reporting and seasonal restrictions. If the project touches wetlands, protected areas, coastal waters or groundwater, identify the separate land or water agency before revising drawings.
Shoreline and foreshore documentation
Verify the legal boundary, lease or concession, surveyed foreshore line, public-access obligations and any consent needed for seawalls, jetties, beach nourishment or reclamation. A building permit cannot cure a missing right to occupy or alter the shoreline.
Design changes and unapproved field decisions
Compare the stamped drawing set with field dimensions and subcontractor instructions. Relocating a building, changing levels, increasing rooms, altering drainage or substituting a structural system may require an amendment before that work proceeds. Ask the authority whether a formal revision, new permit or professional certification is required.
Expired, conditional or phase-limited permits
Check commencement deadlines, expiry dates, renewal requirements and conditions precedent. A permit that was valid for enabling works may not cover permanent buildings. Confirm that inspections, bonds, fees and pre-start notices were completed before relying on the permit.

| Example | What the official guidance says | Why it cannot be generalized |
|---|---|---|
| New York City Department of Buildings | For the permit-related stop-work orders described in its guidance, work cannot resume until the permit is issued and the order is rescinded. The guidance distinguishes full and partial orders. | These are New York City procedures; another authority may use different release documents or standards. |
| New South Wales Building Commission | Its guidance describes a developer’s appeal to the Land and Environment Court within 30 days for specified covered orders and says lodging the appeal does not stop the order unless the Court orders otherwise. | The 30-day period applies to the identified NSW orders, not to resort projects generally. |
| United Kingdom planning system | Planning guidance provides appeal eligibility for specified planning decisions. | Eligibility, forum and timing depend on the decision type and UK jurisdiction; a construction stop notice elsewhere may use another process. |
Ask counsel to check review, reconsideration, administrative appeal, court challenge and stay or injunction options. Separate the merits of the missing approval from the immediate question of whether work may continue. An appeal that does not suspend the order still requires compliance while the case proceeds.
Get written permission before restarting
Before remobilizing, obtain a document that identifies the permit or release and the exact activities covered. Confirm:
- the permit number, approved drawing revision and phase;
- the buildings, coordinates, floors, temporary works and site areas included;
- conditions that must be completed before each stage;
- required inspections, notices, testing and professional certifications;
- the expiry, renewal and display requirements; and
- whether the stop-work order is rescinded entirely, varied for specified work or still active for excluded areas.
Schedule the authority’s required inspection and distribute the written release to the superintendent, contractors, safety team, lender and insurer. Update the method statement and site plan so crews cannot accidentally restart an excluded activity. Keep the release with the permit register and daily site records.
Protect the project while approvals are pending
Use the stoppage to separate lawful preservation from unauthorized construction. Maintain security, drainage, erosion control, weatherproofing and public protection only to the extent the authority allows. Ask the authority whether document review, surveying, off-site fabrication or design coordination may continue without physical work at the site.
Notify contractors and consultants under the applicable contracts, preserve schedules and cost records, and document instructions that changed the sequence. Do not promise a restart date until the authority confirms its review process and the submission is complete. A realistic recovery plan should show the missing approval, dependencies, review milestones, inspection dates and a contingency for further information requests.
Prevent another approval blockage
- Maintain one controlled approval register with owners, dates, conditions, drawings and expiry alerts.
- Hold a permit-to-work gate before each phase and before any design change reaches the field.
- Require the project manager to verify land, environmental, utility and access prerequisites, not just the building permit.
- Use a drawing-revision protocol that removes superseded sheets from site copies.
- Record agency meetings and obtain written interpretations of ambiguous conditions.
- Schedule renewal and inspection reminders well before expiry or the next phase.
- Have local professionals review shoreline, protected-land, water and Indigenous-consultation obligations where they apply.
The practical test is simple: can the project team point to a current written authorization for this activity, on this parcel, in this phase, using these drawings, with all prerequisite conditions met? If not, stop that activity and resolve the gap before it becomes the next enforcement issue.
