If a contractor stops work, first protect people and the building, then preserve evidence before anything changes. Read the contract, send a written demand that follows its notice rules, and obtain a local assessment before withholding money, terminating the agreement, or hiring a replacement. Licensing complaints, mediation, small-claims actions, civil litigation, and lien defenses may all be available, but the correct route and deadlines depend on your state, locality, contract, and project value.
The sequence below is designed for a U.S. homeowner or property owner dealing with incomplete or defective construction. It separates urgent damage control from the legal dispute so that an unsafe opening, leak, or exposed structure is addressed without destroying proof of what happened.

1. Make the site safe and prevent further damage
Walk the property only as far as it is safe to do so. If the unfinished work creates an immediate danger—such as exposed wiring, an unsecured excavation, unstable framing, missing guardrails, an open roof, or a water intrusion—arrange qualified emergency protection. Depending on the hazard, that may mean temporary weatherproofing, shutting off utilities, securing access, boarding an opening, pumping water, or calling the relevant emergency trade. Follow local building and permitting requirements.

Do not wait for a contract dispute to worsen a safety or weather problem. Before and after emergency work, take dated photographs or video from several angles and keep every invoice, receipt, work order, and written explanation of why the work was urgent. Record who authorized the work and whether any part of the temporary repair could affect later inspection. The available official guidance does not establish one nationwide emergency procedure, so use local building officials and appropriately qualified professionals for the particular hazard.

2. Build an evidence file before conditions change
Create one organized project file, digital and paper if possible. Iowa consumer guidance identifies the following records as useful, and they also help a lawyer, mediator, agency investigator, or court understand the sequence:
- The signed contract, every amendment, estimate, proposal, change order, and specification.
- Payment proof, including canceled checks, card statements, bank transfers, invoices, receipts, and the dates and amounts paid.
- Permits, inspection reports, plans, warranty papers, product records, and documents identifying subcontractors or suppliers.
- Emails, texts, letters, voicemail files, and notes of telephone calls. For each call, write the date, participants, promises made, and any proposed return date.
- Dated photographs and video of every incomplete area, visible defect, stored material, damaged surface, and condition that could later be covered by another contractor.
- A chronological timeline showing the contract date, promised milestones, actual work, payments, delays, requests for updates, missed appointments, and the point at which work stopped.
Keep original files and metadata where available. Make a read-only backup and do not edit the original photos. If you must move materials or clean up a hazard, photograph the condition first and note exactly what was moved, by whom, and why. Avoid argumentative social-media posts; they can complicate a later claim and rarely substitute for a formal notice.
3. Read the agreement for the rules that control your next move
Before sending a termination notice or hiring someone else, mark the clauses that answer these questions:

Georgia Attorney General guidance likewise advises reviewing the agreement, guarantees, and warranties for the promised performance and the procedures for seeking redress. If the contract is unclear, a local construction lawyer can explain the effect before you take an irreversible step.
4. Send a written demand that is specific and deliverable
A calm, factual demand gives the contractor a fair opportunity to return and creates a clear record if the matter escalates. List each promised item that is incomplete or defective, identify the relevant contract section when it is clear, describe the present condition, and request a written response with a practical completion plan. State the date by which you want the response, and reserve your rights without threatening remedies the contract or law may not allow.
Use the notice method and address in the agreement. If the contract permits more than one method, send the letter in a way that produces delivery evidence and also use the designated email. Keep the signed letter, attachments, proof of delivery, and any response in your project file. Do not rely on a text message alone when the agreement requires formal notice.

Maine Attorney General guidance recommends a letter describing work that was not done or was not done correctly, asking when it will be finished, and retaining a copy. That guidance suggests allowing 10 days for the contractor to respond and, depending on the remaining work, a further reasonable completion period of 10 to 30 days. Those periods are Maine guidance, not a nationwide statutory deadline; your contract and state law may require a different notice or cure period.
What the demand should contain
- Identify the parties, property, contract date, and project address.
- Attach or reference a numbered list of unfinished or defective tasks, with photographs and dates.
- State the amount paid, the amount (if any) currently disputed, and any emergency protection already arranged.
- Request a written response by a specified date, including a proposed mobilization date, sequence of work, responsible crew, and completion date.
- Ask the contractor to confirm the status of permits, inspections, materials, and subcontractor or supplier payments.
- State that you are preserving all contractual and legal rights and that further action will be considered if there is no adequate response.
5. Decide whether to wait, terminate, or bring in a replacement
Do not sign a completion certificate or release, and do not pay a disputed balance, merely to end an uncomfortable conversation. Conversely, do not assume that stopping payment automatically cancels the contract; withholding money can itself breach an agreement or trigger lien activity. Have the contract and payment history reviewed before taking that step.
While the demand is pending, ask an independent, qualified contractor or construction professional to document the status and estimate the cost and time to complete or correct the work. Request a written scope that distinguishes unfinished work from damage caused by exposure or by earlier defective installation. This assessment helps you compare the original contractor’s proposal with a replacement bid and preserves evidence before new work conceals the condition.

If the original contractor does not respond, states that no further work will be done, or fails to meet a contractually required cure period, termination and replacement may become reasonable. Maine guidance says a homeowner may hire another contractor when the original contractor does not respond or says they will do no more work after a reasonable time. That sequence is state-specific; confirm your own notice, termination, permit, and payment requirements first.
| Route | Typical speed and cost | What it can achieve | Important limits to verify |
|---|---|---|---|
| Negotiated return and written completion plan | Often fastest and least expensive if the contractor remains cooperative | Can secure completion, correction, access to materials, or a documented settlement | Participation is voluntary; preserve claims until performance is actually delivered |
| Agency or licensing complaint | Usually low filing cost; timing depends on the agency | Creates an official record and may prompt contact, investigation, or discipline | Does not guarantee a refund or compel construction; jurisdiction and evidence rules vary |
| Mediation | Usually quicker and less formal than court, but may involve a fee | Can produce a mutually agreed payment or completion settlement | Usually voluntary unless the contract makes it a required step; no decision is imposed without agreement |
| Small-claims or magistrate court | Designed for lower-value disputes with simplified procedure | Can result in a money judgment within the court’s authority | Claim limits, filing rules, service, and whether performance can be ordered differ by location |
| Civil litigation or arbitration | Most formal and potentially most expensive; timing can be lengthy | May address larger damages and, where available, contractual or equitable remedies | Notice, limitation, arbitration, expert, and appeal rules apply; obtain local legal advice |
6. Check licensing, complaints, and local dispute programs
Find the state or local agency responsible for the contractor’s trade and verify the license or registration status. Save the search result and note any bond, insurance, disciplinary history, or complaint instructions the agency publishes. Licensing categories differ: a general contractor, electrician, plumber, architect, and specialty installer may be regulated by different offices.

Iowa guidance explains that some matters belong in consumer protection while others require private legal advice or court action. Georgia guidance describes complaint, small-claims, and law-enforcement routes depending on the facts. An agency complaint can support a record or investigation, but it is not a guaranteed recovery process.

7. Treat subcontractor and supplier notices as a separate emergency
A contractor’s abandonment does not necessarily eliminate the payment rights of subcontractors or suppliers. If a lower-tier party sends a notice, demand, preliminary notice, or lien document, keep the original envelope or electronic header and record when you received it. Do not ignore it or promise payment without advice.
Construction-lien rules are highly jurisdiction-specific. Texas Property Code Chapter 53 illustrates that owner notices and lien procedures can be tied to termination or abandonment, with a notice described in the available statutory summary as due no later than the 10th day after termination or abandonment in specified circumstances. That is a Texas rule, not a national deadline. The trigger, recipient, content, waiver forms, and deadlines in your state may be entirely different. Contact a local construction lawyer promptly and check the current statute before recording, releasing, or paying around a lien.
8. Understand state-specific examples without treating them as national law
| Location and source type | Figure or rule described | How to use it safely |
|---|---|---|
| Maine Attorney General consumer guidance | Suggests 10 days for a response about when incomplete or incorrect work will be finished, followed by a reasonable 10-to-30-day completion period depending on the remaining work | Use only as a Maine-oriented practical example unless your own contract or law adopts a similar period |
| Pennsylvania Attorney General consumer guidance | Covered home-improvement contracts over $500 must be written and signed and include specified information under Pennsylvania law | Confirm coverage, current statutory language, and local enforcement before relying on the threshold |
| Georgia Attorney General consumer guidance | Describes magistrate court for claims of less than $15,000 in the cited consumer scenario | Verify the current limit, venue, service rules, and whether your remedy fits that court |
| Texas Property Code Chapter 53 | Includes a notice requirement summarized as no later than the 10th day after termination or abandonment in specified circumstances | Read the current statute and obtain Texas advice; do not apply this timing elsewhere |
9. Hire a replacement contractor without losing control of the project
Once termination and notice issues are addressed, obtain at least one detailed completion proposal from a properly licensed or registered contractor where required. Give each bidder the same documented scope and disclose known defects, permits, inspections, and disputed work. Ask for a line-item price, schedule, payment milestones, change-order process, insurance information, warranty terms, and the identity of subcontractors.
Photograph and inventory materials left on site before the replacement crew starts. Clarify in writing who owns stored materials and equipment and who will obtain or transfer permits. Require progress documentation and signed approvals for changes. Keep the replacement contract, invoices, and proof of payment separate from the original contractor’s file so the additional completion cost can be calculated without confusion.
10. Escalate when the risk or amount justifies professional help
A local construction lawyer is particularly valuable when the project value is substantial, a lien has been threatened or recorded, the site is unsafe, the contract contains arbitration or detailed notice clauses, you are considering termination, or the contractor denies responsibility. Counsel can evaluate contract damages, completion costs, lien exposure, insurance, limitation periods, and preservation of evidence before a filing is made.
Bring the lawyer an indexed packet: contract and changes, payment ledger, timeline, photographs, demand and delivery proof, contractor responses, permits, inspection records, emergency invoices, replacement estimates, and lien notices. That preparation reduces review time and helps counsel identify missing facts. If litigation is likely, avoid altering or discarding damaged components until your lawyer or an expert advises whether an inspection or evidence protocol is needed.
Quick Recap
11. Common mistakes that make recovery harder
- Waiting to document a leak, exposed structure, or defect until after weather or cleanup changes the condition.
- Using only phone calls when the contract requires written notice, or sending notice to an old address instead of the contract’s designated address.
- Hiring a replacement contractor before checking termination, cure, permit, and lien requirements.
- Paying disputed amounts or signing a release in exchange for an informal promise to return.
- Destroying materials, covering defects, or discarding invoices before an inspection is possible.
- Assuming a consumer complaint will produce a refund or substitute for a court judgment.
- Applying another state’s deadline—such as a Maine response period or Texas lien notice—to your project without verifying local law.
12. A practical action plan
- Today: Secure immediate hazards, arrange temporary protection, and preserve before-and-after records.
- Within the next few days: Assemble the contract, payment proof, communications, permits, warranties, photographs, and dated timeline.
- After reviewing the agreement: Identify notice, cure, termination, dispute, warranty, and lien-related provisions.
- Send the demand: Use the contract’s required method, list incomplete or defective work, request a written completion plan, and retain delivery proof.
- During the response period: Obtain an independent condition report and completion estimate; do not conceal disputed work.
- If there is no adequate response: Verify licensing, contact the appropriate agency, and obtain local legal advice before termination or replacement.
- If a subcontractor or supplier contacts you: Preserve the notice and address lien deadlines immediately under your state’s law.
- For resolution: Select negotiation, mediation, agency action, small claims, arbitration, or civil litigation based on cost, speed, enforceability, claim value, and the rights preserved by each route.
