bank erosion

What to Do When a Check Dam Causes Upstream Flooding or Bank Erosion

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If water is rising, flooding is moving toward people or buildings, or the channel appears close to failing, leave the channel area for higher ground immediately. Do not walk or drive through floodwater. Follow local emergency instructions and call emergency services when anyone faces immediate danger.

Once you are in a safe location, notify the check-dam owner or operator and the local emergency-management, public-works, drainage, stormwater, conservation, or flood-control office. Ask the state dam-safety office whether the structure is regulated. A small erosion-control check dam and a jurisdictional dam may have different owners, inspection duties, permits, and emergency procedures.

First decide whether this is an emergency

Flooding and erosion can worsen quickly during intense rain. Treat the situation as an emergency when water is rising rapidly, the bank is collapsing, a road or building is threatened, people could be swept away, or the structure shows signs of internal erosion or sudden movement.

Move people before investigating the cause

  • Get out of the channel, low areas, spillways, and the space immediately below or beside the structure.
  • Move to higher ground and keep children, pets, and vehicles away from flowing water and unstable banks.
  • Do not walk or drive through floodwater; depth, current, debris, and damaged road surfaces may be impossible to judge.
  • Call emergency services if a person is trapped, a building or road is in immediate danger, or the structure appears to be failing.
  • Return only when emergency officials say the area is safe.

Missouri emergency guidance uses this same life-safety approach. Numeric “safe depth” rules are not universal, so use current local instructions rather than a generic water-depth threshold.

Do not attempt an emergency repair

Do not remove, raise, cut through, excavate around, or brace a check dam on your own. Do not rapidly lower impounded water. For dams, rapid drawdown can increase hydrostatic pressure in the upstream slope and contribute to slope failure. Even a small structure can have site-specific flow paths, foundations, and downstream consequences that are not visible from the bank.

Why a check dam can cause upstream ponding or bank erosion

Check dams are installed across channels to slow water and retain sediment. That function changes the channel’s hydraulics: water backs up upstream, the effective channel capacity is reduced, and flow may accelerate or become turbulent around the structure. EPA construction-stormwater guidance identifies both reduced conveyance and turbulence as mechanisms that can contribute to bank erosion.

Those mechanisms do not prove that the check dam caused a particular incident. Upstream flooding or local scour may also reflect rainfall beyond the design event, a blocked or undersized outlet, channel changes, a displaced structure, sediment accumulation, foundation problems, or a mismatch between the dam and the channel shape. A qualified professional must determine which condition exists.

Conditions that deserve inspection

  • Backwater or ponding: Water remains high upstream, reaches banks or property that previously stayed dry, or overtops the intended flow path.
  • Sediment filling: Sediment has accumulated to more than half the original dam height. EPA guidance treats that level as a maintenance trigger for construction check dams.
  • Changed geometry: The center of the dam is no longer lower than its edges, or part of the structure has shifted, settled, cracked, or been undermined.
  • Bank attack: Turbulence, concentrated side flow, or an overflow path is scouring the bank, exposing roots, or creating slumps.
  • Obstructions: Debris, vegetation, ice, or a blocked outlet is forcing water around the structure instead of through its intended low point.

These are general construction-stormwater maintenance principles, not a design approval or a substitute for the original plans, current standards, or local permits. Maintenance identified during inspection should be addressed promptly by the responsible owner or agency.

Warning signs of structural distress or internal erosion

Muddy seepage, boils, sinkholes, a whirlpool, or a continuous or sudden drop in the impounded water level can indicate seepage or internal erosion at a dam. New York State dam-owner guidance treats muddy seepage and sinkholes as conditions requiring immediate professional attention and says emergency procedures, including downstream evacuation, should be implemented when such signs are observed.

Keep away from the structure and contact emergency services or the dam-safety authority if these conditions are worsening. This warning applies most directly to dams that impound water. A small check dam may not hold a reservoir and may not share the same failure modes, so an engineer or responsible agency must interpret the observation at the actual site.

What to do from a safe location

  1. Record when you noticed the problem. Note the date and time, recent rainfall or snowmelt if known, and whether the water level is rising, falling, or fluctuating.
  2. Describe the affected area. Record where water reaches the bank, roads, yards, structures, or other assets. Note which bank is eroding and whether the erosion is enlarging.
  3. Photograph without approaching danger. Use stable ground well away from flowing water, unstable edges, the dam face, seepage outlets, and slumps. Take wide views and repeat photographs from the same safe position so changes can be compared.
  4. Look for changes, not just a single snapshot. Inspection guidance emphasizes seepage, erosion, settlement, cracking, slumps, and differences from previous observations. Mark the time of each observation rather than entering the channel to measure anything.
  5. Preserve relevant information. If you know the structure’s name, owner, permit number, approximate dimensions, or original purpose, include it. Do not enter private property or restricted areas to obtain those details.
  6. Report the condition. Contact the owner or operator first when known, and notify the appropriate local agencies. If there is immediate danger, call emergency services before making routine reports.

Who should be contacted

Contact When to call Information to provide
Emergency services People are at immediate risk, a road or building is threatened, or failure appears imminent Exact location, hazards, access route if known, water movement, and whether anyone is trapped
Local emergency management Flooding is occurring or could threaten people, homes, roads, or evacuation routes Location, affected areas, timing, rainfall context, photographs from safety, and current water trend
Check-dam owner or operator The owner is known or can be identified from signs, plans, or local records Observed water levels, erosion, seepage, structural changes, dates, and safe-ground photographs
Public works, drainage, stormwater, conservation, or flood-control office The channel, culvert, road drainage, or erosion responsibility is unclear or locally managed Channel location, nearby infrastructure, flooding extent, and any owner information
State dam-safety regulator The structure may meet the state’s definition of a regulated dam, or ownership and oversight are unclear Structure location, approximate size, impounded-water description, owner if known, and distress signs
Licensed civil or water-resources engineer A site-specific cause, risk assessment, or repair design is needed All records, photographs, rainfall and water-level observations, plans, and agency correspondence

USDA Natural Resources Conservation Service guidance places responsibility for safe operation, inspection, maintenance, and emergency preparedness on dam owners and recommends qualified engineering support and communication with relevant agencies. That does not identify the owner of an unknown structure; local records and site signage may be needed.

How to determine whether dam-safety rules apply

“Check dam” is a functional description, not a universal legal classification. Some are temporary construction-stormwater controls or small erosion-control structures. Others may impound enough water to fall under a state’s dam-safety program. The distinction can affect inspections, emergency action plans, permits, downstream notification, and who has authority to order work.

  1. Ask the owner or local public-works or drainage office for the structure’s purpose, plans, and maintenance responsibility.
  2. Contact the state dam-safety office and ask whether the location and dimensions meet that state’s regulated-dam definition.
  3. Ask local emergency management how to obtain inundation-area information if flooding could affect downstream residents.
  4. Use state-specific instructions rather than assuming another state’s forms, thresholds, or reporting chain apply.

California’s dam-safety FAQ, for example, directs the public to local emergency management or the dam owner for inundation-area information. That is a California pathway, not a nationwide rule.

What a professional assessment should examine

A qualified engineer or responsible agency should evaluate the complete system, not just the visible concrete, rock, timber, or earth barrier. The review normally needs to consider:

  • Design flow, recent rainfall, watershed runoff, and whether the event exceeded the original assumptions.
  • Channel width, slope, bends, constrictions, culverts, and alternate flow paths.
  • Foundation and abutment conditions, settlement, cracking, displacement, and undermining.
  • Water levels upstream and downstream, sediment depth, and the condition of the center low point and edges.
  • Bank materials, vegetation, seepage locations, slumps, boils, sinkholes, and evidence that soil is being carried through the structure.
  • Downstream people, buildings, roads, utilities, and other consequences if the structure or bank fails.
  • Ownership, permits, maintenance duties, and any applicable dam-safety or stormwater requirements.

The outcome may be maintenance, redesign, sediment removal, bank protection, controlled decommissioning, or no physical change until more information is collected. The correct remedy cannot be selected safely from a generic materials list or a photograph alone.

Common mistakes and safer alternatives

Mistake Why it can worsen the situation Safer alternative
Entering the channel to measure depth or inspect the dam Fast water, undermined banks, and hidden voids can sweep a person away Observe and photograph from stable ground; let trained personnel inspect
Removing or raising the structure during a storm It can redirect flow suddenly, destabilize banks, or send a sediment surge downstream Report the condition and wait for an engineered, authorized response
Rapidly lowering stored water Rapid drawdown can increase pressure in an upstream slope and contribute to failure Use an owner’s or agency’s emergency procedure under qualified supervision
Adding rock, sandbags, soil, or concrete without a design Unplanned material can constrict the channel, increase turbulence, or fail in the next flow Have a qualified professional design and approve stabilization
Assuming muddy water is harmless sediment Muddy seepage, boils, or sinkholes may indicate internal erosion at a dam Keep away and seek urgent professional and agency assessment
Waiting for a dry-weather inspection after an obvious emergency Conditions can deteriorate before the next visit Report urgent signs immediately, then arrange a detailed inspection

Planning after the immediate hazard is controlled

Ask the owner or agency to establish a repeatable inspection record. Keep dated photographs, water-level notes, maintenance actions, rainfall context, and reports of seepage, erosion, settlement, cracking, and slumps. Comparing the same viewpoints over time helps distinguish a stable feature from a developing failure.

Any repair or alteration should be based on the site’s flow, channel shape, soil, foundation, ownership, and approval requirements. A measure that protects one bank can increase velocity or erosion on the opposite bank; a measure that lowers upstream water can create downstream risk. Obtain the applicable approvals before construction, and make sure the person responsible for the structure also has an emergency communication plan.

Key decision guide

What you observe Priority Next action
Rapidly rising water or threatened people and property Life safety Move to higher ground, avoid floodwater, follow emergency instructions, and call emergency services for immediate danger
Bank erosion without visible structural distress Urgent reporting and assessment Stay back, document from safety, notify the owner and local drainage or stormwater authority, and arrange qualified evaluation
Muddy seepage, boils, sinkholes, whirlpool, or sudden water-level drop at a dam Potential structural emergency Keep away, contact emergency services or the dam-safety authority, and follow evacuation instructions
Persistent upstream ponding or sediment above half the original dam height Maintenance or design review Report the condition and have the owner or engineer verify capacity, geometry, and maintenance needs
Unclear ownership or regulatory status Coordination Ask local public works or emergency management and the state dam-safety office who has responsibility

The governing facts are site-specific: whether the structure is a small check dam or a regulated dam, how water is moving now, who owns it, and what a qualified assessment finds. Protect people first, report changing conditions promptly, and leave repairs and drawdown decisions to the responsible owner, agencies, and appropriately experienced professionals.
