What to do when a building-material shortage delays your construction project

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When a building material is backordered, do not simply wait for the supplier or promise the owner a new completion date. Get the shortage documented, map the revised delivery date onto the approved schedule, compare feasible mitigation options, obtain written approval for any substitute, and give every contractually required notice. A shortage may justify a schedule adjustment in some contracts, but entitlement to more time or money depends on the executed agreement, the cause of the delay, notice compliance, responsibility for procurement, project facts, and governing law.

The most defensible response is an evidence trail that connects one product and quantity to specific schedule activities, decisions, costs, and milestone effects.

Start with a written, item-specific supplier update

Phone calls are useful for speed, but they are not a reliable project record. Ask the supplier to confirm the facts in writing and keep the original purchase order, acknowledgment, promised ship date, and all subsequent revisions.

Request these facts

  • The exact product, manufacturer or model designation, specification reference, and quantity affected.
  • The purchase-order status and the date the order was accepted.
  • The reason for the change, if the supplier can disclose it.
  • A confirmed or estimated ship date, delivery date, and any conditions attached to that date.
  • Whether the available quantity can ship in separate lots, and what each partial shipment would contain.
  • Whether another product, warehouse, distributor, or manufacturing source is available.
  • Any change to material price, freight, storage, expediting charges, or cancellation terms.

Separate confirmed information from estimates. A supplier’s “in stock” statement may refer to a different finish, size, rating, or quantity than the approved submittal. Ask for the exact item and quantity that the project requires.

Translate the shortage into schedule consequences

Use the best-supported procurement date—not an optimistic verbal estimate—to update the procurement activity in the project schedule. Then trace every successor activity that depends on the material. The question is not simply whether delivery is late; it is whether the late delivery consumes available float, moves a critical-path activity, interrupts a crew, or changes a contractual milestone.

Check the schedule logic

  • Identify the activity that requires the material and its planned start and finish.
  • Record the earliest credible delivery date and the uncertainty around it.
  • Trace connected successor activities, including inspections, testing, commissioning, and closeout tasks.
  • Measure available float before and after the procurement change.
  • Determine whether the affected work is on the current critical path or creates a new critical path.
  • Identify any milestone, phased completion date, occupancy date, or liquidated-damages date that could move.
  • Check whether resequencing would cause remobilization, idle labor, temporary protection, or rework.

Federal construction clauses illustrate the level of discipline expected in a properly managed schedule. GSAM 552.236-15 describes the schedule as a material component of contract performance and permits the contracting officer to use it to evaluate progress, extension entitlement, and activity criticality or float. It states: “The project schedule shall be a rational, reasonable, and realistic plan for completing the work, and conform to the requirements specified in this clause and elsewhere in the contract.” That is a federal contract example, not an automatic rule for a private project.

When a schedule is revised after initial approval under that clause, the contractor is expected to provide a written narrative explaining the revision, its rationale, and its effect on projected substantial completion and available float. The GSA alternate schedule clause also expressly includes procurement and field activities and uses connected activity logic in a critical-path-method schedule. Its update interval varies by clause version and contract; some alternatives call for monthly updates and others for weekly updates. Do not assume one interval applies to every project.

Account for the factors that make a delay consequential

Federal acquisition guidance says a construction completion schedule should reflect the project’s nature and complexity, construction seasons, the required completion date, availability of materials and equipment, contractor capacity, and the possibility of multiple completion dates for separable work. Apply those factors to your own schedule rather than treating every late delivery as an equal number of lost days.

Compare mitigation options before choosing one

Evaluate realistic alternatives against the same criteria. The best option depends on project-specific evidence; there is no universal ranking.

Option When it may help Information to verify Main exposure
Alternate supplier Another source can provide the specified product sooner. Written quantity and delivery commitment, specification match, freight, price, and supplier reliability. Different terms, freight risk, or an apparent match that fails a specification detail.
Partial shipment A first lot allows dependent work to begin while the balance follows. Exact quantities, lot sequence, storage needs, installation sequence, and whether the first lot actually releases schedule work. Incomplete work, repeated mobilization, storage damage, or a later lot becoming the new constraint.
Resequencing Other planned work can proceed without creating rework or unsafe conditions. Logic changes, crew and equipment availability, inspections, temporary protection, and effects on float. Idle resources, congestion, out-of-sequence work, or a different activity becoming critical.
Proposed substitute An alternative product can meet the design intent and approved requirements. Specification, code, design, interface, warranty, submittal evidence, review time, and written approval authority. Rejection, redesign, procurement of an unusable product, warranty conflict, or rework.

For each option, compare five dimensions: written availability; affected activities, float and milestone effect; technical acceptability; total delivered cost; and the contract process required. Total cost can include material, freight, storage, expedited shipping, redesign or review, labor disruption, and rework exposure—not just the invoice price.

Do not install a substitute without approval

A supplier’s description of a product as “equivalent” does not, by itself, authorize a change. The retrieved federal materials do not establish one substitution procedure for every project type. Your specifications, drawings, general conditions, funding requirements, and submittal register control the process.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A practical approval sequence

  1. Read the governing documents. Find the substitution, equal-product, submittal, change-order, design-review, warranty, and code-compliance provisions. Identify who may approve a change.
  2. Prepare a comparison package. Show the specified product beside the proposed product, including dimensions, performance ratings, fire or environmental classifications, finishes, accessories, interfaces, maintenance requirements, and warranty terms.
  3. Confirm code and design effects. Obtain the evidence required by the authority having jurisdiction and the design professional. Check loads, clearances, compatibility, testing, and any downstream detail that changes.
  4. State schedule and cost effects. Identify review lead time, revised delivery, freight, labor changes, redesign, and any effect on milestones.
  5. Submit through the contract’s required channel. Use the designated submittal or change process rather than relying on an informal email or field conversation.
  6. Wait for written authorization. Keep the signed approval, approved submittal, or executed change document with the procurement record before ordering or installing.
  7. Control the field installation. Distribute the approved revision to supervisors, inspectors, subcontractors, and commissioning personnel, and verify that receiving and installation records identify the approved product.

If approval is denied or review will take longer than the shortage allows, return to the supplier, partial-shipment, and resequencing analysis. Do not convert schedule pressure into an unauthorized design change.

Give notice exactly as the contract requires

Check the notice clause before sending anything. It may specify the recipient, delivery method, time limit, supporting records, and whether separate notices are required for delay, change, differing conditions, or additional cost. A general shortage announcement does not replace those requirements.

Include the facts the reviewer needs

  • Purchase order, product identification, quantity, and the original promised date.
  • The supplier’s written revised date, reason, and any uncertainty.
  • The schedule activities and milestones potentially affected.
  • Mitigation options being investigated and decisions already made.
  • Known or potential time and cost effects, clearly labeled as estimates where they are not yet established.
  • The date of the next supplier confirmation and schedule review.

Send a concise factual notice, then supplement it as facts develop. Preserve dated supplier correspondence, quotes, purchase orders, submittals, schedule files, meeting minutes, photographs, delivery tickets, labor and equipment records, storage costs, and rework or remobilization records. A contemporaneous record is more useful than a reconstruction made after the project has finished.

Understand what a shortage does—and does not—prove about entitlement

Do not promise an extension, compensation, or a waiver of damages merely because the market is short. Entitlement turns on the contract’s risk allocation, the cause of the shortage, who controlled procurement, compliance with notice and schedule obligations, actual critical-path impact, mitigation, and applicable law.

The Federal Acquisition Regulation’s excusable-delay clause is conditional. It addresses specified events beyond the contractor’s control and without the contractor’s fault or negligence. The stated rule expressly excludes subcontractor defaults at any tier. It does not establish that every material shortage excuses delay, and it does not automatically govern private contracts, state or local work, or a federal project unless the applicable clause is incorporated.

For a significant claim or disputed extension, have the responsible project and contract professionals examine the executed agreement and governing rules. Keep the operational response moving while the entitlement analysis proceeds; waiting for a legal conclusion before investigating alternatives can increase the schedule loss.

Keep stakeholders aligned as facts change

Set a specific date for the next supplier confirmation and schedule review. At each update, record the selected mitigation, who approved it, its price and freight effect, the revised activity logic, and whether the projected milestone changed.

Use one decision record

  • Issue: exact material, quantity, purchase order, and date discovered.
  • Evidence: supplier correspondence and the current delivery commitment.
  • Schedule: affected activities, float, critical-path status, and milestone effect.
  • Options: alternate source, partial delivery, resequencing, and substitute findings.
  • Decision: selected action, approver, date, and conditions.
  • Follow-up: next confirmation, inspection, submittal, or schedule update.

Use the same facts in owner reports, subcontractor coordination, schedule narratives, and notices. Inconsistent dates or quantities can undermine confidence in an otherwise valid delay analysis.

Common mistakes and how to correct them

Relying on an unconfirmed promise

Problem: The schedule is repeatedly changed to reflect optimistic dates. Correction: Record the supplier’s commitment in writing, label estimates, and set a dated reconfirmation point.

Calling every late item a critical delay

Problem: A late delivery is treated as equal to a late completion. Correction: Trace successor logic and float, then document the actual milestone effect.

Ordering a “similar” product first

Problem: The replacement arrives before design or owner review. Correction: Complete the required technical comparison and obtain written approval before procurement or installation.

Changing sequence without checking downstream work

Problem: Resequencing avoids one idle crew but creates congestion, temporary protection, or rework. Correction: Test the revised logic, resources, inspections, and interfaces in the schedule before committing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Sending a vague notice

Problem: “Material shortage will delay the project” gives no product, date, activity, or requested action. Correction: Tie the notice to the purchase order, revised delivery, affected activities, mitigation, and the contract’s notice procedure.

What the 2022 industry statistic means

The Associated General Contractors of America reported in 2022 that 91% of surveyed firms selected “delays due to longer lead times or shortages of materials” as an impact on project completion times. This is a historical survey finding, not a current estimate of the share of projects delayed today. It may not represent every contractor, project type, or region, so it should be used to explain the prevalence of the problem—not to predict the duration or legal result of a particular shortage.

Field checklist

  • Obtain a written, item-specific supplier update.
  • Preserve the purchase order and every promised-date revision.
  • Update procurement and connected schedule activities using the best-supported date.
  • Measure float, critical-path status, and milestone effects.
  • Compare alternate suppliers, partial delivery, resequencing, and substitutes using availability, schedule, technical, cost, and contract criteria.
  • Follow the specifications and submittal process for any proposed substitute.
  • Secure written approval before ordering or installing a changed product.
  • Send all required notices by the contract’s method and deadline.
  • Maintain dated records of communications, decisions, schedule revisions, labor, equipment, freight, storage, and rework.
  • Set the next supplier confirmation and schedule-review date.
  • Have a qualified project or contract professional assess any extension or compensation claim under the actual agreement and governing law.

A shortage becomes manageable when it is treated as a controlled procurement and schedule event rather than a rumor. Verify the item, quantify the schedule effect, choose a documented mitigation, obtain the required approvals, and preserve the record that connects the shortage to the work actually affected.
