What to Do If Your Redevelopment Home Has Construction Defects

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If your newly redeveloped, renovated, or apartment-redevelopment home shows defects, protect people first, preserve the condition, check your contract and coverage, notify the responsible builder or developer in writing, and obtain independent technical advice when the cause is unclear. Escalation agencies, warranty rights, and deadlines depend on the property’s country or state, completion date, contract, dwelling type, and whether the defect is inside your lot or in shared property.

Do not begin extensive remedial work before the builder, developer, insurer, or a relevant authority has had a fair opportunity to inspect, unless immediate action is necessary to prevent injury or serious damage. Record any emergency mitigation in detail and obtain local legal advice before a limitation or warranty-notice deadline expires.

1. Deal with immediate danger before arguing about responsibility

Leave or isolate an unsafe area

A suspected structural movement, exposed live wiring, gas leak, fire risk, collapsing element, or active water ingress can become an emergency. Keep occupants away from the danger and contact emergency services, the relevant utility, or a qualified professional as appropriate. The correct response depends on the hazard and local emergency rules, so do not rely on internet repair instructions or attempt technical work outside your competence.

Prevent further loss without destroying evidence

Where it is safe, take wide and close photographs or video before moving anything. If water is entering, document the source and affected rooms, then use only reasonable temporary measures that a qualified person or your insurer advises. Keep receipts, photographs of the pre-mitigation condition, and a written log of who instructed each step. Do not remove finishes, demolish walls, or discard damaged materials merely to make the home usable unless delay would create a safety or major-loss risk.

2. Create an evidence file that another person can understand

Make a dated defect register

Create one entry for every issue. Record the room or external location, what you can actually observe, when you first noticed it, whether it is worsening, and any effect on use of the home. Distinguish observations from theories: “a 2-millimetre crack runs diagonally above the window and has lengthened since 12 June” is more useful than “the foundation is defective.” Photograph the same area from a distance and close up, include a date reference where practical, and retain the original files rather than editing them.

Preserve contracts and communications

Keep the signed building or development contract, plans, specifications, variations, invoices, completion or handover records, inspection certificates, warranty documents, insurance policies, and owners-corporation or strata records. Save emails, text messages, portal messages, letters, and call notes in chronological order. After a phone call or site visit, write the date, participants, topics discussed, promises made, and any agreed next step. Consumer Affairs Victoria advises retaining relevant documents, recording conversations, and taking photographs of disputed work.

Identify whether the defect is private or common property

In a house, the owner usually deals directly with the contracting builder or developer, subject to the contract and local law. In a unit or apartment redevelopment, a defect may be inside your individual lot, affect shared structure or services, or involve both. A roof, façade, basement waterproofing, fire-safety system, lift, or shared drainage may be common property managed by an owners corporation, strata body, or building manager. Notify that body as well as the builder when appropriate; an individual owner may not have authority to commission work on shared elements.

3. Read the contract, warranty and insurance papers before choosing a route

List the parties and obligations

Write down the legal names and contact details of the builder, developer, contractor, designer, certifier, seller, owners corporation, and insurer shown in your documents. Check the scope of work, approved plans, specification tolerances, variation procedure, completion date, defects-liability process, notice method, inspection rights, and dispute clause. NSW guidance notes that the contract sets work requirements and statutory warranties; the exact obligations still depend on the agreement and applicable legislation.

Separate a warranty promise from an automatic entitlement

A document labelled “warranty” may contain exclusions, maintenance conditions, notification rules, or a short period for particular finishes. Insurance may cover some losses but require prompt notice, mitigation, or an approved assessor. Treat every clause as something to verify, not proof that your claim is covered. Do not assume a universal warranty period: the applicable term can change with jurisdiction, work type, completion date, contract wording, and whether the issue is a major or minor defect.

Build a deadline calendar

Enter the handover date, each stated defects-notice deadline, insurance notification period, statutory warranty end date, and any limitation date that a lawyer or agency identifies. A builder’s promise to “come back later” does not necessarily extend a legal deadline. If dates are unclear, obtain local legal advice promptly and send a protective written notice rather than waiting for a complete diagnosis.

4. Notify the builder or developer in writing

Use a defect-by-defect notice

A calm, specific notice gives the responsible party a chance to inspect and may satisfy a contractual notice requirement. Include:

  1. Your name, property address, contract or lot reference, and preferred contact details.
  2. Each defect’s exact location and observable effect, with the date first noticed and whether it is changing.
  3. Dated photographs, video, relevant plan or specification extracts, and an index of attachments.
  4. The outcome you seek, such as inspection, a written diagnosis, a repair proposal, or confirmation that an insurer has been notified.
  5. A reasonable response date and practical access windows, while reserving your rights if the issue is urgent or deadlines apply.

Send the notice using the contract’s required method and one additional reliable channel if useful. Keep the sent message, attachments, delivery receipt, postal tracking, and every reply. Consumer Affairs Victoria recommends discussing the issue directly first and then sending a formal letter or email when it remains unresolved.

Keep communication factual and continuous

Respond to proposed inspections, but avoid agreeing that a cause or responsibility has been established until the evidence supports it. Confirm appointments in writing, record who attended, and list any areas the inspector could not access. NSW Government states: “In every situation, the most important thing you can do is to make sure that you develop and maintain clear, positive communication with your builder or tradesperson as soon as an issue arises.”

5. Obtain independent technical help when documents are not enough

Know when an expert is justified

Consider an independent consultant for suspected structural movement, waterproofing failure, drainage problems, electrical or plumbing defects, fire-safety concerns, or a dispute about whether work matches the plans. NSW guidance says a technically qualified private consultant may be engaged for a general inspection, and Victorian guidance describes an independent building consultant checking work against contract requirements.

Choose qualifications for the actual problem

Ask prospective consultants which licence, registration, engineering discipline, or building-inspection qualification applies in your jurisdiction. Confirm that they are independent of the builder and insurer, carry appropriate professional indemnity insurance, and have experience with your dwelling type. Before engagement, obtain a written scope, fee basis, deliverables, assumptions, access requirements, and disclosure of conflicts. A general inspection may not answer a specialist question such as concealed waterproofing or structural design.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Request a report that can support a decision

The report should identify the inspected areas, methods used, observed conditions, photographs, documents reviewed, limitations, likely causes expressed with appropriate confidence, and recommended next investigations or repairs. Ask the consultant to distinguish urgent safety measures from permanent rectification and to state whether opening-up or testing is needed. An expert report can clarify the technical issue; it does not guarantee that a builder, insurer, tribunal, or court will accept liability.

Defect is newly noticed and no immediate danger Written notice, inspection request and contract review Use the notice method and dates in the contract.
Cause or scope is technically disputed Independent, appropriately qualified consultant Agree the scope and preserve the original condition where safe.
Issue affects shared apartment property Notify the owners corporation or strata body and the builder/developer Authority to inspect or repair common elements may sit with the body, not an individual owner.

7. Jurisdiction-specific routes

New South Wales

NSW Government guidance recommends reviewing the contract and contacting the builder or tradesperson first. Building Commission NSW can handle complaints and dispute-resolution matters involving home building and specialist trade work, including houses and individual lots or units in class 2 apartment buildings. Common-property disputes have separate guidance. A dissatisfied homeowner may be able to pursue a tribunal claim, but you must confirm current eligibility, forms, evidence requirements and statutory warranty deadlines for your case.

NSW materials use “major defect” as an administrative and legal description involving a defect in a major element caused by defective design, workmanship or materials, or failure to meet National Construction Code structural-performance requirements. That definition is NSW-specific; do not apply it to another country or state. Time limits can depend on the defect, building type, contract and date of completion.

Victoria

Consumer Affairs Victoria advises owners to discuss the issue with the builder, preserve documents and photographs, and send a formal written outline if the problem is not resolved. Its guidance describes escalation through the Victorian building-dispute-resolution framework and directs consumers to the Building and Plumbing Commission process. These agency names and procedures apply to Victoria; a property elsewhere needs its own regulator and dispute pathway.

England and Wales

GOV.UK information on redress measures describes duties and remedies under the Defective Premises Act and changes made by the Building Safety Act 2022, including an extended limitation period for relevant claims. Whether a particular claim qualifies depends on jurisdiction, claim type, the date and nature of the work, and statutory detail. Obtain current advice from a qualified solicitor or the appropriate local body before relying on any limitation period.

8. If the builder will not fix the defects

Set a clear final opportunity

After the initial notice and any inspection, send a concise follow-up listing unresolved items, the evidence supplied, and the response or rectification plan required. Offer reasonable access and ask for dates, responsible trades, protection of occupied areas, and the standard against which completion will be checked. If the builder proposes a repair, ask whether it is temporary or permanent and what warranty applies to the remedial work.

Escalate without losing your evidence

If there is no adequate response, submit the complaint to the regulator or consumer dispute service that covers your location and building type. Provide the contract, defect register, photographs, notices, delivery proof, inspection reports, and a chronology. Follow the agency’s current instructions rather than assuming that an agency handling house work also handles common-property apartment defects. Consider legal advice before filing a tribunal or court claim, accepting a settlement, or signing a release.

Protect your position before major repairs

Extensive repairs can change or conceal the condition needed to determine cause. Ask the responsible party and insurer for an inspection opportunity, record any refusal or failure to attend, and obtain a written scope from the repair contractor. Keep samples, removed components, invoices, permits and completion photographs when practical. If immediate safety work cannot wait, explain the urgency in writing and limit the work to what is reasonably necessary until responsibility is assessed.
