If your paycheck is below the minimum wage that applies to your work, first identify the correct wage floor for the location and dates involved, then preserve your records and choose a reporting or legal route. The federal rate is $7.25 an hour for covered, nonexempt employees, but a higher state or local rate may control. Your job classification, tips, a federal contract, an exemption, and the hours you actually worked can all change the analysis.
Start with the right question: which minimum wage applies?
A low hourly rate is not enough by itself to prove a violation. The comparison must use the law covering your work, the place where you performed it, and the period when you performed it.

Federal baseline
The U.S. Department of Labor’s current federal guidance, accessed October 13, 2026, lists $7.25 per hour as the federal minimum wage for covered, nonexempt employees. This is a baseline, not a universal rate. The Fair Labor Standards Act (FLSA) does not override a higher state or local minimum wage. When more than one wage requirement covers the same work, employees generally are entitled to the highest applicable rate.

Location and work dates matter
State, county, or city law may set a higher rate, use different rules for small employers, or provide a separate enforcement process. Rates can change on a scheduled date, so check the law in effect on each date you worked rather than using today’s number for an older paycheck. Without your work location and dates, no one can identify the exact state or local rate.

Coverage, occupation, and special rules
Some workers are exempt from particular FLSA provisions, while narrow certificates or special wage provisions can apply to particular jobs or circumstances. The title on your paycheck does not decide coverage by itself. Describe what you actually did, who controlled the work, where it occurred, and how you were paid before concluding that a rate was unlawful.
Check whether the pay calculation is actually below the floor
Use all hours worked
Make a day-by-day list of the time you worked, including time that may not appear on a schedule. For construction work, that can include required setup, cleanup, tool or equipment preparation, meetings, training, or waiting when you were required to remain available. Whether a particular activity is legally compensable depends on the facts and the applicable law, but omitting it can hide a shortfall. Also note any work performed at a second site or after clocking out.
Compare pay to hours, not just the stated rate
For each pay period, record the cash wages actually received, the number of hours that may be compensable, and the rate shown on the pay statement. Divide the wages being counted toward minimum wage by the hours being counted. Keep overtime, deductions, reimbursements, and unpaid time as separate notes so an agency or lawyer can apply the correct rules. Do not assume a salary or a day rate automatically satisfies minimum-wage requirements.

Tipped construction or service work
Under federal law, an employer using the tip credit may pay a cash wage as low as $2.13 per hour only when the federal requirements are met. Cash wages plus tips must reach at least the applicable minimum wage; the employer must make up any shortfall. State or local law may prohibit that cash wage or impose different conditions. Keep tip reports and distribution records, and do not treat $2.13 as a lawful rate in every jurisdiction.
Preserve evidence before confronting the problem
Save copies in a personal account or device if you can do so lawfully and without taking confidential company material unrelated to your pay. Keep the originals and note when each record was created.

Information WHD will ask for
The Wage and Hour Division’s complaint guidance asks for your contact information; the employer’s name and contact information; a manager or owner’s name; the type of work; when the events occurred; and how and when you were paid. Organizing those details before calling reduces delays and helps the investigator understand the allegation.
Choose a reporting or legal route
You do not have to make the same choice as every other worker. The best route depends on whether the suspected violation is federal, state, or local; the evidence available; the remedy you need; and how quickly a deadline is approaching. More than one route may be possible, but their interaction is fact-specific.
| Route | When it fits | What it does | Important limits or considerations |
|---|---|---|---|
| U.S. Department of Labor Wage and Hour Division (WHD) | You suspect an FLSA violation or are unsure which federal rule applies. | Discusses your questions, decides whether an investigation is appropriate, and may supervise payment of back wages. | WHD does not charge workers to file or investigate a complaint. It cannot promise an investigation or a particular recovery. |
| State or local labor agency | Your jurisdiction has a higher minimum wage or a separate wage-claim process. | Applies the state or local law and procedures for that jurisdiction. | Deadlines, coverage, forms, and remedies vary. The correct office cannot be identified without the work location. |
| Private legal claim | You need advice about a complex classification, substantial back wages, retaliation, or overlapping state and federal claims. | An employee may seek back wages and other relief through a private action when the law permits. | Deadlines and filing requirements apply. A lawyer or legal-aid service must assess the facts, costs, and jurisdiction. |
How to contact the Wage and Hour Division
- Prepare your timeline. List the worksite locations, dates, hours, pay rates, payment dates, and the people who gave instructions.
- Call WHD at 1-866-487-9243. Explain plainly: “I wasn’t paid the minimum wage,” “I didn’t get paid for time I worked,” or “I don’t think I’m being paid right.” Ask which federal and state issues may apply and what documents the office wants.
- Provide accurate employer details. Include the legal business name if known, physical and mailing addresses, owner or manager, payroll contact, and the job or project involved.
- Ask about state enforcement too. A WHD staff member can discuss federal coverage, but a state agency may be the proper forum for a higher state or local rate or a state-law remedy.
- Record your submission. Keep the date, method, confirmation information, and names of agency staff. Worker.gov says a complaint is routed to the nearest field office and that the office will contact the worker within two business days; treat that as the agency’s stated estimate, not a guarantee.
WHD says it does not charge workers to file or investigate a complaint. It will decide whether an investigation is appropriate and what action the evidence supports.
Confidentiality, privacy, and retaliation
What confidentiality means
WHD says discussions and complaints are confidential. It also describes exceptions: the agency may need permission to disclose your identity to pursue an allegation, or a court may order disclosure. Therefore, do not promise yourself or a coworker absolute anonymity. Ask the agency how your information will be handled before giving details.
Retaliation is a separate violation
Federal law prohibits retaliation for protected wage complaints or for cooperating with an investigation. The Department of Labor states: “An employer cannot retaliate against a worker for exercising their rights, filing a complaint or cooperating with an investigation.” Threats, termination, reduced hours, undesirable assignments, discipline, or other adverse treatment can be relevant, but the legal test depends on the facts.

Keep a second timeline for retaliation: what you reported, to whom, when, what changed afterward, and any witnesses or written messages. Contact WHD promptly about the retaliation rather than waiting for the wage issue to finish. Potential relief can include reinstatement, lost wages, and damages, depending on the applicable law and circumstances.
Deadlines make prompt action important
General federal FLSA claims have a two-year limitations period. The period is generally three years for a willful violation. These are federal rules, not a universal deadline for every state claim, administrative filing, or retaliation allegation. A dispute over the correct start date, willfulness, or a different state deadline can change the result.
Do not wait for every record or for an employer’s promise to “fix it later.” Contact WHD or the relevant state agency while the events are recent, and obtain legal advice quickly if a private claim may be needed.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What recovery may look like
Under the FLSA, WHD may supervise payment of back wages. The Secretary of Labor may sue for back wages and an equal amount as liquidated damages, and may seek an injunction. An employee may also bring a private action, where permitted, for back wages, an equal amount in liquidated damages, attorney’s fees, and court costs.
These are possible federal remedies, not a prediction that a particular claim will succeed. The amount depends on the applicable rate, compensable hours, lawful credits or deductions, evidence, and defenses. State law may provide additional or different remedies.

An employee cannot bring an FLSA suit for the same back wages if WHD has supervised payment or if the Secretary of Labor has already filed suit to recover those wages. Tell each agency or lawyer about any prior complaint, settlement, supervised payment, or lawsuit so the routes can be coordinated correctly.
Construction-specific issues to flag
Federal contract work
Covered federal service-contract and construction work can carry prevailing-wage requirements instead of an ordinary minimum-wage comparison. Ask whether your project was performed under or in connection with a covered federal contract, identify your labor classification, and obtain the wage determination that applied to that project. A worker paid more than $7.25 can still have a prevailing-wage issue; a worker paid less may have both a minimum-wage and contract-wage question.
Multiple worksites and subcontractors
Record the exact address and project for every shift, the company named on your paycheck, and any general contractor or subcontractor that directed your work. Different sites can fall under different local rules, and responsibility for payroll may require identifying more than one business. Do not guess which entity is legally responsible; provide the agency with the full chain of names and instructions.
Unpaid time and changing rates
Construction employers sometimes use different rates for different tasks or projects. Preserve written notices and pay statements showing each change. List time spent loading, unloading, traveling between required sites, attending mandatory meetings, or correcting work after a shift, then let the agency or lawyer determine which hours count under the governing law.

- Work locations, project names, and the dates for each rate.
- Hours actually worked, including possible off-the-clock time.
- Cash wages, tips, deductions, and payment dates.
- Pay statements, schedules, time records, messages, and photographs.
- Employer, owner, manager, payroll, and subcontractor contact information.
- Any complaint already made and any response or retaliation that followed.
- The federal, state, or local agency you contacted and the date.
When to get individual legal help
Consider prompt advice from an employment lawyer or qualified legal-aid service if the employer disputes your hours, labels you an independent contractor, claims an exemption, uses a tip credit, operates across state lines, performs federal-contract work, or takes retaliatory action. Ask about the jurisdiction, filing deadline, fee arrangement, and whether contacting an agency could affect a private claim. A consultation does not replace preserving records or reporting an urgent deadline.
This guidance is U.S.-focused and general. The correct rate, coverage, deadline, and remedy depend on your location, dates, job duties, employer, and evidence.
