If a building permit is delayed, first find out whether the application is complete, which reviewer is holding it, and exactly what information or plan change is required. If it is denied, read the written decision immediately, identify the named appeal body and deadline, and decide—after checking local rules—whether a targeted revision or a formal appeal is the better route. Do not assume that silence equals approval or that a deadline from another city applies to your project.

Building-code permits, zoning approvals and planning permissions can involve different departments, standards, remedies and clocks. The workflow below helps you move the file forward while avoiding missed deadlines, undocumented conversations and work that may have to be removed.

First identify which approval is actually delayed

People often call every local approval a “building permit,” but the legal process may be different. A building-code permit usually addresses construction methods, structural safety, fire protection, plumbing, electrical work or energy requirements. Zoning approval concerns use, setbacks, height, lot coverage, parking and similar land-use rules. Planning permission may address the development’s overall acceptability, design, heritage, environmental effects or policy compliance.

Check the application receipt, portal record and correspondence for the exact application type and the department assigned to it. The correct appeal board, review period and required documents depend on that classification. A remedy for a code interpretation may not be available for a zoning variance, and a planning appeal route may not apply to a building-code denial.

Why a permit may be taking so long

A delay can mean the application is still in ordinary review, has been deemed incomplete, is waiting for another department, or has unresolved comments. It can also mean the authority has issued a notice but the applicant has not supplied the requested material through the required channel. Treat “pending” in a portal as a status to clarify, not as an explanation.

Common status questions to ask

  • Has the application been accepted as complete, or is information still missing?
  • Which review stream is active now—building code, zoning, planning, fire, engineering or another specialist review?
  • Has a reviewer issued comments, and are any comments still outstanding?
  • Is the next action required from the applicant, the authority or another agency?
  • What milestone should occur next, and what date is currently estimated?
  • Has the application been placed on hold, withdrawn, superseded or closed in the system?

Toronto Building, for example, provides separate resources for application status, review streams, plan review and document resubmission. That separation illustrates why a general “pending” label is not enough to diagnose the hold.

Step 1: Confirm the live status through the official channel

  1. Locate the application record. Use the local permit portal or contact the permitting department with the application or reference number, property address and applicant name.
  2. Ask for a completeness determination. Request confirmation that the file contains every document required for review, rather than assuming that payment or upload receipt means the application is complete.
  3. Request the current reviewer position. Ask which comments remain open, whether another department must respond, and what the authority expects next.
  4. Ask how to submit material. Confirm the portal folder, naming convention, file format, revision procedure and whether a resubmission restarts or affects any review period.
  5. Record the response. Write down the staff member’s name, date, exact status, promised next step and any stated target date, then send a short email confirming your understanding.

Keep the conversation factual. “What is missing and where should it be uploaded?” is more useful than an argument about how long the file has been open.

Step 2: Get every problem in writing

Ask for the written correction notice, deficiency list, denial notice or other explanation that identifies what is holding up the application. Verbal guidance can be helpful, but it is difficult to verify later and may not establish an appealable decision.

Create a permit record

  • Application and reference numbers.
  • Property address and project description.
  • Submission date, completeness date and every resubmission date.
  • Copies of plans, calculations, specifications, forms and supporting reports, with version numbers.
  • All correction notices, denial letters, portal messages and emails.
  • Names, roles and contact details for reviewers and consultants.
  • Proof that each revision was submitted, including portal receipts or dated delivery confirmation.

Save files in a read-only archive before replacing a plan set. A later dispute may turn on which drawing or calculation the reviewer saw on a particular date.

Use the jurisdiction’s stated rule, not a borrowed deadline

Florida Statutes §553.792 (2025) provides a specific example: for covered building-permit applications, the local government must notify the applicant about information needed to deem or determine an application properly completed within five business days. The statute also describes fee reductions for certain missed deadlines, subject to exceptions. That is a Florida rule for the applications covered by that statute; it is not a nationwide entitlement and does not automatically apply to every permit type.

Step 3: Turn review comments into a response plan

Read each comment as a separate task. Ask the reviewer to identify the applicable code section, ordinance, policy or filing requirement and to describe what evidence, calculation, drawing or change would resolve it. If a comment is unclear, request a clarification before redesigning the project.

Build a comment-response matrix

Column What to record
Comment number The identifier used by the authority
Reviewer request The exact wording, copied into your internal log
Requirement The cited code, ordinance, standard or document requirement
Response The plan revision, calculation, narrative or attachment supplied
Drawing/version The sheet and revision number where the change appears
Submission proof Date, portal receipt or other evidence of delivery
Open question Anything requiring written clarification from the reviewer

Have the design professional coordinate changes across every affected sheet. A structural change may require architectural, mechanical, energy, fire or accessibility updates. Upload a clean, clearly marked revision package through the authority’s prescribed process; do not email an unofficial replacement if the portal requires formal resubmission. Toronto provides a defined route for revised documents, illustrating the importance of using the local channel.

What to do when the permit is formally denied

A denial is different from a request for more information. Read the notice for the decision date, reasons, appeal board, filing deadline, form, fee, service requirements and documents that must accompany the appeal. Calendar the earliest deadline immediately and verify it with the named body or its clerk.

Separate correctable defects from disputed decisions

  • Correctable omission: a missing calculation, signature, form, survey, detail or required report. A complete resubmission may be faster than an appeal.
  • Design noncompliance: the proposal does not meet a measurable requirement such as a setback, height, fire separation or accessibility provision. A redesign or variance may be necessary.
  • Code or policy interpretation: you and the reviewer disagree about how a provision applies. An administrative review, interpretation request or appeal may be available.
  • Variance or alternative-material request: the project seeks relief from a requirement or proposes an alternative method. This may have a separate application and hearing route.

Philadelphia offers a local example. Its Board of Building Standards hears many construction-permit appeals, including certain code-interpretation and variance matters. The city’s current guidance says a formal permit-denial appeal to that board must be filed within 30 days and specifies the required package. That 30-day period belongs to the Philadelphia procedure; it must not be treated as a general deadline elsewhere.

Prepare an appeal file

  1. Copy the signed denial and every cited reason.
  2. Identify the precise relief requested: reversal, interpretation, variance or another remedy authorized by the local rules.
  3. Assemble the approved application record, denied plans, revised plans, code analysis, photographs, surveys, expert letters and other required exhibits.
  4. Use the required form, filing method and fee payment process.
  5. Confirm service on the authority or other parties if the rules require it.
  6. Obtain a stamped copy, electronic receipt or docket number and keep it with the project record.

Do not wait for an informal conversation to preserve an appeal right. A meeting can continue while a timely filing protects the formal remedy, if local rules allow both.

Can you appeal if the building department does not respond?

Sometimes, but there is no universal “deemed approved” rule. A local system may permit an appeal after a determination period, provide a refund or fee reduction for a missed statutory deadline, or require a different escalation. Silence may also mean the application was incomplete, routed to another review stream or never properly submitted.

Ask the authority in writing:

  • What date starts the applicable review period?
  • Was the application deemed complete?
  • What period applies to this permit category?
  • Is there an appeal, administrative review or supervisor-escalation process for non-determination?
  • Does a revised application replace the original and affect any appeal right?
  • Are there refund, fee-reduction or automatic-action provisions, and what exceptions apply?

England’s planning system demonstrates how specific these rules can be. The Planning Inspectorate’s 2026 guidance lists eight weeks for a standard valid planning application, 13 weeks for major development and 16 weeks where an environmental impact assessment is required, subject to written extensions. Those are planning-permission periods in England, not general building-permit deadlines. Appeal limits also depend on the application type.

Revision or appeal: how to choose

When both routes are available, compare the issue, deadline, cost, evidence and likely result before changing the application.

Question Favors a targeted revision Favors an appeal or formal review
What is wrong? A missing item or objectively correctable design issue A disputed code interpretation, variance decision or policy judgment
Can the project meet the requirement? Yes, with a defined plan or document change The applicant has a defensible basis that the decision misapplies the rule
What is the timing risk? Revision can be prepared before a short appeal deadline, with rights confirmed locally A filing clock is running and cannot safely be preserved by informal discussions
What evidence is needed? Updated drawings, calculations or missing documents The complete record, legal or technical analysis and required exhibits
What should be confirmed? Whether resubmission changes the original application or review date Filing method, fee, service, hearing date and authorized relief

Government guidance for planning appeals in England advises re-engaging with the local planning authority about possible changes before appealing. Its wording is: “Before making any appeal the party seeking permission should first consider re-engaging with the local planning authority to discuss whether any changes to the proposal would make it more acceptable and likely to gain permission.” This advice concerns planning applications in England. It does not eliminate a local appeal deadline or decide what is best for a building-code case.

Escalate methodically when the file stalls

  1. Send a concise written status request with the application number, completeness question, open comments and requested milestone.
  2. Ask for the assigned reviewer’s supervisor or permit coordinator if no response arrives within the authority’s stated service channel.
  3. Use the department’s formal complaint, administrative-review or records process when available.
  4. Contact the named appeal body if the issue is a decision or failure to act covered by its rules.
  5. Document every escalation and continue meeting any applicant-side deadlines.

Keep the tone professional and narrow. Escalation should clarify ownership and procedure, not substitute for the technical response the application requires.

When professional help is worth the cost

A licensed architect, engineer, code consultant, permit expediter or construction attorney can help when comments conflict, the project needs a variance, a code interpretation is disputed, or an appeal package must be assembled quickly. Philadelphia’s Board of Building Standards guidance recognizes design professionals, attorneys, contractors and licensed expediters as possible authorized agents in its process.

Before engaging anyone, verify the person’s license or registration, local experience, exact scope, deliverables, fee structure, conflicts and authority to communicate on your behalf. An expediter can manage submissions, but the design professional remains responsible for technical documents within that professional’s scope. Legal advice is especially important when an appeal deadline, enforcement action, property-rights issue or contract claim is involved.

Protect the project while approval is unresolved

  • Do not start work that requires a permit unless the authority confirms a lawful exception in writing.
  • Tell the owner, lender, insurer, contractor and affected trades that the approval is pending or denied.
  • Check contracts for notice requirements, suspension rights, redesign costs and schedule extensions.
  • Keep procurement and site decisions aligned with the latest permitted design; do not build from superseded drawings.
  • Preserve inspection, testing and professional-review records for any work that is already authorized.

Starting construction without the required approval can create stop-work orders, rework, penalties, financing problems, insurance disputes and difficulty obtaining final approval. A short delay in clarifying the status is usually safer than committing the project to an unapproved design.

Jurisdiction examples and what they do—and do not—tell you

Jurisdiction and process Published figure Limited meaning
England standard valid planning application 8 weeks Listed determination period, subject to written extensions
England major-development planning application 13 weeks Listed determination period, subject to written extensions
England planning application requiring environmental impact assessment 16 weeks Listed determination period, subject to written extensions
Philadelphia formal construction-permit denial appeal to the Board of Building Standards 30 days Current city guidance deadline where that board is the designated route
Florida covered building-permit application 5 business days Statutory period to notify the applicant about information needed for completion or determination under §553.792 (2025)

These figures cannot be combined into a universal permit timetable. The property’s jurisdiction, approval type, application completeness, written extensions and local exceptions control.

A practical checklist before you call or file

  • Application number and property address.
  • Exact approval type and responsible department.
  • Submission and completeness dates.
  • Latest portal status and all open reviewer comments.
  • Written correction or denial notice.
  • Current plan set and revision history.
  • List of documents already supplied and documents requested.
  • Possible appeal body, deadline, fee and filing method.
  • Names of the owner, applicant, design professional and authorized agent.
  • A written question asking for the next action and expected milestone.

The objective is not merely to make the portal say “in review.” It is to establish a complete record, answer each requirement through the correct channel, and preserve the remedy that applies if the authority’s decision remains wrong or the file does not move.
