Do not ignore a notice for unauthorized construction. Read every page, stop only the work the notice or authority requires you to stop, record the effective and response dates, and contact the issuing authority promptly. A planning enforcement notice, building-code order, and stop-work order are different legal instruments; the correct response depends on the exact document, location and authority.
This is general information, not jurisdiction-specific legal advice. Follow the notice itself and obtain advice from a qualified local planning, building or construction professional when property rights, safety, major costs or a short deadline are involved.

First, identify exactly what you received
“Unauthorized construction” is a plain-language description, not a single worldwide legal process. The document may be a planning enforcement notice, building-code order, stop-work order, notice of violation, correction order or another instrument. Each can have different powers, deadlines, appeal rights and consequences.

Keep the original envelope, email headers, photographs of a posted notice and every attachment. Missing a page can hide a deadline or a required form.
Protect safety and preserve your position immediately
Follow any stop-work or safety direction
If the document says work must stop, follow that direction while you verify the position. Do not remove a posted order, conceal work, continue through a different contractor or allow workers into an unsafe area. If an excavation, temporary structure, exposed electrical installation or partially completed building presents an immediate hazard, arrange appropriate temporary protection through a competent professional and notify the authority about urgent safety conditions.
Do not assume a conversation changes the deadline
An officer’s informal suggestion, a pending permit application, a promise to provide drawings or an appeal may not suspend an order. Obtain any extension, variation, stay or revocation in writing from the body legally able to grant it. Treat the printed deadline as operative unless the authority or a court confirms otherwise.

Contact the issuing authority with focused questions
Use contact details verified independently through the authority’s official website or published directory, rather than relying solely on a number in an unsolicited message. Ask for the officer or team responsible for the file and request written confirmation of key points.
- What exact work or use is alleged to be unauthorized?
- Which permission, permit, approved plan, condition or code requirement is said to be missing or breached?
- What evidence does the authority rely on, and can you inspect or obtain copies of the relevant plans, photographs, inspection notes and calculations?
- What must happen by each date, and is the date a compliance deadline, an appeal deadline, an effective date or something else?
- Must all work stop, or are safety, weatherproofing or preservation activities allowed?
- Who is entitled to respond or appeal, what form is required, where must it be filed and how will receipt be proved?
- Will filing an application, review request or appeal suspend enforcement? Ask for the legal rule, not an assumption.
- Can a meeting or pre-application discussion occur without waiving any appeal or response right?
Send a short written follow-up summarizing the answers and asking the authority to correct any misunderstanding. Keep proof of delivery and a call log.
Build the file you will need
A clear chronology helps an authority, adviser or tribunal understand what happened. Gather records that show both the physical facts and your dealings with officials:
- current and historic permits, approvals, certificates, conditions and approved drawings;
- inspection reports, sign-offs, survey plans, structural calculations and utility approvals;
- dated photographs, videos and aerial or site records showing the work at relevant stages;
- contracts, invoices, change orders, delivery records and contractor or designer statements;
- emails, letters, meeting notes and call logs with the authority, neighbours, consultants and contractors;
- title, lease, occupancy and ownership documents identifying who controls the land and who carried out the work; and
- evidence of the property’s use, dates of construction and any earlier enforcement or permission discussions.
This is a practical preparation list, not a universal legal requirement. Preserve originals, keep a read-only copy and label photographs with the date, location and photographer. Do not alter records or create a backdated document.

Choose the right response route
Once the notice is classified, compare the available routes rather than filing the first form you find.
| Route | When it may fit | Questions to resolve first | Common risk |
|---|---|---|---|
| Informal clarification or meeting | The facts, scope or required remedy are unclear and the authority allows discussion. | Does discussion preserve every formal deadline and appeal right? | Assuming a meeting replaces a written response. |
| Permission or permit application | The work might be acceptable if assessed under the applicable planning or building rules. | Is retrospective permission available, what drawings and fees are required, and must work remain stopped? | Believing an application legalizes existing work automatically. |
| Written representation or correction plan | You can address an error, provide missing documents or propose a compliant remedy. | What evidence and format does the notice require? | Sending explanations without answering each alleged breach. |
| Administrative appeal or review | The notice provides a statutory appeal or review process. | Who is eligible, where is it filed, what grounds apply, and does filing suspend enforcement? | Filing late or in the wrong forum. |
| Court or tribunal application | The statute provides judicial review, an injunction, an appeal or another court remedy. | What is the limitation period and what order is actually available? | Relying on court action without obtaining a stay. |
| Compliance, removal or making-safe work | The work cannot be authorized or the notice requires immediate correction. | What specification, inspection and sign-off will satisfy the authority? | Starting remedial work that creates a new breach or destroys evidence. |
A local professional can help separate a planning issue from a technical code defect. Retrospective permission may be possible in some systems, but no application or appeal should be described as guaranteed.
Deadlines and appeals: examples that cannot be generalized
Deadlines depend on the notice and jurisdiction. The following examples illustrate why you must read the governing document; they do not create a universal timetable.

England: planning enforcement notice
The Planning Inspectorate’s procedural guide applies to England. It describes a breach of planning control as development carried out without required planning permission or failure to comply with a planning permission condition or limitation. The local planning authority considers whether enforcement is expedient and encourages constructive discussion where appropriate.

For an eligible appeal, the Planning Inspectorate says the appeal must be received before the enforcement notice’s effective date. The latest filing date is the day before that date; “A late appeal will be turned away.” An appellant generally must have an interest in the land or be a relevant occupier. The appeal must rely on one or more of seven statutory grounds. Ground (a) asks that planning permission ought to be granted or a condition or limitation discharged; using that ground is treated as a deemed planning application and may involve a fee. Check the current GOV.UK guidance, the Planning Inspectorate’s Enforcement notice appeals: Procedural Guide England (updated 22 April 2026), and the notice itself for the form, fee and evidence requirements.
Washington, DC: stop-work order
The District of Columbia Department of Buildings states that an appeal of a stop-work order must be filed within 15 calendar days after the order is posted. The reviewing official has ten working days after receiving the form to affirm, modify or reverse the order. Those figures apply to the DC process described by that agency. Permit requirements and penalties on the same agency page are also DC-specific and must not be transplanted to another city or country.
New South Wales: Building Commission orders
For the classes of orders covered on its page, Building Commission NSW says an order remains in effect after its compliance date unless it is revoked. A developer may appeal to the Land and Environment Court within 30 days, but lodging an appeal does not itself stop the order’s effect unless the court orders otherwise. The agency also states that failure to comply is an offence. Confirm that your document is one of the orders covered before relying on those rules.

Ontario: building-code context
Ontario’s Building Code Act provides for orders and, in specified circumstances, a stop-work order when an order is not complied with. The Act is a statute-specific example, not a universal procedure for planning notices or construction orders elsewhere. An Ontario recipient should identify the municipality, order section and available review or appeal mechanism in the document.

Prepare a defensible written response
Use the notice’s reference number and answer each allegation in the same order. A practical structure is:
- Identity and authority: state the address, your relationship to the land and the notice date.
- Position on facts: admit, deny or state that you cannot yet verify each alleged item. Explain dates and measurements precisely.
- Documents: list the permit, drawing, inspection or photograph supporting each factual point and attach copies permitted by the rules.
- Proposed action: identify a permit application, correction, inspection, removal or request for clarification, with realistic dates.
- Procedural request: ask for an extension, meeting, inspection or written confirmation only where the authority has power to grant it.
- Reservation of rights: do not concede legal points or withdraw an appeal right without local advice.
Write in a calm, factual tone. Do not blame an inspector, accuse a neighbour or speculate about motives. A concise chronology and indexed attachments are more useful than a long narrative.
Common mistakes and how to avoid them
- Waiting for a contractor to fix everything: the legal recipient may remain responsible even when a contractor performed the work. Coordinate, but track the deadline yourself.
- Assuming a permit application cures the breach: application, approval and inspection are separate events. Ask when, if ever, the authority will treat the work as authorized.
- Assuming an appeal pauses enforcement: some systems expressly say it does not. Seek a stay or suspension from the body empowered to grant one.
- Demolishing before documenting: take dated photographs and obtain technical advice before altering evidence, unless immediate safety requires action.
- Using the wrong appeal form or recipient: verify filing method, fee, service requirements, office hours and receipt confirmation.
- Missing the effective date by one day: calculate in the notice’s time zone and calendar convention, allowing for weekends, holidays, delivery and electronic filing rules.
- Continuing work secretly: this can create additional offences, safety exposure and credibility problems.
When to obtain professional help urgently
Seek prompt local advice if the notice threatens demolition, alleges unsafe construction, affects a mortgage or tenancy, involves environmental or heritage controls, names multiple owners, or gives only a few days to respond. Choose an adviser familiar with the authority and the specific discipline involved: a planning professional for land-use permission, a building surveyor or code consultant for technical compliance, and a lawyer for statutory appeals, court remedies, title issues or enforcement risk. Ask what deadline they can meet, what work must stop, what evidence they need and whether they can seek a stay.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsIf professional advice is unaffordable, ask the issuing authority whether it provides a plain-language explanation, inspection appointment, public guidance or referral to a local assistance service. Do not treat administrative help as legal representation, and do not let a request for assistance replace a formal filing.
A practical 48-hour checklist
- Scan and securely store the complete notice and envelope or posting photographs.
- Highlight the issuer, legal basis, alleged work, required remedy, effective date and every deadline.
- Stop any activity expressly prohibited and address immediate hazards safely.
- Verify the authority’s contact details independently and request the file officer.
- Ask in writing about evidence, eligible respondents, forms, fees, stays and inspection access.
- Create a chronology and collect permits, plans, inspection records, photographs, contracts and ownership documents.
- Calculate the earliest filing date and arrange proof of delivery.
- Book qualified local advice if rights, safety, substantial expense or a formal appeal is involved.
- Send only a measured, complete response; keep copies of everything submitted.
What a resolved case should leave you with
Ask the authority to confirm in writing what action satisfies the notice, whether an order is revoked or closed, which permits or inspections remain outstanding and whether any continuing conditions apply. Keep the confirmation with the property records. If the authority requires work to remain stopped or imposes a continuing order, comply until it is formally lifted or a competent tribunal or court changes it.
