What to Do if Street Construction Blocks Your Driveway or Damages Your Property

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not enter an active work zone. First obtain safe-access instructions from the project representative or your municipality, then document any damage before cleanup or repairs. Identify the utility, contractor, or public agency controlling the work, notify your insurer, and check your city’s exact claim-notice deadline immediately. Temporary access, physical restoration, and financial compensation are separate issues, and the rules vary by location.

1. Make the site safe and get an access plan

Stay outside the work zone

Do not cross barriers, walk around heavy machinery, move cones, or approach equipment to reach a parked vehicle. Active excavation, paving, trenching, and concrete work can create hazards that are not obvious from the driveway. Vaughan’s roadwork guidance specifically tells residents not to enter work zones or approach heavy equipment.

If someone in your household needs medical transport, disability access, caregiving support, or urgent vehicle access, tell the project representative immediately. Explain the practical need and ask what safe alternative the crew can provide. Never create your own route through an excavation or freshly placed surface.

Find the project contact

Look for a project sign, door hanger, mailed notice, or posted construction information. The notice may identify the municipality, utility, general contractor, project number, and an on-site inspector. If a representative is present, ask for their name, employer, phone number, and the person responsible for access decisions.

Ask four specific questions:

  • When will vehicles and pedestrians be allowed to use the driveway again?
  • Is there a safe temporary entrance, parking area, or pedestrian route?
  • Which stages of the work will restrict access, and for how long?
  • Who should be contacted if the schedule changes or an emergency arises?

Vaughan describes projects in which driveway access is limited while curb, sidewalk, apron, or road surfaces are removed and then restored after an initial asphalt layer, with later finishing work still to come. That sequence is a local example, not a guaranteed schedule or restoration standard elsewhere. Obtain the plan for your own project in writing when possible.

Report unsafe or unexpected conditions promptly

Use the project contact and your municipality’s public-works, transportation, or 311 channel to report an open hazard, missing barrier, blocked emergency route, or damage that was not expected. Ask the person receiving the report to log it. Record the report number, date, time, department, and name of anyone you spoke with. A prompt report gives the responsible party an opportunity to protect the site and may create an important contemporaneous record.

2. Identify who controls the work

Start with the utility or contractor when one is identifiable

Utility replacement, telecommunications work, gas or water repairs, and private development often occur in a public right-of-way but are performed by a utility or hired contractor. Calgary advises residents to contact the utility or contractor first and to use 311 when the responsible party is unclear.

Ask the crew or municipal representative for:

  • the project owner or utility;
  • the prime contractor and any subcontractor working at your address;
  • a claim or damage-reporting contact;
  • the project or work-order number; and
  • the department responsible for inspecting restoration.

Understand the public-right-of-way boundary

A curb, sidewalk, boulevard, driveway apron, easement, and the portion of a driveway on private land may be controlled by different parties. The project agreement, easement, permit, or local right-of-way boundary can determine who must restore a disturbed surface. Do not assume that damage near the street is automatically the city’s responsibility, or that a private contractor is responsible for every defect on your lot.

For utility work in a right-of-way, Calgary states that the utility disturbing the surface is responsible for appropriate restoration under its local rules. That statement applies to Calgary’s framework; another municipality may assign duties differently.

3. Build a dated damage record before repairs

Photograph and describe the condition

If it is safe, photograph and video the damage before moving materials, washing surfaces, or beginning repairs. Take wide images showing the property and work zone, followed by close images with a ruler or other scale where useful. Keep the original files so their date and metadata remain available.

Write down:

  • the exact address and the affected area;
  • the date and time you first noticed the problem;
  • what work was occurring and what you observed;
  • the type, dimensions, and apparent extent of the damage;
  • weather or visibility conditions if they matter;
  • project signs, contractor names, vehicle markings, and equipment numbers;
  • the names and contact details of witnesses; and
  • any notice, text, email, or conversation about access or restoration.

Vancouver’s claims guidance asks for incident time, place, details, witness contacts, photographs, and supporting documents. A contemporaneous log is more useful than trying to reconstruct events months later.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Preserve documents and damaged items

Keep copies of door hangers, mailed notices, emails, text messages, work orders, estimates, invoices, receipts, and every claim submission. Toronto advises retaining photographs, receipts, and estimates; its initial online claim form may not accept attachments, so preserve the materials for later delivery to the assigned adjuster.

Do not discard damaged materials until the insurer, city, contractor, or adjuster says they are no longer needed, unless leaving them in place creates a safety risk. If immediate removal is necessary, photograph the item thoroughly, retain a sample where practical, and document why mitigation could not wait.

4. Protect people and limit further loss

Take reasonable emergency measures

Protect people first. Keep children, visitors, and pets away from excavations, unstable edges, standing water, exposed wiring, and freshly placed concrete or asphalt. If water is entering a building, a structure is unstable, or a utility appears damaged, contact the appropriate emergency or utility service rather than entering the area.

For urgent mitigation, use reasonable temporary measures and keep every receipt. Examples may include arranging safe temporary access, covering an opening to prevent additional weather damage, or obtaining emergency pumping when necessary. Document what you did, why it was urgent, and the condition before and after. Do not assume the city or contractor will reimburse a cost before responsibility has been investigated.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Delay nonessential repairs until inspection

Notify your insurer and ask whether it wants to inspect the property, whether the policy covers the loss, and whether you should wait before making permanent repairs. Vancouver recommends notifying the insurer, retaining damaged items for possible inspection, and preserving evidence. Emergency work to prevent further harm is different from replacing the entire surface before an inspection.

5. Separate access, restoration, and compensation

Issue What you are asking for Best first contact What it does not establish
Temporary access A safe route, parking arrangement, or reopening date On-site representative, project owner, or municipality It does not decide who owes money for damage.
Physical restoration Repair or replacement of a disturbed curb, sidewalk, apron, boulevard, or road surface Utility, contractor, or agency responsible under the permit or project agreement Restoration does not automatically cover unrelated losses.
Financial compensation Payment for a documented property loss or expense Responsible company, municipality’s claims office, and your insurer Filing a claim does not guarantee payment.

A crew may lawfully restrict access for part of a project while still owing a duty to restore a disturbed surface. Conversely, a restored driveway does not necessarily compensate you for a damaged vehicle, landscaping, lost use, or emergency expense. Present each loss separately with evidence showing its cause and amount.

Municipal liability offices investigate responsibility; they do not function as automatic reimbursement programs. Toronto explains that a third-party claim may take longer because the city investigates negligence and that payment is not guaranteed. Vancouver states that it will consider compensation only when circumstances suggest legal responsibility.

6. Choose the right claim route

Direct claim to the contractor or utility

Use the company’s claim contact when the project owner or contractor is identifiable. Send a concise description, the incident date, photographs, estimates, receipts, and the amount sought, while keeping the originals. Ask for a claim number and the name of the person handling it. NYC Department of Transportation guidance tells property owners to document damage caused by a utility or contractor and contact the responsible company about repair.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A direct route can be efficient when the company controls the site and can inspect quickly. It may still require investigation, proof of causation, and proof that the requested repair or expense is reasonable.

Municipal claim

If the city or another public agency owns or controls the work, follow its formal claims process exactly. The city may send the matter to an adjuster and may forward it to a contractor that controlled the location. Vancouver also notes that contractor-caused damage may be referred to the contractor for investigation.

Use the municipality’s required form, delivery method, recipient, and notice language. Keep proof of submission and the claim number. A phone call or report to 311 may document a hazard but may not satisfy a statutory written-notice requirement.

First-party insurance claim

Notify your insurer even when you believe a contractor or city is at fault. Ask about coverage, deductibles, inspections, emergency mitigation, and subrogation. Toronto notes that first-party coverage can be broader than recovery through a city third-party claim, while a city claim can involve a longer investigation and may be denied.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Insurance coverage and recovery from another party are separate determinations. Do not promise the insurer that the contractor is liable; provide the facts and preserve the evidence.

7. Check the local notice deadline immediately

Deadlines differ by jurisdiction, claim type, and the entity being sued or asked to pay. Do not borrow a deadline from another city, and do not assume that notifying a contractor satisfies a statutory notice requirement for a municipal claim.

Jurisdictional example Published requirement Qualification
Toronto The city’s current claims page says notice for a claim concerning the condition of city roads or sidewalks must be submitted within 10 days of the incident. This is a Toronto process and a specified claim category, not a universal construction-damage deadline. The page was marked modified May 15, 2026.
Vancouver The city says written notice for a claim against the city must be delivered within two months and describe the time, place, and manner of the damage. This is Vancouver’s municipal requirement and does not set the deadline elsewhere.

Submit notice as soon as you can, even if the full repair cost is not yet known. State that additional documents or estimates will follow if the process permits, and ask the claims office what information must be supplied later. Keep a dated copy of everything sent and confirmation that it was received.

8. A practical documentation and communication checklist

  1. Photograph the approach to the property, barriers, signs, machinery, and every damaged area from several distances.
  2. Record the incident date, discovery time, address, project description, witnesses, and any prior notice.
  3. Obtain the project owner, utility, contractor, inspector, and claim-contact details.
  4. Report unsafe conditions through the project channel and municipal service line; save the report number.
  5. Ask for a written access plan and restoration sequence, including any temporary route.
  6. Notify your insurer and ask about inspection, coverage, mitigation, deductibles, and damaged-item retention.
  7. Request written repair estimates from qualified professionals when the extent of damage is clear.
  8. Send the required municipal or contractor notice before the applicable local deadline.
  9. Keep a communication log with dates, names, promises, photographs, invoices, receipts, and claim numbers.
  10. Follow up in writing after every significant call, confirming what was said and what action is expected.

9. Common mistakes that weaken a claim

Entering the work zone or moving barriers

This can cause injury, interfere with evidence, and create disputes about how the damage occurred. Ask the site representative for a safe inspection route instead.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Repairing before documenting

Permanent replacement can erase evidence of the original condition. Photograph first, notify the relevant parties, and limit work to reasonable emergency protection unless delay would worsen the loss.

Assuming the city is the only responsible party

A city may own the road while a utility or contractor controls the excavation. Identify every entity shown on the project notice and ask the municipality to clarify ownership and control.

Relying on a verbal promise

A statement that access will return “soon” does not identify a date, scope, or responsible person. Request the sequence and expected dates in writing, then record changes.

Waiting for a final repair estimate before giving notice

Notice deadlines can run from the incident date, not from the date a contractor finishes investigating. Send the required notice promptly and supplement it as permitted.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Combining every loss into one unsupported figure

Separate surface restoration, damaged personal property, loss-of-use expenses, landscaping, and emergency costs. Tie each amount to photographs, estimates, invoices, or receipts.

10. When the problem remains unresolved

Ask the assigned adjuster or claims contact what evidence is missing, whether an inspection has been scheduled, and when you should expect the next decision. Provide documents in an organized index rather than sending multiple unlabelled files. Continue using safe temporary arrangements while the claim is investigated.

If access remains dangerous, the work expands beyond the described project, or the claimed loss is substantial, consider speaking with a qualified local construction or property lawyer and a licensed insurance professional. The applicable limitation periods, notice rules, contract terms, easements, and negligence standards depend on your location and facts. A professional can assess those issues; a general article cannot determine liability for your property.

The key sequence is practical: stay out of danger, obtain a documented access plan, identify who controls the work, preserve evidence, notify your insurer, and meet the exact local notice rule. Treat reopening the driveway, restoring the disturbed surface, and obtaining compensation as three separate requests so that one unresolved issue does not hide another.
