A pending application, an approved site plan and an issued permit do not have the same protection everywhere. The controlling answer comes from the ordinance and transition rules for the parcel, interpreted through the state and local procedures where the project is located.
Start by identifying the rule that actually changed
News coverage, a planning-commission discussion or a proposed draft is not enough to determine your rights. Ask the planning or zoning office for the adopted ordinance or amendment and the code version that applies to your parcel. Keep a copy with the clerk’s adoption record or other official date information.

Confirm the status and dates
- Is the measure only proposed, formally adopted but not yet effective, or already effective?
- What date did the governing body adopt it, and what is the stated effective date?
- Was a public-hearing notice published, and does the local or state rule tie protection to that notice date?
- Which parcel, zoning district, overlay or mapped area does the text cover?
- Does the amendment contain a transition, grandfathering, nonconforming-use or pending-application clause?
A change can have different consequences at each stage. Massachusetts General Laws chapter 40A, section 6, for example, uses the relationship between hearing-notice publication, applications and permits in determining certain protections. That timing model is not a nationwide rule; it is a reason to collect the exact dates before relying on a project status.

Ask which code version governs each action
Request a written explanation of whether the amendment applies to a pending application, an amended application, an extension, a construction permit or a later inspection. A project can involve several approvals governed by different provisions. Do not assume that the code in effect when you bought the property, hired a designer or submitted an incomplete package is the code that controls the next decision.

Build a dated project record immediately
Your strongest position usually comes from a clear record showing what the government approved, what you did in reliance on it and when each event occurred. Create a chronology rather than relying on memory.
- Collect submission evidence. Save application forms, receipts, fee records, completeness notices, plan sets, revision stamps and correspondence showing the date and content of each submission.
- Collect decisions and approvals. Include zoning-administrator determinations, approved site plans or plats, special-use approvals, variances, rezonings, subdivision decisions and any final administrative determination.
- Collect permit records. Preserve issued building, grading, demolition or other permits, their expiration and extension records, inspection reports and notices of violation.
- Document construction. Keep dated photographs, delivery tickets, invoices, contracts, pay applications, inspection sign-offs, utility work and other evidence showing what work began and whether it continued.
- Record reliance and obligations. List nonrefundable design fees, financing commitments, purchase orders, contractor obligations and other project expenses, identifying the date and the government act on which each relied.
- Mark every change. Put the amendment’s notice, adoption and effective dates on the same timeline as your application, approval, permit, start-of-work and discontinuance dates.
Expenses alone do not automatically create vested rights. Some statutes require a qualifying governmental act, good-faith reliance and extensive obligations or substantial expenses incurred in diligent pursuit of a specific project.
Compare your project’s stage before choosing a response
The following is a triage framework, not a universal vesting test. Local ordinances and the applicable state statute control.

| No application filed | There is generally no project-specific approval to rely on. The new rule may control the first application. | Ask whether any transition period, pre-application status or hearing-notice rule applies. |
| Application pending | Protection varies. Filing alone does not universally freeze every zoning standard. | Obtain a completeness determination, the local permit-choice rule and a written statement of the code version that will be used. |

Can the city change zoning after you apply for a building permit?
Sometimes. The answer depends on whether the application was complete, what the local ordinance says about permit choice, and whether a state vesting or transition rule applies. Treat “applied,” “accepted as complete,” “approved,” and “permit issued” as separate events.
Pending is not the same as vested
Some jurisdictions let an applicant choose the regulation in effect on a particular filing date; others apply the regulation in effect when the decision is made, subject to statutory exceptions. North Carolina General Statutes section 160D-108 addresses permit choice when a regulation changes between application and decision, but it does not create a blanket rule that filing any application freezes every regulation. Read the current statute together with the local ordinance and the project’s completeness record.

Ask for a parcel-specific determination
Send the zoning administrator or planning department a concise written request identifying the parcel, application number, submission date, completeness date, amendment number and requested action. Ask which standards apply, whether an amendment is needed, and whether the determination can be appealed. Keep the request and response with your project record.
Does an approved site plan protect the project from new zoning rules?
An approved plan can be more significant than a pending application, but approval does not have the same effect in every state or locality. Check the approval’s duration, conditions, extension history and any statute that defines vested rights.

Virginia Code section 15.2-2307(A) states: “A landowner’s rights shall be deemed vested in a land use and such vesting shall not be affected by a subsequent amendment to a zoning ordinance when the landowner (i) obtains or is the beneficiary of a significant affirmative governmental act that remains in effect allowing development of a specific project, (ii) relies in good faith on the significant affirmative governmental act, and (iii) incurs extensive obligations or substantial expenses in diligent pursuit of the specific project in reliance on the significant affirmative governmental act.”
The statute lists examples of potentially qualifying acts, including certain rezonings, special-use approvals, variances, preliminary or final plans and final administrative determinations. It also contains provisions concerning buildings constructed under permits and some nonconforming structures. Those are Virginia statutory details, not a test that can be transplanted to another state.
What to prove with an approval
- The approval was a significant affirmative governmental act and remained in effect.
- It authorized a specific project rather than merely describing a possible future use.
- You relied on it in good faith.
- You incurred extensive obligations or substantial expenses while diligently pursuing that project.
- You complied with conditions, extensions and permit requirements.
What if the zoning changed after you bought the property?
Buying land before an amendment does not, by itself, guarantee the right to develop under the former zoning. Ownership date is one timeline entry; it is not automatically a project approval or vested-rights event.

Gather the zoning history, your purchase documents and any representations made by the seller or public agencies, but focus on whether a qualifying approval existed before the amendment and whether you relied on it. If the property was already lawfully occupied or developed, ask whether the amendment creates a nonconforming use or structure and what rules govern continuation, abandonment, replacement and expansion. These questions are local and often differ from the rules for a new project.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteCan you keep building after the rules changed after your permit was issued?
Do not stop or continue solely on an informal statement. Ask the issuing department to confirm in writing whether the permit remains valid, what work counts as commencement, whether a lapse or discontinuance occurred, and whether the amendment affects unbuilt portions of the plan.
Permit duration and expiration
North Carolina General Statutes section 160D-108 addresses permit duration and expiration, including circumstances in which rights can lapse. The current statute and local regulations must be checked for the specific permit. A permit that was issued but allowed to expire can produce a different result from a permit kept active through timely work or an extension.
Separate zoning from building and safety requirements
Determine whether the change affects use, density, setbacks, height, parking or other zoning standards, or instead imposes generally applicable building, fire, accessibility or safety requirements. A zoning vesting argument does not necessarily exempt a project from current safety rules. Ask the building official which code edition and inspections apply to remaining work.

Virginia
Virginia Code section 15.2-2307 focuses on a significant affirmative governmental act, good-faith reliance and extensive obligations or substantial expenses in diligent pursuit of a specific project. The statute identifies several approval categories and addresses certain permitted buildings and nonconforming structures. G.S. 160D-108 includes rules about choosing the applicable regulation when a change occurs between application and permit decision, as well as statutory vested-right categories and expiration. It should not be summarized as “the filing date always wins.” Check the permit record, the current statute and local provisions together.
Massachusetts
General Laws chapter 40A, section 6 contains timing rules for certain existing uses and building or special-permit applications in relation to publication of hearing notice, along with conditions affecting some approvals and construction. That is why the hearing-notice date, application date and permit status should all be preserved.

Once you know the operative text and your project stage, ask the responsible office which route is available. The possible routes are not interchangeable.
Written administrative determination
Use this when the immediate question is which regulation, transition clause or permit condition applies. Request the decision, reasons and appeal instructions in writing.
Transition or grandfathering application
Use the procedure named in the amendment or local ordinance. Submit the dated approvals, permit records, construction evidence and reliance documents the ordinance requires.

Variance or other discretionary relief
A variance generally addresses a legally defined hardship from dimensional or similar standards; it is not a substitute for proving that an existing approval is vested. Ask the zoning office what findings and evidence are required.
Appeal
Appeal rights, the decision-maker, filing form, service requirements and deadline are jurisdiction-specific. Planning and zoning training materials commonly describe an appeal from an administrative decision that an official misapplied zoning rules to a permit, but an example from Tennessee does not supply a deadline for another locality. Obtain the actual ordinance and filing instructions immediately.
Deadlines and records that prevent avoidable losses
- Request the amendment, map, staff memorandum, adoption record and effective-date provision.
- Ask for the local appeal, extension, variance and transition-application forms.
- Calendar every stated deadline from the official decision or ordinance; do not calculate it from a general article.
- Keep proof of delivery for submissions, appeals and requests for determinations.
- Maintain one indexed folder containing the approved plan set, permit cards, extensions, inspections, photographs, contracts and financial commitments.
- Record any direction to stop work and ask whether it is a formal order that can be challenged.
Common mistakes and how to correct them
Relying on a news story or draft
Obtain the enacted text and effective-date provision. Proposed language can change, and an adopted amendment may have a delayed effective date.
Assuming a purchase date creates a right
Analyze project-specific approvals, reliance and construction history instead of treating ownership as vesting.
Continuing work without confirming permit status
Ask the issuing department whether the permit is active, whether work has commenced for purposes of the local rule and whether any portion requires a new review.
Missing an appeal window
Request the written decision and filing instructions the same day you learn of the change. Local deadlines and service rules vary.
Submitting an uncoordinated redesign
Before revising plans, ask whether a material change would be treated as a new application or could affect an existing approval. Get that answer in writing.

When to involve a land-use attorney
Consider advice from a lawyer qualified in the project’s jurisdiction when an approved plan or permit is challenged, construction commitments are substantial, a stop-work or violation notice has issued, a vesting claim depends on complicated dates, or an appeal deadline is near. Provide the attorney with your chronology and indexed records. A local attorney can identify the controlling statute and ordinance; a general article cannot calculate your deadline or guarantee that a project is vested.
Quick Recap
Final checklist
- Obtain the adopted amendment and verify adoption, effective, notice and parcel dates.
- Build a complete application, approval, permit and construction timeline.
- Ask the zoning or planning office for a written, parcel-specific determination.
- Separate zoning questions from building, fire, accessibility and other safety-code requirements.
- Identify whether the appropriate route is transition treatment, an extension, a variance or an appeal.
- Calendar the local deadline and preserve proof of every filing.
- Escalate to locally qualified counsel when the project, investment or deadline warrants it.
