Check the current local development plan and speak to the planning authority before starting work. A Section 57 declaration can clarify specified works to a protected or proposed protected structure, but it is not a blanket approval for a later or larger scheme. The Planning and Development Act 2024 is being commenced in stages, so confirm which rules and procedures are operative when you apply.
Start with the building’s legal status and the current local plan
Do not decide that work is exempt merely because a building is old, because the work is inside, or because replacement materials look similar. The controlling questions are the property’s designation, the significance of the element being altered, and the likely effect of the proposal.

- Find the address in the current local development plan. Check the record of protected structures (RPS), mapped architectural conservation area boundaries, and any local objectives or policies for the street, townscape, archaeological context or building use.
- Confirm whether the structure is listed or proposed for listing. A proposed protected structure must be treated cautiously while its addition to the record is being considered; the fact that the listing is not yet final does not make sensitive work risk-free.
- Map every part of the project. Record internal alterations, external repairs, windows and doors, roof work, extensions, services, accessibility changes, signage, changes of use, demolition and removal or replacement of historic fabric.
- Identify the significant elements. These can include interiors, stairs, joinery, roofs, boundary walls, outbuildings, decorative work and other fabric that contributes to the structure’s special interest, not just the front façade.
- Ask the planning authority what formal route applies. Depending on the proposal, that may be a planning application, a Section 57 declaration, another consent or assessment, or confirmation that a narrowly defined exemption applies.
The relevant authority is the planning authority for the property. An architect, building surveyor or conservation professional with experience in Irish historic buildings can help describe the work, but only the authority can determine the planning route for the particular address and proposal.

Protected structures: the material-effect test
Under section 51 of the Planning and Development Act 2000, development plans include a record of protected structures. Section 57 provides the central exemption rule: work to a protected or proposed protected structure is exempt development only where it would not materially affect the character of the structure or an element that contributes to its special interest.

“Special interest” can be architectural, historical, archaeological, artistic, cultural, scientific, social or technical. The test is therefore about the effect on this building and its significant elements, rather than a simple category such as “internal” or “like-for-like.” Removing an important staircase, opening a historic plan form, cutting through a decorated ceiling, replacing surviving windows with a different profile, or altering a significant roof may affect character even if the work is inside or intended as an improvement.
Protection can extend beyond the façade
A protected structure’s significance may include the interior, curtilage and associated features. The protection can therefore reach features such as historic plaster, floors, roof structures, shopfronts, boundary walls, gates and designed landscape elements where they contribute to the building’s interest. The planning authority will assess the proposal as a whole and the particular element affected.
Proposed protected structures
If the building is proposed for addition to the RPS, do not assume that ordinary exempt-development rules are safe to use. Section 57 expressly refers to a protected or proposed protected structure. Obtain a written position from the authority before work that could alter significant fabric, because the designation process and the consequences of damage can develop while a project is being prepared.

Demolition is subject to an exceptional threshold
Permission to demolish a protected or proposed protected structure is not to be granted except in exceptional circumstances. A proposal based on convenience, a desire for a larger replacement, or the cost of routine repair will not by itself meet that threshold. Any case involving partial demolition, removal of a significant wing or stripping out historic fabric should be treated as a heritage-led planning matter from the outset.

Owners and occupiers must not endanger the structure
Section 58 of the 2000 Act places a duty on owners and occupiers, subject to their respective rights and obligations, to ensure that a protected structure or significant elements are not endangered. Delayed maintenance, water ingress, careless temporary works and unauthorised alterations can all create risk. Emergency stabilisation should be discussed with the planning authority and documented, rather than used as a reason to proceed without advice.
What a Section 57 declaration does
A Section 57 declaration is a formal written route for an owner or occupier to ask the planning authority which types of work it considers would, or would not, materially affect the character of a protected or proposed protected structure or an element contributing to its special interest.
How to request one
- Write to the planning authority. Identify the property, the owner or occupier, and the protected-structure or proposed-protected-structure status.
- Describe the works precisely. Include drawings, photographs, specifications and schedules where useful. State locations, dimensions, materials, finishes, methods of fixing and whether historic fabric will be removed, cut, drilled, repointed or concealed.
- Separate alternatives. If you are considering two window details, repair methods or service routes, describe each option rather than asking for an open-ended approval.
- Ask the authority to state the effect of each specified item. A declaration should identify work that would or would not materially affect character; it is not a substitute for a planning application where permission is required.
- Allow for the statutory period. The Act provides for the declaration within 12 weeks after the request, or another period prescribed by regulation. Confirm the current administrative process and any validation requirements with the authority.
Use the declaration only for the works it addresses. A later extension, different material, additional opening, change of use or more extensive removal of fabric may require a new assessment or a planning application. Keep the declaration with the project records and ensure the contractor’s method matches the described work.
Architectural conservation areas: protection of the place
An architectural conservation area protects the character of a place, area, group of structures or townscape identified through the development-plan process. The building does not have to be individually listed as a protected structure for ACA controls to apply.

Exterior works in an ACA
Section 82 of the Planning and Development Act 2000 makes exterior works to a structure in an ACA exempt only where they would not materially affect the character of the area. The question is therefore broader than whether the individual building is historic. Changes to roof forms, windows, shopfronts, render, colour, boundary treatments, external insulation, satellite equipment, signage or front-of-house services can affect the streetscape even when the building is not on the RPS.
Planning applications in an ACA
When deciding a planning application for development in an ACA, the planning authority or an appeal body must take account of the likely material effect on the area’s character. Submit a proposal that explains how scale, alignment, materials, openings, roof profile, signage, landscape and construction details relate to the established townscape. Check the actual mapped boundary and local objectives: an address near an ACA may be outside it, while a rear lane or side elevation may still fall within the designated area.
When both designations apply
A property can be both a protected structure and inside an ACA. The controls overlap but answer different questions.
| Control | What it protects | Key question for renovation |
|---|---|---|
| Protected structure | The building and significant elements contributing to its special interest | Would the work materially affect the character of this structure or a significant element? |
| Proposed protected structure | A structure proposed for addition to the record, with section 57 expressly relevant to proposed structures | Could the work affect significance while the proposed designation is being considered? |
| Architectural conservation area | The character of the designated place, area, group of structures or townscape | Would exterior work materially affect the character of the area? |
| Local development plan | Mapped designations, objectives and policies applying to the site | What local requirements, boundaries and objectives apply at this address? |
An internal alteration might be acceptable under the ACA test yet still affect a protected structure’s significant interior. Conversely, a building not on the RPS may need permission for a new frontage, window pattern or roof alteration because of its ACA setting. Assess both tests independently and submit one coordinated proposal where both apply.

Planning permission beyond the heritage designation
Heritage status does not replace ordinary planning controls. Extensions, material external changes, subdivision, changes of use, new access arrangements, signage, plant, car parking, boundary changes and some works to services may require permission under the general planning system. Exempted-development limits also apply; an exemption cannot be used to override a heritage restriction or a condition attached to an existing permission.
Do not treat “repair” as a legal category that automatically avoids permission. Repointing with a hard cement mortar, replacing timber windows with a different section, applying external insulation, raising a roof, inserting dormers or removing a chimney can change appearance or fabric. Describe the actual intervention and its effect, not merely the intended purpose.
The Planning and Development Act 2024 transition
The Planning and Development Act 2024 is being brought into force in stages. The Department’s commencement information lists provisions commenced through 8 May 2026, and a 2025 transition circular explained that decision-making functions continued under the 2000 Act until the relevant new provisions commenced.

A practical renovation workflow
- Freeze irreversible work. Do not remove windows, plaster, roof coverings or decorative elements while the designation check is pending. Make the building weather-tight using reversible measures where possible.
- Assemble an evidence pack. Include a location map, photographs of every elevation and significant interior, measured drawings, a condition survey, historic research where available, and a schedule of proposed works.
- Check designations and policies. Review the RPS entry, ACA map, local objectives, archaeological constraints and any previous permissions or conditions.
- Obtain early authority advice. Ask whether the authority expects a planning application, a Section 57 declaration, other assessment or a combination. Put technical questions in writing.
- Develop a conservation-led specification. Prioritise repair over replacement, retain sound historic material, and make new work legible but compatible in scale, detail and performance.
- Submit the correct application or declaration. Drawings should show existing, proposed and demolition information. Explain effects on significant elements and the ACA character where relevant.
- Coordinate building-control and safety requirements. Planning consent does not replace building regulations, fire-safety, accessibility, archaeological or other approvals that may apply.
- Control construction on site. Give contractors the approved drawings and method statements. Record concealed discoveries and stop if unexpected historic fabric is exposed.
- Document completion. Keep photographs, product data, repair details, approvals and any changes agreed with the authority for future owners and maintenance.
How common renovation works are treated
| Proposed work | Why it can trigger heritage review | Information to provide |
|---|---|---|
| Window repair or replacement | Profiles, glazing bars, opening pattern, glass and colour can affect protected fabric or ACA streetscape character. | Window schedule, elevations, sections, photographs, repair-versus-replacement rationale and finish. |
| Façade repointing or rendering | Mortar hardness, joint profile, texture and colour can damage masonry or alter the area’s appearance. | Existing mortar analysis, sample panels, specification and method statement. |
| Roof repair, insulation or dormers | Roof structure, profile, coverings and visible plant may contribute to significance or townscape. | Roof plan, sections, structural approach, materials and visibility assessment. |
| Internal reconfiguration | Plan form, stairs, ceilings, joinery and finishes may be significant in a protected structure. | Existing and proposed plans, room-by-room fabric schedule and details of removals. |
| Extension or new opening | It can affect the protected structure, its setting and the ACA character, even when the addition is at the rear. | Site context, massing, daylight, materials, junction details and heritage impact explanation. |
| Change of use or services | New fire, ventilation, accessibility, drainage or commercial requirements can require invasive routes or external equipment. | Services strategy, plant locations, access and fire-safety coordination, with minimal-fabric-impact details. |
| Partial or full demolition | Demolition of a protected or proposed protected structure faces the statutory exceptional-circumstances threshold. | Condition evidence, alternatives analysis, structural reports and a carefully justified heritage case. |
Repairs, materials and traditional construction
Repair specifications must match the existing masonry and exposure conditions. A compatible lime mortar repair mix may be appropriate for some historic brick or stonework, but “lime” alone is not a specification: binder type, aggregate grading, colour, strength, permeability, curing and joint profile all matter. Test and approve sample areas before full application. A hard, impermeable mortar can trap moisture, damage softer masonry and make later repairs more difficult.
Use conservation guidance published by the Department responsible for architectural heritage, including the Architectural Heritage Protection Guidelines, and obtain advice from a suitably qualified conservation professional for complex or significant work. The correct objective is not to make every new component look artificially old; it is to retain significant fabric, avoid unnecessary loss, and ensure new work is proportionate, durable and readable.
Common mistakes and how to avoid them
- Assuming internal work is automatically exempt: check whether the interior or plan form is significant to a protected structure.
- Assuming like-for-like means exempt: demonstrate that the replacement truly matches the existing material, profile, method and visual effect, and that no significant fabric is lost.
- Checking only the RPS: an unlisted building can still be inside an ACA.
- Using an old planning answer: confirm the current local plan and the Act 2024 commencement position before relying on previous advice.
- Requesting a vague Section 57 declaration: an authority can assess specified work, not an undefined future renovation.
- Starting enabling works first: stripping finishes or removing windows can destroy evidence and create an unauthorised alteration before the application is decided.
- Ignoring cumulative effects: several individually modest changes can collectively alter character; present the complete scheme.
- Letting the contractor redesign on site: substitutions in mortar, windows, insulation or fixings can change the heritage impact. Refer deviations back to the design team and authority.
When specialist advice is essential
Obtain conservation input before design is fixed where the building is protected or proposed for protection; where original interiors, stairs, roof structures or decorative finishes survive; where structural movement or water ingress is present; where demolition or major reconfiguration is proposed; or where an ACA project changes a visible elevation. A specialist can prepare a significance and condition assessment, identify reversible options, coordinate structural and fire requirements, and produce drawings detailed enough for the authority to assess material effects.
For a straightforward repair, the same principle still applies: verify the designation, describe the exact work, and obtain the planning authority’s view before irreversible intervention. Keep all decisions and specifications with the building records so future maintenance does not repeat the permission question from scratch.
