If you notice new or worsening cracks while construction is happening nearby, first make sure people are safe. Then record the damage before disturbing it, preserve project documents, notify the responsible party and your insurer, and arrange an independent assessment if the damage is significant or progressing. Construction happening at the same time does not, by itself, prove it caused the damage; responsibility and reporting routes depend on where you live and what work is involved.

What should you do first?

Deal with possible danger before documenting damage

If a crack is rapidly worsening, or you have other reasons to think part of the building may be unsafe, keep people away from the affected area. Contact the emergency service or building-safety authority responsible in your location. Do not wait for the contractor, insurer, or a dispute about responsibility to be resolved before raising an immediate safety concern.

In its party-wall guidance for England and Wales, the UK government says concerns about dangerous buildings should be raised with local authority building control. That is a jurisdiction-specific route, not a universal instruction: elsewhere, the appropriate authority may be different. A safety report and a damage claim are also separate matters. Reporting a potentially dangerous building does not itself establish who caused the damage or who must pay for repairs.

Record what you can see before making changes

Before cleaning, filling, painting over, or repairing a crack, make a clear record of its current condition. Take dated photographs close enough to show the detail and from farther away so the location in the room or on the wall is clear. Write down where it is, when you first noticed it, and what you observed changing. If there are several affected areas, record each one separately rather than relying on a general description such as “cracks in the house.”

Keep the original photographs and notes, along with project notices, work schedules, correspondence, and any pre-work survey or schedule of condition. A schedule of condition is a written record of parts of a property that could be affected, such as walls, floors, and ceilings, often supported by photographs. The UK government’s explanatory booklet describes creating one as prudent, though not a requirement of the Party Wall etc. Act 1996; without a baseline, later comparison and attribution may be harder. Victoria’s Building and Plumbing Commission likewise says an adjoining-property survey should record existing cracks and defects and be acknowledged before protection work starts.

If you do not have a pre-work survey, still make a dated record now. Note when you first saw the crack and any changes you have observed since, and preserve any project notices or work schedules that help establish what work was planned or underway. These records can inform a later comparison, but none of them alone proves that the construction caused the damage.

Can nearby construction cause cracks in a home?

Construction activity can be relevant when investigating new or worsening damage, but timing alone does not establish causation. A crack appearing while nearby work is underway is an observation worth documenting, not proof that the work produced it. A pre-work condition record, the location and progression of the damage, project information, and an assessment by a qualified independent building professional may all help inform an investigation. The available guidance does not support a general numerical estimate of how often nearby construction causes cracks or how likely a claim is to succeed.

Do not try to settle a technical question from photographs alone. If the damage is substantial, appears to be progressing, or you are uncertain whether it needs closer attention, ask an appropriately qualified independent professional to assess the condition and say whether further investigation is warranted. The right professional depends on the type and severity of the issue; not every visible crack calls for the same expertise.

A crack-monitoring gauge can be an optional aid for tracking visible width changes over time. It is not a diagnostic tool: it cannot identify the cause, assess structural safety, or determine legal responsibility. Treat any readings as part of your record rather than as a professional conclusion, and do not let monitoring delay a safety report or assessment when the condition appears serious.

How should you notify the project and your insurer?

Contact the responsible project party in writing

Write to the site owner or other party responsible for the project. Identify the property and the affected locations, describe when you noticed the damage and any changes you have observed, and attach copies of your dated photographs if appropriate. Keep the message factual: explain what you have seen without presenting timing as conclusive proof of cause.

Ask the project party for the pre-work condition record or schedule of condition and for its process for inspecting reported damage. Keep a copy of what you send and any reply. If there are notices, an award, a work schedule, or earlier correspondence, retain those with your records rather than discarding them after making contact. A calm written account makes it easier to track what was reported and when.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the project party offers an inspection, ask how it will be arranged and what record will be made of the findings. Keep your own dated record as well. An inspection process or response from the project party is not, by itself, a decision about legal responsibility, so continue to preserve the documents and follow any applicable local process.

Notify your insurer promptly

Tell your insurer about the observed damage promptly enough to meet the requirements of your policy, and ask what information and next steps it needs. The process and coverage depend on the policy and your location; there is no single insurer procedure established for all homeowners. Keep a record of the notification and any instructions you receive. Do not assume that reporting the damage to the project party replaces notifying your insurer, or that an insurer’s response determines legal responsibility.

How can you establish what changed?

A useful record distinguishes what was present before work from what you noticed later. If a schedule of condition exists, compare it with the current condition and preserve both records. If no baseline is available to you, your dated photographs, notes, project notices, and correspondence can still document what you observed, but they do not independently prove who caused it.

Keep the record organized by date and location. Include the first date you noticed each affected area, subsequent observations, photographs, and copies of communications with the project party or insurer. Preserve the original files where possible rather than relying only on edited or annotated images. A clear chronology helps a professional understand what you are asking them to assess; it is not a substitute for their assessment.

If you use a crack-monitoring gauge, treat it only as an optional way to observe visible width changes over time. It cannot diagnose the cause, determine whether a building is safe, or establish liability. It should not replace a written record, photographs, or a qualified assessment where one is warranted. If monitoring suggests the condition is changing or the building may be unsafe, prioritize the appropriate safety route rather than relying on the gauge to interpret the risk.

Who pays for damage from construction next door?

There is no single answer for every location or project. Legal responsibility, the agency to contact, and the available claims process depend on local law and the kind of work involved. Do not assume that a rule described for one country applies where you live.

England and Wales: specified work under the Party Wall etc. Act 1996

The Party Wall etc. Act 1996 applies in England and Wales to specified work to party walls and structures, building at a boundary, and certain excavations near neighbouring structures. Government guidance says the Act is separate from planning permission and building-regulations approval. Scotland and Northern Ireland have different rules, so the Act should not be treated as UK-wide law.

For relevant work within the Act’s scope, the explanatory booklet says the building owner is legally responsible for putting right damage caused by that work, even if a contractor caused it. It also says that for damage outside the Act, an adjoining owner may need to prove the loss and should seek legal advice before taking legal action. The question of whether a particular project or item of damage falls within the Act’s scope is not settled merely by the fact that construction occurred next door.

The government’s party-wall guidance summarizes the relevant duty this way: “protect your neighbour’s property from damage caused by the works, and fix or pay for any damage that is caused.” This statement applies to building work within the guidance’s scope; it is not a universal rule for every construction project or country.

A party-wall award may set out the work and protective measures and often includes a record of the adjoining property’s condition before work begins. If you have a notice or award, preserve it and check its terms. Government guidance also separates other concerns from a damage claim: local authority building control or the Health and Safety Executive may be relevant to health-and-safety concerns, while noise and nuisance complaints may go to the local authority’s environmental department. These are different routes for different issues.

Victoria, Australia: adjoining-property protection work

In Victoria, the Building and Plumbing Commission says adjoining-property protection work requires insurance against potential damage in the circumstances it describes, as well as a survey recording existing cracks and defects. This is guidance for that jurisdiction and those circumstances; it should not be generalized into an insurance requirement for all construction work or other places.

When the local rule is unclear

Confirm which local authority or legal framework applies before relying on a specific claim route. A building professional can help assess the physical condition, but that assessment is not a substitute for advice about legal rights. If you are considering legal action, seek advice from someone qualified in the relevant jurisdiction, especially where the applicable rule or the project’s coverage is uncertain.

How do you choose an independent professional?

Match the professional to the question you need answered. An assessment of visible building condition is different from a legal opinion about liability, and neither should be assumed to answer the other. When comparing professionals, consider:

  • Independence from the contractor, developer, or other party whose work is in question.
  • Qualifications recognized in your location and appropriate to the issue.
  • A written scope that states what will be inspected, what the report will cover, and whether further investigation may be recommended.
  • Fees and the deliverables included in the quoted work.

The UK government’s explanatory booklet says a party-wall surveyor should understand construction and party-wall procedures and advises choosing someone appropriately knowledgeable. That is useful guidance for party-wall matters in its jurisdiction; local qualifications and professional roles vary elsewhere. Before booking, check that the professional is independent and that the written scope answers your actual question rather than assuming every crack requires the same kind of specialist.

Frequently Asked Questions

How do I prove nearby construction caused a crack?

A crack’s timing alone does not prove causation. Preserve dated close-up and context photographs, notes about location and changes, any pre-work schedule of condition, project notices or work schedules, and your correspondence. A qualified independent building professional can assess the condition and advise whether further investigation is warranted.

Who should I contact if I think my home may be unsafe?

Keep people away from the affected area and contact the emergency service or building-safety authority responsible where you live. In England and Wales, UK party-wall guidance directs concerns about dangerous buildings to local authority building control. The correct route depends on location.

Does the contractor have to pay for damage from construction next door?

It depends on the jurisdiction and the type of work. For relevant work within the scope of the Party Wall etc. Act 1996 in England and Wales, the building owner is legally responsible for putting right damage caused by the works, even if a contractor caused it. Do not assume that rule applies elsewhere or to work outside the Act.

Should I repair a crack before contacting anyone?

First document it with dated photographs and notes before filling, painting over, or repairing it, unless immediate action is needed for safety. If you think the building may be dangerous, prioritize keeping people clear and contacting the appropriate local safety authority.

Do I need a structural engineer for every crack?

No single professional is right for every issue. Choose an appropriately qualified, independent professional based on the type and severity of the damage, and compare relevant experience, written scope, local qualifications, fees, and deliverables. Seek legal advice separately if you need advice about rights or liability.

The Bottom Line

Put safety first, document damage before altering it, and keep a dated record of observations and project communications. Notify the responsible project party and your insurer, and seek an independent assessment when damage is substantial or progressing. Timing can inform an investigation but does not prove cause; local law determines the relevant responsibility and reporting routes.
