Leave the danger and get emergency help first. If construction, maintenance or utility work has created an immediate threat—such as debris in a travel lane, a collapsed surface, missing barriers or an active crash—move to safety when possible and call your local emergency number or law enforcement. A routine web form may not be monitored continuously.
After the immediate risk is addressed, report the precise location to the agency that owns or maintains that road. If a vehicle or person was hurt, document the incident only from a safe place, notify your insurer and check the local claim process quickly. Road ownership, reporting channels and filing deadlines differ by state and by whether the road is state, county, city or privately maintained.

Use the danger itself—not the fact that a construction company is present—to choose the first call. An emergency report is appropriate when waiting could expose drivers, pedestrians, workers or nearby residents to injury.
Call emergency services or law enforcement now when:
- Debris, equipment, an open trench or damaged pavement is in a live travel lane.
- A vehicle has crashed, someone may be injured, or traffic cannot safely pass.
- Barriers, signs, cones or lighting are missing or have been knocked out of position and drivers are entering a hazard.
- A bridge, retaining wall, road edge or utility installation appears unstable.
- Flooding, a washout, exposed wiring or another condition creates an immediate threat.
Texas and Utah specifically direct drivers to call 911 for immediate roadway hazards such as dangerous debris. North Carolina advises contacting local law enforcement about dangerous public-road damage or obstructions. Follow the emergency instructions used where you are; do not assume that a state transportation department’s online form is watched around the clock.

Protect yourself while making the call
- Do not enter the damaged section, stand in a live lane or walk onto a work zone to inspect it.
- If you are driving, continue to a safe shoulder, parking area or other protected location when you can do so without creating a second crash.
- Call from that safe location. Tell the dispatcher if a lane is blocked, traffic is approaching the hazard, workers are present or anyone is injured.
- Follow instructions from emergency personnel. Do not move construction equipment, barricades or debris unless responders specifically direct you and it is safe.
2. Give responders a location they can find
A report that says only “construction damage on the highway” can delay a response. Provide enough information for a crew or officer to reach the exact spot:
- Road name, route number and direction of travel, if known.
- Nearest street address, intersection, mile marker, exit or recognizable landmark.
- Type of damage: for example, exposed excavation, loose aggregate, missing plate, collapsed shoulder or standing water.
- Approximate size or length of the affected area and which lane, shoulder or sidewalk is involved.
- Whether vehicles are striking it, traffic is backing up, a work zone is improperly set up or anyone is injured.
Delaware’s reporting form asks for an approximate address or street, a nearby feature and a detailed description. That is a useful standard anywhere. If you do not know the exact address, describe the approach from the nearest intersection and identify permanent landmarks.

3. Report the hazard to the road owner or maintainer
Emergency services can secure an urgent scene and route the information. For non-immediate follow-up—such as a rough patch, recurring debris or a damaged sign that is not currently threatening traffic—contact the authority responsible for that specific road.
Identify the jurisdiction
| Road type or location | Likely first routine contact | Important qualification |
|---|---|---|
| State highway | State transportation department | Some states arrange for county highway departments to perform maintenance; Wisconsin directs many maintenance reports on state highways to the relevant county. |
| County road | County highway or public-works department | State transportation departments may not accept or investigate county-road maintenance requests. |
| City or town street | Municipal public-works or transportation department | Use local law enforcement for an immediate danger rather than waiting for a municipal form. |
| Private road, shopping-center access or developer-controlled street | Owner, property manager or construction site’s posted contact | Emergency services remain the right route when the condition threatens public safety. |
Look for route shields, street signs, project notices or a work-zone information board. A posted contractor number can help with follow-up, but it should not replace a 911 or law-enforcement call during an emergency. If you cannot determine ownership while the hazard is urgent, report it to emergency services or law enforcement and explain what you know.
4. If your vehicle hits the damage
Once you have reached a safe place, treat the event as both a safety incident and a potential insurance or property-damage claim.

Immediate actions after stopping safely
- Check occupants for injuries and request medical assistance if needed.
- Check whether the vehicle can move without creating another hazard. Do not continue driving if steering, braking, tires, lights or the structure may be unsafe.
- Record the date, approximate time, road, direction of travel and precise location.
- Photograph the vehicle damage and the roadway condition from a safe position. Include signs, barriers, lane markings and nearby landmarks when they can be captured without entering danger.
- Obtain a police or incident report when required or when the circumstances make one useful.
- Keep towing, inspection, repair and rental records. Notify your insurer promptly and ask what evidence and deadlines apply.
Do not assume that a public agency or the contractor will reimburse you. Responsibility can depend on ownership, the work contract, notice of the defect, warnings, applicable immunity rules and whether another driver or event caused the condition.
5. Separate an urgent hazard report from a damage claim
These are different processes. The emergency or maintenance report asks an authority to protect the public and correct a dangerous condition. A claim seeks payment for an injury or property loss and may require a specific form, notice period, police documentation and proof of ownership or maintenance responsibility.
Questions to ask the responsible authority or your insurer
- Who owns and who maintains the road at the incident location?
- Which office accepts construction-zone or roadway-damage claims?
- What is the filing deadline, and when does it begin?
- Is a police report, officer signature, repair estimate or inspection required?
- Should notice go to the agency, a named contractor, or both?
- How should photographs, video, receipts and damaged parts be preserved?
Ask for written confirmation of the submission and keep copies of every form and attachment. A maintenance complaint does not automatically start a claim, and an insurance notice does not substitute for reporting an active public hazard.

6. State examples—and why you must not generalize them
The following agency instructions illustrate how routes differ. They are not nationwide deadlines or universal contact details.
| State agency guidance | Emergency direction | Routine or claim detail |
|---|---|---|
| North Carolina Department of Transportation | Contact local law enforcement about public-road damage or an obstruction that may endanger motorists. | For vehicle damage in a contracted work zone, the department says it forwards the claim to the contractor responsible for road conditions in that area. |
| Texas Department of Transportation | Call 911 for immediate hazards such as dangerous road debris. | Its report form is not monitored 24/7. The department handles the state highway system; city- and county-maintained roads are handled locally. |
| Delaware Department of Transportation | Its Transportation Management Center is listed for immediate issues such as debris, sign damage or an improperly set-up work zone; an accident should go to 911. | The center is described as operating 24/7/365. Verify the current Delaware contact before relying on it. |
| Utah Department of Transportation | Report hazardous debris in a travel lane to 911. | It handles incidents on state-owned or maintained roads, advises safe stopping and documentation after a debris strike, and evaluates claims case by case. |
| Wisconsin Department of Transportation | Serious pavement problems may warrant 911. | County highway departments perform maintenance on state highways under Wisconsin’s arrangement; the department directs people to counties for many pothole and debris reports and advises drivers with vehicle damage to contact their insurer. |
| Rhode Island Department of Transportation | Use the emergency route for an active threat rather than waiting for a claim process. | Its jurisdiction is limited to state roads. It lists a 60-day deadline for construction-zone damage claims and requires a police signature or separate police report under the stated procedure. |
| Illinois Department of Transportation | Use the agency maintaining the road when the location is outside the department’s jurisdiction; emergency conditions still require emergency reporting. | Its materials describe prior notice and an adequate opportunity to repair or warn as part of Illinois standards. That is an Illinois procedure, not a nationwide liability rule. |
7. Understand the work-zone setting
The Federal Highway Administration describes a work zone as an area of a highway affected by construction, maintenance or utility work and identifies control devices such as signs, channelizing devices and barriers. That older implementation guidance helps explain why a missing or displaced control device can change the risk quickly, but it is not a substitute for current emergency instructions from your local agency.
Construction responsibility may be shared. A state or city can own the road, a contractor can control the work area, and a utility can have equipment or excavation in the corridor. Report the condition to the public authority even if a contractor’s logo is visible; the authority can direct the complaint to the party responsible for the work.
Quick Recap
8. Mistakes that make a dangerous situation worse
- Submitting only a routine web form when debris or damage is actively endangering traffic.
- Stopping in a travel lane or walking into a work zone to take photographs.
- Moving cones, barricades, plates or machinery without authorization.
- Assuming the state transportation department handles every road.
- Waiting to identify the contractor before calling emergency services.
- Throwing away damaged parts or receipts before an insurer or agency can inspect them.
- Assuming that reporting a pothole automatically files a compensation claim.
- Applying another state’s deadline or liability rule to your own incident.
9. A concise decision checklist
- Danger now? Get clear and call emergency services or law enforcement.
- Can responders find it? Give the road, direction, nearest address or landmark, lane and type of hazard.
- Who maintains it? Route routine follow-up to the state, county, city or private owner with jurisdiction.
- Was there a collision or injury? After reaching safety, check people and the vehicle, preserve details and notify your insurer.
- Are you seeking payment? Confirm the correct claimant, required records and local deadline immediately.
