What to Do if Construction Blocks Access to Your Driveway

Stay clear of the work zone, ask the project contact when access will return, document the obstruction, and report unresolved problems to the agency responsible for the road or right-of-way.

If construction blocks your driveway, first stay out of the work zone and ask the on-site foreman or the contact on the posted notice who is responsible, how long access will be restricted, and what safe, authorized access is available. If the crew cannot resolve the problem, contact the local agency responsible for the street or right-of-way—often public works, transportation, permitting, or 311—and provide the address, duration, safety impact, and any permit or project number.

There is no single access rule or complaint process for every location. A project may be authorized to restrict part of a street or sidewalk for a period, but that does not by itself answer what arrangements are required for your driveway or whether you can seek reimbursement. Verify the permit conditions and procedures with the authority responsible for the affected road.

What to do first

Check for immediate danger

Keep people and vehicles clear of machinery, excavations, unstable ground, and barriers. Do not enter the work zone, move a barricade, or drive over a cut or unfinished surface to reach your property. If someone faces immediate danger or emergency responders cannot reach them, tell the responsible local authority that clearly and use the local emergency channel for an immediate threat. The correct emergency procedure depends on where you are.

When you report an urgent concern, distinguish it from a routine access complaint: explain whether someone is in immediate danger, whether emergency response is impeded, and what part of the property or route is inaccessible. No single emergency number or procedure applies everywhere, so use the local emergency service for an immediate threat and the appropriate road or project authority for the work-zone issue.

Ask the crew or project contact

Speak with the on-site foreman if it is safe to do so. Ask who is responsible for the work, when vehicle access is expected to return, whether the restriction is total or intermittent, and whether there is a safe, authorized way to reach the property in the meantime. If a construction notice or permit sign is posted, photograph it and copy the contact information, project or permit number, and stated dates. A Los Angeles construction-notice form, for example, includes anticipated dates, permit and contractor contacts, and a field for intermittent driveway-access closures; it also directs people to 311 for assistance. That form is an example, not proof that a particular job is permitted or subject to the same notice rules elsewhere (City of Los Angeles construction notice).

Keep the conversation focused on details you can act on. Ask whether the crew expects the restriction to last hours or longer, what work remains before access can return, whether the schedule or work hours have changed, and whom to contact if the stated restoration time passes. If no one is available or the answer is unclear, record that and contact the project owner or local authority rather than trying to negotiate access through the work zone yourself.

Document the blockage

Make a concise record while details are easy to verify. Note the date and time, property address, what is blocking access, the apparent project or permit number, who you spoke with, what they said, and any expected restoration time. Take dated photographs from a safe place outside the work zone. Keep copies of notices, texts, emails, and call reference numbers, and record whether the obstruction prevents all vehicle access or only access at certain times.

Be specific about the obstruction rather than recording only that “construction is blocking the driveway.” Note, for example, whether access is blocked by fencing, equipment, materials, a roadway cut, or traffic-control devices, and whether the condition changes during the day. If the driveway is sometimes accessible, write down the periods when it is not. These details help the project contact or agency understand the practical impact and route the report to the right party.

Photos and specific location details can help an agency route a complaint. Portland, Oregon, asks people reporting a blocked or difficult public walkway to attach photos, and its reporting process accepts information about work-zone obstructions such as fencing, roadway cuts, equipment, materials, and traffic-control devices (City of Portland obstruction reporting).

Report an unresolved problem to the local authority

If the project contact does not address the issue, report it to the agency responsible for the street or public right-of-way. Depending on the location, that may be a public works or transportation department, a permitting office, or a 311 service. Explain the address, how long access has been restricted, whether the blockage is total or intermittent, any safety or emergency-access concern, and the project or permit number if you have it. Ask for a report or case number and the next step for follow-up.

When you call or use an online form, give the exact location and describe what you need the agency to do: identify the responsible project contact, clarify whether the work is authorized, explain the expected duration, or review an unresolved access or safety concern. Include the dates and times you observed the blockage and attach photos if the service accepts them. Ask which office is handling the report, how you will receive a response, and whether you should contact another agency if the road is outside that office’s jurisdiction.

Use the channel that handles the affected road, not simply the nearest city office: jurisdiction can differ for city streets, county roads, private roads, and state routes. Local examples show how much processes vary:

  • New York City: NYC311 provides permit guidance and says residents can call 311 or 212-NEW-YORK for street-construction permit help. Its page also points to a service for reporting street construction that blocks vehicle traffic or occurs without permits (NYC311 street construction permit information).
  • Portland, Oregon: The city says an obstruction report can be routed to the appropriate entity and lists PDX311 Dispatch at (503) 823-1700. Its definition of public right-of-way includes street surfaces, curbs, sidewalks, and often additional areas (City of Portland obstruction reporting).
  • Boston, Massachusetts: The city provides a street-occupancy permit lookup and project-specific permit information for work that can restrict access to part of a street or sidewalk (City of Boston street-occupancy, excavation, or driveway permits).
  • Ottawa, Ontario: The city describes permits for certain construction, modification, closure, or removal of vehicular accesses in the municipal right-of-way and directs residents to Service Ottawa at 311 (City of Ottawa access permits).

These are examples of where to start in those jurisdictions, not a universal directory. In another area, use the contact on the notice or ask the local government which agency manages the affected street or right-of-way. If the first office says it does not handle that road, ask for the responsible agency or a referral rather than assuming the issue has been resolved.

Ask what the permit allows

Ask the responsible authority whether the work is permitted, who holds the permit, and what its conditions say about dates, hours, temporary closures, traffic control, notice, or access. A permit may authorize restricting access to part of a street or sidewalk for a period; its existence alone does not establish that a particular driveway must remain continuously open or that every disruption entitles a resident to payment.

If a permit or project number is available, use it to ask about the specific work rather than relying on general rules. Find out whether the dates and location match the blockage you observed, what closure or traffic-control conditions apply, and whether the permit lists a project contact. Ask the authority how to view permit details if they are not posted. A permit lookup may clarify what was authorized, but it is still the local authority—not a different city’s process—that can explain the conditions that apply at your address.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Permit lookup tools and rules are local. Boston’s street-occupancy, excavation, or driveway permit guidance includes a lookup and explains its own scope and neighbor-notice procedures. Ottawa regulates specified vehicular-access work in its municipal right-of-way. Neither city’s process controls work elsewhere, and local rules or fees can change. Confirm the current requirements with the authority handling your location.

Notice procedures also vary. A posted notice or a sample city form can help you identify the contractor, permittee, dates, and contact route, but it does not establish that every project everywhere must give the same notice or preserve uninterrupted vehicle access. If you did not receive a notice, ask the local office whether one was required for this particular project and where its permit or contact information can be found.

What to ask about a safe access arrangement

Do not assume that a board, temporary ramp, alternate driveway, or route through the work site is safe or authorized. Ask the contractor or agency whether a specific arrangement is approved for the site and who is responsible for providing it. Clarify:

  • Whether vehicle access is fully blocked or interrupted only during particular work periods.
  • The expected duration of the restriction and the hours when work will occur.
  • Whether a safe pedestrian route or vehicle alternative is available.
  • Who can approve or provide that arrangement, and how to request an accommodation.
  • How to report a missed restoration time or a change in the work plan.

Ask for the plan in practical terms: where the approved route begins and ends, when it is available, and whom to contact if it is blocked or conditions change. A route that appears passable may cross an excavation, machinery path, or unstable surface, so do not treat visual access as permission to enter. If there is no approved route, ask the project contact or authority what other site-specific option, if any, can be authorized.

If a person in the household has a mobility, medical, caregiving, or other urgent access need, explain the practical impact when contacting the project lead and authority. Ask what site-specific option can be authorized; do not treat an unapproved route as safe just because it seems passable. When following up, state the time-sensitive need and ask who has authority to evaluate an accommodation or temporary arrangement.

Keep records if the disruption causes costs or harm

Save notices and receipts for expenses you believe resulted from the blockage, and record the dates and reason for each cost. Ask the project owner or local authority where to submit a complaint, accommodation request, or claim, and what documentation it requires. The available city guidance does not establish a general right to compensation or reimbursement. Whether any remedy applies depends on local law, permit terms, and the specific facts, so do not assume reimbursement is guaranteed.

Keep the record organized: the timeline, photographs, project or permit details, messages, case numbers, and itemized receipts can help explain what happened if you later ask about a claim process. Before submitting anything, confirm whether the relevant office accepts claims or only handles construction complaints, and ask whether a separate form or process is required. A report to 311 or a permitting office is not necessarily a compensation claim.

Why driveway access rules differ

A driveway connection may cross a public right-of-way, such as a sidewalk or curb area, while construction may also involve a street, utility, or privately controlled site. Different agencies can regulate those parts of a project. Boston’s guidance addresses permits that restrict access to sections of a street or sidewalk; Ottawa’s page addresses certain vehicular-access work in the municipal right-of-way. These examples illustrate why the relevant permit, notice period, and complaint route must be checked locally rather than inferred from another city’s rules.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The same distinction matters when deciding whom to contact. The contractor may know the day-to-day work schedule, while a permitting office or road authority can explain authorization and conditions. A report may need to go to the agency responsible for the specific street or right-of-way, even if another city department handles a related issue. Start with the project contact when safe, then follow the authority’s direction if the problem remains unresolved.

Frequently Asked Questions

Who should I call if construction blocks my driveway?

Start with the on-site foreman or the phone number on the construction notice. If the crew cannot resolve the issue, contact the agency responsible for the affected street or right-of-way—often public works, transportation, permitting, or 311. For an immediate danger, use the local emergency channel.

Can construction legally block access to my driveway?

There is no universal answer. Some local permits may authorize restricting access to part of a street or sidewalk for a period, but permit conditions, notice requirements, and any access arrangements vary by location and project. Ask the responsible authority whether the work is permitted and what conditions apply.

What information should I provide when reporting a blocked driveway?

Give the exact address, date and time, whether access is fully or intermittently blocked, what is causing the obstruction, the expected duration if known, any safety or emergency-access concern, and the project or permit number. Include the contact’s name and response, and attach photos taken safely outside the work zone if the reporting service accepts them.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can I get reimbursed for costs caused by a driveway closure?

Do not assume reimbursement is guaranteed. The available city guidance does not establish a general compensation entitlement; possible remedies depend on local law, permit terms, and the facts. Keep relevant notices and itemized receipts, then ask the project owner or local authority where to submit a complaint or claim and what documentation is required.

Should I move a barrier or use a temporary ramp to get to my driveway?

No. Do not move barriers, enter the work zone, or use a ramp, board, alternate driveway, or site route unless the project contact or authority confirms that the specific arrangement is safe and authorized.

The Bottom Line

Stay out of the work zone, document the obstruction from a safe place, and ask the foreman or posted project contact when access will return and what approved option is available. If the issue remains unresolved, report it to the agency responsible for the affected road or right-of-way and check the local permit conditions. Keep records of any costs, but verify local claim procedures rather than assuming reimbursement is owed.
