Segregate the affected lot, preserve its labels and physical condition, and open a documented investigation before anyone discharges, blends or uses it. A failed check is a hold-and-investigate trigger, not an automatic permission to return or an automatic right to reject: the result depends on the cement designation, intended use, contract, location, test method and authority governing the shipment.
- Place the identified batch on hold and mark the storage area or vehicle clearly.
- Keep it separate from compliant cement; protect it from moisture, contamination and deterioration.
- Record the lot, delivery vehicle or silo, packaging and seals, time, condition, location and the exact failed criterion.
- Notify the supplier and the person authorised under your contract or quality plan to decide disposition.
- Preserve the purchase order, specification, delivery note, labels, declarations, certificates, sampling details, laboratory report, photographs and correspondence.
Why a failed check does not have one universal outcome
Cement controls combine commercial contract terms, national regulation, adopted standards and project specifications. A missing declaration may be curable; a laboratory result below a specified strength limit may require controlled retesting or definitive rejection. A receiver may have authority to refuse delivery under a contract, while a regulator’s reporting duty may rest on the manufacturer, importer or certification body instead.

Before deciding, identify five facts: where the shipment is located, which cement designation was ordered, what it will be used for, which requirement failed, and who performed the inspection or test. Also establish whether the finding concerns paperwork or marking, visible condition, or measured performance. Do not treat a supplier’s assurance as a release decision unless the person authorised by the contract and applicable rules has recorded that decision.

Pause use without destroying traceability
Keep the lot out of production and construction use. Do not blend it with compliant cement, transfer it into a shared silo, relabel it or discharge it in a way that makes the failed material impossible to identify. If a vehicle has not been unloaded, place it on hold; if it is already in a silo or warehouse, isolate the relevant compartment and access records.

Protect condition while a decision is pending
Store bags or bulk material in dry, clean conditions and prevent additional contamination. Photograph the load, seals, packaging, silo identification and any visible damage before moving it. Record who controls the area and maintain an access log if the material is subject to a formal hold.
Write the hold notice
A useful notice states the batch or lot number, delivery date, quantity, location, failed criterion, test report number, immediate restrictions and the person who placed the hold. Give copies to site management, quality personnel, the purchaser and the supplier. A hold is not a final rejection; it preserves options while the governing procedure is checked.
Classify what failed
Documents, labels or marking
Check that the cement designation, strength class, producer, batch identification, conformity mark and accompanying declaration or certificate match the order and applicable requirements. Compare the delivery note with the physical bags, bulk tanker documents and silo records. If authenticity or completeness is doubtful, ask the supplier for corrected, verifiable documents; do not silently amend records yourself.

Look for moisture damage, hardened lumps, foreign bodies, torn packaging, broken seals or marked lack of homogeneity in appearance or colour. Visual evidence can justify a hold and further investigation, but appearance alone does not establish performance conformity. Record exactly what was observed and under what lighting or handling conditions.
Measured performance
For a strength, setting-time, composition, soundness or other laboratory failure, preserve the original sample and chain of custody. Confirm the method, sampling point, sample size, laboratory competence, equipment status and acceptance criterion. A result cannot be interpreted apart from the cement type and the specification that sets the limit.

Build an evidence file before contacting the supplier
Keep one controlled file for the incident. It should contain:
- Purchase order, contract clauses, project specification and ordered cement designation.
- Delivery note, quantity, vehicle or silo identifier, batch and producer details.
- Bag labels, bulk documentation, seals, declarations of performance or conformity certificates.
- Inspection checklist, photographs, temperature or moisture observations and the hold notice.
- Sampling plan, sampler identity, date and time, sample seals, laboratory accreditation details, test method and complete report.
- Emails, meeting notes, supplier responses, corrective-action proposals and every acceptance, rejection or release decision.
Use consistent identifiers on every document. If a sample is split, record who received each portion and where it is stored. Retain the original report even if a later test produces a different result.

Set the governing procedure and decision-maker
Ask the contract administrator or quality manager to identify the applicable national rules, edition of the standard and project acceptance plan. Confirm whether the receiver, purchaser, engineer, manufacturer, importer, certification body or regulator has authority to order a retest, accept a correction or reject the consignment. Local legal or regulatory advice may be necessary, especially where the cement has already entered a structure or a regulated market.
| Source or jurisdiction | Who has the stated reporting duty | Timing or trigger | Counter-test or storage provisions |
|---|---|---|---|
| Spain, RC-16 reception instruction | The reception procedure requires the receiver to document rejection or deferred acceptance; specified market-surveillance or certification notifications can also arise. | After documentary, visual or test nonconformity, following the RC-16 process. | Supplier-requested counter-tests are addressed. A conditionally rejected load must be suitably stored until reliable results are available. |
| South Africa, VC 9085 (2021) | Manufacturer or importer and its appointed certification body. | They undertake in writing to report any failure to conform immediately to the NRCS. Importers notify the NRCS in advance of each import consignment. | The cited specification does not create a universal receiver counter-test right. |
| Namibia cement regulations (2019 text) | Manufacturer or importer reports to the regulator and takes corrective action. | Failure is reported immediately in writing, with details; the regulator is kept informed of corrective action and findings. | The regulator may request corrective steps after rejection of a conformity-certificate or import-licence application. |
| EN 197-2:2020 listing | Conformity-assessment responsibilities depend on the adopted standard and national system. | The public catalogue describes records and handling of nonconforming production, but not the complete acceptance procedure. | Obtain the official standard and national adoption for sampling, testing and disposition rules. |
These are jurisdiction-specific routes, not alternatives that a project may select freely. The shipment’s location, parties’ roles and incorporated documents control.

- The applicable declaration, certificate, conformity mark and traceability information.
- An explanation of the suspected cause and a written corrective-action proposal.
- Agreement on who will control any additional sampling, sealing, laboratory and costs under the contract.
Keep communication factual. State that the material remains on hold while the authorised procedure is followed; avoid declaring definitive rejection before the contract or regulation permits that step.
When a counter-test is proposed
Check that retesting is actually available
A counter-test is not an automatic universal right. Some rules expressly provide for one; others leave the issue to the contract, certification scheme or regulator. Obtain written confirmation of the permitted test, time window, laboratory qualification and acceptance rule before releasing the hold status.
Control sampling and identity
Agree in advance on the sampling location, number of increments, composite method, sample quantity, seals, witnesses, laboratory and test method. Use tamper-evident identification and record the chain of custody. If the original sample is exhausted or compromised, say so in the record rather than presenting a new sample as a repeat of the first.
Interpret contradictory results carefully
Compare methods, sample locations, curing or conditioning, equipment and uncertainty before choosing a result. Under Spain’s RC-16 procedure, a further test series may be considered in the limited case of contradictory results and a supplier request. That provision does not establish a general rule outside the Spanish procedure.
Disposition options
Verified correction and acceptance
Use this route only for a defect that the governing rules permit you to correct, such as incomplete documentation, and only after the replacement information is authenticated and matched to the lot. Record who verified the correction and the exact acceptance basis.

Conditional rejection while testing is pending
Keep the load segregated, labelled and protected when an authorised counter-test is underway. Define a deadline, responsible person and storage inspection schedule. No production or construction use should occur during this status unless the governing authority expressly permits it.
Definitive rejection, return or controlled disposal
Issue a written decision identifying the failed requirement, evidence considered, contractual or regulatory basis, quantity affected and physical disposition. Arrange return or disposal so the material cannot re-enter the project under another label. Update inventory, nonconformance and payment records.

Documentary review
Spain’s RC-16 separates documentary review, visual inspection and testing. Accompanying labels and records must match the ordered cement, be complete and satisfy applicable requirements. If defects cast doubt on authenticity, the receiver requests correction. If the defect is not corrected, the consignment may be rejected and the reason documented. The procedure also contemplates market-surveillance and certification-body notifications in specified circumstances.
Visual inspection
RC-16 identifies weathering, foreign bodies and marked lack of homogeneity in appearance or colour as warning signs. These observations support further action but are not a substitute for a performance test.
Testing and rejection status
When testing shows nonconformity, the receiver records either conditional rejection, when counter-tests are requested, or definitive rejection. A conditionally rejected consignment must be stored appropriately to avoid contamination or deterioration until reliable results are available. The final decision and its justification are recorded, together with the supporting documents.

South Africa: duties under VC 9085
The 15 March 2021 South African Government Gazette specification VC 9085 places a written undertaking on the manufacturer or importer and its appointed certification body to report any failure to conform immediately to the National Regulator for Compulsory Specifications (NRCS). Importers must notify the NRCS in advance of each import consignment. This is a rule for the named parties and does not mean every receiver has the same immediate reporting duty. A receiver should nevertheless notify the contractual quality lead and ask the responsible manufacturer or importer to confirm compliance with its NRCS obligations.
Namibia: corrective action and regulator reporting
The cement regulations published on 11 September 2019 require a manufacturer or importer to take corrective action and immediately report a failure to the regulator in writing, including details of the nonconformity. The regulator must be kept informed of corrective action and findings, and may request additional corrective steps after rejecting an application for a conformity certificate or import licence. The accessible copy reviewed is hosted outside the government domain, so verify the current official text before applying it to a shipment.

Using EN 197-2 without over-reading a catalogue entry
A public SIST catalogue listing for EN 197-2:2020 describes conformity assessment and related records, including handling nonconforming production. Its public preview is limited. It does not, by itself, establish the sampling frequency, laboratory method, acceptance limit or receiver’s rejection rights for your project. Obtain the official standard and the national adoption cited in the contract, then align the incident file and retest plan with those documents.
Common mistakes that make a failed shipment harder to resolve
- Using part of the load “temporarily” and losing the ability to isolate the affected batch.
- Mixing bags or bulk material from different lots in one silo.
- Changing labels or correcting a certificate without supplier and authority verification.
- Ordering an informal repeat test with a different method or an uncontrolled sample.
- Allowing cement to weather while parties debate responsibility.
- Assuming that a reporting rule for an importer or certification body automatically applies to the receiver.
- Closing the nonconformance verbally without a signed disposition and retained evidence.
Release checklist
- The governing contract, cement designation, intended use and applicable jurisdiction are identified.
- The failed criterion, method, sample identity and laboratory report have been reviewed by a competent person.
- The lot remains segregated, traceable and protected.
- Supplier responses, conformity documents and any corrective action are verified.
- Any counter-test follows an agreed sampling, sealing, laboratory and acceptance procedure.
- The authorised decision-maker signs acceptance, conditional status or definitive rejection.
- Regulator, certification-body and market-surveillance notifications required for the relevant jurisdiction are completed.
- Inventory, payment, construction records and the incident file reflect the final disposition.
Only after those checks are complete should the hold be removed. If the evidence cannot establish conformity, keep the cement out of use and obtain jurisdiction-specific technical or legal advice rather than relying on an informal release.
