What to Check Before Renting in a Building Under Construction

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not sign until the exact unit is approved for occupancy and you have independently checked the building’s permits, violations, safety arrangements and remaining work. A landlord’s assurance is not a substitute for the occupancy document held by the local building authority.

Construction can continue legally while residents live elsewhere in a building, or in a properly approved occupied portion, but the rules and documents vary by location. Confirm the local requirements, then make the work schedule, service interruptions, complaint contact and any remedy part of your written lease.

1. Confirm that your exact unit may legally be occupied

Legal occupancy is the threshold question. Ask for the certificate of occupancy, occupancy permit, partial-occupancy approval or equivalent document covering the unit you would rent. Then contact the local building or permitting authority and verify the document independently. Check that it covers the current construction phase, not merely a finished floor, a different unit or an earlier stage of the project.

The document’s name and process depend on the jurisdiction. New York City guidance tells prospective tenants to verify that a building can legally be occupied as represented, research its permits and violations, and check the building’s history. Toronto’s unfinished-building process uses an Authority to Occupy permit for the relevant occupied portion and stage. Toronto warns that unauthorized occupancy can result in an order to vacate or other legal action, and says a separate occupancy permit is required for each stage described in its process. Neither example is a universal rule; ask your own building department what approval applies to your address and unit.

Check What you need to establish
Document type The locally required occupancy certificate, permit or partial-occupancy approval.
Coverage Your unit, the occupied common areas and the current construction stage.
Status That the approval is active and has not been superseded, suspended or accompanied by a vacate order.
Independent confirmation The building authority’s record, not only a landlord-provided copy or marketing statement.

If the owner says approval is “pending,” treat that as a condition that must be resolved before you commit money or a move-in date. Put a right to cancel and a full deposit-return obligation in the lease if approval is not issued by a specified date.

2. Check permits, violations and posted notices yourself

Obtain every active permit number that affects the building or your route through it. Record the work location, approved scope, contractor and design professional, permit status and a responsible contact. Compare those records with the work you can see and with the landlord’s description. Demolition, structural work, façade work, plumbing, electrical changes and alterations to fire-protection systems may each have different filings.

In New York City, building applications and permits are available through the Building Information System (BIS) and DOB NOW. The city’s tenant checklist says permit identifiers and related information should appear in the Tenant Protection Plan (TPP) Occupants Notice. Other jurisdictions use different databases or an in-person records counter, so ask the local authority where permit and violation histories are published.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Check whether the permit is issued, active, expired, suspended or closed.
  • Read the permitted work description rather than relying on a project name.
  • Look for violations, stop-work orders, unsafe-condition notices and required construction postings.
  • Confirm that the contractor and professionals named in the record match the people managing the site.
  • Compare the approved scope with the work occurring during your viewing; a mismatch deserves an explanation from the authority, not just the agent.

Where residents occupy a building during covered work, request the tenant-protection plan or local equivalent. New York City requires a separate TPP for each covered construction, alteration or partial-demolition permit in an occupied building. The plan should identify the permit and explain how occupants will be protected while that specific work proceeds.

  • One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips

3. Examine how residents will be protected from the work

Ask to see the plan, drawings, notices or procedures that govern the occupied area. Do not accept a statement that the contractor will “be careful.” Walk the route from your door to a safe exit, the street and any required fire or emergency assembly area while work is active.

Protection area What to verify before signing Warning signs
Exits and fire safety Clear, usable exits; maintained stairs and corridors; fire alarms, extinguishers, sprinklers and emergency lighting protected during the work. Materials, tools or debris narrowing an exit; locked or confusing alternate routes; alarms or sprinklers taken offline without a documented safeguard.
Separation and access Physical separation between work zones and occupied areas; controlled entrances; safe elevators, stairs and hallways. Residents must pass through an active work area, an unsecured opening or a changing route with no notice.
Dust, debris and pests Containment, cleaning, negative-air or equivalent controls where appropriate; pest prevention; covered chutes and regular removal of debris. Visible dust entering the apartment, open demolition, recurring pests or shared spaces left dirty.
Sanitation and housing standards Working toilets, water, ventilation and other basic conditions for the occupied portion. Construction crews and residents sharing inadequate facilities or common areas that cannot be kept sanitary.
Lead and asbestos The required surveys, licensed handling and compliance measures for suspected or confirmed hazardous materials. Uncontained suspicious material, unexplained testing gaps or instructions to disturb it yourself.
Structural safety Engineering controls and monitoring where work could affect floors, walls, façades or the occupied structure. Cracks, movement, vibration or structural work adjacent to occupied rooms without an explained protection plan.
Essential services How heat, hot and cold water, electricity, gas, elevators and other necessary services will remain available or be restored. Unscheduled shutoffs, no alternative arrangements or no notice procedure.
Noise Permitted hours, expected high-noise activities and a method for reporting violations. Early-morning, late-night or weekend work that conflicts with local rules or the written schedule.

New York City’s TPP categories specifically include egress, fire safety, dust and debris, pests, sanitary conditions, housing-standard compliance, structural safety, noise limits and essential services. Use those categories as a practical checklist elsewhere, while confirming the legal requirements in your own city.

4. Price the disruption before you price the rent

Find out what remains unfinished, where it will occur and how long it is expected to last. Ask for the construction hours and projected completion date, but treat the date as a forecast rather than a guarantee. Identify work that can change daily life: drilling beside a bedroom, blocked balconies, unavailable amenities, temporary entrances, elevator reservations, deliveries, vibration, dust and changing parking or storage access.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

New York City’s Safe Construction Bill of Rights information identifies the type of work, unavailable or interrupted services, construction hours, projected timeline, owner contact and complaint information as notice contents. Those are sensible questions in any jurisdiction, but the notice name, timing and remedies may differ elsewhere.

For every possible interruption, ask four practical questions:

  1. Which service or area will be affected?
  2. When will the interruption start and end, and how much warning will residents receive?
  3. What alternative is provided, such as another entrance, restroom, elevator, heat source or temporary accommodation?
  4. Who has authority to respond, and how will you reach that person outside ordinary office hours?

There is no universal construction-related rent discount established by the official guidance. Compare the documented disruption with the rent, move-in date and your own tolerance rather than assuming a discount is legally required.

5. Put occupancy and construction promises in the lease

Verbal assurances are difficult to enforce and easy to reinterpret after move-in. Attach the occupancy approval, construction schedule, plan or notice that the parties are relying on, and identify which statements are conditions of the tenancy.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

At minimum, the lease should state:

  • the approval required for your unit and the deadline for obtaining it;
  • the remaining work, affected spaces, permitted hours and current projected completion date;
  • the services that may be interrupted, expected duration, notice method and alternatives;
  • the owner, construction manager or other person responsible for updates and complaints;
  • what happens if approval is delayed, an essential service is unavailable at move-in or the agreed access route cannot be maintained;
  • how you may terminate, postpone possession, receive a rent adjustment or recover costs if a stated condition fails, subject to local law.

Have a local tenant lawyer, housing counselor or tenant organization review unusual clauses, waivers and liability language. A clause cannot legalize an otherwise unauthorized occupancy or remove mandatory protections that local law gives tenants.

6. Follow a documented pre-signing process

  1. Identify the authority. Find the city, county, provincial or state building department responsible for the address and ask which occupancy document applies to an unfinished building.
  2. Request records. Get permit numbers, occupancy approvals, violations, required notices and the tenant-protection plan or equivalent.
  3. Verify the records. Check the authority’s database or records office and confirm that the unit and current stage are covered.
  4. Inspect the route. During a viewing, follow the actual path to exits, stairs, elevators, entrances and street access; note barriers, dust, noise and changing conditions.
  5. Ask for the schedule. Obtain work hours, affected areas, high-impact tasks, service interruptions and the latest projected completion date.
  6. Get names and channels. Record the owner contact, site contact, emergency number and government complaint route.
  7. Negotiate contingencies. Add approval, service, access and delay conditions to the lease before paying a non-refundable amount.
  8. Preserve evidence. Save documents, emails, photographs, dated notes and inspection observations in one file.

Do this before signing, not after a problem appears. Construction conditions can change quickly, and a dated record helps distinguish an agreed temporary inconvenience from an unsafe or unauthorized condition.

7. Compare a construction rental with another apartment

Use the same criteria for every property so a lower asking rent does not hide a greater legal or practical risk.

Decision factor Questions to compare
Lawful occupancy Is approval documented for this exact unit and construction stage, and independently confirmed?
Remaining work What work remains, where is it located, what hours apply and how credible is the completion forecast?
Safety controls Are exits, fire protection, separation, dust control, hazardous-material procedures and structural safeguards documented?
Daily disruption How much noise, dust, vibration, blocked access, amenity loss or delivery activity should you expect?
Services Could heat, water, power, gas or elevators be interrupted, and are alternatives and notice periods specified?
Accountability Is there a named contact, a written complaint path and a clear response time?
Lease protection What happens if approval, access, services or the promised schedule fails?

The official material supports these as due-diligence factors but does not assign a universal dollar value to them. Make the decision using your budget, work-from-home needs, health concerns, household schedule and willingness to tolerate uncertainty.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

8. If the building or paperwork does not match the promise

Stop and document the discrepancy. Photograph conditions from a safe location, save the permit or notice, write down dates and times, and communicate with the owner in writing. Do not enter a restricted work area or disturb suspected lead or asbestos.

In New York City, tenants can search permit and related TPP information in BIS or DOB NOW, report suspected construction noncompliance through 311 and contact the Office of the Tenant Advocate about TPP concerns. The city identifies 311 channels for construction noise and dust and routes suspected lead or asbestos matters to the relevant agencies. Check the live agency page because procedures and contact details can change.

For a Toronto unfinished building, the municipal process directs applicants and occupants to the building inspector regarding readiness and the Authority to Occupy process. The page specifies a 10-business-day lead time before the proposed occupancy date and separate permits for stages. That deadline is a Toronto administrative requirement, not a general rule for other locations.

Elsewhere, contact the equivalent building inspector, permitting office, fire authority, public-health department or tenant-protection agency. If there is an immediate danger—blocked emergency exits, active structural instability, fire-system failure or suspected hazardous exposure—leave the area and use the emergency or inspection channel required locally.

9. The decision rule

Rent only when the exact unit is lawfully occupiable, the public record matches the stated project, the occupied area has a credible safety plan and the remaining disruption is acceptable on terms written into the lease. If any of those elements is unknown, delay signing until the responsible authority or a qualified local adviser resolves it. A finished-looking apartment is not proof of legal occupancy, and a promised completion date is not a substitute for documented protections.
