Noise and dust are possible, but so are changes to access, safety arrangements, utilities and sanitation. The impact depends on the project and the specific unit; no single visit or general rule can guarantee what living there will be like.
What can construction next door affect?
Noise and dust are the most obvious concerns, but work can also affect building access, emergency exits, utilities, sanitation and safety. New York City’s Department of Buildings Office of the Tenant Advocate says construction may be disruptive, but conditions should not be dangerous or hazardous to occupants. NYC tenant protection guidance describes protections for occupied buildings undergoing covered work.

Your experience depends on the project’s stage and type, its schedule and distance from the unit, and which rooms face the site. The guidance available does not establish a typical noise level, dust exposure or construction duration for neighboring apartments. A closed window or higher floor is not a guarantee of a quiet or dust-free home.
Check the project and its rules before you sign
Find the permit and local authority
Ask the landlord or agent for the construction address, permit numbers, project stage and estimated schedule. Then check the local building or planning authority’s permit lookup, if available. Confirm that the work and any work outside ordinary hours have the required permissions; a fence or crew on site does not tell you what work is authorized. Permit systems and rules vary by municipality. NYC residents can start with the Department of Buildings’ Tenant Protection Plan information and the Department of Environmental Protection’s construction noise rules.

Ask about hours and the remaining schedule
Ask what work is happening now, what comes next, how long each stage is expected to last, and whether the dates are firm or subject to change. Ask specifically about noisy work, deliveries, loading and any expected work outside usual hours. For NYC, DEP says construction is generally allowed from 7 a.m. to 6 p.m. on weekdays; work at other times, including weekends, requires after-hours authorization. That is a NYC rule, not a general construction schedule. DEP also says construction work must have a noise mitigation plan. Check the current local rules for the apartment’s address.
Rules elsewhere illustrate why it matters to check locally: UK councils can control construction and demolition noise through notices setting conditions such as hours and mitigation, while Sydney’s limits vary by work type and location. See UK government guidance on noise nuisance, UK HSE guidance on dust and noise concerns and the City of Sydney’s construction noise guidance.

Ask whether an occupant protection plan applies
In NYC, a Tenant Protection Plan (TPP) is required before a permit can be issued for covered work when at least one dwelling unit is occupied. The plan addresses matters including exits, fire safety, dust and debris, pests and sanitation, lead and asbestos compliance, housing standards, structural safety, noise measures and hours, and essential services. Each relevant construction, alteration or partial-demolition permit requires its own plan, and the details depend on the scope of work. Ask whether the building has a TPP and how to see it. These requirements are specific to NYC; ask your local authority what protections apply elsewhere.

- Listen where you will spend time. Stand in the bedroom and main living area with windows closed. Notice whether work is audible and whether it would interfere with sleep, calls or working from home.
- Check windows and ventilation. Look at the window seals and ventilation openings. Consider whether you can ventilate comfortably when windows need to stay shut; closed windows are not proof that noise or dust will be eliminated.
- Look for dust. Check sills and other surfaces for visible dust, and note whether it appears to be entering the unit. This is a screening observation, not an air-quality or dust assessment.
- Assess orientation and nearby activity. Note which rooms face the site, the distance and line of sight, and where construction vehicles, deliveries or loading take place.
- Walk the access route. Check the entrance, elevators and route through the building. Ask whether any entrance or emergency exit will change or be obstructed during work.
Ask what could be interrupted—and get answers in writing
Before signing, ask the landlord or agent about expected changes to entrances, elevators, water, heat, gas or electricity, and how concerns will be handled. Record the answers and any promises in writing, including anticipated work dates and hours, the contact person, how to report a problem, and any concession or lease-exit arrangement offered.
Do not assume you are entitled to a rent reduction, construction-related disclosure, cancellation right or particular remedy: those questions depend on local law and the lease. If a promised concession or flexibility matters to your decision, make sure the agreement itself states it clearly and check local tenant advice before relying on it.

Compare apartments on the same terms
If you are choosing between units, use the same questions for each instead of relying on a general impression of the site.
| What to compare | What to record |
|---|---|
| Distance and orientation | Which rooms face the site, approximate separation, line of sight, and nearby vehicle or loading access. |
| Project stage and timing | Current work, expected next stages, estimated remaining schedule, and how certain those dates are. |
| Observed conditions | Noise in the bedroom and living area during active work, visible dust, window closure and ventilation. |
| Access and protections | Entrance and exit arrangements, essential services, safety measures, and any applicable occupant plan. |
| Documentation and flexibility | Written answers and promises, rent and lease terms, and any agreed flexibility if conditions change. |
Decide how much disruption you can accept in exchange for the apartment’s location, price or features. Do not treat a quieter visit, an informal estimate or a verbal assurance as a firm guarantee.

Know where to report a problem
Ask for a named contact for construction concerns and the correct reporting route for noise, dust or unsafe conditions. In NYC, the tenant checklist directs occupants to 311 for construction-dust complaints, and the Office of the Tenant Advocate handles questions and complaints about work in occupied buildings. See the NYC Tenant Protection Plan checklist and Office of the Tenant Advocate information. Elsewhere, contact the municipal building, planning or environmental health authority, and a local tenant advice service for address-specific guidance.
