What to Check Before Buying Property on Al Marjan Island

Before signing or transferring money for a home or investment unit on Al Marjan Island, verify six things in order: the unit’s legal title and transferability, the seller’s authority to sell, any mortgage or restriction, the project’s registration and escrow account if it is off-plan, the official unit plan, and the complete one-time and recurring cost picture. Ras Al Khaimah Municipality lists Al Marjan Island among the emirate’s freehold areas and says UAE and non-Emirati customers may own in designated freehold areas, but that general eligibility does not prove that a particular advertised unit is correctly titled, transferable or free of restrictions.

Use the municipality and RERA-RAK records for the exact project, plot and unit. Treat sales brochures, agent messages and payment instructions as unverified until they match official documents and the signed contract.

1. Confirm that the exact unit can be owned and transferred

Freehold-area eligibility is only the starting point

Ras Al Khaimah Municipality’s ZL13 Real Estate Sale Contract service lists Al Marjan Island as a freehold area and states: “UAE and non-Emirati customers are entitled to own property in freehold areas.” This establishes the general area rule, not the legal status of every apartment, villa, hotel unit or investment product marketed on the island.

Ask for the exact unit number, building and plot reference, then match those details across the title deed, sale agreement, official plan and developer records. Confirm how the proposed buyer—an individual, joint owners, company or another structure—will be recorded. If the purchase is through a company, trust-like arrangement or power of attorney, obtain advice from a suitably qualified UAE property professional on the required ownership and signing documents.

Ask the municipality or a qualified local adviser to explain the ownership record that will be issued for your structure before you pay a reservation amount. A general statement that foreigners may buy in a freehold area does not answer whether the particular unit is registered, whether a hotel or managed unit has special contractual rights, or whether the proposed ownership name matches the buyer’s identity documents.

Match the advertised property to the legal property

  • Record the project’s legal name, building, plot number, unit number and floor.
  • Compare the seller’s description with the title deed and municipality-issued plan.
  • Identify whether parking, storage, terraces, furniture, rental rights or other spaces are included, and where each right is documented.
  • Check that the contract identifies the same property and seller as the official records.
  • Write down the seller’s full legal name, identification details and contact for the developer or manager handling the transfer.

Do not assume that an island-wide “freehold” label, a marketing floor plan or a reservation form proves legal ownership of the specific unit. If the seller will not provide enough information to identify the property precisely, you cannot complete a meaningful title or plan check.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

2. Check title, mortgages and restrictions before agreeing to a transfer

Use the sale-registration requirements as your document checklist

The ZL13 service says the sale-registration process checks the parties’ eligibility and legal impediments to transfer. For a freehold sale, it requires the original title deed and a developer no-objection message. The listed supporting documents also include Emirates IDs, powers of attorney where someone signs for another party, and company documents when a company is involved. Confirm the current requirements with the municipality because service pages and channels can change.

Before paying a non-refundable deposit, establish:

  • Who is named on the original title deed.
  • Whether every registered owner will sign or has granted a valid power of attorney.
  • Whether the seller is a company and, if so, which corporate resolutions and authority documents are required.
  • Whether the developer will issue the no-objection message and what outstanding charges must be settled first.
  • Whether the title is subject to a mortgage, reservation, suspension, attachment or another restriction.
  • Who will submit the registration application and who will receive the new title deed after review.

Ask for copies early enough to compare names, identity numbers, unit identifiers and signatures. A document that is merely promised for completion day gives you less protection than a document reviewed before the deposit becomes non-refundable.

Request a property-document investigation

RAK Municipality’s ZL24 Property Investigation service can investigate a real-estate document and report whether it is valid, mortgaged, suspended, reserved or subject to another restriction. The listed fee is AED 200 and the stated service time is up to five working days. The municipality says applicants must be directly related to the property, such as an heir, legal guardian or authorised agent, so confirm whether the buyer, seller or representative can request the particular check required.

Obtain the result for the actual title or document, not a different unit in the same building. If a mortgage or other restriction appears, require written evidence of the release process and confirm with the registration authority how and when the transfer can complete. Do not accept a verbal assurance that a restriction will disappear after payment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

3. For an off-plan purchase, verify the project and escrow account

Check the developer and project registration

Ras Al Khaimah’s Real Estate Regulatory Administration says developers must register with the regulator and that an off-plan project must itself be registered. The regulator also says an escrow or guarantee account should be opened under the project name and plot number with an account trustee registered with RERA-RAK. Read the current requirements on the Real Estate Regulatory Administration page and independently match the exact developer, project, plot and trustee against current records before making a payment.

The municipality describes escrow as a way “To ensure that funds invested by buyers of properties are used only for those projects only.” The account information in your contract should identify the same project and plot. Do not send money to a salesperson’s personal account, an unrelated company account or an account whose name does not match the officially identified project and trustee.

Reconcile the payment instructions

  1. Ask the developer for the project’s registered legal name, plot number, trustee and escrow-account details in writing.
  2. Check those details against current RERA-RAK information, rather than relying only on a brochure or chat message.
  3. Compare the account instructions with the signed sale-and-purchase agreement and payment schedule.
  4. Make the bank transfer only after the beneficiary and project references match across the official and contractual documents.
  5. Keep the bank confirmation, receipt, contract and correspondence together.
  6. Ask what document confirms each instalment, and retain evidence that the payment was credited to the project account.

Registration of the project does not by itself answer every commercial question. Read the delivery date, instalment triggers, cancellation terms and handover obligations in the contract, and have a qualified adviser explain clauses you do not understand. Do not substitute a sales launch date or estimated completion date for the registered project and payment checks.

Do not generalise a project-specific notice

A municipality notice for the specific Al Mahra project on Al Marjan Island directs buyers to register sale-and-purchase contracts and pay through that project’s escrow account. It says unregistered contracts would not be recognised or considered and that payments outside the project escrow would not be considered. Read the notice at RAK Municipality’s Al Mahra notice, but treat it as project-specific. Its instructions are not a substitute for checking the current registration and payment requirements for another Al Marjan development.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Verify the official plan, area and included rights

For investment units in designated areas, including Al Marjan Island, RAK Municipality’s ZT23 Site Plan for Investment Units service issues a site plan. The listed fee is AED 200 and the stated service duration is one working day. Obtain the plan for the unit under consideration and compare its identifier and documented area with the title deed, contract and seller’s schedule.

Resolve discrepancies before signing. Ask specifically how the contract treats balconies, terraces, parking bays, storage rooms, common areas and any hotel or rental-management rights. A marketing plan can show layout or furniture placement, but the legal boundaries and rights are determined by the official documents and contract.

Check whether the area is described consistently—such as internal area, total area or another measurement—and ask which figure controls the price and title. Confirm whether parking or storage has its own identifier or is merely a shared or revocable right. Keep the issued plan with the final contract so a later discrepancy can be traced to the document used at purchase.

5. Inspect a completed unit and verify its operating history

Arrange an independent condition inspection

For a completed property, commission an independent inspection if you need evidence about water ingress, façade or window seals, plumbing, electrical systems, air-conditioning, finishes, appliances and visible defects. The official municipal services establish document and plan checks; they do not provide a condition report for a particular apartment. Do not rely on a viewing, developer promise or seller statement as a substitute for a written inspection.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask the inspector to identify urgent defects, items needing specialist testing and defects in common areas that could lead to future charges. For a new handover, record each snag, the responsible party and the promised completion date. For a resale, compare the inspection with repair invoices, warranty correspondence and any unresolved complaint before agreeing the price or completion date.

Request records from the building

Ask the seller, owners’ association or building manager, and developer where relevant, for current records covering:

  • Owners’ association rules, leasing restrictions, alteration rules, use of amenities and move-in procedures.
  • Any outstanding defect, warranty or handover claims affecting the unit or common areas.
  • Written confirmation of any fees needed to issue a developer no-objection message.

Current building charges, reserve funds, association rules, planned works, insurance, condition and defect history are property-specific. No reliable island-wide figure should be used in a purchase calculation without dated records for the named building. If records are unavailable, treat the missing information as a risk to resolve rather than assuming the costs are ordinary or included in the asking price.

6. Calculate the transaction costs using the official figures, then add the deal-specific items

Municipality charges listed for sale registration

Charge Listed amount Qualification
Buyer’s sale-registration fee 2% of market value Listed by RAK Municipality’s current ZL13 service page; confirm the applicable valuation and fee before completion.
Seller’s sale-registration fee 2% of market value Listed by the same service page; establish in the contract who will pay each amount.
Plan issuance AED 200 Listed administrative charge; verify whether the relevant plan service or transaction requires it.
Title-deed issuance AED 200 Listed administrative charge on the ZL13 service page.

The ZL13 page gives an estimated service duration of three working days and says the completed registration produces a title deed. These are listed service details, not a guarantee for every transaction. Reconfirm fees, documents, valuation treatment and timing with RAK Municipality before relying on them.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The 2% figures are stated separately for buyer and seller and are calculated on market value, so do not assume that an agent’s percentage of the negotiated price is the same charge. Clarify whether the contract reallocates either party’s amount and obtain the municipality’s applicable valuation or payment instruction for the exact transfer.

Build a written total-cost schedule

Ask for a written breakdown of every amount payable by the buyer and seller, including any developer or no-objection charges, broker commission, legal advice, financing and valuation fees, management or hotel-programme charges, utilities, registration-related expenses, moving costs and outstanding service charges. The official administrative figures above are not a complete estimate of buying or owning a particular Al Marjan property.

Separate costs due before signing, at registration, at handover and during ownership. Mark each amount as fixed, percentage-based or subject to confirmation, and identify who receives it. This prevents a low headline price from hiding a transfer charge, unpaid building account or management deduction that appears only after the deposit is paid.

7. Compare two units using the same evidence

If you are choosing between actual properties, score each one against identical documents and dates rather than comparing brochure claims.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Decision axis Evidence to obtain Why it matters
Title and transferability Original title deed, investigation result, seller authority and developer no-objection process Shows whether the seller can transfer the exact unit.
Completed or off-plan status Handover status, project registration, escrow details and signed payment schedule Determines which protections and payment checks apply.
Area and included rights ZT23 plan, title, contract and parking or storage documents Prevents payment for space or rights that are not legally included.
Physical condition Independent inspection, snagging list, repair and warranty records Reveals costs and risks that a viewing may miss.
One-time and recurring costs Municipality charges, service-charge statements, budgets and planned works Tests affordability and rental assumptions.
Use and building rules Owners’ association rules, lease restrictions and management terms Confirms that your intended occupation or letting is permitted.

Use the same document date and ask the same questions of each seller. A unit with a lower asking price may carry unresolved service charges, a different management arrangement or repair obligations. Conversely, an amenity or rental promise matters only if the contract and building rules grant that right.

These are due-diligence comparison axes, not a market ranking. The official material does not establish island-wide prices, returns, occupancy rates or appreciation forecasts.

8. A practical sequence before signing or transferring funds

  1. Identify the legal property. Write down the project, plot, building, unit, floor and seller shown in the offer.
  2. Collect primary documents. Request the original title deed for a completed unit, or the registered off-plan contract and project details for a new purchase.
  3. Check restrictions. Use the ZL24 process where eligible and resolve mortgages, suspensions, reservations or other impediments.
  4. Confirm authority. Verify all owners, Emirates IDs, company documents and powers of attorney, and ask how the developer no-objection message will be obtained.
  5. Verify the plan. Obtain the applicable official site plan and reconcile area, parking, storage and other rights with the contract.
  6. Verify an off-plan escrow account. Match project name, developer, plot, trustee and beneficiary account with current RERA-RAK records and the signed agreement.
  7. Inspect the property. For a completed unit, obtain an independent condition report; for a new unit, document snagging and handover obligations.
  8. Obtain building records. Review service charges, reserve funds, rules, insurance, planned works and maintenance or defect history.
  9. Price the complete transaction. Include the listed 2% buyer and 2% seller market-value charges, AED 200 plan and AED 200 title-deed fees, plus all deal-specific costs.
  10. Sign only when the documents agree. Keep a final pack containing the contract, title or registration evidence, plan, escrow confirmation, inspection, cost schedule and payment receipts.

Allow time for the listed administrative services: the municipality gives up to five working days for the ZL24 document investigation, one working day for the ZT23 investment-unit plan and three working days for the ZL13 sale-registration service. These estimates can change and do not include time needed to correct a discrepancy, obtain a no-objection message or release a mortgage.

9. Red flags that justify stopping the transaction

  • The unit number, plot or seller differs between the advertisement, contract and title documents.
  • The seller refuses to show the original title deed or cannot explain who has signing authority.
  • A mortgage, reservation, suspension or other restriction is discovered without a documented release route.
  • An off-plan payment is requested into an account that does not match the registered project, plot and trustee.
  • You are told to pay before the contract is registered, or that an unregistered agreement will be recognised later.
  • The seller will not provide service-charge statements, association rules or planned-maintenance information.
  • The documented area or included parking and storage differs from the marketing material.
  • Costs are described as “standard” but no written, building-specific schedule is provided.
  • A deadline or discount is used to discourage a title, plan, escrow or inspection check.

Pause and obtain clarification from the municipality, RERA-RAK or an independently selected UAE property adviser when a document or payment path cannot be reconciled. Do not treat a deadline, discount or sales assurance as a reason to bypass title, registration or escrow checks.

Frequently Asked Questions

Can a non-Emirati buyer own property on Al Marjan Island?

RAK Municipality’s ZL13 service lists Al Marjan Island among the emirate’s freehold areas and states that UAE and non-Emirati customers are entitled to own in freehold areas. Confirm the exact unit’s title, registration and transferability rather than relying only on the area designation.

What documents are needed to register a freehold sale?

The ZL13 listing identifies the original title deed and a developer no-objection message for a freehold sale, along with Emirates IDs and, where relevant, powers of attorney and company documents. Confirm the current checklist and submission channel with RAK Municipality for the particular transfer.

How can I check whether a property is mortgaged or restricted?

RAK Municipality’s ZL24 Property Investigation service can report whether a real-estate document is valid, mortgaged, suspended, reserved or subject to another restriction. The listed fee is AED 200 and the service may take up to five working days; eligibility to request the check should be confirmed.

How do I verify an off-plan escrow account?

Match the project’s legal name, developer, plot number, registered trustee and beneficiary account with current RERA-RAK records and the signed sale-and-purchase agreement. Do not transfer funds to an unrelated or personal account. A municipality notice for Al Mahra specifically says unregistered contracts and payments outside that project’s escrow would not be considered, but that notice does not automatically apply to other projects.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What official fees should I allow for a sale?

The current ZL13 listing shows a 2% market-value fee for the buyer, 2% for the seller, AED 200 for plan issuance and AED 200 for title-deed issuance. Confirm the valuation, who pays each amount under the contract and whether other developer, broker, financing, legal or building charges apply.

Is there a standard service charge for Al Marjan Island buildings?

No single building-level figure should be assumed. Request dated service-charge statements, budgets, reserve-fund information, planned works, insurance and owners’ association rules for the named building, then test those costs against your intended use.

Should I inspect a completed apartment before buying?

Yes, if you need evidence about defects or condition. An independent inspection can examine water ingress, seals, plumbing, electrical systems, air-conditioning, finishes and appliances. Municipal title and plan services do not replace a physical condition report.

The Bottom Line

Buy the exact documented property, not the island-wide sales story. Before signing or transferring funds, reconcile the title, seller authority, restrictions, official plan, project registration and escrow details, inspection findings, building records and written cost schedule. Reconfirm current fees and procedures with RAK Municipality and RERA-RAK, and stop if any document or payment instruction does not match.
