Do not sign an unconditional purchase contract or lease until the planning authority confirms that hotel use is acceptable in principle. A building that appears suitable can fail on zoning, heritage constraints, fire strategy, structural capacity, utilities, access, title restrictions or a missing licence. Treat the project as a feasibility exercise involving planning, building control, fire, access, legal and services specialists—not as a cosmetic refurbishment.
The approval path is specific to the property and jurisdiction. The sequence below helps you identify fatal issues early, price the technical work realistically and make the transaction conditional on evidence rather than assumptions.

1. Define the proposed hotel before assessing the building
Authorities and consultants cannot assess a vague concept. Write a short operating brief before requesting advice. Record:
- Exact address, parcel and local authority.
- Current lawful or approved use, building age and heritage or conservation status.
- Proposed model: full-service hotel, boutique hotel, hostel, extended-stay property or another format.
- Target room count, room mix, accessible rooms and expected occupancy pattern.
- Ancillary uses such as a restaurant, bar, events space, gym, spa, laundry, kitchen, rooftop venue or retail.
- Opening hours, deliveries, waste arrangements, parking or drop-off requirements and staffing assumptions.
- Whether the building will be bought, leased, assigned or operated under a management arrangement.
A hotel with a restaurant and late-night events space can trigger different planning, licensing, noise, ventilation, parking and fire questions from a small room-only property. No universal classification applies across jurisdictions, so ask the local authority how your exact proposal is categorised.

2. Obtain written planning confirmation before committing
Verify the existing lawful use
Ask the planning authority for written confirmation of the building’s current approved or lawful use. Obtain copies of prior permissions, certificates, approved plans and conditions. A marketing description such as “suitable for hotel use” is not planning evidence.
Test the proposed use and every material operation
Submit a concise description and plans showing guest rooms, reception, kitchens, public areas, plant, waste storage, access and any outdoor activity. Ask whether the proposal requires a change-of-use application, full planning permission, a variance, an appeal or another consent. Include ancillary uses: a bar, event room, signage, extraction flue, terrace, parking change or late-night operation may be assessed separately.
Check zoning, local plans and neighbours
Confirm the site’s zoning, local-plan designation, conservation or heritage controls, listed-building status, height and massing limits, noise policies, parking standards, flood or environmental constraints and conditions attached to earlier approvals. Examine adjoining uses: bedrooms next to a nightclub, industrial process, loading yard or busy road may create noise, vibration, air-quality or access problems even when the hotel use is theoretically allowed.
Singapore illustrates why a general rule is unsafe. The Urban Redevelopment Authority states that Hotel-zoned land is allowed for hotel development, while proposals on land not zoned Hotel may be considered individually according to planning intention and compatibility. Its guidance also warns that a change-of-use application is subject to contextual evaluation and may be approved or disapproved. Treat this as a Singapore-specific example, not a global entitlement.
3. Make the purchase or lease conditional on feasibility
Have a local property solicitor or transaction adviser review the title and draft conditions before you become committed. Ask for conditions or termination rights tied to the following evidence:
- Planning permission or change-of-use approval for the stated hotel brief.
- Building-control acceptance of the proposed works and confirmation of the applicable regulations.
- An acceptable fire strategy and any required fire-authority approval.
- Utility-capacity confirmation for water, drainage, electricity, heating, cooling and telecommunications.
- Independent building, structural, services, access and hazardous-material surveys.
- Landlord, superior-landlord, lender, management-company or co-owner consent where required.
- Any heritage, environmental, highways, signage, food, alcohol or entertainment licences needed for the operating model.
Title and lease points to investigate
- Permitted-use wording and whether “hotel” includes your proposed ancillary operations.
- Restrictive covenants, easements, rights of way, air-rights restrictions and party-wall obligations.
- Assignment, subletting, change-of-control and operator-approval provisions.
- Who pays for structural work, statutory upgrades, plant replacement and common-area alterations.
- Fit-out approval, reinstatement obligations, service-charge exposure and insurance requirements.
- Break rights, long-stop dates and what happens if an approval is refused or delayed.
A conditional contract does not guarantee approval. Local counsel must draft conditions that match the authority’s process and the evidence you need. Do not rely on a seller’s promise to obtain consent after completion.

4. Commission surveys against a room-and-operations brief
Use independent professionals who are experienced with hotel conversions. Give them the room schedule and operating brief, not just the existing floor plan. A general building survey can miss the capacity and layout issues that determine whether the hotel actually works.
Building fabric and structure
- Foundations, load paths, floor loading, movement, cracking and the capacity for partitions, bathrooms, plant and water tanks.
- Roof, façade, windows, waterproofing and evidence of leaks or rising damp.
- Floor-to-floor heights, risers, shafts, plant rooms and routes for new ducts, pipes and cables.
- Hazardous materials, including any local regulatory survey requirements.
- Historic fabric, protected features and the practical limits on opening walls or floors.
Building services
- Electrical incoming capacity, distribution boards, standby generation and space for new equipment.
- Cold-water pressure, storage, hot-water generation, recirculation and peak demand.
- Drainage capacity, pipe condition, grease management and connection points.
- Heating, cooling, ventilation, smoke control, controls and acoustic performance.
- Lift capacity, telecoms, security, refuse storage, laundry services and delivery routes.
- Kitchen extraction, odour control and make-up air if food service is planned.
These are investigation prompts rather than a universal list of legal requirements. England and Wales provide a useful example of the scale of a regulatory change: the cited Building Regulations treat use as a hotel where the building was not previously a hotel as a material change of use. Work may then need to address applicable requirements covering structure, warning and escape, internal and external fire spread, fire-service access, ventilation, cold and hot water, sanitary facilities, kitchens, drainage, waste, combustion appliances, energy and electrical safety, along with access and use provisions. Confirm the current rules and building-control route for the actual property.
5. Resolve fire and life safety before fixing room numbers
Fire design can reduce the number of rooms, consume valuable floor area and determine whether a historic building is viable. Appoint a qualified fire engineer early and ask the local building or fire authority how it expects the strategy to be documented.
Questions the fire review must answer
- Are escape routes, stairs and exits adequate for the proposed occupancy and travel distances?
- Can floors, walls, doors and service penetrations achieve the required compartmentation?
- What alarm, detection, emergency-lighting, signage and smoke-control systems are required?
- Is suppression required, and can tanks, pumps, pipework and maintenance access be accommodated?
- Can fire appliances reach the building, and are there suitable fire-fighter access points?
- How will guests who are asleep, disabled or unfamiliar with the building be evacuated?
- What constraints arise from retained timber, decorative plaster, masonry, staircases or other historic fabric?
Scottish Government guidance for traditional buildings states: “When converting to hotel or residential use, it is highly probable that a suppression system must be provided (Refer to The Building (Scotland) Amendment Regulations 2025).” The same guidance notes that compartment floors can be difficult where historic fabric is retained. This is a Scotland-specific warning, not a substitute for the applicable standards elsewhere.
6. Test accessibility and the complete guest journey
Have an architect and access specialist draw the journey from street, parking or drop-off through entrance, reception, lifts, corridors, bedrooms, bathrooms, restaurant and amenities. Check gradients, thresholds, door widths, turning spaces, lift dimensions, accessible toilets, hearing or visual alarm provisions and evacuation arrangements against local standards.
Ask the authority whether heritage status permits an alternative solution and what evidence it requires. The number and specification of accessible rooms are jurisdiction-specific; do not rely on a generic percentage copied from another project.

7. Separate planning from building control, licences and utilities
Planning permission is only one consent. Build a matrix with an owner, authority, prerequisite, submission date, decision date, fee and dependency for each item.
- Planning or change-of-use approval.
- Building-control plan review and completion certification.
- Fire-safety approval or consultation.
- Alcohol, entertainment and late-night operating licences.
- Food-business registration, kitchen approval and environmental-health requirements.
- Highways, parking, loading, signage and pavement-occupation consents.
- Heritage or listed-building consent.
- Environmental permits, waste arrangements and noise controls.
- Utility connections, upgrades and wayleaves.
Singapore’s URA guidance illustrates the separation: after change-of-use approval, separate permits or licences may still be required from relevant agencies. It identifies items such as location and floor plans, owner consent and agency clearances among possible supporting information. Ask the local authority for its current checklist rather than assuming one approval covers the operation.
8. Compare candidate buildings on risk, not headline area
When screening more than one property, use the same evidence for each. A larger building is not automatically better if stairs, shafts, fire upgrades or services consume the additional area.
| Decision axis | Evidence to compare | Downside if unresolved |
|---|---|---|
| Use approval | Written planning advice, zoning, local-plan policy and neighbour compatibility | Refusal, redesign or an unplanned appeal |
| Life safety | Fire strategy, escape capacity, compartmentation, suppression and fire-service access | Reduced room count, major structural work or inability to operate |
| Usable area | Net rooms after corridors, stairs, accessible rooms, plant, storage and back-of-house | Lower capacity than the appraisal assumes |
| Services | Electrical, water, drainage, ventilation, cooling, lifts and telecoms capacity | New substations, tanks, plant rooms, risers or off-site upgrades |
| Heritage and neighbours | Protected fabric, noise sensitivity, vibration, traffic and delivery limits | Consent delays, restricted hours or costly specialist detailing |
| Transaction flexibility | Title restrictions, permitted use, owner consent, assignment and break rights | Loss of control or exposure to an unusable lease |
| Programme and downside | Approval dependencies, long-stop date, contingency and refusal remedies | Rent, finance and professional fees while the asset is idle |
Use staged go/no-go gates
- Gate 1 — paper screening: Confirm address, current use, zoning, heritage status, title or lease restrictions and the intended operating brief.
- Gate 2 — authority response: Obtain written planning and building-control direction before spending on detailed design.
- Gate 3 — technical feasibility: Complete building, structural, services, fire and access surveys against the room schedule.
- Gate 4 — consent and cost test: Map every permit, price compliance work and confirm utility capacity and programme dependencies.
- Gate 5 — conditional commitment: Sign or complete only when the negotiated conditions, approvals and termination rights protect the identified risks.
9. Jurisdiction examples and the limits of general advice
| Jurisdiction | Confirmed point | How to use it |
|---|---|---|
| England and Wales | A previously non-hotel building used as a hotel can be a material change of use under the cited Building Regulations, bringing applicable requirements across fire, structure, services, energy, sanitation, drainage, waste, electrical safety and access. | Ask local building control to identify the exact provisions and evidence required for the proposed works. |
| Singapore | Hotel-zoned land is allowed for hotel development; non-Hotel-zoned proposals may be assessed individually. Change-of-use decisions are contextual and may be refused, with separate agency permits or licences potentially required. | Seek URA feedback and do not commit to tenancy or renovation before the decision. |
| Scotland | Official traditional-building guidance says suppression is highly probable for hotel or residential conversion and highlights compartmentation challenges in historic fabric. | Commission a Scottish fire strategy early and test heritage-compatible solutions with the authority. |
| France | Hotels fall within the “commerce et activités de service” destination. A planning declaration or building-permit route depends on whether façade and/or load-bearing structures change, and local PLU rules must be checked. | Determine whether the proposal is a change of destination, a change of use or both, then follow the local PLU process. |
These examples demonstrate different approval concepts; they do not establish a universal hotel-conversion rule. The property’s country, city, age, condition, heritage status, title, lease and operating brief determine the actual answer.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.10. Common failure modes and practical responses
“The agent says hotel use is permitted.”
Request the planning record and written authority response. If the statement is not supported by an approval or formal advice, treat it as an unverified assumption.
“We can solve fire compliance during fit-out.”
Do not fix room count or sign an unconditional deal first. Fire compartments, stairs, shafts and suppression infrastructure can require structural intervention and consume saleable area.

“The existing utilities are adequate.”
Obtain capacity data and a peak-demand assessment. Guest rooms, showers, kitchens, laundry and cooling can exceed the capacity of an office, retail or residential installation.
“A planning approval covers the business.”
Maintain a separate consent matrix for building control, fire, food, alcohol, entertainment, signage, environmental, highways, heritage and utilities.
“The heritage exemption will remove the problem.”
Ask the authority which alternative solutions are acceptable and what compensating measures are required. Heritage status can constrain compartmentation, shafts, windows and access rather than eliminate safety duties.
11. The professional team to appoint
