What to Check Before Buying a Newly Built Home in Dedham

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before you make a binding offer or close on a newly built home in Dedham, verify five things independently: the written contract and specifications, the Town’s permit and occupancy record, the home’s physical condition, title and parcel obligations, and the ongoing costs and land-use limits for that exact address. A new home is not automatically defect-free or free of title, drainage, tax, or insurance risk.

This is a due-diligence guide, not a finding that any particular Dedham property complies with its approvals. Have a Massachusetts real-estate attorney, qualified inspector, and title professional review the documents for the specific home. The Commonwealth’s homebuying process guide advises legal advice before signing a binding agreement.

1. Establish exactly what the contract promises

The purchase-and-sale agreement, its exhibits, the approved plans, and the written specifications—not a model-home conversation or sales listing—define what you are buying. Massachusetts treats the purchase-and-sale agreement as legally binding, so have a Massachusetts real-estate attorney review the offer and final agreement before you sign.

Collect the complete document set

Ask for one complete, current package and check that every attachment is identified in the agreement. The state’s residential new-construction curriculum specifically addresses plans, specifications, buyer selections, allowances, change orders, financing, title, and the construction process from cellar hole through certificate of occupancy.

Document or term What to confirm Why it matters
Purchase-and-sale agreement and exhibits Legal description, parties, price, deposits, contingencies, closing conditions, default remedies, and all referenced attachments Anything promised outside the signed documents may be difficult to enforce.
Plans, lot plan, survey, and specifications House dimensions, grading, retaining walls, decks, driveways, landscaping, finishes, energy equipment, and locations of utilities They let you compare the promised home with the approved and constructed home.
Allowance and selection schedules Dollar amounts, deadlines, substitution rights, taxes, installation charges, and who pays overruns An allowance is not the same as a specified product or a credit at closing.
Change orders Written price, schedule, design, and warranty effect; signatures and dates Unrecorded changes create disputes about both scope and cost.
Completion and extension clauses Target completion date, permitted extensions, notice requirements, and your cancellation or remedy rights Construction status should be measured against contractual milestones, not a verbal estimate.
Warranty Covered systems and structure, term, exclusions, response procedure, documentation, and whether obligations transfer A warranty is useful only if its coverage and claim process are clear.

Audit inclusions and exclusions line by line

Confirm whether the price includes appliances, light fixtures, window treatments, heating and cooling equipment, water-heating equipment, landscaping, fencing, irrigation, driveway work, basement finishing, and rubbish removal. Ask whether any solar, security, water-treatment, or other equipment is leased or separately billed. The Massachusetts purchase-and-sale teaching material lists included and excluded property, leased equipment, plans, title, and contingencies as issues buyers should address; see Purchase and Sale Agreement in Residential Transactions.

Require every buyer selection and requested change to be written. Check whether it changes the price, completion date, permit plans, or warranty. Arrange in the contract for reasonable access to inspect the property during construction and for a documented pre-closing walkthrough; a builder’s walkthrough is not a substitute for an independent inspection.

2. Verify Dedham’s permit, inspection, and occupancy record

Use the property address—not a generic statement from a listing or builder—to obtain the municipal record. Dedham’s Building Department evaluates and approves plans, issues permits, and performs on-site inspections.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Request the building file

  1. Ask the Building Department for the building permit, approved plans, permit history, inspection entries, open permits, correction notices, final inspection status, and certificate of occupancy.
  2. Request related electrical, plumbing, and gas permits and inspection records when those trades apply.
  3. Compare the approved plans and permit descriptions with the house and site as built. Look for changes to floor area, bedrooms, decks, retaining walls, grading, drainage, driveway location, accessory structures, and mechanical systems.
  4. Ask whether any corrections, testing, sign-offs, or other approvals remain outstanding and obtain written confirmation of the status.

Dedham offers digital building records from 2007 onward; older records can be requested from the department. The municipal file is the source for that parcel’s permitting history. A certificate of occupancy is required to occupy a completed permitted building, according to the Town’s business guidance, but it does not certify that every finish is workmanship-perfect, that the contract has been fully delivered, that title is clear, or that future additions will be allowed.

Treat the certificate of occupancy as a milestone, not the whole review

Ask for the certificate itself and verify that it describes the correct address and use. If the home is being sold before construction is complete, identify the precise conditions for issuing it and the consequences if it is delayed. Do not close on the assumption that a final certificate will appear later unless your attorney has made that risk and remedy explicit in the agreement.

3. Arrange an independent inspection and control the punch list

Massachusetts homeowner guidance says inspections are generally recommended for new homes and warns that an inspection cannot guarantee that no problems exist. A new structure can have incomplete work, installation defects, drainage problems, or systems that have not been operated through a full season. See the state’s resources for homeowners and prospective buyers.

Know what the inspection should cover

The state’s residential home inspection guidance describes visible areas and systems including the roof, attic, exterior and interior walls, windows, ceilings, floors, doors, basement, foundation, air conditioning, plumbing, and electrical systems. Before hiring an inspector, ask for the written scope, standards used, areas that will be inaccessible, and circumstances requiring a specialist.

  • Have the inspector document unfinished or inaccessible areas rather than assuming they are acceptable.
  • Ask for specialist follow-up when the report identifies structural, roofing, drainage, electrical, environmental, or other issues beyond a general inspection’s scope.
  • Attend if possible and ask how systems were tested, what could not be tested, and which defects are urgent.
  • Keep the report, photographs, invoices, permits, and all builder responses together.

Check whether the inspection rule applies to this transaction

The state inspection page describes an exception for a pre-completion sale of a new home when construction is not substantially complete and the seller offers a qualifying one-year written warranty covering systems and structural integrity. That does not mean every new-construction sale is exempt, and it does not mean every warranty has the same scope. Confirm the current disclosure and licensed-inspector requirements with your Massachusetts attorney or another qualified professional using the exact contract facts.

Turn findings into a verifiable punch list

Put each defect, incomplete item, promised correction, responsible party, and due date in writing. Distinguish a cosmetic choice from a safety, water-intrusion, structural, code, or system-performance issue. Reinspect material repairs before closing where possible. If work will remain after closing, have the agreement specify access, deadlines, retainage or other protection, and the evidence needed to show completion.

4. Review title, boundaries, easements, and shared obligations

A sound building can still be a poor purchase if the lot, access, or title is not what you expect. Have a Massachusetts real-estate attorney or title professional review the actual deed, title commitment, and recorded instruments.

Match the deed and plan to the ground

Review the deed and the plan it references, a current survey or reliable boundary information, and access to a public way. Check for easements, rights-of-way, restrictions, reservations, covenants, liens, municipal betterments, unpaid taxes, and other charges. Determine whether utility, drainage, driveway, or retaining-wall rights cross the lot or benefit neighboring parcels. Confirm that the house, garage, driveway, fences, and other improvements fit within the described parcel and do not occupy an easement or required setback.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask who must maintain shared drives, private ways, utilities, drainage systems, retaining walls, and open space. A plan may show an easement without explaining its practical maintenance burden; the recorded language controls.

Investigate an association before accepting its obligations

If the property is in a condominium or other community association, obtain the master deed or declaration, bylaws, rules, budget, current fees, insurance, reserve information, pending or known assessments, and meeting disclosures. Confirm restrictions on parking, rentals, fences, additions, exterior materials, pets, and landscaping. Verify whether the association or individual owners maintain shared roads, stormwater facilities, private utilities, or open space. Do not assume an association exists—or does not exist—until the title documents establish it.

5. Check Dedham zoning, wetlands, stormwater, and future-use limits

Use Dedham’s mapping tools to orient yourself, then obtain a legal answer from the responsible Town office. The Town directs prospective purchasers to contact Building or Planning, Zoning and Natural Resources about applicable land-use regulations. Its Planning, Zoning, and Natural Resources Department includes planning and zoning, conservation, and stormwater functions.

Start with parcel and GIS information

Dedham’s Geographic Information Systems resources and property information can help you locate parcel boundaries and mapped features. A map is an orientation tool, not a legal determination of a wetland boundary, flood hazard, zoning compliance, or buildable area. Ask the Town for the zoning district, dimensional requirements, variances, special permits, site-plan approvals, conditions of approval, and any enforcement or open application affecting the parcel.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask specifically about wetlands and stormwater

Dedham’s Conservation Division administers the state Wetlands Protection Act and local wetlands and stormwater bylaws. The Town lists site-plan, stormwater, and wetlands permits among its municipal permitting information. Ask whether the lot or proposed work is near a wetland resource area or buffer, whether an order of conditions or stormwater permit applies, and whether drainage easements, inspection obligations, operation-and-maintenance plans, or conservation conditions bind the owner.

These checks matter even when the house is complete. A future deck, pool, addition, shed, driveway expansion, grading change, or increase in impervious area may require review or may be restricted. Obtain the relevant plans, permits, orders, and recorded conditions instead of relying on a statement that the lot is “new” or “already approved.”

6. Calculate taxes, utilities, and insurance for the exact address

Ownership cost is more than the contract price. Verify the parcel’s assessment, current tax bill, utility arrangements, municipal charges, insurance availability, and any flood-related requirement before your financing and contingency deadlines expire.

Use the assessor’s parcel record, not a listing estimate

Dedham’s Assessors’ office provides property searches by address, owner, map/block, or parcel ID, along with assessor maps and GIS resources. The Town publishes a residential tax rate of $12.30 per $1,000 of assessed value for FY2026. Rates are updated each December, and the first two quarterly bills in a fiscal year are preliminary. The published rate is not a forecast of a particular home’s bill.

Cost item What to obtain before closing Question to resolve
Real-estate tax Current assessed value, tax bill, fiscal-year rate, and any pending reassessment information How will the bill and any adjustment be calculated at settlement?
Water and sewer Service confirmation, account status, meter information, and outstanding charges Are there betterments, liens, connection fees, or balances to be paid?
Private utilities Well, septic, propane, oil, solar, or other equipment records where applicable Who owns, services, leases, or removes the equipment?
Association charges Current fee, budget, assessments, and insurance information What recurring and one-time charges transfer to the buyer?
Homeowners insurance Quote based on the exact address, replacement cost, construction details, and systems Are exclusions, deductibles, or required inspections acceptable to the lender?
Flood coverage Insurer and lender determination for the parcel Is flood insurance required, recommended, available, and affordable?

Massachusetts closing materials address water, sewer, and tax adjustments, municipal lien certificates, and insurance; see Closing and Settlement. Ask an insurer for a quote using the exact address and construction details. The state material identifies flood insurance as a possible closing issue, but it does not determine the flood hazard of a particular Dedham property; obtain the parcel-specific answer from the insurer and lender.

7. Compare two new homes or offers with the same evidence

When you are choosing between properties, score each one from documents rather than from finishes or a builder’s timetable. Use the same questions and request the same records for every address.

Decision axis Evidence to compare Why it can change the decision
Contract certainty Completeness of plans and specifications, allowances, change-order controls, completion terms, and remedies Unclear scope can turn a lower price into expensive upgrades or delay.
Construction and occupancy Permit history, inspection entries, unresolved corrections, final inspection, and certificate of occupancy One home may be legally occupiable while another still depends on approvals.
Warranty strength Covered systems and structure, term, exclusions, claim procedure, and responsible party Coverage varies; a “one-year warranty” label alone is not enough.
Title and parcel risk Deed, survey, easements, restrictions, access, liens, municipal charges, and association documents Recorded obligations can limit use or create continuing costs.
Site constraints Zoning, wetlands, stormwater approvals, drainage conditions, and future-work limits A finished house may not be readily expandable or regraded.
Total ownership cost Assessed taxes, utilities, association fees, insurance, and possible flood coverage Recurring costs affect affordability after the introductory purchase decision.

Mark an item “not established” until you have an address-specific document or written response. Do not award a home a clean score merely because a record was not supplied.

8. Use a closing-readiness sequence

Before making an offer

  • Obtain the draft agreement, plans, lot plan or survey, specifications, allowances, selection forms, proposed warranty, and completion terms.
  • Ask for permission and timing for independent inspections and construction access.
  • Have your Massachusetts attorney identify contingencies, title protections, occupancy conditions, and remedies before you become bound.

After signing and during construction

  • Track signed changes, selections, invoices, credits, and schedule updates in one file.
  • Request Dedham permit and inspection records and follow up on open items, including electrical, plumbing, and gas work where applicable.
  • Order the independent inspection at a stage that allows defects to be seen and corrected, and obtain specialist reports when recommended.
  • Have title and survey professionals review easements, restrictions, liens, municipal charges, boundaries, and association documents.
  • Ask Dedham offices about zoning, wetlands, stormwater, drainage, and approvals that could affect future work.

Before the final walkthrough and closing

  • Confirm the final inspection status and certificate of occupancy for the correct address and use.
  • Recheck completed repairs against the written punch list and preserve evidence of any remaining obligation.
  • Review the final settlement figures, tax and utility adjustments, municipal lien information, insurance binder, and association charges.
  • Verify that the delivered home, site work, equipment, and included property match the signed plans, specifications, and change orders.
  • Keep the contract, plans, permits, inspection reports, title documents, warranty, and correspondence for future claims and maintenance.

The decision is ready only when the legal deal, municipal approvals, physical condition, title, site constraints, and ownership costs all make sense for this particular Dedham parcel. A newly built label reduces the age of the structure; it does not replace buyer due diligence.
