What to Check Before Buying a Newly Built Home in a Changing Construction Market

Before committing to a newly built home, verify the builder, contract, deposit rules, financing, insurance and warranty; hire an independent inspector; and preserve a written record from the first walkthrough through every warranty claim. A new home can still have defects, delayed completion, exclusions and significant hazard or insurance costs. The exact rights, registries, inspection qualifications and warranty scheme depend on the property’s jurisdiction.

Start with this due-diligence checklist

Work through these checks before signing, and update them again before closing:

As an Amazon Associate I earn from qualifying purchases.

  • Identify the government regulator, builder registry and warranty administrator for the property’s location.
  • Confirm the builder’s licence or registration, past projects, regulatory history and after-sale service record.
  • Read every page of the purchase agreement, amendment and disclosure statement with a locally qualified real-estate lawyer or conveyancing professional where appropriate.
  • Ask in writing when the builder’s deposit is refundable, where it is held and what protection applies if construction is delayed or cancelled.
  • Compare the builder’s affiliated lender with independent loan offers using total costs, not just a headline rate or incentive.
  • Obtain property-specific homeowners, flood and other insurance estimates before your commitment becomes non-refundable.
  • Arrange an independent inspection and establish what access is allowed during construction and before closing.
  • Walk through with utilities operating, photograph every defect and record the builder’s promised repairs and dates.
  • Obtain the actual written warranty, its exclusions, deadlines and dispute process; calendar every claim deadline.
  • Keep a complete closing file and submit defects in the form and within the time required by the warranty.

These steps apply broadly, but local law controls the legal result. A protection available in Ontario, Alberta or Miami-Dade County may not exist in another state, province or country.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Is the builder licensed and dependable in this jurisdiction?

Find the authority that licenses builders or administers new-home protections where the property is located. Do not rely solely on a sales representative’s statement that the company is “approved.” Verify the record yourself and save a dated copy or screenshot.

What an official record can show

Ontario’s public Ontario Builder Directory allows buyers to check HCRA licensing and review information such as experience, homes built, regulatory actions and home-warranty details. Alberta’s builder registry includes licence status, warranty provider and homes built since 2014. These are examples of local systems, not a universal North American standard. If your jurisdiction has no public registry, ask the relevant licensing authority how to verify standing.

  • Check that the legal entity on the registry matches the entity named in your contract.
  • Look for restrictions, disciplinary actions, unresolved orders or a gap between the salesperson’s brand and the licensed builder.
  • Ask who will perform after-sale service, how requests are logged and the typical response process.
  • Speak with owners of earlier homes when feasible. Ask how defects were handled, whether promised dates changed and whether communication continued after closing.

A clean registry entry does not guarantee workmanship or financial strength. Treat it as one verification, then assess the contract, inspection evidence and warranty provider separately.

What does the purchase agreement say about price, deposits and delays?

Read the complete agreement and every amendment before signing. A locally qualified lawyer should review unfamiliar clauses, particularly for an unfinished home or a condominium. Alberta guidance describes the purchase agreement as setting terms such as deposit, price and applicable taxes; Ontario guidance directs buyers to examine closing dates, delays and deposit protection.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Confirm the property and everything included

  • Legal description, lot or unit number, floor area and parking or storage rights.
  • Included appliances, fixtures, landscaping, window coverings, energy equipment and finishes.
  • Upgrade selections, allowances, model-home representations and the procedure for approving substitutions.
  • Purchase price, taxes, development or connection charges, adjustment clauses and the amount due at each stage.

Understand the deposit before transferring money

For a home that has not yet been built, ask the builder in writing under what conditions an upfront deposit can be returned. Do not assume that “deposit,” “reservation fee” or “pre-construction payment” is refundable, held in trust or protected if the project changes. Identify the refund trigger, release process, escrow or trust arrangements, interest treatment and what happens if your mortgage is declined or the builder cannot complete the home. The contract and local rules determine the answer.

Pin down completion, occupancy and delay remedies

Check the firm closing or occupancy date, permitted extension periods, notice requirements, compensation, cancellation rights and what happens if permits, materials or utilities are late. Determine whether the builder can make unilateral changes, substitute materials or extend the date for broad causes. A marketing estimate is not the same as a contractual date.

Check inspection, termination and dispute clauses

Look for your right to inspect, the deadline for raising objections, available remedies, termination conditions, mediation or arbitration requirements and the law governing the contract. An inspection contingency may allow cancellation after an unsatisfactory report, but only where the contract provides that right; local law may alter it.

How should you compare the builder’s lender and other financing?

Builders often offer an affiliated lender, rate incentive or closing credit. CFPB guidance states that buyers do not have to use the builder’s associated lender. Request competing written offers and compare the complete cost over the period you expect to hold the loan.

Compare Questions to ask
Interest rate Is it fixed or variable, and for how long? What happens when a promotional period ends?
Fees and cash due What are origination, appraisal, legal, underwriting, points and lender-credit conditions?
Timing Can the lender close on the builder’s date, and what if construction is delayed?
Loan contingencies What happens if the appraisal is low, your circumstances change or the home is not substantially complete?
Restrictions Are there prepayment penalties, rate-lock fees or mandatory products?

Compare the annual percentage rate or equivalent total-cost measure, required cash, monthly payment, taxes, insurance and association dues. Keep the financing contingency and approval deadline visible in your calendar; an early pre-approval is not a guarantee of final approval on a completed property.

Can you insure the home, and what hazards affect its total cost?

Request an insurance estimate using the actual address, construction type, roof, systems and intended occupancy. CFPB warns that insurance can be difficult to obtain or more expensive in high-risk areas. New construction alone does not prove that coverage will be available or affordable.

Investigate prior damage and local exposure

Ask about prior flood, storm, wildfire, subsidence or other disaster damage and check local records where available. Disclosure rules differ among states and provinces. Repeated storm damage can affect both premiums and future value, even after repairs.

In Miami-Dade County, local guidance tells buyers to obtain flood-zone information from the lender and insurance agent and determine appropriate homeowners, flood, title and other coverage. Treat that as county-specific guidance, not a nationwide legal requirement. In any location, ask the insurer which deductibles, exclusions, elevation certificates, protective devices and rebuilding limits apply.

Budget the complete ownership cost

  • Loan interest and lender charges.
  • Property taxes and any special assessments.
  • Homeowners, flood, title and other required insurance.
  • Condominium or homeowners-association dues and future assessments.
  • Utility connection, meter, septic or well costs.
  • Upgrades, window coverings, landscaping, fencing and post-closing repairs.

The purchase price is only one line in the decision. Obtain written estimates rather than relying on a builder’s allowance or a model-home budget.

When and how should you arrange an independent inspection?

An appraisal estimates value for the lender; it is not a condition inspection. CFPB recommends an independent inspector who is accountable to you. The inspector’s findings may support negotiation or cancellation only if your contract and local law provide that remedy.

Choose someone qualified for the property and jurisdiction

Ask about licence or registration requirements, training, insurance, experience with new construction and references. CFPB notes that inspectors are not licensed in some areas and suggests checking state or county records. Alberta requires inspector licensing. Confirm what the inspection includes and excludes, and whether specialist reviews are needed for structure, drainage, septic, wells, chimneys, pools or environmental hazards.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Arrange access before work is concealed

Ask whether the builder permits independent visits at framing, mechanical, insulation or pre-drywall stages. Put any agreed access, notice period and response process in writing. The available sources support independent and pre-closing inspection, but they do not establish a universal right to enter during construction. Never enter an active site without the builder’s authorization and required safety arrangements.

Use the final walkthrough as a functional test

Schedule it early enough to preserve contractual options and after utilities are on. Miami-Dade County’s checklist provides a useful local example. Adapt it to your climate, building type and code:

  • Run every faucet, shower, toilet and drain; look below sinks and around water heaters for leaks.
  • Check roof tiles, visible flashing and ceilings for leaks or staining.
  • Operate heating, cooling, ventilation and thermostats through their normal modes.
  • Test supplied appliances, outlets, switches, lights, smoke alarms and other fixtures.
  • Inspect grading, drainage and areas where water ponds after rain.
  • Open and close cabinetry, doors and windows; note alignment, damage, caulking and finish defects.
  • Look at attic insulation, access panels and visible ductwork.
  • Compare rooms, dimensions, finishes and equipment with approved plans and the signed specification.

Photograph each item with the date, room and identifying detail. Keep the signed inspection report, a numbered punch list and the builder’s written response. Do not treat a builder’s own quality check as a substitute for an independent inspection.

What does the written warranty actually cover?

Obtain the warranty certificate and full terms before closing. Identify the provider, start date, covered defect definition, component periods, exclusions, claim method, deadlines, repair standard and dispute route. A warranty’s name or brochure is not enough.

Illustrative U.S. coverage patterns

FTC consumer guidance describes general patterns, not guaranteed terms for an individual home:

Item Pattern described by FTC Qualification
Workmanship and materials Often expires after one year Actual duration and covered defects depend on the written warranty.
Heating, cooling, plumbing and electrical systems Generally two years Component exclusions and definitions vary.
Major structural defects Some builders offer up to ten years “Some” is not a promise that your home has ten-year coverage.

Many builder warranties exclude consequential costs such as temporary accommodation during repairs. Appliances and other products may be covered only by their manufacturers’ warranties. Read who pays for removal, access, permits, matching finishes and consequential damage.

Do not confuse a builder warranty with a service contract

A paid home-service contract costs extra and is not the same as a builder warranty. Compare its exclusions, service-call charges, contractor-selection rules and claim process with coverage already included in the purchase.

Jurisdiction-specific programs need separate verification

Ontario’s HCRA states that Tarion oversees the province’s new-home warranty program and that enrolled homes have coverage for defects in work and materials and major structural defects for up to seven years. Confirm that the particular home is enrolled and review current terms; Ontario’s program does not establish the warranty rights for a home elsewhere.

Report defects exactly as required

Submit each claim in the form and by the deadline stated in the warranty. Describe the location, symptom, date discovered and requested remedy; attach photographs and relevant reports. Keep emails, letters, portal confirmations, call notes and proof of delivery. FTC and Miami-Dade guidance both emphasize written notice and retaining correspondence and technical records.

What documents should be in your closing file?

Request final, signed copies rather than relying on a model-home brochure or an oral promise. The exact package varies by jurisdiction and property:

  • Purchase agreement, amendments, specification sheet and change orders.
  • Deposit receipts, financing disclosures and final settlement statement.
  • Warranty certificate, full terms, provider contact and claim instructions.
  • Approved plans, permits or occupancy documentation where available.
  • Survey, grading, drainage, utility, well or septic information where relevant.
  • Insurance policies, binders, flood-zone information and required certificates.
  • Appliance, equipment, roof and manufacturer warranty records.
  • Condominium or association declaration, bylaws, budget, rules and contact details.
  • Contractor and subcontractor contacts, inspection report, photographs and completed punch list.

Miami-Dade examples include contractor contacts, approved plans, survey, flood-zone information, product approvals, roof-insulation certification and association documents. Verify which items exist and are applicable locally; do not assume a county checklist is mandatory where you live.

What should you do during the first year?

Create a dated defect log immediately after possession. Photograph changes, keep copies of every submission and record the builder’s response, inspection date and promised completion date. Calendar both builder-warranty deadlines and manufacturer-registration deadlines. Send reminders before a deadline rather than assuming an earlier conversation preserved your rights.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If a repair is urgent, take reasonable steps to prevent further damage while documenting the condition and notifying the responsible party. Before authorizing major work yourself, check whether the warranty requires the builder to inspect or approve it; otherwise you could complicate a claim.

How should you compare two new-build homes or builders?

Use the same written questions for each option. A lower advertised price can be outweighed by a larger deposit, weaker delay remedy, expensive insurance or excluded upgrades.

Decision axis Record for each option
All-in price Base price, included upgrades, taxes, adjustments and expected post-closing work.
Deposit protection Amount, holder, refund triggers and protection if the project is delayed or cancelled.
Contract flexibility Completion dates, extension rights, substitutions, termination and dispute remedies.
Builder record Licence, regulatory history, earlier homes, references and after-sale process.
Inspection access Permitted stages, independent inspector qualifications and response to defects.
Warranty Provider, periods, structural coverage, exclusions, deadlines and dispute route.
Financing Rate, APR or equivalent total cost, fees, incentives, lock period and delay handling.
Insurance and hazards Availability, premiums, deductibles, flood or disaster exposure and rebuilding limits.
Association obligations Dues, bylaws, reserve position, assessments, common-property responsibilities and future phases.

Score only documented terms. Mark an item “not established” until the builder, lender, insurer or regulator provides a written answer.

Red flags that justify slowing down

  • Pressure to sign before you receive the full agreement or warranty.
  • A deposit described as non-refundable without a clear explanation of the applicable protection.
  • Refusal to identify the legal builder, warranty provider or lender compensation and fees.
  • Promises made in a showroom that do not appear in the specification or contract.
  • Unexplained substitutions, repeated date changes or reluctance to permit an independent inspection.
  • Insurance quotes unavailable until after signing, or major exclusions discovered late.
  • Requests to report defects only verbally or to waive inspection and warranty rights.

A red flag is a reason to obtain advice and documentation, not proof of misconduct. If a material answer remains unresolved, do not let a promotional deadline replace your due diligence.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How the “changing construction market” affects your decision

The available official guidance does not establish a single national trend in prices, construction costs, incentives, supply or builder solvency. Market conditions can change, but a buyer should not assume that a new home is cheaper, safer or easier to insure because it is newly built. Focus on property-specific evidence: the enforceable completion date, deposit protection, builder standing, inspection results, warranty terms, financing and insurance.

Builder records, warranty status, local legal rights, inspection rules, insurance eligibility and lender offers can change. Re-check the relevant regulator, warranty administrator, contract, lender and insurer for the specific home before signing and again before closing.

Product prices and availability are accurate as of the date/time indicated and are subject to change. Any price and availability information displayed on Amazon at the time of purchase will apply.
