What to ask your contractor before building near a highway construction zone

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before you sign a building contract near an active highway work zone, make the contractor explain— in writing—how traffic, deliveries, pedestrians, workers, excavation and utilities will be controlled. The most important questions are who controls public traffic, who controls vehicle routes inside the site, how exposed workers will be visible, how underground lines will be located, and which parcel-specific approvals are required.

Highway projects create hazards both inside and outside the marked work area. OSHA identifies falls, electrical contact, struck-by incidents and caught-between incidents, including exposure to passing traffic and construction vehicles. A contractor who cannot describe the controls, responsible people and timing for each risk is not ready to mobilize.

Start with a written work-zone and site-safety plan

Ask the contractor to bring a site-specific plan to your first serious meeting, not a generic safety policy. It should show the highway, project limits, driveways, staging areas, excavation, pedestrian paths, delivery points and emergency access. Ask how the plan will be reviewed when lane shifts, excavation limits, weather or neighboring construction changes.

OSHA’s construction guidance recognizes that work-zone employees can be exposed to traffic from the highway and to vehicles moving within the project. The plan therefore needs two linked parts: temporary traffic control for the public and internal traffic management for the jobsite.

Who controls each route?

  • Ask which public authority approves and maintains temporary traffic control for motorists and pedestrians. OSHA says the authority in charge determines that public configuration.
  • Ask which project manager establishes internal routes for dump trucks, cranes, concrete trucks, employee vehicles and visitors. OSHA assigns internal worksite vehicle-route decisions to the construction project manager.
  • Request a drawing showing where public traffic ends and controlled site traffic begins, including gates, spotter positions and no-go zones.

What should the plan contain?

  • Locations of barriers, cones, drums, signs, flaggers and temporary signals.
  • Delivery windows, truck queuing space and a way to prevent vehicles from backing into live traffic or pedestrian paths.
  • Separate routes or physical barriers for workers on foot and moving equipment.
  • Lighting, visibility and inspection responsibilities for each shift and after storms or impacts.
  • A contact name and phone number for reporting a damaged barrier, blocked sidewalk or unsafe lane condition.

Questions about deliveries, access and public traffic

Highway work can make a normal driveway unusable without warning. Have the contractor walk through every movement a project requires, from the first excavator arriving to the last waste truck leaving.

Ask these access questions

  1. Where will construction vehicles enter and leave, and does that point require a highway-access or right-of-way approval?
  2. How will a driver see approaching traffic before crossing a sidewalk, shoulder or lane?
  3. Who schedules deliveries so trucks do not queue on the highway or block emergency access?
  4. Who supplies and positions flaggers, and what qualifications or communication method will they use?
  5. How will pedestrians, cyclists, school routes and neighbors be routed around the entrance?
  6. What happens if the road authority changes the work-zone layout or closes the planned entrance?

Ask for a contingency route and the cost and schedule effect of using it. “We will coordinate with the road project” is not a control by itself; the contract should identify who makes the call, who pays for traffic-control changes and how quickly the site can be secured.

Worker visibility and protection from traffic

Ask which employees, subcontractors and delivery personnel could be exposed to roadway or construction traffic. The contractor should explain the visibility garments, barriers, lighting, training and supervision used for each exposure, and show where those controls appear in the written job-safety plan.

OSHA discusses high-visibility garments for workers exposed to roadway and construction traffic, including performance Class 2 or Class 3 clothing for applicable traffic-control work. A commonly specified item is an ANSI Class 2 high-visibility safety vest, but the contractor—not the homeowner—should select, provide and maintain the protective equipment appropriate to the task and conditions.

Clarify the visibility system

  • Which workers must wear high-visibility garments, and when does that requirement start and end?
  • How will garments remain visible in rain, dust, darkness and glare from headlights?
  • Are flaggers, spotters and equipment operators given distinct positions and communication signals?
  • How are workers kept out of blind spots, swing radii and backing paths?
  • Who replaces damaged, dirty or noncompliant garments and checks compliance?

OSHA’s Directorate of Construction interpretation dated August 5, 2009, states: “Road and construction traffic poses an obvious and well-recognized hazard to highway/road construction work zone employees.” Treat that statement as a reason to demand a specific exposure assessment, not as a reason to buy gear yourself.

Underground utilities and excavation sequencing

Before any digging, ask who contacts each utility company or installation owner, when locating will occur and how marks will be protected as work progresses. OSHA says utility companies or owners should be contacted before actual excavation. The property owner is not necessarily the utility owner, so a title search or a visible meter does not replace utility locating.

Require a locate-and-dig sequence

  1. Identify every known and suspected utility, including lines serving neighboring parcels or the highway.
  2. Confirm which utility companies or installation owners have been contacted and record the ticket or reference numbers.
  3. Wait for marks and records before excavation begins; ask what happens when a utility does not respond.
  4. Expose critical crossings using the method required by the utility owner or local authority before using mechanical excavation nearby.
  5. Set a tolerance or hand-dig zone around marked lines and define who may authorize work inside it.
  6. Recheck marks after rain, grading, relocation or damage, and stop work when an unknown line is found.

Ask about protection during the build

  • How will marks, warning signs and exposed utilities be supported and protected from equipment?
  • Who verifies utility depth and alignment where highway widening or drainage work may have altered them?
  • How will the excavation be shored, sloped or otherwise protected, and who inspects it after changes?
  • What is the stop-work and emergency-notification procedure for a strike, odor, arcing, flooding or loss of service?

Have the contractor put the locate responsibility and delay responsibility in the contract. “The owner will call 811” (or a local equivalent) is incomplete unless the agreement also states who coordinates utility owners, verifies marks and pays for redesign when records are wrong.

Site-specific hazards to review together

Ask the contractor to identify hazards by activity and location rather than handing you a broad list. The review should cover traffic exposure, construction vehicles, equipment movement, excavation, access and changing conditions.

Exposure Questions for the contractor Evidence to request
Passing highway traffic Which tasks occur within the road user’s sightline or recovery area? What separates people from vehicles? Traffic-control drawing, barrier layout, inspection log and responsible authority.
Internal vehicles and equipment Where do trucks, loaders and cranes travel, turn and back? How are pedestrians separated? Internal route map, spotter rules, speed limits and radio or hand-signal protocol.
Excavation What are the soil, water, surcharge and utility conditions? Who inspects after rain or a change in geometry? Excavation protection method, inspection record and stop-work criteria.
Deliveries and access How are trucks staged without blocking the highway, sidewalk or emergency route? Delivery schedule, gate plan, alternate access and contact list.
Changing conditions What triggers a new briefing or revised control when the road project shifts? Daily briefing process, change log and approval authority.

Ask to attend a preconstruction walk-through with the superintendent. Stand where a driver, pedestrian and worker would stand; sight lines and blind spots are easier to identify on the ground than on a plan.

Permits, setbacks and highway approvals

No universal answer exists for the approvals on a particular parcel. Requirements depend on the jurisdiction, road classification, project design and the highway authority’s right-of-way limits. Confirm them directly with the local building department and the relevant road or highway authority.

Ask the contractor to identify, not assume, these approvals

  • Building, grading, demolition and excavation permits.
  • Driveway, curb-cut, access or work-in-right-of-way permits.
  • Setbacks from the highway right-of-way, drainage facilities, ramps, bridges or sight-triangle areas.
  • Temporary lane, shoulder, sidewalk or pedestrian-route closures.
  • Utility relocation, protection or crossing approvals.
  • Stormwater, dewatering, erosion-control or dust-control requirements.
  • Noise, work-hour, trucking-route or oversize-load restrictions.

Request permit numbers, issuing agencies, expiration dates and the person responsible for each condition. Ask whether a permit belongs to the owner, the contractor or a separate utility or roadwork project. Do not let a contractor’s statement that “the highway project has approval” substitute for parcel-specific confirmation.

Compare contractor proposals on the controls, not just the price

If contractors offer different site layouts, schedules or access plans, compare them against the same safety and approval criteria. A cheaper plan that depends on an unconfirmed driveway or leaves workers mixed with delivery traffic can create delay and redesign costs.

Excavation sequence Utility locating completed before digging, with protection and recheck steps. Utility-owner procedures and excavation rules.
Approvals A permit register tied to the proposed layout and schedule. Parcel setbacks, right-of-way limits and restrictions.

Contract terms that prevent responsibility gaps

Put the agreed controls in the contract and exhibits. Include the traffic-control drawing, internal route map, utility-locate procedure, permit register, emergency contacts and change-order rules.

Clauses worth discussing

  • Named safety and traffic-control contacts available during working hours.
  • Who supplies, installs, inspects, repairs and removes signs, barriers, lighting and pedestrian protection.
  • Who obtains each permit and what happens if an authority changes a condition.
  • Required pretask briefings and documentation of worker visibility and traffic-control checks.
  • Stop-work authority for an unlocated utility, damaged barrier, unsafe excavation or uncontrolled vehicle movement.
  • Notice periods and cost allocation for redesign, delay, standby time or an alternate access route.
  • Notification procedures for incidents, near misses, utility strikes and complaints from the road authority.

Have the contractor explain insurance and indemnity terms separately from operational controls. Insurance does not make an unsafe route acceptable and does not replace a permit.

Red flags before you authorize mobilization

  • The contractor says the road authority’s plan is “someone else’s problem” without naming the responsible authority.
  • No drawing shows how trucks enter, turn, queue and leave.
  • Utility locating is assigned vaguely to “the owner” with no utility-owner contacts or timing.
  • Workers are expected to watch traffic rather than be protected by a designed control.
  • There is no process for changing the plan when the highway work zone moves.
  • Permit, setback or right-of-way questions are answered with a guess instead of an agency confirmation.
  • The contractor cannot state who may stop work or who inspects controls each shift.

A practical meeting checklist

  1. Send the contractor the current highway work-zone map, parcel survey and proposed site plan before the meeting.
  2. Ask for the written traffic-control and internal-route plans, then mark every crossing and shared space.
  3. Walk the access points and identify pedestrian, worker and equipment conflicts.
  4. Review worker-visibility measures and confirm the contractor provides appropriate PPE.
  5. Document utility contacts, locate dates, tolerance zones and excavation protection.
  6. List every permit and approval, the issuing agency and the responsible applicant.
  7. Agree on emergency contacts, stop-work triggers and change-notification times.
  8. Attach the final plans and responsibilities to the contract before scheduling excavation or major deliveries.

What the available safety guidance can—and cannot—tell you

OSHA provides federal workplace-safety guidance, but State Plans may impose different or more stringent standards. Confirm which state and local rules apply to the project. OSHA guidance also cannot determine your parcel’s zoning, setbacks, highway-access permission or road-authority conditions; only the applicable agencies can do that.

NIOSH Publication 2001-128, as attributed on OSHA’s construction motor-vehicle page, estimated that more than 100 highway and street construction workers were killed and more than 20,000 injured each year. That is a historical estimate from 2001, not a current annual count, but it illustrates why traffic controls and utility planning belong in the contract before work starts.
