Decide only after you identify the approved project, map its schedule to the rooms you will occupy, verify the rules for that address, and obtain a written plan for noise, dust, access, safety and utility interruptions. A site that is tolerable during a quiet foundation phase may be much louder during demolition, excavation or structural work.
The questions below are a location-specific due-diligence checklist. Construction hours, permit records, notice duties, complaint routes and tenant protections vary by city, state or province. Treat every example as an illustration of what to verify, not as a rule that follows you to another address.

First establish what “near construction” means at this address
There are two materially different situations: a separate project next door or across the street, and renovation inside the building you would occupy. The first mainly affects your windows, light, access, noise, vibration, dust and the condition of your property. The second can also affect hallways, fire exits, elevators, water, electricity, heating, ventilation, pests and the safety of other occupants. Ask different questions for each situation.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsIdentify the governing jurisdiction
Write down the complete address, including the municipality and, where relevant, borough, county or district. Find the local permit and inspection portal, planning or zoning application records, construction-hours rules, noise and dust complaint procedure, and building-safety contact. A rule from another city is not evidence of your rights at this address.

Ask who is responsible for answers
For a rental, ask the landlord or property manager to identify the building owner, construction contact and person who handles urgent complaints. For a purchase, ask the seller, listing representative, inspector and local authority which documents they can provide. Record names, phone numbers, email addresses and the date each answer was given.
1. What exactly is being built, demolished, excavated or renovated?
“Construction next door” is not a sufficient description. A small interior fit-out, a high-rise excavation and a demolition followed by months of deliveries create very different conditions. Request the permit or planning application and the approved scope before signing a lease or purchase agreement.
Documents and facts to request
- Permit numbers, application numbers and the issuing department.
- The approved description of work, drawings or site plan that can be released to the public.
- Whether the work is demolition, excavation, piling, structural alteration, utility installation, façade work, interior renovation or new construction.
- Estimated start and finish dates, major stages and whether later phases are planned.
- The general contractor, subcontractors with a site presence and the on-site manager’s contact details.
- Any approval for night, weekend or holiday work, lane closures, sidewalk closures, crane operations or temporary utility shutdowns.
Compare the paperwork with what you can see from the apartment and public areas. New excavation, additional floors, a crane or work outside the approved description warrants a follow-up with the permit office. New York City advises prospective tenants to review a building’s history, violations and permits. Philadelphia likewise advises checking that permits are posted and that the approved work description matches work underway.

Repair common Windows errors and clear accumulated junk for a smoother, more stable PC - no reinstall needed.Free scan · no reinstallAsk about the project’s sequence, not only its end date
A stated completion date can conceal the loudest stages. Ask when demolition, rock breaking, excavation, foundation work, concrete pours, steel erection, façade work, interior fit-out and landscaping are expected. Ask which phases are intermittent and which will run continuously. If the developer has no reliable schedule, treat the uncertainty as a cost to your quality of life or a reason to negotiate a shorter commitment.
2. When will work happen, including deliveries and after-hours tasks?
Ask for the normal start and finish time for each phase, not a single broad “working hours” statement. Include truck arrivals, reversing alarms, concrete deliveries, crane setup, waste removal, security patrols, generator use and cleaning. These activities may begin before the most visible work.
Questions about the schedule
- What time do workers and delivery vehicles typically arrive and leave?
- Which days are scheduled for noisy work?
- Are Saturday, Sunday, holiday or overnight operations expected?
- What events can trigger an after-hours request, and who authorizes it?
- How much notice is given when the schedule changes?
- Are there planned road, sidewalk, parking or loading restrictions?
Do not treat statutory hours as a promise of quiet. Victoria’s environmental regulator states that noise during normal hours can still be unreasonable, depending on its duration and circumstances. In New York City, general construction hours are 7 a.m. to 6 p.m. on weekdays; work at other times, including weekends, requires authorization. Those hours apply to New York City only. Ask the local authority for the current rule and its exceptions.

Observe more than one time of day
Visit the apartment during the morning arrival period, the middle of the day, late afternoon and an evening when the site is supposed to be inactive. Keep windows closed and open during separate visits. Listen in bedrooms, living areas, balconies and any room used for remote work. A single quiet inspection cannot reveal an intermittent delivery pattern.
3. What noise, vibration, dust and traffic will reach this unit?
Construction disturbance is not uniform. It can be short-term, long-term or intermittent. Potential sources include power tools, machinery, heavy vehicles, generators, radios, voices and movement of materials. These categories describe possible sources; they do not predict the actual exposure in your apartment.
Map the apartment’s exposure
- Which side of the building faces the site?
- Which bedrooms, living rooms, balconies and workspaces face it?
- How far are windows, vents and balconies from the work?
- Can windows be opened without facing the site directly?
- Is there another building, courtyard or street between the unit and the project?
- Will trucks queue on the same street, and will engines idle below the windows?
- Could vibration travel through the structure or affect delicate items?
Ask the contractor or manager to identify expected high-noise activities and the controls planned for each: barriers, enclosure, equipment placement, delivery routing, dust suppression, covered loads, wheel washing, street cleaning or restricted idling. Ask how complaints are logged and how quickly someone responds.
Use your own sensitivity as a decision factor
If you sleep during the day, work from home, record audio, care for an infant, have a migraine condition or depend on open windows for cooling, ordinary daytime disturbance may be unacceptable even when the site follows its permit. State those needs before comparing apartments. A unit with a quiet interior bedroom may suit you better than a larger unit whose only sleeping room faces the site.
4. What protections apply when work is inside an occupied building?
Renovation in your building requires a separate safety discussion. Request the applicable tenant-protection, occupant-protection or site-safety plan before moving in. The legal name and scope differ by jurisdiction.
Topics a protection plan should address
- Maintained exits, evacuation routes and fire-safety systems.
- Separation of occupied areas from dust, debris and work zones.
- Pest prevention and treatment during demolition or opening of walls.
- Accessible sanitary facilities.
- Lead, asbestos and other hazardous-material compliance where applicable.
- Structural monitoring and protection of occupied floors.
- Noise controls, permitted hours and advance notice of especially disruptive work.
- Essential utilities, including water, electricity, heat, cooling, elevators and ventilation.
New York City’s Tenant Protection Plan is a local example. For work in an occupied building, it addresses exits and fire safety, dust and debris, pests, sanitary facilities, lead and asbestos compliance, structural safety, noise measures and hours, and essential services. It is not a universal requirement. Ask the authority in your jurisdiction whether an equivalent plan applies.

Get an interruption plan in writing
Ask which services may be interrupted, the expected duration, the notice period and the alternative arrangement. Examples include temporary restroom access, a relocated entrance, a scheduled elevator shutdown, bottled water, temporary heating or cooling, or a hotel arrangement. Do not assume a promise to “minimize disruption” answers these questions. Ask what happens if the outage lasts longer than stated and whom you contact outside business hours.
5. How will the adjacent property be protected?
Excavation, underpinning, demolition and structural work can create risks for neighboring buildings and property. Ask what safeguards are planned, how monitoring is performed and who receives an urgent report.
Questions for a neighboring tenant or buyer
- Will the project require shoring, underpinning, blasting, deep excavation or work below the neighboring foundation?
- Are vibration, settlement, dust or water-intrusion monitors planned?
- Who inspects and records the condition of the neighboring building before work?
- How are cracks, leaks, broken windows or damaged finishes reported?
- What insurer, owner or contractor contact handles a damage claim?
Philadelphia advises documenting existing conditions with timestamped photographs and provides advance information for some qualifying adjacent work. That guidance does not create a universal notice, compensation or inspection right elsewhere. For a rental, ask the owner or manager how your concerns will be recorded. For a purchase, ask your inspector and the local authority what property-specific records or protections are available.

Create your own condition record
Before moving in or removing purchase contingencies, photograph ceilings, walls, floors, windows, doors, balconies and visible utility areas. Include a timestamp and a wide view that shows the room, followed by close-ups of existing marks. Send the inventory to the landlord or retain it with your transaction file. If new damage appears, photograph it promptly, note the date and time, describe what was happening at the site, and report it through the documented channel.
6. Where do you verify rules and report problems?
Save the official contact routes before signing. A landlord’s phone number is not a substitute for the municipal agency that controls permits, inspections or noise enforcement.
Build an address-specific contact sheet
- Search the municipality’s permit and inspection portal using the project address and, if different, your building address.
- Review planning, zoning and development applications for approved use, height, demolition or excavation.
- Confirm construction hours, after-hours authorization and any special restrictions.
- Find the noise, dust, vibration and traffic complaint route.
- Find the building-safety or emergency contact for unsafe conditions, blocked exits or utility failures.
- Write down the case number, required evidence, response hours and escalation route for each agency.
New York City directs people affected by construction noise to 311. Victoria identifies local council as the complaint authority for residential construction noise. Philadelphia also uses 311 for specified permit and property-protection concerns. These are examples, not a universal process. Confirm the exact agency and current procedure for your address.

Understand what a complaint can and cannot do
An agency may inspect permits, measure noise, order corrective work or refer the matter to another department. It may not provide an immediate remedy, decide a private lease dispute or guarantee compensation. Keep copies of notices, photographs, recordings where lawful, work logs and case numbers. Follow the emergency route for an immediate safety threat rather than waiting for a routine noise response.

Compare two apartments with the same project nearby
Use the same questions for every unit. The following framework is a practical synthesis of the official guidance above, not a published scoring system.

| Cooperation and documentation | Documents and named contact supplied. | Documents and named contact supplied. | Willingness of owner or seller to answer in writing. |
Prefer the apartment with better evidence and a lower-impact orientation, not merely the one that sounds quiet during a short tour. A smaller unit with a rear bedroom, closed windows that still ventilate adequately and a documented utility plan may be more livable than a larger unit facing the work.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.A due-diligence sequence before you commit
- Collect the address and project identity. Obtain the neighboring parcel number if available, the developer or contractor name and the permit or planning application number.
- Read the approved scope. Note demolition, excavation, structural work, height, access arrangements and any stated completion stages.
- Check the project history. Look for active permits, violations, stop-work notices, inspection results and expired or missing permits in the local portal.
- Inspect the unit repeatedly. Visit at different times, listen in every important room and observe deliveries, traffic and windows-open conditions.
- Interview the responsible people. Ask the landlord, seller, manager and site contact the same schedule, controls and interruption questions.
- Request written documents. Save permits, protection plans, schedules, notices and contact details with the lease or purchase file.
- Check the legal route. Confirm local hours, complaint agencies, emergency contacts and any notice or inspection process.
- Make the risk explicit in the transaction. Decide whether you need a shorter lease, a construction disclosure, a repair or access promise, a contingency, or simply a different apartment. Have local counsel review any term that is important to you.
Warning signs that merit a pause
- The visible work does not match the permit description, or no permit can be located where one should exist.
- No one will identify the contractor, site manager or responsible complaint contact.
- Answers about completion are verbal, changing or inconsistent between the owner and the site.
- The unit’s only bedroom or workspace faces demolition, excavation or a delivery entrance.
- There is no plan for blocked exits, dust separation, utility outages or elevator access during interior renovation.
- The seller or landlord refuses a condition record or discourages photographs of existing damage.
- Work repeatedly occurs outside stated hours and there is no clear authorization or reporting route.
- You are told that “construction hours” guarantee quiet, despite no information about machinery, deliveries or intermittent work.
Questions that differ for renters and buyers
If you are renting
- What notice will I receive for disruptive phases, access changes and utility outages?
- Can the lease identify the construction contact and the process for reporting damage or loss of access?
- What happens if the apartment becomes unusable for a period, and which local rules govern that situation?
- Can I inspect the unit again after a major phase begins before committing to a longer term?
- Are promised quiet hours, ventilation, parking or amenities likely to change while work continues?
Do not assume a general habitability statement answers a construction-specific problem. If a term matters, ask for precise wording and obtain local legal advice rather than relying on an informal promise.
If you are buying
- Could future phases affect light, views, parking, access, drainage or resale appeal?
- Have the seller and inspector reviewed permits, violations, notices and neighboring-property records?
- What existing cracks, moisture marks, settlement signs or ventilation issues are documented?
- Are there lender, insurer, condominium or homeowners-association requirements relating to adjacent work?
- Which facts should be addressed in the purchase agreement or disclosure, and what inspection or contingency period remains?
A purchase decision includes conditions after completion. Read the full approved project, not only the current excavation stage, and ask how the finished building could change your light, outlook, traffic and access.
Put local examples in their proper context
New York City
New York City’s general construction schedule allows work from 7 a.m. to 6 p.m. on weekdays, with authorization required at other times, including weekends. The city directs people affected by construction noise to 311. These are city-specific rules and contacts; they do not establish a national standard.

Philadelphia
Philadelphia states that construction noise affecting residences should not exceed five decibels above background from 8 p.m. to 7 a.m. on weekdays and from 8 p.m. to 8 a.m. on weekends, subject to stated exceptions. That is a local limit, not a general measure of safe or typical apartment exposure. Philadelphia also describes permit-posting, property-protection and 311 processes for specified concerns.
Victoria
Victoria’s environmental regulator explains that construction noise during normal hours may still be unreasonable depending on its duration and circumstances, and identifies local council as the complaint authority for residential construction noise. The principle is useful elsewhere, but the agency, hours and legal test must be checked locally.
Separate radon due diligence from construction assumptions
The U.S. Environmental Protection Agency’s real-estate radon resource points buyers and sellers to a home buyer and seller guide revised in March 2024. Radon testing is a separate home due-diligence question; that resource does not establish that a nearby construction project creates a radon risk.
How to decide whether to proceed
There is no universal rule that an apartment beside a new construction site should be avoided. Proceed when you can identify the project, verify its approved scope, understand the loudest phases, observe the unit under realistic conditions, confirm local rules and obtain credible contacts and protection plans. Pause or choose another address when the project is undocumented, the schedule is unknowable, the unit depends on quiet or open windows, or the owner will not provide basic safety and access information.
Make the decision on the evidence for that address and that project. Construction disturbance may be temporary, prolonged or intermittent; only the permit record, site schedule, apartment orientation, local rules and documented protections can tell you which description fits your prospective home.
