If a newly built apartment is unfinished when your lease says you can move in, your options depend on where the property is, whether it is legally occupiable, and whether the problem is a construction delay, a failure to meet rental standards, or a failure to give you possession. There is no universal rule: Minnesota, Victoria in Australia, and Delaware, for example, provide different remedies.
First determine what kind of problem you have
An unfinished apartment can raise different legal issues. A delay in completing new construction may trigger a specific statutory process. A unit that fails legally required rental standards may give you pre-move-in options. If the landlord does not let you take possession at the start of the lease, rules about possession and rent may apply. These categories can overlap, but the available remedies and required procedures depend on local law.

- Construction delay: Ask whether the applicable law specifically covers new construction and requires notice or alternative arrangements.
- Minimum-standard failure: Find out whether the unfinished work means the unit does not meet mandatory rental standards.
- No possession: Confirm whether you can enter and occupy the unit on the lease start date, and what the local law says about rent and termination if you cannot.
Check city or local occupancy requirements as well as state, provincial, or national tenant law. A unit’s appearance alone does not establish whether it may legally be occupied.

| Jurisdiction and issue | What the cited rule or guidance provides | Important limits |
|---|---|---|
| Minnesota: delay to new construction | For a covered construction delay, the landlord must notify affected tenants within seven days after knowing the unit will not be available by the lease move-in date, and before that date. The tenant must be offered a choice of reasonably equivalent landlord-provided temporary housing, payment equivalent to lease rent to help cover tenant-arranged alternative housing, or lease termination with return of rent, deposit, and other amounts paid to enter the lease. Reasonable fees associated with securing alternative housing must also be reimbursed. A tenant who chooses one of the housing options may terminate if the unit is still unavailable 90 days after the original move-in date. | The statute defines “new construction” broadly, including certain rehabilitation, modifications, reconstruction, changes affecting use or occupancy, and additions. The cited statute page is the 2024 published version and is marked historical; check the current statute before relying on it for a present-day legal decision. Minn. Stat. § 504B.153. |
| Victoria, Australia: failure to meet minimum rental standards before move-in | If the agreement is signed but the renter has not moved in and the property fails Victoria’s minimum standards, the renter may end the agreement immediately without fees by notifying the rental provider, or move in and request urgent repairs. | The guidance applies to failure to meet Victoria’s legal minimum standards, not every incomplete feature or construction delay. Consumer Affairs Victoria last updated its guidance on November 24, 2025. Consumer Affairs Victoria: Minimum standards. |
| Delaware: failure to supply possession | If the landlord fails to supply the rental unit and put the tenant in full possession at the start of the term, rent abates while the tenant is unable to enter. After notice, the tenant may terminate while unable to take possession, and the landlord must return money paid for the unit, including prepaid rent, pet deposit, and security deposit. In a narrower circumstance involving wrongful inability to enter because of a substantial building- or housing-code failure, the tenant may recover qualifying substitute-housing expenses up to one month’s rent. | The substitute-housing remedy has specific conditions; the statute also requires code compliance and a unit fit for its expressly rented purpose and not dangerous to health, welfare, or safety. Del. Code tit. 25, § 5304. |
What to do before the lease start date
- Review the lease. Note the exact start date, possession terms, any construction-delay clause, and what the landlord promised would be ready. Keep a complete copy.
- Ask for the facts in writing. Request a list of unfinished work, the expected completion date, confirmation of whether the unit may legally be occupied, and any proposed temporary housing, payment, refund, or termination options.
- Document the condition and your communications. Take dated photos or video if you have access. Save messages and notices, and keep receipts and records for any temporary accommodation costs.
- Check local occupancy and rental requirements. Contact the relevant housing or code authority to ask about required occupancy approvals and standards for the unit.
- Get location-specific advice before acting. Contact a local tenant legal service or housing agency about the applicable notice, deadlines, and procedure.
Before withholding rent, paying for repairs, or ending the lease
Do not assume you may safely withhold rent, arrange and deduct repairs, or terminate without following a local process. The cited examples show that notice requirements, timing, and remedies differ: Minnesota addresses certain construction delays, Victoria describes a choice tied to minimum-standard failures before move-in, and Delaware provides remedies for failure to deliver possession under defined conditions. Check the law for the property’s location and your specific circumstances before choosing a remedy.
