The strongest construction-arbitration claim is a chain of proof: the contract or approved change creates entitlement; a timely notice and response establish the dispute; dated project records show what happened and how it affected the work; and primary financial records support every amount. Invoices, receipts, payroll, equipment logs, schedules, site diaries and a transparent calculation are materially stronger than a claimant’s unsupported summary.
The exact evidentiary test depends on the arbitration seat, governing law, contract, institutional rules and tribunal orders. The checklist below is therefore a disciplined way to build the record, not a jurisdiction-neutral legal test. Philippine Construction Industry Arbitration Commission (CIAC) filing materials and Philippine decisions are used as practical examples; a United States appellate decision illustrates the consequences of inadequate records.

Start with a claim-by-claim evidence chain
Organize evidence around each distinct head of loss rather than submitting a large undifferentiated project file. For every item, a tribunal should be able to follow four links:
- Entitlement: the contract clause, approved variation, instruction, changed condition or other legal basis that permits recovery.
- Notice: the notice given, when and how it was delivered, the response, and any reservation of rights required by the contract or applicable law.
- Causation: the dated event and contemporaneous records showing its effect on the work, resources, time or opportunity.
- Quantum: source documents and a reproducible calculation that produces the amount claimed, less mitigation, credits and amounts already recovered.
Missing one link does not automatically defeat a claim in every jurisdiction, but it gives the opposing party a clear attack. Preserve the original electronic files, metadata where available, and a stable document index so that a witness can identify what each record is and when it was created.

Contract and entitlement records
Executed agreement and incorporated documents
Collect the signed construction contract and every document incorporated into it: general and special conditions, specifications, drawings, schedules, pricing documents, payment provisions, suspension and delay clauses, change-order procedures, notice clauses, and the arbitration agreement. Keep the version that was actually executed, not only a later clean copy.
Also preserve amendments, addenda, approved variations, site instructions, architect or engineer determinations, payment certificates and settlement agreements. A change order can establish both entitlement and valuation; an informal instruction may establish neither unless the contract or governing law gives it effect.
Arbitration and procedural documents
Retain the arbitration clause, any submission agreement, commencement notice, tribunal orders, procedural timetable and directions about evidence. CIAC’s official filing guidance identifies the construction contract, agreement to arbitrate, case narrative, issues and documents establishing the circumstances as request materials. Those items are useful organizational benchmarks, but CIAC requirements apply only when that forum and its current rules govern the case.

Index each notice to the clause it invokes and to the event date. A late notice may affect entitlement, quantum or both, depending on the contract and governing law. Do not assume that a general progress complaint substitutes for a contractual notice; show the language, timing and recipient that matter under the applicable documents.
Contemporaneous records showing what happened on site
Daily and weekly project records
- Daily reports, site diaries and superintendent logs.
- Weekly and monthly progress reports and meeting minutes.
- Baseline, update and look-ahead schedules, preferably in native scheduling format as well as PDF.
- Photographs and video with reliable dates, locations and descriptions.
- Inspection requests, test results, nonconformance reports and approvals.
- Delivery tickets, gate logs, weather records where relevant, and access or possession records.
These records should identify the affected area, activity, responsible party, date and resulting action. A photograph of standing water, for example, becomes more useful when tied to the location, access condition, work item, labor and equipment affected, and the instruction or notice that followed.
Labor, equipment and productivity records
Keep daily man-hour and equipment-hour records by crew, equipment unit, activity and work package. Include timesheets, payroll registers, equipment hire invoices, utilization logs, fuel records and idle-time explanations. Separate productive, standby, rework, remobilization and out-of-sequence hours. A lump sum of “extra labor” without task-level support is difficult to test.

Primary cost documents
For incurred expenditure, assemble invoices, receipts, purchase orders, subcontract agreements, payroll and time records, equipment hire or ownership records, cost-code reports, general-ledger extracts, payment certificates and proof of payment. Link each document to the project activity and the event said to have caused the cost. If an invoice covers several jobs, show the allocation method and retain the underlying timesheets or delivery records.

Where actual cost is unavailable, contemporaneous estimates may be relevant, but label them as estimates and explain why the primary record does not exist. Do not present an estimate as a paid expense. Preserve credits, refunds, back-charges, insurance recoveries and amounts included in another claim.
What the Philippine overhead decision illustrates
In Empire East Land Holdings, Inc. v. Capitol Industrial Construction Groups, Inc., the Philippine Supreme Court discussed an additional-overhead claim supported by the contractor’s own computation but not by actual receipts, invoices, contracts or similar documents. The decision treats the practical problem as proof of actual damages: a calculation must be anchored to evidence of the expense claimed. Its result is jurisdiction-specific, but the recordkeeping lesson is broadly useful.
Proving delay, disruption and extended costs
Establish the event’s effect on the work
Show more than the existence of a delay notice. Identify the affected activity, planned start and finish, actual performance, resources assigned, work that could not proceed, and mitigation attempted. Use schedule updates, critical-path or other appropriate delay analysis, progress photographs, daily reports, labor and equipment records, and correspondence about access or sequencing.
For disruption, describe the changed method or loss of productivity: repeated mobilization, fragmented work fronts, stacking of trades, out-of-sequence installation, waiting time, acceleration or rework. Tie each claimed hour or cost to a task-level record. If the analysis relies on a baseline schedule, explain the update process and any assumptions about logic, calendars, constraints and contemporaneous changes.

Rustler as a cautionary example
In Rustler Construction, Inc. v. District of Columbia (District of Columbia Court of Appeals, 2019), the court described gaps in task-level cost records, reliable actual costs or estimates, and proof of overall critical-path delay. It also noted inadequate detail for additional and out-of-sequence work. The opinion’s concise warning was: “The same flaw—poor record keeping—permeates all of Rustler’s claims.” This United States example is not a rule for every arbitration, but it shows how weak project records can impair both causation and amount.
Records supporting a loss-of-profit claim
Define the profit opportunity
Identify whether the claim concerns expected profit on unperformed contract work, a lost project or opportunity, or another prospective margin. Preserve the tender, bid and estimating files; planned quantities, production rates and resource assumptions; subcontractor quotations; pricing worksheets; overhead allocations; and the anticipated margin or contribution calculation in effect when the opportunity existed.
Connect the alleged breach to the lost result
Document the event that allegedly eliminated or reduced the opportunity, the counterfactual work that would have been performed, and why the loss was not caused by unrelated market, financing, capacity or performance factors. Relevant records may include award or cancellation correspondence, procurement status, capacity plans, customer communications, production records, project financial statements and contemporaneous forecasts.

State the method, period, quantities, prices, variable costs, fixed-cost treatment, probability assumptions, tax treatment where relevant, and discounting or present-value approach if required by the governing law. Identify who prepared each input and what source record supports it. The sources reviewed do not establish one universally accepted lost-profit formula or threshold; the applicable law and tribunal directions control.

Keep loss categories separate and prevent double recovery
Prepare distinct schedules for (1) reimbursable incurred cost, (2) extended or additional overhead, (3) idle or inefficient labor and equipment, (4) acceleration or mitigation expense, and (5) expected profit on unperformed work. Explain whether each amount is an actual outlay, a contribution margin, or a prospective loss. Remove costs already included in a subcontractor claim, change-order valuation, settlement, insurance payment or another head. A profit calculation that also includes the same labor or overhead as reimbursement presents an overlap that the tribunal can deduct.
Use a practical claim schedule
A single index can make the evidentiary chain auditable. This organizational format is a recommendation, not a prescribed CIAC or universal arbitration form.
| Field | What to record |
|---|---|
| Claim or head of loss | Specific item, such as standby crane cost, extended supervision or lost contribution margin. |
| Contractual basis | Clause, approved variation, instruction or legal entitlement. |
| Event date and location | When and where the triggering condition occurred. |
| Notice and response | Notice date, delivery proof, recipient, response and reservation of rights. |
| Contemporaneous references | Daily report, schedule update, photograph, minute, delivery record or other identifier. |
| Work package or cost code | Activity, area, crew, equipment or ledger code to which the item belongs. |
| Amount claimed | Gross amount, credits and net amount, with currency and period. |
| Source documents | Invoice, receipt, payroll, contract, estimate, ledger extract or financial record. |
| Method and inputs | Formula, quantities, rates, assumptions and person responsible for preparation. |
| Mitigation and credits | Avoided cost, reallocation, salvage, insurance, payment or other offset. |
| Witness or expert | Person who created, received or can explain the record and calculation. |
Witness and expert foundations
Identify the people who created or received key records: project managers, quantity surveyors, schedulers, superintendents, commercial managers, payroll staff and finance personnel. A witness should be able to explain the ordinary course of preparation, the meaning of codes and the link between the record and the event.
Experts should trace each opinion and calculation to disclosed source records, state assumptions and distinguish observed facts from estimates. The authorities considered here support a documentary foundation but do not prescribe a universally required witness statement or expert-report format. Follow the tribunal’s procedural order and the governing evidentiary rules.
How to assemble the record before filing
- Freeze and preserve data. Collect native schedule files, accounting exports, email, project-platform records, photographs and mobile-device data. Preserve versions instead of overwriting updates.
- Map the contract. Extract notice periods, pricing rules, recordkeeping duties, causation standards, caps, exclusions and dispute procedures into a clause matrix.
- Build the event chronology. Place instructions, notices, site conditions, schedule updates, mitigation and cost consequences on one dated timeline.
- Code the costs. Reconcile payroll, equipment, procurement and ledger entries to work packages and affected events; investigate unexplained variances.
- Analyze time and productivity. Use the schedule method appropriate to the case and explain critical-path, concurrency, out-of-sequence and mitigation issues rather than asserting delay from calendar slippage alone.
- Calculate each head independently. Show formulas and source references, then run an overlap check across all schedules.
- Test the file with a neutral reader. A person who did not manage the project should be able to locate the entitlement, event, causation record and amount for every line item.
Common weaknesses and practical fixes
- Unsupported summary computation: replace it with invoices, receipts, contracts, payroll, equipment records and a reconciliation to the ledger.
- Notice without proof of impact: add task-level diaries, schedules, resource hours, photographs and a causal narrative tied to the affected work.
- Schedule slippage treated as critical delay: demonstrate the relevant critical-path or other accepted analysis and address concurrency and mitigation.
- Global disruption total: divide the amount by activity, period, crew or equipment and explain the allocation method.
- Estimate presented as actual cost: label its status, disclose assumptions and explain why actual records are unavailable.
- Profit claim with hidden inputs: provide the bid file, production and price assumptions, variable-cost treatment, probability analysis and source for every figure.
- Duplicated recovery: cross-check reimbursement, overhead, idle-resource, acceleration and profit schedules for shared costs.
- Unverified procedural assumption: confirm the current rules, filing forms, notice provisions and tribunal orders for the actual seat and contract.
What to verify for the governing jurisdiction
Before relying on any checklist, confirm the seat and governing law, the arbitration institution or ad hoc rules, the contract’s notice and substantiation clauses, the burden and standard of proof, limitations or caps, and any order governing disclosure or expert evidence. Philippine CIAC examples should not be generalized to a different forum. Likewise, the Rustler decision is an illustration from a United States appellate court, not a universal test for construction claims.
Bottom line
For reimbursement, prove the incurred expense with primary records and trace it to the work and event. For lost profit, prove the opportunity, the causal loss, and every calculation input while separating prospective profit from incurred cost and other heads. The best file lets a tribunal move from clause, to notice, to dated project fact, to source document, to transparent number without relying on an unsupported assertion.
