What happens to a housing project after planning permission is refused?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A refusal does not automatically end a housing project. The decision notice explains why the scheme failed, and those reasons determine whether the sensible next move is a revised application, a formal appeal or review, or a pause while the project is redesigned. The correct route and deadline depend on where the site is in the UK and, in some cases, the application date and type.

Start by securing the full decision notice, checking its date and stated reasons, and identifying the jurisdiction. England, Scotland and Wales use different procedures. Northern Ireland is not covered by the current guidance summarised here, so anyone with a Northern Ireland project should verify the route with the relevant official planning service before acting.

What a refusal actually means for the project

A refusal means the local planning authority has decided that the application, as submitted, should not receive permission. It is not a prohibition on ever developing the site, and it does not by itself cancel land ownership, a development option or unrelated consents. It does mean that the authority cannot issue permission for that particular proposal on that decision.

The written decision is the starting point for every next step. Planning authorities are expected to give clear reasons for refusal. Those reasons may concern the principle of development, housing mix, scale, design, landscape, highways, drainage, ecology, heritage, amenity, flood risk, infrastructure or the evidence supplied. A reason that can be addressed by changing the scheme points towards redesign; a decision that appears inconsistent with the development plan or planning policy may justify an appeal or review.

Do not rely on a case officer’s informal comments as a substitute for the notice. Check the approved drawings, the description of development, conditions or informatives, the date of the decision and the appeal paragraph. Preserve the complete application record, including reports, consultation responses and submitted technical studies, because an adviser will need to compare the evidence with each refusal reason.

The first 48 hours: protect options and establish the facts

  1. Record the jurisdiction. Confirm whether the site is in England, Scotland, Wales or Northern Ireland. Planning procedures are devolved, so a deadline from one nation cannot safely be applied in another.
  2. Diary the decision date. Appeal and review periods normally run from the date shown on the decision notice, not from the date someone on the project reads it.
  3. List every refusal reason. Copy the wording into a working schedule. Add the drawing, report or policy paragraph that the authority relied on, where identified.
  4. Separate fixable and fundamental issues. A changed access arrangement, reduced height, different unit layout or additional survey may be capable of addressing a reason. A conflict with a protected designation or a clear policy objection may require a much more substantial change.
  5. Check parallel commitments. Tell funders, landowners, consultants and contractors that the permission milestone was missed. Review any option, promotion, acquisition, finance or consultant agreement for notice requirements and expiry dates.
  6. Obtain planning advice quickly. A planning consultant or planning-law adviser can test the reasons against the development plan, the evidence and the correct procedural route. Use a professional who is independent of any paid referral arrangement.

Option 1: change the scheme and apply again

A fresh application is usually the route when the refusal reasons can be overcome through design changes, additional information or a different development approach. In England, official procedural guidance says that where an applicant thinks amendments could overcome the reasons for refusal, the applicant should make a new planning application. It also says the local planning authority should be open to discussing whether it is likely to view an amended proposal favourably.

When redesign is a strong candidate

  • The notice identifies measurable problems, such as building height, separation distances, parking layout, access geometry, overlooking or the amount of hardstanding.
  • The authority indicates that a different housing mix, lower density, revised massing or landscape treatment could address the harm.
  • A missing survey or assessment prevented the authority from reaching a positive conclusion and can now be supplied.
  • The project team can make a genuine change rather than simply resubmitting identical drawings.

How to make a resubmission useful

  1. Prepare a refusal-reasons matrix. Put each reason in one row, then state the proposed change, supporting evidence and the drawing or report where the change appears.
  2. Request a focused discussion with the authority. Ask whether the amended principles are likely to be viewed favourably and what information would be needed. Keep a written record of the response; informal advice is not a grant of permission.
  3. Redesign the whole scheme coherently. Fixing one issue can create another. For example, moving blocks to improve neighbours’ privacy can alter trees, drainage, fire access or viability.
  4. Update the evidence. Commission surveys or statements that directly answer the notice. Explain changed assumptions rather than attaching reports without an index.
  5. Submit a clearly labelled new application. Identify the changes in the planning statement so the case officer can see how every refusal reason has been addressed.

A new application starts a new assessment. It does not erase the earlier refusal, and it does not guarantee that the authority will agree with the proposed fixes. The time and cost of redesign depend on the project; no universal rule makes resubmission quicker or cheaper than an appeal.

Option 2: appeal or seek a review

An appeal challenges the refusal through the procedure available in the relevant jurisdiction. It is not a second informal negotiation and it is not a promise that permission will be granted. In England, the Planning Inspectorate’s procedural guidance states: “Making an appeal should not be used as a bargaining tactic but only as a last resort.” That reflects the practical test: appeal when there is a defensible planning case, not simply to gain leverage for concessions.

Questions to answer before choosing an appeal

  • Does the decision conflict with the adopted development plan or relevant planning policy?
  • Did the authority misunderstand a submitted plan, apply the wrong policy test or fail to give a coherent reason?
  • Can the appeal be decided on the existing evidence, or would the project need a fundamentally different design?
  • Is an appeal legally available for this application type?
  • What is the exact deadline, fee, procedure and likely workload?
  • Would a short, documented discussion with the authority reveal an amendment that has a better chance of approval?

Appeal statements should answer the authority’s reasons one by one. They should not merely repeat the original planning statement. Explain the policy balance, identify the evidence supporting each proposition and acknowledge any unavoidable adverse effects with proposed mitigation.

Costs and conduct in England

The GOV.UK overview of planning appeals says either side may apply for costs where it believes the other acted unreasonably. That exposure is separate from the project’s professional fees. A party that pursues an appeal without a properly arguable case, ignores relevant evidence or behaves unreasonably may face a costs application. Obtain advice on the merits and procedure before filing.

For England, the same overview identifies 13 weeks as the decision period after which an applicant can appeal non-determination for major projects, with examples including 10 or more dwellings or more than 1,000 square metres of floor space. That is a threshold for appealing because no decision was made in time; it is not a universal deadline for appealing a refusal.

Nation Route after refusal Time limit or timing point Important qualification
England Appeal to the Planning Inspectorate; alternatively submit a new application where amendments may overcome the reasons. Check the notice and the procedure guide matching the application date. The guide distinguishes applications dated on or before 31 March 2026 from those dated on or after 1 April 2026. The 13-week figure often quoted for major projects concerns non-determination, not the deadline for a refusal appeal.
Scotland A qualifying delegated application for local development may go to the planning authority’s local review body. Other cases may be appealed to Scottish Ministers. Local review: within three months beginning with the decision-notice date. Scottish Ministers appeal guidance also gives a three-month appeal period. The notice should identify the proper route. Fees for this type of appeal were introduced on 9 June 2025; check current fees and exemptions.
Wales Appeal to the Welsh planning appeals system after discussing the decision with the local planning authority. Six months from the date on the decision notice. The Welsh Government says appeals normally receive a decision within 14 weeks, but some take longer. This is an indicative expectation, not a guarantee.
Northern Ireland Not stated here. Not stated here. No current official Northern Ireland route and time limit is stated here. Obtain and check the relevant Northern Ireland official guidance before advising or filing.

England: choosing between a new application and an appeal

England’s procedural guidance is split by application date. Select the guide for applications dated on or before 31 March 2026 or on or after 1 April 2026; do not assume that a form or deadline from one guide applies to the other. The authority’s refusal reasons remain the central evidence in either case.

Prefer a new application when the design needs to change

If the authority’s objections are physical or evidential, a revised scheme can put a materially different proposal before the authority. Examples include reducing the number of homes, changing building positions, altering access, adding ecological information or revising drainage. Ask the authority whether it is likely to view the amended scheme favourably, then submit a complete application rather than relying on an appeal to introduce a new project.

Consider an appeal when the submitted scheme is defensible

An appeal is more coherent where the drawings already meet policy, the refusal reasons are disputed on the evidence, or the authority appears to have misapplied the development plan. The inspector considers the planning merits through the appeal process; the appeal is not a mechanism for forcing the authority to renegotiate.

Scotland: local review is not the same as an appeal

Scotland distinguishes between a local review and an appeal to Scottish Ministers. A delegated application for local development may be eligible for review by the planning authority’s local review body instead of an appeal. The Scottish Government’s development-management guidance gives three months beginning with the decision-notice date to seek that review for a qualifying refusal.

Other applicants may have a right of appeal to Scottish Ministers. The Scottish Government’s appeal-form guidance gives a three-month appeal period. Read the notice carefully: it should indicate whether local review or appeal is available. Filing in the wrong forum can waste the limited period. Fees for this type of appeal were introduced on 9 June 2025, so verify the current amount and any exemption before submission.

Wales: a six-month appeal window

Welsh Government guidance gives the person who applied six months from the date on the decision notice to appeal a refusal. Other interested parties can comment on an appeal, but they do not have a right to appeal against a permission grant. Discussing the proposal and decision with the local planning authority first is recommended, particularly where a modest amendment could resolve the objection.

The guidance says appeals normally receive a decision within 14 weeks, while warning that some take longer. Treat 14 weeks as an indicative administrative expectation when planning finance, land agreements and professional appointments; do not promise it as a fixed outcome.

What happens to money, contracts and the construction programme?

Construction cannot lawfully start under a permission that has been refused. The project team should therefore re-baseline the programme around the selected route. Freeze non-essential procurement that depends on the refused design, but preserve time-sensitive surveys, option agreements and consultant availability where they support a resubmission or appeal.

Review consultant appointments to see whether redesign, additional reports or an appeal statement are included or charged separately. Check whether a land purchase, promotion agreement or development finance facility has a long-stop date linked to permission. A refusal may trigger notice obligations even when the project remains viable.

Do not treat an appeal or revised application as a guaranteed programme recovery. Build scenarios for approval, further information requests, another refusal and a decision to withdraw. Keep a single controlled drawing register so that the authority, funders and consultants are working from the same proposal.

Common mistakes and how to avoid them

  • Using the wrong national deadline: confirm the nation and read the notice before diarising dates.
  • Appealing to gain leverage: the English guidance says appeal should be a last resort, not a bargaining tactic.
  • Submitting the same scheme again: map every refusal reason to a real design or evidence change.
  • Ignoring the application date in England: use the procedural guide for the correct date band.
  • Confusing non-determination with refusal: the 13-week major-project figure in England concerns an absent decision, not every refusal appeal.
  • Assuming a local review is an appeal: in Scotland the forum depends on whether the application was delegated and on the development category.
  • Starting work while challenging the decision: planning permission has not been granted merely because an appeal is lodged.
  • Relying on verbal assurances: record discussions, but treat only a formal decision as permission.

A practical decision framework

  1. Can each refusal reason be answered by a credible change? If yes, develop and discuss a revised scheme.
  2. Would the required changes produce a substantially different project? If yes, a new application is usually more transparent than asking an appeal to decide an unsubmitted design.
  3. Does the existing proposal comply with the development plan and policy? If the evidence supports that position, investigate an appeal or review.
  4. Which procedure is legally available? Confirm the nation, application type, decision date and any England application-date distinction.
  5. Can the team meet the deadline and evidence burden? If not, obtain urgent professional advice rather than filing an incomplete case.

The immediate outcome after refusal is therefore a controlled choice, not an automatic project failure: understand the reasons, protect the deadline, then either change the proposal or challenge the decision through the correct national route.
