What Proposition 45 is—and when it would matter
Proposition 45 is a proposed California statute concerning “essential projects,” a category that includes housing projects meeting the measure’s eligibility criteria. It is on the statewide ballot for November 3, 2026. The measure is not an administrative rule already in effect: no applicant can use its procedures unless voters approve it and the law takes effect.

The official title and summary describes a package of changes to application processing, environmental review, permits, public comments and litigation. The proposed text makes the package elective. An eligible applicant could select none, some or all of the chapter’s provisions and combine them with other applicable procedures. The measure also says that an agency retains authority to approve or disapprove an essential project and that no project outcome is predetermined. How housing approvals work under current CEQA rules
California’s Environmental Quality Act (CEQA) requires a public agency to determine whether a proposed project is covered and whether it could cause significant environmental effects before the agency approves it. The agency may find that no further review is required, impose measures that reduce impacts, or prepare a more detailed environmental impact report (EIR) when significant effects cannot be avoided or reduced through minor changes.
Environmental analysis and alternatives
An EIR analyzes the project’s potential effects, ways to reduce those effects and alternatives. Under the ordinary process, the agency develops and evaluates multiple alternatives as part of that analysis. The agency also follows CEQA rules for notices and public and other-agency comments at specified stages.
Other approvals still apply
CEQA is only one part of a housing approval. Depending on the project, an applicant may need zoning or general-plan approvals, subdivision approval, building permits, infrastructure approvals and other permits. CEQA compliance does not itself grant those approvals, and Proposition 45 would not turn the separate approvals into automatic permissions.

After approval, a person or organization may file a court challenge alleging that the agency failed to follow CEQA. If a court finds a violation, it can halt work and require the agency to correct the defective process. That possibility can delay financing, construction and occupancy even when the underlying housing proposal remains viable. The Secretary of State’s official analysis explains this existing framework.

Which housing projects could use the new procedures?
Not every housing application would qualify. Proposition 45 defines specified categories of “essential projects,” and an applicant would have to satisfy the statutory criteria for the particular project. The official materials do not establish that all residential developments, all jurisdictions or all project sizes would be covered.
Eligibility would therefore be a threshold issue. An applicant would need to identify the relevant category, document compliance with its conditions and confirm how the agency interprets the requirements. A project that falls outside the defined categories would remain on existing tracks, subject to ordinary CEQA and permitting rules.
What would change for an eligible applicant?
The following table compares the principal features described in the official analysis. “Optional” is important: an eligible applicant could elect the new chapter, retain current procedures, or use only selected provisions where the statute permits.

How an eligible housing applicant would use the pathway
- Confirm eligibility. Match the project to an “essential project” category and verify every statutory condition. Do not assume that a housing label alone is sufficient.
- Choose the procedural package. Decide whether to retain existing CEQA procedures or elect none, some or all of the Proposition 45 provisions available to the project.
- Obtain the agency’s information list. Before filing, request or review the agency’s stated information requirements. Build the application around that list to reduce later disputes over missing material.
- Submit the application and lock the review standards. Under the proposed option, environmental impacts would be assessed using laws and standards in effect when the application is submitted. The application date would therefore become an important record.
- Coordinate the EIR and permits against the deadlines. Track business days, completeness determinations, EIR milestones and separate permit deadlines. The 365-business-day EIR figure is an example in the official analysis, not a promise that every project receives the same schedule.
- Prepare the permitted alternative and consultation record. If the elected procedure calls for one applicant-developed alternative, document how it was selected and analyzed. Keep a complete record of the required tribal consultation and public notices.
- Use the enforcement mechanisms only when necessary. If an agency misses a statutory deadline, the applicant could request a hearing and may have a court remedy under the measure. The exact remedy would depend on the statute, the agency record and judicial interpretation.
- Complete all non-CEQA approvals. Zoning decisions, subdivision actions, building permits, utility approvals and other required authorizations still have to be obtained from the responsible agencies.
What the litigation changes would mean
Proposition 45 would alter both the timing and the scope of CEQA litigation for projects using its procedures. The official summary describes tighter deadlines for court challenges and narrower review of the issues a court could consider. A court also could not stop an entire project solely because of a CEQA error; the remedy would be directed at the noncompliant portion while the agency corrects the problem.
That is different from eliminating lawsuits. A challenger could still bring a case within the applicable deadline, and a court could still require corrective action. Project teams would need a litigation record that shows the agency followed the selected procedure, analyzed the required impacts and alternatives, completed consultation and respected comment limits.
The proposed remedy is also not a construction shield. If a defect affects a discrete component—such as a particular approval, mitigation measure or phase—that component could be stopped while the rest of the project proceeds only to the extent the court allows. The statute’s application to particular disputes would ultimately be determined through implementation and judicial decisions.
Would Proposition 45 make it easier to build housing?
What supporters argue
Supporters’ ballot arguments say that predictable deadlines and fewer opportunities for repeated delay could reduce carrying costs and help housing move from application to construction. Those statements are campaign arguments, not measured outcomes. They do not establish that rents would fall, that a specific number of homes would be built, or that every eligible project would move faster. (official arguments and rebuttals)

What opponents argue
Opponents argue that limiting environmental analysis, tribal consultation, public-comment time or court remedies could increase pollution and health risks. Those are also advocacy claims. Whether any project experiences a particular environmental effect would depend on its location, design, mitigation and agency findings.
What can be said with confidence now
The measure could make review more predictable for qualifying applicants by setting specified deadlines and limiting some procedural choices. It could also reduce the ability to pause an entire project for a CEQA defect. It would not guarantee approval, remove all environmental review, or establish a statewide rent reduction. Actual effects would require an approved measure, eligible projects, agency implementation and post-election evidence.

The Legislative Analyst’s Office estimate reproduced in the 2026 California Secretary of State voter guide projects initial state and local government costs in the high tens of millions of dollars annually, potentially exceeding $100 million annually. Applicant fees and fees paid by people filing lawsuits would cover some costs. This is a government-cost estimate, not a forecast of rent savings or construction volume. (official analysis)
Longer-term fiscal effects are uncertain. They would depend partly on how many eligible projects are submitted and built, the environmental impacts of those projects, the staffing needed to meet deadlines and the number and complexity of court challenges. A faster statutory clock could require agencies to add reviewers, consultants, clerks or court capacity even when a project ultimately is denied.

What the measure would mean for different participants
Housing developers and applicants
- Budget for eligibility analysis and a deliberate choice between the ordinary and optional procedures.
- Preserve a dated record of the application, the agency’s information requirements, completeness determinations, notices and every deadline calculation.
- Do not treat the 365-business-day example as permission to skip permits, mitigation or a complete EIR.
- Model financing around the possibility that a court challenge or a separate land-use approval still delays construction.
Public agencies
- Publish clear information requirements before submission if the project uses the new process.
- Assign staff and tracking systems capable of measuring business-day deadlines and documenting extensions or pauses allowed by law.
- Maintain a defensible environmental record even when the applicant supplies the single alternative.
- Continue making an independent approval or denial decision; the proposed statute does not transfer that authority to the applicant.
Neighbors, tribes and other commenters
- Identify the applicable notice and comment windows promptly because the elected procedure could impose maximum durations.
- Submit specific evidence on environmental impacts, mitigation and alternatives within the allowed period.
- Understand that the consultation rule described in the official analysis would be narrower than the current approach, while the project would still remain subject to environmental review.
What to watch after the November 3, 2026 vote
The first question will be whether Proposition 45 passes. If it does, applicants and agencies will need the effective date, implementing guidance and interpretations of the eligibility categories. Early cases may determine how courts calculate business days, what counts as a complete application, how an applicant-developed alternative is evaluated and when a court may halt a project component.
For anyone evaluating a housing proposal, the most useful evidence will be project-level data: applications using the option, time from submission to EIR completion, permit issuance, approval and construction; the number and outcome of challenges; and measured environmental effects. Those facts do not exist yet, so predictions about rents, production or pollution should be labeled as predictions rather than results.
Bottom line for a housing approval decision
If approved, Proposition 45 could offer qualifying housing applicants a faster, more bounded procedural route through CEQA-related review and litigation. It would leave environmental review and agency approval authority in place, and participation would be elective. Whether that produces more housing or lower costs cannot be known from the ballot language alone; it will depend on eligibility, implementation, court rulings and evidence after the law takes effect.
