Usually, a builder can charge for costs included in the signed contract and for properly authorized additions. A line item is not automatically payable merely because it appeared on an invoice. The answer turns on the contract’s scope, pricing method, allowances, permit allocation, change-order procedure and the law where the property is located.
This is a U.S.-focused explanation. State, city and county rules differ, so use the examples below as illustrations rather than nationwide rules. For a dispute, compare the invoice with the signed agreement and obtain advice under the law governing the home.

Start with the signed contract, not the invoice
The contract and its exhibits should identify the work, materials, specifications, total price or pricing formula, payment dates, permit responsibilities and process for changing the work. Plans, finish schedules, allowance sheets and later signed amendments are part of the scope you must compare with the bill.
A builder may list labor, materials or permits as separate invoice lines even when those costs are already included in a fixed contract price. Conversely, a contract may expressly make a particular cost reimbursable. The same expense can therefore be included in one agreement and separately billable in another.

How the pricing method changes what you may owe
Fixed-price contracts
A fixed-price contract sets one agreed amount for a defined scope. Costs needed to deliver that scope are ordinarily the builder’s responsibility within that amount, even if the builder’s own costs are higher than expected. The contract may still reserve specific adjustments for owner-selected items, approved changes, taxes or other stated events.
Utah’s Department of Professional and Occupational Licensing sample contract illustrates this structure: its fixed project price describes contractor costs such as subcontractor payments, wages, materials, equipment, insurance and permit and plan-approval costs. It also provides for agreed cost changes to be recorded in a change order. That allocation is an example of contract drafting, not a rule that controls every Utah project or any other state.
Cost-plus contracts
Under cost-plus pricing, the owner pays defined actual costs plus an agreed percentage or stipulated fee. The contract must say which costs qualify, how overhead and profit are calculated, whether subcontractor markups are allowed and whether a cap or estimate applies. “Actual cost” does not have one universal meaning.
Recommended Free Tools
Ohio law describes a cost-plus arrangement in terms of product cost, an installation labor rate and an agreed profit percentage or stipulated fee. The Florida Bar’s consumer guidance likewise distinguishes fixed-price and cost-plus arrangements and stresses that the agreement should make the method clear. Those descriptions do not authorize charges outside the written terms.
Time-and-materials contracts
Time-and-materials billing usually applies stated labor rates to hours worked and adds the contract’s treatment of materials, equipment, subcontractors, overhead and profit. Require records that let you verify hours, rates and purchases. Ask whether travel, supervision, delivery, disposal or administrative time is included or separately billable.
Pennsylvania provides a specific consumer rule for certain home-improvement time-and-materials contracts: the Attorney General’s guidance says the contractor must give a written initial estimate and disclose that costs may not exceed it by more than 10 percent without a written change order signed by both parties. That 10-percent threshold is Pennsylvania-specific and should not be applied elsewhere.

Expense categories that may appear on a bill
Labor and subcontractors
Labor and subcontractor work are commonly part of a fixed price. In a cost-plus or time-and-materials arrangement, they can be billed using the specified rates and cost rules. Check whether the builder may add overhead or profit to subcontractor invoices and whether supervision is already covered.
Materials, fixtures and equipment
Compare billed and installed items with the plans, specifications, model numbers, quality descriptions and approved selections. A builder cannot convert an included material into a new charge simply by itemizing it later. If you approved a different or higher-grade product, the price effect should follow the contract’s change process.
Allowances and owner selections
An allowance is a budget placeholder for an item not selected when the contract was signed, often a fixture, appliance or finish. If the final selection exceeds the allowance, the agreement may make you responsible for the difference. The allowance may or may not include installation, tax, delivery, waste, accessories or markup, so read its definition rather than assuming it is a complete installed price.
Permits, inspections, tests and approvals
Contracts should identify who applies for permits and who pays application, plan-review, inspection and approval fees. An expense can be assigned to the owner while still being included in the fixed project price, or it can be payable separately; the wording controls. Also check how a newly required inspection or changed code requirement is handled.
Changes, additions and unforeseen conditions
A homeowner-requested addition, substitution or deletion can be chargeable when authorized under the contract. Discovery of an unexpected condition does not by itself establish what you owe. The agreement and local law determine notice, documentation, pricing and whether work may proceed before approval.
Cleanup, debris, protection and storage
These job-condition costs may be included in the scope or treated as separate services. Look for provisions covering debris removal, temporary protection, storage, site access, damage caused by other trades and restoration after construction. Do not accept an add-on that the written scope already includes.

Taxes, insurance, overhead, profit and financing
Determine whether sales or use taxes, builder’s insurance, general overhead, profit, financing charges and administrative fees are embedded in the price, itemized or permitted as extras. There is no universal list of charges a builder may add; the contract and applicable law govern each category.
How allowances are reconciled
Before choosing an allowance item, obtain the calculation method in writing. Ask:
- What exact item, quantity and quality level does the allowance cover?
- Does the amount include labor, installation, tax, delivery, waste and accessories?
- Is builder markup applied to the purchase, installation or both?
- How are credits handled when the selection costs less?
- When will the allowance be reconciled and shown on the payment application?
Oregon’s Construction Contractors Board identifies fixtures and appliances as common allowance items. The Florida Bar explains that a selection above an allowance can increase the owner’s cost. Keep the allowance schedule and every selection approval with your contract records.

Permits and approvals: separate responsibility from cost
Find two answers, not one: who obtains the permit, and who ultimately pays the fee. California Contractors State License Board guidance says the contract should direct who gets necessary permits. Oregon guidance similarly recommends listing required permits and the responsible party.
Utah’s sample agreement assigns permit acquisition to the contractor and states that the owner pays approval and permit costs, while its fixed-price description also includes permit and plan-approval costs. That apparent tension shows why you must read the complete agreement: “owner pays” may describe responsibility for a fee without creating a second invoice beyond the agreed price.
When a change order is required
A useful change order states what is added, removed or substituted; the price increase or credit; any allowance adjustment; and the schedule effect. It should be dated and signed by the homeowner and builder before changed work starts when the contract or governing law requires prior approval.

California CSLB guidance says a change to price or scope must be in a written change order signed by the customer and contractor before the change. Oregon guidance recommends written changes signed by both parties, and the Florida Bar recommends a signed writing before changed work is performed. These statements reflect those jurisdictions’ guidance; verify the rule for your property.

- Assemble the controlling documents. Gather the signed contract, plans, specifications, allowance schedule, payment applications, receipts, invoices, emails and every signed amendment.
- Match the line item to the scope. Decide whether it is included work, an allowance overage, an approved change, or a charge with no obvious contractual basis.
- Request the authorization and calculation. Ask the builder to identify the clause or signed change order and show labor hours, rates, invoices, markups and credits supporting the amount.
- Check record-access rights. Cost-plus contracts and some forms give owners a process to inspect supporting records. Utah’s sample agreement, for example, describes requesting records for costs, labor and supplies.
- Respond in writing. State which item you dispute, the documents supporting your position and what clarification or correction you seek. Preserve every reply.
- Protect payment and lien rights. Do not ignore an invoice, notice or lien deadline. State rules govern construction liens, required notices, withholding and escrow.
- Obtain local advice for significant disputes. An independent construction lawyer can review unclear cost-plus terms, arbitration clauses, statutory notices and a large disputed balance.
State examples that should not be generalized
California
California CSLB consumer guidance requires a written contract for home-improvement projects over $500 and limits the down payment to $1,000 or 10 percent of the contract price, whichever is less. It also addresses payment schedules, permit responsibility and written change orders. These are California requirements, not a national standard.
Oregon
Oregon CCB guidance recommends a detailed written contract, clear allowances, identified permits, signed written changes and careful review of arbitration terms. It also advises homeowners to consider having their own lawyer review the agreement.
Florida
The Florida Bar’s “Building a Home” consumer material discusses fixed-price and cost-plus arrangements, allowances, change orders and lien risks. Florida lien procedures are jurisdiction-specific; do not assume another state follows them.

Pennsylvania
The Pennsylvania Attorney General’s cited time-and-materials guidance uses a 10-percent estimate threshold before a written bilateral change order is required. Treat that figure as Pennsylvania-specific.
Ohio
Ohio Revised Code section 4722.01, effective September 20, 2024, defines a covered home-construction service contract in the cited provision as one exceeding $25,000. That is a statutory scope threshold, not a general rule about which expenses a builder may charge.

Records that make a charge easier to resolve
Maintain one project file containing the executed contract and exhibits, dated plans, selection approvals, allowance reconciliations, change orders, invoices, receipts, payment confirmations, inspection records and photographs. Keep communication about price or scope in writing. A clear chronology often shows whether a charge was part of the original bargain, resulted from your instruction or lacks authorization.

Practical answer
A builder can generally charge for the defined contract scope, covered costs under a cost-plus or time-and-materials formula, allowance overages and additions approved through the required change process. A builder generally cannot create a new obligation simply by placing an unapproved item on an invoice. Whether a particular charge is valid depends on the exact wording of the signed agreement and the law where the home is located.
