What Private Landlords Must Do When Tenants Report Damp and Mould (England and Scotland)

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When a tenant reports damp or mould, treat it as a potentially urgent repair and health issue. A private landlord should acknowledge the report, assess the risk promptly, inspect to find the moisture source, arrange work that fixes the underlying defect, and keep the tenant informed. Do not wait for medical evidence before acting. The legal detail depends on the nation where the property is located: England and Scotland now have different rules, while this article does not establish the equivalent position in Wales or Northern Ireland.

First establish which rules apply

“Private landlord” is not a complete legal answer. The property’s nation and the landlord’s sector determine the duties and escalation routes.

Property and landlord Position established as at 13 October 2026 What a tenant can do if action is inadequate
England, private rented home Existing repair and fitness duties apply. English damp-and-mould guidance requires a serious, prompt assessment and action on the underlying cause, but it does not set a specific private-landlord completion deadline. Contact the local council’s environmental health department if repairs are not done.
England, social housing Awaab’s Law statutory response deadlines apply to social landlords. Those deadlines are not currently the rules for English private landlords. Use the landlord’s complaints process and the relevant housing and council routes.
Scotland, private or social rented home The Investigation and Commencement of Repair (Scotland) Regulations 2026 came into force on 6 October 2026 and create damp-and-mould investigation and repair-commencement duties. Scotland’s Repairing Standard also applies. Use Scottish housing standards and remedies, including the applicable tribunal or council route.
Wales or Northern Ireland The equivalent rules are not established in the evidence used for this article. Obtain nation-specific advice before relying on the England or Scotland position.

What an English private landlord should do after a report

Official English guidance, Understanding and addressing the health risks of damp and mould in the home (updated 1 April 2026), says landlords should take reports seriously, assess severity and possible health risk urgently, identify the cause and tackle it promptly. The guidance specifically says not to delay action while waiting for a doctor’s letter or other medical proof.

1. Acknowledge and record the report

Reply in a way that confirms the concern has been received and gives the tenant a named contact. Record the date and method of the report, rooms affected, visible extent, any smell or staining, whether the condition is spreading, suspected leaks, loss of heating or ventilation, and any health or vulnerability information the tenant volunteers. Ask for photographs if they help triage, but do not make photographs a substitute for an inspection.

Arrange a reasonable inspection appointment and explain what access is needed. Keeping the original report, messages, photographs, inspection notes, contractor communications and completion information creates a clear chronology if the condition later becomes disputed.

2. Triage urgency and health risk

Ask focused questions before the visit: Is there an active leak? Is water near electricity? Has heating, hot water or ventilation failed? Is mould in a bedroom, living room or another heavily used area? Is it rapidly spreading? Does anyone in the household report breathing difficulty or other symptoms, or have a vulnerability that may increase the risk from damp and mould?

A significant area, continuing water ingress, loss of essential services or a reported health concern should be treated as urgent. The guidance does not require a clinical diagnosis before you act. If there is an immediate danger, arrange emergency attendance and give clear safety instructions while help is on the way.

3. Inspect instead of assuming tenant behaviour caused it

The inspection should look for the source of moisture and the building conditions that allow mould to grow. Check the roof, gutters, walls, windows, plumbing, bathrooms, kitchens, heating system, extractor fans, air-bricks and other ventilation. Look for leaks, penetrating damp, failed seals, condensation caused by inadequate ventilation, cold surfaces, defective components and previous repairs that have not solved the problem.

Do not start with an allegation that the tenant failed to heat or ventilate the home. Occupant activity can contribute to condensation, but the landlord must establish whether a defect, inadequate ventilation or another property issue is responsible, or whether several factors are interacting. The inspection should also identify any work that falls within the landlord’s repair responsibility.

4. Fix the cause, not only the visible mould

Cleaning or repainting a mould patch may remove the appearance temporarily while a leak, penetrating damp or inadequate extraction continues. Arrange appropriate remedial work for the diagnosed cause: for example, repairing plumbing or roofing, replacing failed seals or components, restoring heating or hot-water systems, improving defective ventilation, or dealing with water penetration. Remediation should be suitable for the extent and source of the problem and carried out by competent contractors where specialist work is required.

Give the tenant practical information about what will happen, but do not present a cleaning product, dehumidifier or moisture meter as a substitute for building repairs. No single consumer device or cleaner is made generally necessary by the official guidance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

5. Set expectations and keep the tenant informed

Tell the tenant what the inspection found, what work is planned, who will attend and when the next update is due. GOV.UK repair guidance says landlords should tell tenants when repairs can be expected. If an investigation reveals that further testing or a specialist contractor is needed, explain that reason and provide a revised timetable rather than allowing the report to go silent.

Keep copies of appointments offered, access problems, contractor findings, invoices, photographs and completion dates. These records help demonstrate that the report was assessed and acted on, and they identify outstanding work if the first intervention does not resolve the moisture.

6. Check the result and maintain the property

After work, check whether the moisture source has stopped and whether mould is returning. A follow-up visit may be needed after the building has had time to dry. Continue normal inspection and maintenance arrangements, including attention to ventilation, heating, roofs, gutters, plumbing and external fabric. Official guidance calls for regular property inspections, prompt repairs and a regular maintenance programme.

Are there fixed deadlines for private landlords in England?

There is currently no specific timeframe for private-landlord remedial work in the English damp-and-mould guidance. That statement means the guidance does not provide a single number of days; it does not mean a landlord may ignore the report. Existing legal duties concerning repair and fitness still apply, and the guidance says significant damp or a significant concern about tenant health should be treated urgently.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

English private landlords are responsible for repairing the structure and exterior, heating and hot water, gas appliances and pipes, and ventilation where those are landlord responsibilities. A mould report can therefore indicate a breach of an existing repair or fitness obligation even though the guidance has no universal completion clock. The appropriate response depends on severity, cause, access and the work required.

Does Awaab’s Law apply to English private landlords?

Not yet in the same way it applies to English social landlords. Awaab’s Law is in force for social landlords and sets statutory deadlines for emergency hazards and significant damp-and-mould hazards. Those social-housing deadlines should not be presented as current private-rented-sector deadlines.

The Renters’ Rights Act guide says Awaab’s Law will be extended to privately rented homes. A government consultation published in October 2026 says the earliest feasible implementation date is 2027 and seeks views on how the extension should operate. At the 13 October 2026 position covered here, the private-sector commencement date, scope and final deadlines remained unsettled. Landlords should check the final regulations when published rather than applying draft or social-sector timings as if they were already private-sector law.

Scotland: a separate regime from England

Do not import England’s “no specific timeframe in the guidance” description into Scotland. The Investigation and Commencement of Repair (Scotland) Regulations 2026 came into force on 6 October 2026 and establish damp-and-mould investigation and repair-commencement duties for both social and private landlords. Scotland’s existing Repairing Standard is set out under the Housing (Scotland) Act 2006.

The Scottish Government’s landlord guidance should be used for the applicable investigation and commencement details, notices and records. The legal tests, timing requirements and remedies are distinct from those in England, so a Scottish landlord should obtain current nation-specific guidance before deciding that a response is sufficient.

Access for inspection and repair in England

An English tenant should give the landlord access to inspect or repair after at least 24 hours’ notice and at a reasonable time, except where an emergency calls for immediate access. A landlord should offer practical appointment options, respect the tenant’s privacy and keep a record of notice and agreed access. Repeated failed appointments should be documented, but access difficulties do not remove the duty to keep pursuing a safe inspection and repair.

What if the landlord blames the tenant?

A landlord should not decide that mould is the tenant’s fault before inspecting. Condensation may be influenced by moisture produced during normal occupation, yet the same symptoms can result from leaking pipes, penetrating damp, cold bridging, failed windows, inadequate extraction or insufficient heating. The responsible approach is to identify the physical cause and any contributing factors, then explain the findings in plain language.

If the inspection finds a tenant-caused issue alongside a defect, deal with the defect and give reasonable, specific advice about ventilation or heating. Do not use generic instructions to open windows or wipe mould as a reason to postpone repairs where the property itself is contributing to the problem.

When and how a tenant can escalate in England

If the landlord does not inspect, communicate or carry out necessary repairs, the tenant can contact the local council’s environmental health department. GOV.UK says the council must take action if it considers the conditions could harm the tenant or cause a nuisance. The tenant should keep the original report, photographs, appointment history and copies of the landlord’s replies to show what was reported and what happened next.

Council involvement is separate from the landlord’s responsibility to respond. A landlord should not wait for an environmental-health visit before taking reasonable urgent action, particularly where the report identifies a health concern or an active defect.

A practical landlord checklist

  • Confirm the property’s nation and whether the tenancy is private or social.
  • Acknowledge the report and record date, rooms, extent, suspected source and any volunteered health or vulnerability information.
  • Triage active leaks, loss of heating or ventilation, rapid spread and health concerns as urgent.
  • Offer an inspection with the required notice and make emergency access arrangements where necessary.
  • Inspect the structure, exterior, plumbing, heating, hot water and ventilation; do not assume blame.
  • Write down the diagnosed or suspected cause and the work needed to resolve it.
  • Arrange appropriate remedial work promptly, addressing the source as well as visible mould.
  • Tell the tenant the plan, expected dates and any reason for a change.
  • Retain reports, photographs, notices, contractor records and completion details.
  • Follow up to confirm the moisture source is controlled and schedule further maintenance if needed.

Questions landlords and tenants commonly ask

How quickly must mould be fixed in England?

The English private-landlord guidance does not set one fixed number of days. The response should be prompt, with significant damp or a health concern treated urgently, while existing repair and fitness duties continue to apply.

Can a landlord wait for medical evidence?

No. The official guidance says medical evidence is not a requirement for action. A reported health concern is a reason to assess and respond urgently.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Who should a tenant contact if repairs are not done?

In England, the tenant can contact the local council’s environmental health department. Scotland has separate standards and remedies, so the tenant should use the Scottish route applicable to the property.

Are England’s Awaab’s Law deadlines already private-sector deadlines?

No. They currently apply to English social landlords. Extension to private renting is planned, but the commencement date and detailed deadlines were unsettled as at 13 October 2026.
