light rail construction

What permits are needed for construction near a light rail project in Seattle?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Seattle has no single “light rail proximity” permit. The approvals depend on what you are building, who owns the land, whether work enters the public right-of-way (ROW), and whether excavation, cranes, vibration, settlement, utilities, staging or other activities could affect Sound Transit property or active Link operations.

Most projects need a project-specific review by Seattle Department of Construction and Inspections (SDCI) for private-property construction. Any work or occupation in a street, sidewalk or planting strip is separately regulated by the Seattle Department of Transportation (SDOT). Work on, over or near Sound Transit facilities can require written Sound Transit approval, and activity near active Link tracks may also require coordination with King County Rail Division’s Link Track Access team. Obtain the exact list and written conditions before setting a start date.

Why proximity to light rail does not create one universal permit

A parcel can be near a station or rail line without being subject to a special permit category. Agencies instead screen the project’s physical effects and legal boundaries. The same address might need only a normal building permit for interior work, or it might need several coordinated approvals for excavation, sidewalk occupation, a crane, utility relocation and rail-protection measures.

Screen these questions at the start:

  • Is the work entirely on private property, or does any part of the site, access route, staging area or protection zone enter public ROW?
  • Will construction occupy or alter a street, sidewalk, alley, planting strip, curb lane or other city-controlled space?
  • Is the work within, on, over or next to Sound Transit property, infrastructure, facilities or operating areas?
  • Could excavation, shoring, tiebacks, dewatering, boring, cranes, demolition, vibration, settlement or deliveries affect rail assets?
  • Will the activity be next to active Link tracks or require anyone or anything to enter a rail operating area?
  • Does the project include a permanent street, alley or sidewalk improvement rather than a temporary construction use?

Visible pavement, a fence line or a station entrance is not a reliable legal boundary. Have the parcel and ROW lines shown on a current survey or civil plan before deciding which agency owns each review.

SDCI permits for work on private property

Building and construction permits

SDCI is the starting point for qualifying private-property construction. Seattle identifies construction permits for new multifamily, commercial, mixed-use and industrial buildings. Alterations, additions, tenant improvements, demolition, land-use actions, mechanical or electrical work and other scopes can have different requirements, so the building type alone does not determine the complete permit set.

Ask SDCI to screen the actual scope, not just the project name. Provide the address, parcel information, drawings, use, structural work, demolition details and construction sequence. SDCI can identify whether a building permit, demolition permit, shoring or excavation review, land-use approval or another discipline-specific permit is needed.

Shoring and excavation near a ROW

Excavation and shoring deserve an early review even when the excavation is technically on private land. A basement, deep foundation, tieback system, soldier piles, dewatering or crane setup can extend toward a sidewalk or street and create public-safety or property impacts. Seattle notes that shoring and excavation near a ROW may trigger SDOT review and fees in addition to SDCI review.

Include excavation limits, depths, shoring sections, tieback locations, groundwater or dewatering plans, equipment footprints and any sidewalk or lane effects in the first agency inquiry. Do not assume that approval of the building plans authorizes occupation of the ROW or work affecting another owner’s property.

SDOT permits for public-right-of-way work

Street Use is required for work or occupation in public ROW

SDOT regulates public streets, sidewalks and planting strips. Its general permit guidance states that any work conducted in public ROW requires a Street Use permit. This can include a construction fence, scaffolding, materials, equipment, a temporary lane closure, a sidewalk detour, a crane pick, a concrete pump, a dumpster or a delivery setup, even when the building itself is on private property.

Determine the legal ROW boundary first. If a staging plan, protection zone or access route crosses that boundary, describe the crossing and its duration in the SDOT application. A private-property building permit does not substitute for Street Use authorization.

ROW Construction permits for temporary impacts

SDOT’s ROW Construction permit addresses temporary construction uses such as deliveries, materials or equipment, safety buffers, scaffolding and temporary structures. The application generally calls for a ROW Impact Plan and, when applicable, a site plan. SDOT may request traffic-control, parking, technical or location-specific documents based on the impact.

Before work starts, the permit conditions may require public notification, job-start notification and temporary no-parking steps. Show pedestrian, bicycle, vehicle, emergency and transit access, not only the contractor’s work footprint. If conditions change, contact SDOT rather than moving barriers or extending a closure informally.

Street Improvement Permit and SIP Lite

A Street Improvement Permit (SIP) is for permanent or semi-permanent improvements connected to a land-use requirement, a street, alley or sidewalk improvement, voluntary streetscape work, subdivision review or a public-main extension. SDOT also lists interagency projects such as Sound Transit Link rail extensions in this permit family.

SIP Lite is for qualifying smaller improvements under 2,000 square feet. The area threshold does not guarantee eligibility; SDOT reviews the scope and category. A sidewalk reconstruction, curb change, frontage improvement or utility-related street project can therefore require a SIP even when the adjacent building permit is straightforward.

Sound Transit review and written approval

When to make an adjacent-construction inquiry

Sound Transit’s Adjacent Construction Handbook, published in May 2025, covers third-party work on, adjacent to or over Sound Transit property, infrastructure, facilities and operations. Examples include excavation, demolition, cranes, geotechnical testing, boring, utility crossings, staging, shoring, tiebacks, settlement monitoring and dewatering.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The handbook asks requesters generally to submit an inquiry when work is within 100 feet of Sound Transit property or operations. That 100-foot figure is a screening rule of thumb measured outward from the edge of Sound Transit ROW; it is not a universal construction setback and does not automatically mean a permit is required. Work farther away can still require review if its effects could reach Sound Transit assets, while work inside the distance may be screened out after the agency evaluates the details.

Why city permits are not enough

Sound Transit states that requesters should assume written approval, such as a statement of conflict or no-conflict, is required in addition to approved permits from the local authority having jurisdiction before proposed adjacent construction proceeds. In practical terms, an approved SDCI or SDOT permit does not release a contractor from Sound Transit conditions.

Sound Transit may request approved local permits and plans, structural or geotechnical reports, insurance evidence, traffic-control details, property agreements, monitoring plans, method statements and other materials. The exact package depends on the activity and its potential effect on the transit system.

Allow time for the review

The May 2025 handbook says Sound Transit review can take 8–12 weeks or longer, depending on scope and how complete the information is. This is an estimate, not a guaranteed turnaround. Treat it as an early design and scheduling dependency, particularly for deep excavation, cranes, tiebacks, dewatering, utility crossings or work beside an operating guideway.

Link Track Access and King County coordination

Work near active Link light rail ROW may require notification to King County Rail Division’s Link Track Access team and may require a Link Track Access Permit. King County decides whether a proposed activity needs the permit or can instead be recorded as permit-exempt. Ask the team for that determination; do not make the classification yourself.

Sound Transit’s handbook generally describes Link ROW as any area extending 10 feet from the nearest rail and/or property dedicated to light rail operations. This is a general handbook description, not a substitute for a boundary survey or an operations decision. If people, equipment, materials, access routes or protection measures could enter that area, request track-access guidance.

The handbook lists a request timing of at least two weeks before scheduled work, with a specified Monday 8 a.m. submission cutoff. Confirm the current cutoff, contact details and safety requirements with the Link Track Access team because operating procedures can change. A city street-use or building permit does not replace rail-access authorization.

How to sequence the approvals

Use the following order to avoid designing around an approval that another agency later rejects.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Assemble a complete site picture. Gather the address, parcel and ROW boundary, survey, site plan, project description, excavation and shoring details, work hours, delivery route, crane or hoist locations, staging areas, closure limits and pedestrian-access plan.
  2. Screen the private work with SDCI. Ask whether the scope needs building, demolition, shoring, excavation, land-use or other SDCI permits. Request the answer for the specific use and construction method.
  3. Screen every public-space impact with SDOT. Ask whether the project needs ROW Construction, a Street Use approval, SIP, SIP Lite or another SDOT permit. Include temporary occupation as well as permanent frontage work.
  4. Confirm SDOT sequencing. SDOT permit groups have different relationships to the SDCI application: Group 1 approval is needed before SDCI building or demolition permit issuance; Group 2 is submitted at the same time as SDCI; and Group 3 is obtained at a specified approval stage before the SDCI building-permit application. Ask SDOT which group applies instead of assuming all Street Use reviews follow one sequence.
  5. Contact Sound Transit early. If the project is within the general 100-foot inquiry area or could affect Sound Transit property, infrastructure, facilities or operations, submit an adjacent-construction inquiry with complete plans and reports.
  6. Ask for a track-access determination. For active Link proximity or occupancy, contact the Link Track Access team to learn whether notification, a permit or a logged exempt activity is required.
  7. Resolve conditions in writing. Collect permits, agency letters, statements of conflict or no-conflict, rail-protection requirements, insurance terms, monitoring obligations, traffic-control approvals, inspections and preconstruction-meeting requirements.
  8. Start only after the package is complete. SDOT’s SIP general notes require all required ROW permits before ROW construction starts. Apply the same discipline to temporary closures, staging and rail-adjacent work.

Common mistakes and how to correct them

Assuming distance alone decides the permit

Being “near the station” is not a legal test. Use the surveyed ROW and the activity’s effects. Send Sound Transit an inquiry when the project falls within its 100-foot screening area or could affect its assets, but do not describe that distance as a guaranteed setback.

Using the visible sidewalk or fence as the ROW line

Public ownership can extend beyond what appears to be pavement. Verify the boundary with survey and city records before placing a fence, crane, dumpster, scaffold or delivery vehicle.

Applying only for the building permit

SDCI approval covers the qualifying private construction scope; it does not authorize public-ROW occupation, permanent frontage improvements or rail access. Run SDCI, SDOT, Sound Transit and King County screens in parallel where the facts require it.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Waiting until construction is imminent

Sound Transit review may take 8–12 weeks or longer, and SDOT permits can require notifications, traffic plans and preconstruction steps. Start agency coordination during design, before advertising a firm mobilization date.

Submitting an incomplete impact plan

Missing closure limits, access routes, shoring sections or monitoring information often leads to additional requests. Submit the full construction sequence and update agencies when methods, dates or equipment change.

Preconstruction checklist for the owner and contractor

  • SDCI has confirmed the applicable private-property permits.
  • SDOT has confirmed Street Use, ROW Construction, SIP, SIP Lite or other required approvals.
  • All public-ROW permits are issued before any fence, scaffold, delivery, closure or staging begins.
  • Sound Transit has provided the required written approval or conflict/no-conflict determination.
  • King County Rail Division has determined whether Link Track Access authorization, notification or an exempt log is required.
  • Traffic control, pedestrian accessibility, emergency access and temporary no-parking measures are approved and scheduled.
  • Insurance, property agreements, monitoring, inspections and preconstruction meetings required by the agencies are complete.
  • Superintendents and subcontractors have the permit conditions and know the limits of work.

The practical answer is therefore a coordinated permit screen, not a single light-rail permit. Confirm the private construction path with SDCI, every public-space impact with SDOT, and any possible effect on Sound Transit or active Link operations with the relevant transit teams. Get the final list and conditions in writing before mobilization.
