What Permits and Zoning Approvals Does a Data Center Need in Georgia?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Georgia does not issue one statewide “data-center permit.” A project normally needs approval from its host city or county for zoning and site development, a Georgia Development of Regional Impact (DRI) review when applicable, and separate land-disturbance, stormwater, utility, building and potentially environmental permits. Confirm the jurisdiction’s current code and obtain a written permit matrix before buying land or starting construction.

How Georgia’s approval system works

The local government where the facility will be built controls the core land-use decision. The city or county applies its zoning ordinance, conducts any required public hearings and decides whether the proposed use is allowed as of right, requires a conditional or special-use approval, or needs rezoning. State and federal agencies become involved when the site or design triggers their separate programs.

A Georgia data center therefore moves through several related reviews rather than one application. Approval of one stage does not automatically authorize the next. For example, zoning approval does not substitute for a land-disturbance permit, a building permit, stormwater approval or utility service commitments.

The usual approval sequence

  1. Confirm the jurisdiction and zoning status. Identify whether the parcel is in a city, an unincorporated county area or both for different services. Check the zoning map, permitted-use table, overlay districts, setbacks, height limits, parking rules, noise standards and any moratorium or pending ordinance.
  2. Complete zoning hearings or seek discretionary approval. If a data center is not a permitted use, the applicant may need rezoning, a conditional-use permit or a special-use permit, depending on the local code. Public notice, a planning commission recommendation and a governing-body vote are common components of this stage.
  3. Complete DRI review when the project meets the applicable thresholds. DRI examines regional effects such as transportation, infrastructure and water demand. It informs local governments; it does not replace local zoning or any construction permit.
  4. Obtain site-plan and architectural approval. Local staff or a design-review body may evaluate the building footprint, circulation, parking, grading, landscaping, screening, elevations, lighting, security features and equipment yards after the land-use decision.
  5. Secure civil permits. Expect a land-disturbance permit and stormwater approval, usually supported by engineered grading, drainage, erosion-control and stormwater plans.
  6. Secure building permits. The building department reviews structural, architectural, electrical, mechanical, plumbing and life-safety plans under the applicable codes adopted by the jurisdiction.
  7. Finalize utility approvals. Electric, water and sewer providers must confirm capacity, connection points, upgrades, easements and cost responsibility. Written terms can be a prerequisite to local civil approval.
  8. Obtain any site-specific state or federal permits. Wetlands, streams, floodplains, air emissions, wastewater discharge, fuel storage, generators and cooling systems can create additional approvals.

The Town of Tyrone’s published process illustrates the sequence. Its Microsoft project went through Planning Commission and Town Council hearings before rezoning was approved in March 2024. Tyrone also states that construction cannot begin until the required approvals and permits have been obtained.

Do you need rezoning or a special-use permit?

Start with the permitted-use table

Ask the planning department for a written interpretation of the current zoning classification. A data center can involve a principal computing use, substantial electrical equipment, cooling infrastructure, emergency generators, fuel tanks, substations and offices. The code may treat those components separately or regulate them through development standards.

If the use is expressly permitted and the site meets objective standards, the project may proceed through administrative site-plan review. If the use is conditional or special, the applicant must satisfy additional findings and appear at public hearings. If the zoning district does not allow the use, rezoning is required before site development can be approved.

What makes discretionary zoning risky

  • Public-hearing exposure: Neighbors and elected officials can raise traffic, noise, visual, environmental and utility-capacity concerns.
  • Conditions of approval: A rezoning may impose limits on building height, generator testing, noise, lighting, screening, operating hours or future expansions.
  • Schedule uncertainty: Hearing dates, continuances, revised plans and appeals can change the path to a final decision.
  • Future-change risk: A moratorium, ordinance amendment or comprehensive-plan update can affect a parcel before acquisition or construction.

Because local rules differ, do not rely on a broker’s description of a parcel as “industrial.” Obtain the zoning code section, zoning map, written use determination and any applicable overlay or development agreement.

When does Georgia DRI review apply?

DRI review applies when a proposed development meets the state’s applicable development thresholds. The review considers transportation, infrastructure, water demand and other regional effects. The process is designed to give affected governments information before local action; it is not a substitute for rezoning, a conditional-use decision, site-plan approval or a building permit.

At site-selection, ask the local government or regional commission to confirm in writing whether the project must be submitted for DRI review. The answer can depend on the project’s scale, location, expansion plans and the thresholds in effect when the application is filed. If the facility will be built in phases, evaluate the full planned build-out rather than only the first building.

Site-plan and architectural approvals after zoning

Zoning approval establishes the land-use entitlement, but a local government can still require detailed development review. Typical submittals show property boundaries, setbacks, building dimensions, equipment yards, substations, generators, fuel storage, internal roads, parking, loading, stormwater facilities, landscaping, fencing, lighting and emergency access.

Architectural review can address elevations, exterior materials, rooftop equipment, screening and compatibility with nearby development. A technically compliant data hall can still require redesign if visible equipment, lighting or security infrastructure conflicts with local standards or rezoning conditions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Submit the civil and architectural plans as a coordinated package. Changes to grading, building placement or equipment locations can alter wetlands impacts, drainage calculations, utility routing and fire access.

Land-disturbance, stormwater and building permits

Land-disturbance permit

Mass grading, clearing, road construction, utility trenching and foundation work generally require a land-disturbance approval from the responsible local authority. The application typically depends on a site plan, erosion and sediment-control measures, grading plans and proof that required reviews are complete.

Stormwater approval

Stormwater is identified separately in Tyrone’s municipal checklist. The design must account for runoff from large roofs, paved yards, access roads and generator or utility compounds. Detention, conveyance, water-quality treatment, outfalls and maintenance responsibilities should be resolved before construction documents are finalized.

Building and trade permits

Building permits cover the structures and their systems. Expect separate technical reviews for structural framing, fire protection, electrical distribution, mechanical cooling, plumbing, emergency power and life-safety features. Phased buildings, temporary construction facilities and later fit-outs may require additional permits or inspections under the local process.

Utility approvals are a development condition, not an afterthought

Electricity is usually the critical-path utility for a data center, but water and sewer capacity can also determine whether a site is viable. The serving providers control interconnection, substation or feeder upgrades, voltage and redundancy requirements, water pressure and flow, sewer discharge capacity, connection points, easements and construction responsibilities.

Request written availability and capacity terms early. Local conditions may make those documents prerequisites to civil approval. Confirm whether the provider’s commitment covers the initial load, ultimate build-out and backup generation configuration. A preliminary conversation is not the same as a capacity reservation or executed service agreement.

Georgia’s Department of Audits and Accounts, in a revised January 2026 summary, warned that rapid data-center growth could place short-term strain on the electric grid and local water and sewer infrastructure. That statewide observation makes provider documentation particularly important during site comparison.

Environmental and infrastructure permits triggered by site facts

Tyrone cautions that other state and federal permits may be required. The exact set depends on the parcel, design and operating systems. Screen these conditions before acquisition:

Georgia’s data-center sales-tax exemption is separate from construction permission

The high-technology data-center equipment sales-and-use tax exemption is an incentive. It does not authorize a land use, waive zoning, or replace any permit. The Georgia Department of Revenue directs applicants to Rule 560-12-2-.117 and requires documentation of planned qualifying expenditures and new quality jobs.

For applications filed on or after May 9, 2022, the 2022 rule version sets the following minimums:

County population Average new quality jobs Qualifying expenditures Rule qualification
More than 50,000 25 $250 million Minimums for applications on or after May 9, 2022
30,001–50,000 10 $75 million Minimums for applications on or after May 9, 2022
30,000 or fewer 5 $25 million Minimums for applications on or after May 9, 2022

The thresholds are county-based, so verify the population category that applies to the project location under the rule in effect for the application.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What counts as a quality job?

A qualifying job generally requires at least 30 hours per week in the county on data-center matters and pay of at least 110% of the county average wage. The applicant must document the jobs and maintain the required reporting.

What spending qualifies?

Qualifying expenditures can include design and construction costs and eligible equipment. The real property itself is not exempt. Separate eligible and ineligible costs in the project accounting system from the beginning.

Certificate, bond and compliance

The owner or qualifying customer applies electronically for an exemption certificate. The Department of Revenue may require a bond of up to $20 million. A certificate can be revoked if the project fails investment, job or reporting requirements, so treat the incentive as contingent rather than automatic.

What the statewide figures mean for project planning

The Department of Audits and Accounts’ revised January 2026 summary reports $474.2 million in forgone state tax revenue in fiscal year 2025. It attributes 8,505 construction jobs and 1,641 operations jobs to activity attributed to the credit. These figures describe statewide activity and do not guarantee that an individual project will qualify or receive a particular benefit.

The same summary’s warning about grid, water and sewer pressure reinforces a practical rule: demonstrate infrastructure capacity before treating a parcel as buildable. A favorable tax analysis cannot cure a utility shortfall.

How to compare Georgia sites before acquisition

Use the same written questions for every candidate jurisdiction. The most important comparison axes are:

Decision area Questions to answer in writing
Zoning entitlement Is the use permitted, conditional or prohibited? Is rezoning required? Who decides and what hearings apply?
DRI Does the project meet current DRI thresholds, including planned phases?
Site and architectural review Which body reviews the plans, and what standards govern height, screening, materials, lighting and equipment?
Land disturbance and stormwater Which agency issues each approval, what plans are required and are approvals prerequisites to grading?
Electric service What firm capacity, redundancy, interconnection work, schedule and cost responsibility are documented?
Water and sewer Are flow, pressure, discharge and ultimate build-out capacity available under written terms?
Noise and generators What limits apply to construction, generator testing, cooling equipment and nighttime operation?
Environmental exposure Are wetlands, streams, floodplain, emissions, wastewater or fuel-storage permits likely?
Public process What is the hearing sequence, notice requirement and appeal path?
Local policy and incentives Are there current incentives, moratoriums, development agreements or pending code changes?

A practical permit-matrix workflow

  1. Before signing a purchase agreement: Obtain the zoning map, code provisions, comprehensive-plan designation, overlay requirements and any moratorium notice.
  2. Define the complete project: Include all data halls, substations, generators, fuel tanks, cooling plants, offices, roads, stormwater facilities and planned phases.
  3. Ask for written determinations: Request zoning classification, permitted-use interpretation, DRI applicability and the list of required local reviews.
  4. Screen physical constraints: Commission wetlands, stream, floodplain, geotechnical, environmental and utility-capacity investigations.
  5. Obtain provider commitments: Secure written electric, water and sewer availability, connection requirements and cost responsibilities.
  6. Coordinate the entitlement package: Align rezoning materials, DRI submissions, site plans, architectural elevations, grading and stormwater designs.
  7. Track conditions and dependencies: Put every hearing condition, agency comment, utility prerequisite and permit expiration into a responsibility matrix.
  8. Apply for the tax certificate separately: Document qualifying jobs and expenditures, and plan for bond and reporting obligations under Rule 560-12-2-.117.
  9. Do not mobilize prematurely: Follow the local government’s written authorization sequence; Tyrone expressly states that construction cannot begin until required approvals and permits are obtained.

Bottom line for owners and builders

A Georgia data center needs a coordinated local entitlement and permitting strategy. The decisive early questions are whether the use is allowed at the proposed site, whether rezoning or a special-use approval is needed, whether DRI applies, and whether electric, water and sewer providers can document capacity. After land-use approval, the project still needs site-plan, architectural, land-disturbance, stormwater and building approvals, plus any environmental or infrastructure permits triggered by the site and equipment. Treat the sales-tax exemption as a separate, compliance-based incentive—not as permission to build—and confirm every requirement in a current written permit matrix before acquisition or construction.
