Residential deconstruction is usually handled through the same local demolition or building-permit system used for a conventional tear-down. You normally need the authority having jurisdiction (AHJ) to confirm the trigger, issue a permit, clear utilities and hazardous materials, complete pre-work inspections, document required salvage, and approve final inspections before the job is closed.
There is no national checklist. Portland, Montgomery County, Maryland, and Austin, Texas, all require demolition permits but use different thresholds, forms, reviews, notification periods, and inspection sequences. Treat the examples below as a framework for questions to ask your own building department, not as a substitute for its current written requirements.

Why the permit question is local
“Deconstruction” means carefully taking a structure apart to recover materials, while “demolition” generally means removing it by mechanical or other destructive means. Permit offices often regulate both through demolition or building-permit rules because either activity can affect structural stability, utilities, neighboring property, erosion, trees, historic resources, and hazardous-material exposure.

The controlling agency may be a city, county, or another local authority. Before scheduling labor or advertising salvage, ask the AHJ for its current residential-demolition or deconstruction checklist. Confirm whether your project is a complete razing, a partial removal, an addition or remodel, or work on a historic resource. The answer determines which applications, plans, notices, and inspections apply.

When a demolition or deconstruction permit is triggered
| Jurisdiction | Trigger or scope rule | Additional requirements identified in official guidance |
|---|---|---|
| Portland | A demolition permit is required for a structure that needed a building permit; a separate permit is required for each structure. | Historic-resource notification or delay and environmental-overlay rules may apply. Houses and duplexes built in 1940 or earlier, and certain historic resources, are covered by the deconstruction ordinance. |
| Montgomery County | A permit is required for complete razing or when less than 33% of first-story exterior habitable-space walls remain. | Utility-disconnection letters and asbestos removal are required before demolition. |
| Austin | Demolition review and notification apply when more than 50% of exterior walls are removed in an addition or remodel. | Historic-preservation review applies to residential structures 45 years or older. Tree and environmental review can apply where protected trees or site controls are affected. |
These thresholds are not interchangeable. A project that falls below a partial-wall threshold in one jurisdiction can still require a permit in another. Ask whether the measurement is based on exterior walls, habitable-space walls, a percentage of the entire structure, or the scope shown on approved plans.
Seven steps from concept to permit close-out
1. Confirm the jurisdiction and exact trigger
- Identify every parcel and structure involved, including detached garages or accessory buildings.
- Describe the work in writing: full removal, selective interior salvage, partial wall removal, addition, remodel, or full deconstruction.
- Ask the AHJ whether each structure needs its own permit and whether a building permit, demolition permit, or both are required.
- Request the current application, fee schedule, plan requirements, inspection list, and close-out checklist.
Do not rely on a contractor’s description such as “interior-only” or “mostly salvage.” The permit office decides whether the proposed scope crosses its removal threshold.
2. Check zoning, historic, tree, and environmental overlays
Permit eligibility can change after an overlay review. Portland flags historic-resource notification or delay and environmental-overlay rules. Austin requires historic-preservation review for residential structures at least 45 years old and may require tree or environmental review when protected trees or site controls are affected.
Provide the address, age of the building, site plan, and a description of trees, slopes, waterways, or other regulated features at the first inquiry. Ask whether an overlay creates a waiting period, a separate approval, a protection plan, or a requirement to revise the demolition method.
3. Assemble the permit packet
A complete packet commonly includes:
- Demolition or building-permit application.
- Site plan showing the structure, property lines, access, protection measures, and nearby features.
- Site-controls, erosion, or environmental plan when required.
- Pre-demolition survey and asbestos survey.
- Owner acknowledgments and any structural, tree, or historic-resource plans.
- Close-out evidence, such as disposal records or deconstruction documentation, where the AHJ requires it.
Portland expressly lists these types of materials. The reviewer may return an incomplete packet without starting substantive review, so check whether surveys must be performed by qualified professionals and whether the documents must be uploaded in a particular format.

4. Obtain utility and hazardous-material clearances
Utilities normally must be disconnected, capped, or otherwise addressed before demolition activity. Montgomery County requires utility-disconnection letters and asbestos removal before demolition. Austin requires service-disconnect requests, verifies that utilities are capped or addressed, and requires refrigerant-disposal documentation.
Coordinate electric, gas, water, sewer, communications, and fuel systems separately. Keep the written confirmations: the permit office may require them before issuing the permit or before allowing the last pre-demolition inspection. A shutoff at an interior valve is not automatically the same as an approved service disconnection.

Portland’s guidance also identifies lead-paint-removal inspections; its lead-hazard reduction rules use January 1, 1978, as a threshold for painted exterior surfaces. If asbestos or lead is present, use the abatement and disposal process required by the AHJ. The presence of either material does not exempt a Portland project from its deconstruction requirements.
5. Complete pre-work inspections and required notice
Do not begin dismantling simply because an application was submitted. The inspector may need to verify site conditions, utility status, environmental protections, and trade permits before work starts.
Portland’s inspection sequence includes pre-demolition, lead-paint-removal, and mechanical-demolition checks. Austin’s last inspection before demolition verifies tree and environmental protections, capped utilities, and trade permits. Austin then requires a minimum five-day notification window after the acknowledgment is uploaded.

Where a local deconstruction ordinance applies, salvage is part of permit compliance rather than an optional sustainability feature. Portland-covered projects must use a certified deconstruction contractor, track salvaged, recycled, and disposed materials, submit a post-deconstruction form, and obtain Bureau of Planning and Sustainability approval before final inspections.
Set up a material log before work begins. Record what was salvaged, recycled, or disposed of and retain supporting receipts or other records required by the local form. Separate hazardous materials from reusable materials and do not represent contaminated or regulated components as salvageable merely because they have resale value.
7. Schedule final inspections and close the permit
Permit close-out is an affirmative approval, not the absence of a complaint. Portland requires approval of deconstruction documentation before final inspections. Austin lists final tree, environmental, and building inspections. Other jurisdictions may add utility, erosion, or site-restoration inspections.
Ask the AHJ which final inspections are required for your scope, schedule each one, respond to corrections, and obtain written final approval. Keep the closed permit, inspection reports, surveys, disposal records, and deconstruction forms with the property records.

Portland: a detailed deconstruction example
Portland’s ordinance covers houses and duplexes built in 1940 or earlier and certain historic resources. A certified contractor must submit a Pre-Deconstruction Form before permit issuance, carry out the required salvage and disposal tracking, submit a Post-Deconstruction Form, and receive Bureau of Planning and Sustainability approval before final inspections.
The city states: “No separate permit is required for deconstructing a house.” That statement means deconstruction is handled through the applicable demolition-permit process; it does not mean the work is permit-free. The project still needs the required demolition permit, surveys, utility clearances, inspections, contractor qualification, and close-out documentation.
Asbestos or lead does not create an exemption from Portland’s deconstruction ordinance. Abatement and proper disposal remain required, and lead-paint-removal inspections may be part of the sequence. Confirm whether a historic-resource notice or environmental-overlay review adds time before you set a start date.

Montgomery County
The county’s less-than-33% first-story exterior habitable-space-wall threshold is a specific trigger for its residential-demolition guidance. Complete razing also requires a permit. Utility-disconnection letters and asbestos removal must be completed before demolition, so schedule those clearances early rather than treating them as paperwork after removal begins.
Austin
Austin’s more-than-50%-of-exterior-walls rule applies to additions or remodels and can bring demolition review and notification into a project that is not described as a full tear-down. Historic-preservation review applies to residential structures 45 years or older. Where protected trees or environmental site controls are involved, the last pre-demolition inspection checks those protections along with capped utilities and trade permits. After the acknowledgment is uploaded, the city requires at least five days of notification before demolition.

Can a homeowner deconstruct the house?
There is no universal yes-or-no answer. The AHJ may require a licensed or certified contractor, specialized abatement professionals, or trade permits even when the owner is doing the labor. Portland-covered projects specifically require a certified deconstruction contractor. In every jurisdiction, the owner remains responsible for obtaining the correct approvals and ensuring that hazardous-material, utility, structural, and environmental requirements are met.
Before choosing self-performed work, ask the permit office four questions: whether an owner may be the permit applicant, whether a certified deconstruction contractor is mandatory, which work must be performed by licensed trades, and who may conduct asbestos or lead abatement. Obtain the answer in writing if the project’s eligibility depends on it.
Pre-application checklist
- Address, parcel number, building age, and a list of every structure to be removed.
- Written scope identifying full, partial, mechanical, or selective deconstruction.
- Current demolition/building application and local fee information.
- Site plan plus erosion, tree, environmental, structural, or historic plans triggered by the site.
- Pre-demolition and asbestos surveys; lead documentation where applicable.
- Utility-disconnection requests, letters, and capping confirmations.
- Refrigerant-disposal documentation where required by the jurisdiction.
- Qualified contractor information and owner acknowledgments.
- Inspection sequence, notice period, and method for scheduling inspections.
- Salvage, recycling, disposal, post-deconstruction, and final-approval forms.
Common causes of delay
- Using the wrong threshold: A partial remodel can cross a local wall-removal percentage even when the owner does not call it demolition.
- Missing overlay review: Historic, tree, or environmental controls can add approvals or a notice period.
- Starting before clearances: Utility letters, asbestos abatement, refrigerant records, or pre-demolition inspections may be prerequisites.
- Incomplete documentation: A permit can remain open until salvage logs, disposal evidence, or post-deconstruction forms are approved.
- Assuming one structure equals one permit: Portland requires a separate permit for each structure that falls within its rule.
Rules, fees, inspection codes, and notice periods change. Verify the current official checklist with the AHJ immediately before filing and again before work starts. No national permit-count or inspection-count statistic applies because residential deconstruction is governed by local rules.
