What Permits and Environmental Reviews Does a Marine Fuel Pier Require?

For a U.S. marine fuel pier, the starting permit screen usually includes U.S. Army Corps of Engineers authorization under Rivers and Harbors Act Section 10 for structures or work in navigable waters, Clean Water Act (CWA) Section 404 authorization for regulated dredged or fill discharges, and CWA Section 402 NPDES coverage for regulated pollutant discharges such as construction or industrial stormwater. Those are not a universal package: the exact requirements depend on the site, dredging and fill, discharge points, federal approvals or funding, fuel-storage and transfer design, and state, tribal, and local jurisdiction. NEPA review and resource consultations apply when their specific federal-action and statutory triggers are met.

Why the permit list depends on the project

A “marine fuel pier” can describe very different work: a fixed pier with piles, dolphins and a transfer arm; a floating berth; dredging to create a turning basin; tanks and pipelines on shore; truck-loading areas; stormwater controls; or all of these together. Regulators do not issue one nationwide marine-fuel-pier permit. They evaluate each activity, its location and its environmental effects.

The first scoping questions are:

  • Where exactly is the project, and which state, tribal government, municipality, port, coastal zone and U.S. Army Corps district have jurisdiction?
  • Will piles, bulkheads, dolphins, cables, intake or outfall structures, dredging, fill, temporary work pads or access roads enter waters or wetlands?
  • Where will dredged material be transported and placed?
  • What water discharges will occur during construction and operation?
  • Will a federal permit, federal funding or federal project decision be involved?
  • What fuel volumes, tanks, pipelines, vapor controls, combustion equipment and transfer operations are proposed?

Answering those questions produces a permit matrix rather than an assumption that every possible environmental program applies.

Federal approvals at a glance

Project activity or issue Potential legal trigger Typical lead authority What the review addresses
Pier, piles, dolphins, bulkhead, dredging or other work in navigable waters Rivers and Harbors Act Section 10 U.S. Army Corps of Engineers Whether the structure or work is regulated at that location and which permit path applies
Dredged or fill material discharged into jurisdictional waters or wetlands Clean Water Act Section 404 Corps, unless an approved state or tribal program has assumed authority for the activity Avoidance and minimization of aquatic impacts, and compensation for unavoidable impacts
Construction runoff, industrial stormwater, wash water, process water or another pollutant discharge Clean Water Act Section 402 NPDES EPA or an authorized state, territory or tribal authority Discharge points, pollutants, receiving waters, monitoring and controls
Federal permit, funding or other federal decision National Environmental Policy Act The federal agency making or recommending the action Environmental effects and reasonable alternatives through the applicable review level
Ocean disposal of dredged material seaward of the U.S. baseline Marine Protection, Research and Sanctuaries Act Corps for dredged material, with EPA review and concurrence Characterization, transport and suitability of the proposed ocean-disposal site
Stationary combustion, storage, vapor-control or other emission sources Applicable air-program thresholds, including New Source Review in qualifying cases EPA or the authorized state or local air agency Emissions, controls, construction and operating authorization
Regulated hazardous-waste treatment, storage or disposal Resource Conservation and Recovery Act permit programs EPA or an authorized state Only activities that meet the hazardous-waste treatment, storage or disposal triggers

Several rows can apply to one project, and one authorization does not replace another. In particular, NPDES coverage does not authorize a pier under Section 10 or a dredged/fill discharge under Section 404.

Corps authorization: Section 10 and Section 404 are different

Section 10 for structures and work

Section 10 screening covers structures or work in navigable waters. A pier deck, piles, dolphins, bulkhead, dredging and related construction may fall within this pathway, but coverage depends on the precise waterbody, location and work method. A feature’s presence on a conceptual drawing is not itself a jurisdictional determination.

Contact the relevant Corps district early and request a jurisdictional and permit-path determination. Provide coordinates, ordinary high-water or shoreline information, plan and profile drawings, pile and construction methods, dredging limits, temporary work areas and a description of the completed facility. The district can then indicate whether an authorization is needed and whether a general or individual permit process is appropriate.

Section 404 for dredged or fill discharges

Section 404 requires authorization before a regulated discharge of dredged or fill material into jurisdictional waters or wetlands unless an exemption applies. Filling for a causeway, shoreline stabilization, access pad, pile-related work or other facility component may be relevant, as can the placement of dredged material. The Corps generally administers Section 404, although an approved state or tribal program can assume authority for portions of the program while federal jurisdiction remains for other matters.

A qualifying activity with minimal environmental effects may fit a general permit. Potentially significant impacts can require an individual permit. The application must show how the design avoids and minimizes aquatic impacts and how remaining unavoidable impacts will be compensated. Reducing the footprint, relocating a transfer line, using a trestle instead of fill, changing pile spacing or selecting a different dredging method can affect both permit eligibility and mitigation obligations.

NPDES coverage for construction and operating discharges

Screen every point where construction or operation could discharge a pollutant to waters of the United States. The analysis commonly includes:

  • Runoff from clearing, grading, pier construction, tank foundations, roads and staging areas;
  • Industrial stormwater exposed to fuel, lubricants, cargo, waste or material-handling areas;
  • Equipment or vehicle wash water;
  • Process water, hydrostatic-test water or other wastewater; and
  • Any pipe, ditch or other outfall to a receiving water.

Coverage may be under an individual permit or a general permit. EPA administers the program where a state, territory or tribal authority has not been authorized; otherwise, the authorized authority administers its program. Identify each discharge point and receiving water on the site plan, determine which permit and current forms apply, and obtain coverage before a regulated discharge occurs. Stormwater authorization does not legalize an unpermitted dredged/fill discharge or construction in navigable waters.

When NEPA and related consultations apply

NEPA is tied to a federal action

The National Environmental Policy Act is triggered by a qualifying federal action, such as a federal permit approval, federal funding decision or federal project. A privately proposed pier does not automatically require an environmental impact statement merely because it is a pier or handles fuel. The federal agency with decision authority determines the applicable process, which can include an environmental assessment or an environmental impact statement.

The lead agency evaluates environmental effects and reasonable alternatives. A Corps permit may make the Corps the lead or a cooperating agency, while another federal agency can lead when it controls the action or has special expertise. Ask the lead agency which review level applies and what information it needs before submitting a complete application.

Consultations and consistency reviews

A federal action can also bring additional reviews when their statutory triggers are present. Screen the design and site for:

  • Endangered Species Act effects on listed species and critical habitat;
  • National Historic Preservation Act Section 106 effects on historic properties and archaeological resources;
  • Coastal Zone Management Act consistency with an approved coastal program;
  • Wild and Scenic Rivers Act restrictions, if a designated river is affected;
  • Fish and Wildlife Coordination Act consultation; and
  • Magnuson–Stevens Act essential fish habitat consultation.

These are conditional reviews, not automatic approvals attached to every fuel pier. Species surveys, cultural-resource studies, coastal-consistency materials or fish-habitat analysis may be necessary when the site and project effects create the relevant trigger.

Dredging and disposal: the destination changes the permit path

Dredging has two separate regulatory questions: authorization to perform the dredging and authorization for where the material will go. Characterize the material before selecting a disposal route. The sampling plan, contaminants, grain size, quantity, transport method and disposal location can all affect the analysis.

Ocean disposal seaward of the baseline

The Marine Protection, Research and Sanctuaries Act can apply when dredged material is placed in ocean waters seaward of the U.S. baseline. The Corps issues permits for dredged material, subject to EPA review and concurrence. EPA issues permits for other regulated ocean-dumped material. Do not infer that a project needs an MPRSA permit simply because it is called “marine.” Confirm the disposal coordinates and whether they are seaward of the baseline.

In-harbor or other landward placement

Placement in a harbor or another site landward of the baseline follows a different CWA analysis. It may involve Section 404, an upland disposal facility, beneficial-use placement or another approved management method. The selected site must be shown in the permit application; a vague statement that material will be “disposed of nearby” is not a disposal plan.

Air, hazardous-waste, oil-spill and transfer screens

Air permits

Evaluate stationary sources such as emergency or prime generators, boilers, vapor-control equipment, tank vents and other emission units. New Source Review can apply to a new stationary source or a qualifying modification when the applicable program thresholds are met. The responsible air agency—EPA or an authorized state or local program—will need source details, pollutants, control equipment and operating conditions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Hazardous-waste requirements

A fuel pier does not automatically need a hazardous-waste permit. Screen for hazardous-waste treatment, storage or disposal only if the facility will conduct an activity covered by that program. Spent materials, contaminated soil, tank-cleaning residues and maintenance wastes still require proper classification and management even when the facility is not a permitted hazardous-waste treatment, storage or disposal site.

Spill prevention and oil-transfer rules

Fuel tanks, piping and transfer operations warrant an oil-spill prevention screen. EPA identifies Spill Prevention, Control, and Countermeasure (SPCC) planning among CWA responsibilities, but applicability depends on operational facts such as oil storage, containment and the potential to discharge. Confirm the requirements against the final tank inventory and containment design.

Separate Coast Guard oil-transfer requirements may apply depending on the facility and transfer configuration. Confirm those requirements with the Coast Guard rather than treating an environmental permit as a substitute for transfer-safety authorization.

State, tribal and local approvals

Federal screening cannot produce a complete permit list without the location. Depending on the jurisdiction, investigate:

A project workflow that prevents late permit surprises

  1. Fix the jurisdiction. Establish the country, state, county or municipality, tribal lands, coastal-zone status, port, shoreline owner and Corps district. Record the coordinates and all adjacent waterbodies.
  2. Define the physical footprint. Map the pier, piles, dolphins, bulkhead, dredging limits, fill, temporary trestles, work pads, access roads, pipelines, tanks, truck areas, power equipment and outfalls.
  3. Obtain a Corps pre-application view. Send concept drawings and construction methods to the relevant district and ask which Section 10 and Section 404 jurisdictions and permit types apply.
  4. Map environmental constraints. Identify wetlands, ordinary high-water boundaries, aquatic habitat, essential fish habitat, listed species and critical habitat, historic properties, archaeological resources and coastal-program boundaries.
  5. Inventory discharges. List construction runoff areas, industrial stormwater exposure, wash water, process water, test water and final outfalls. Identify each receiving water and determine NPDES coverage with EPA or the authorized authority.
  6. Identify the federal action. Determine which agency will issue a permit, provide funding or make another federal decision. Ask that agency whether an environmental assessment, environmental impact statement or a categorical exclusion is available and which consultations it will coordinate.
  7. Characterize dredged material. Establish the volume, sampling results, contaminants, transport route and proposed disposal location before choosing an in-harbor, upland, beneficial-use or ocean-disposal route.
  8. Screen operational programs. Compare the final design with air-emission thresholds, hazardous-waste activities, SPCC applicability and Coast Guard transfer rules.
  9. Confirm nonfederal approvals. Obtain written requirements from state, tribal, coastal, shoreline, port, fire, building and land-use authorities.
  10. Build a permit matrix. For every approval, name the activity, legal trigger, responsible authority, application or notice, design information, sequencing dependency and condition that must be satisfied before construction or discharge.

Information regulators will expect

A complete package normally needs more than a site plan. Assemble:

  • Surveyed plan and profile drawings with coordinates, water depths, shoreline and jurisdictional boundaries;
  • Construction sequencing, pile methods, dredging equipment, dewatering and temporary-work details;
  • Fill quantities, dredging volumes and alternatives considered to avoid or reduce aquatic impacts;
  • Wetland, habitat, species and cultural-resource information appropriate to the site;
  • Dredged-material sampling and the proposed transport and disposal plan;
  • Drainage plans showing every stormwater and wastewater discharge point;
  • Tank, pipeline, transfer-arm, containment, vapor-control and emergency-shutdown details;
  • Air-source calculations and control equipment descriptions where applicable; and
  • Ownership, leases, easements, coastal consistency information and local fire or building submissions.

Common mistakes and how to correct them

Treating one Corps permit as a complete authorization

Section 10 and Section 404 address different activities. Correct the error by listing structures/work and dredged/fill discharges separately, then checking each for its own permit path.

Ignoring stormwater until construction starts

Runoff from an otherwise permitted pier project can still require NPDES coverage. Correct the error by drawing drainage areas and outfalls during design and obtaining coverage before regulated discharge.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Choosing a disposal site after dredging is designed

A disposal destination can determine whether MPRSA or a different CWA analysis applies. Correct the error by characterizing material and selecting a feasible destination before finalizing dredging quantities.

Assuming NEPA means an automatic EIS

NEPA depends on a federal action and the lead agency’s review. Correct the error by identifying the federal decision and asking for the applicable review level rather than promising an EIS.

Leaving state and local approvals to the end

Coastal consistency, water-quality certification, submerged-land leases, fire-code review and port approvals can change the layout. Correct the error by contacting those authorities with the same preliminary footprint used for federal pre-application meetings.

What the project owner should take away

The defensible answer is a site-specific matrix, not a fixed number of permits. Start with Section 10, Section 404 and NPDES screening; then determine whether a federal action triggers NEPA and consultations. Resolve dredged-material disposal separately, and screen air, hazardous-waste, SPCC and Coast Guard transfer requirements against the operating design. Finally, obtain state, tribal and local approvals for the actual shoreline, ownership, storage capacity and engineering plan. The U.S. Environmental Protection Agency describes the CWA as “the primary Federal statute regulating the protection of the nation’s water,” but that statute is implemented through several distinct programs rather than one marine-fuel-pier license.
