For a new home in Hungary, the approval route depends on the building’s total useful floor area, height, residential use, the relationship to neighboring structures, and the legal status of the plot. A qualifying, exclusively residential home can use a simple-notification procedure; other projects generally require a building permit. Local townscape rules and site-specific heritage, environmental or agricultural controls can add procedures to either route.
Construction is not the final step. A newly built home normally needs an occupancy permit or acknowledgment before anyone can move in. The current national framework is Government Decree 281/2024 (IX. 30.), applied through the competent county or capital government office and the ÉTDR electronic system.

At a glance: the two main approval routes
| Question | Simple notification | Building permit |
|---|---|---|
| Typical project | New residential building used only for housing and supporting rooms | New home outside the simple-notification conditions, including projects with additional functions |
| Floor-area and height rule | No more than 300 m² total useful floor area | Generally applies when a new building exceeds 35 m² total useful area, exceeds a 4.5 m ridge height, or exceeds a 3.5 m parapet height for a flat roof, unless a notification rule or listed exception applies |
| Neighboring structure | Cannot require reinforcement of the foundation of a connected neighboring building | Separate permit triggers can apply to work affecting a party wall or the foundation of a terraced or semi-detached building |
| National-monument site | Not available for a new residential building on the site of a building that is a national monument | Heritage procedures and the permit route must be checked with the competent authority |
| How to file | Electronically through ÉTDR with the required central identification, or in person on electronic media at the competent building authority or a government window | Application handled by the building authority operating within the competent county or capital government office; ÉTDR supports electronic building and heritage proceedings |
| When construction can start | The authority has a 15-day prohibition period, counted from the first working day after receipt; if no prohibition is issued, the official guidance allows work to begin 20 days after that first working day | Do not start until the building permit is final and any conditions attached to it have been met |
The owner may choose the permit route even when a project could otherwise use simple notification. That can be useful when a project team wants a formal permit decision, but the choice does not remove local planning, townscape or special-protection requirements.

Section 16 of Government Decree 281/2024 allows simple notification for a new residential building with no more than 300 m² of total useful floor area when the building contains only residential functions and rooms that support those functions. The project must also avoid the neighboring-foundation condition and the national-monument exclusion shown in the table.

“Residential only” matters. A house that incorporates another regulated function, rather than merely normal rooms and installations supporting the dwelling, may fall outside the notification route. The architect should classify every proposed use before documents are prepared; a home office, workshop, guest accommodation, commercial unit or other activity may raise questions under local and national rules even when the building looks like an ordinary house.
Simple notification is a legal procedure, not an exemption from design control. The filing still requires the prescribed architectural and technical documentation. Local townscape consultation, a favorable townscape opinion, or another planning opinion may also be required. Work may begin only after the statutory waiting arrangement has run and only if no authority prohibition or separate approval prevents it.
When a building permit is required
The official construction portal describes a general permit trigger for new buildings that exceed the stated area or height limits, subject to the simple-notification rules and listed exceptions. The area and height tests should therefore be read together with the proposed use and the plot conditions. A small building can still require a permit if another rule applies, while a qualifying residential project can follow notification instead of the general trigger.
Separate permit rules can apply to work that affects a party wall or the foundation of a terraced or semi-detached building. This is particularly important for infill plots, attached houses and projects built close to an existing structure. The structural design should establish whether neighboring foundations need reinforcement before the owner selects a procedure.
Permit applications are handled by the building authority within the competent county or the capital government office. The exact application package depends on the project, but the authority will expect the prescribed architectural and technical material and any opinions or records required by local rules.

Plot checks that can add approvals
Local building and townscape rules
Before the architect fixes the site plan, check the municipality’s applicable local building rules and townscape ordinance. These rules can control placement, setbacks, height, roof form, materials, frontage, landscaping and the way a new building relates to the street. They also determine whether a townscape consultation, notification or formal opinion is needed.
A national simple-notification route does not cancel a municipal townscape process. If local rules require consultation, keep the record with the project file. Where a favorable townscape opinion is required, obtain it before filing the notification or permit application, or follow the local procedure for challenging an unfavorable opinion.

Check whether the parcel or nearby setting is affected by listed-building protection, an archaeological designation, a historic area or World Heritage status. Heritage authority involvement can create additional documentation, consultation or approval requirements. The national-monument exclusion for the notification route is only one example; a plot can have other heritage constraints that affect the design or procedure.
Nature protection and environmental designations
Protected natural areas and other environmental designations can trigger involvement by a nature-protection authority. Restrictions may concern the location of the building, vegetation removal, access, drainage, utility connections or construction impacts. The applicable status is parcel-specific, so obtain an official check rather than relying on a general statement about the municipality.
Agricultural land
If the parcel is agricultural land, changing it to a building or residential use may require a separate approval for the land to be used for another purpose. This land-use decision is distinct from the building procedure. Do not assume that a building notification or permit automatically authorizes the change in land use.

Documents and opinions needed for filing
Architectural and technical documentation
Both procedures rely on prescribed architectural and technical documentation. The package should describe the site, building design, dimensions, structure, intended uses and the technical solutions needed to show compliance. The architect and other required designers are responsible for producing the documents in the form required for the selected procedure.

Repair Windows errors before they cause bigger problemsFix Now →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Because the notification route can proceed without a conventional permit decision, accuracy at filing is especially important. The authority can prohibit work during its review period, and deficiencies or missing supporting material can prevent the project from lawfully starting. A complete package is not the same as a favorable outcome: local restrictions or special approvals can still control the project.
Townscape records and opinions
Depending on the municipality and the design, the filing can include a record of required professional townscape consultation, a favorable townscape opinion, or the relevant opinion after a challenge. If the design asks for an individual departure from applicable building rules, a planning-council or state chief architect opinion may also be required.
Ask the municipality which townscape document applies to the specific parcel and design. The answer can differ between neighboring sites because local ordinances, protected streetscapes and requested departures are not uniform across Hungary.
Electronic filing through ÉTDR
An applicant with the required central identification can submit a simple notification electronically through ÉTDR. The official guidance also permits filing in person on electronic media at the competent building authority or a government window. ÉTDR supports electronic building and heritage authority proceedings, so confirm the correct proceeding type and authority before uploading or delivering the package.

How the simple-notification timetable works
The Pest County Government Office guidance describes a 15-day period in which the authority may prohibit work. The count starts on the first working day after the notification is received. If no prohibition is issued, that guidance says work may begin 20 days after that first working day.
These are statutory time points for a complete notification under the described procedure, not a guarantee that a defective filing, an unresolved townscape issue or a missing special approval can proceed. Keep proof of submission and the date of receipt. If the authority issues a prohibition or requests action, stop and resolve the stated issue before starting.
For a building-permit project, the owner must wait for the permit to become final and comply with its conditions. A contractor’s availability, a signed design contract or the delivery of materials does not authorize an earlier start.

Build according to the notified or permitted plans. Changes to the building’s area, height, location, use, structural relationship to a neighboring building or other regulated feature can alter the approval route. A change that looks minor on site may require a new notification, a permit amendment or a separate approval.

Have the architect and structural designer review proposed changes before work is ordered. Do not rely on an informal agreement with a contractor or neighbor as a substitute for the authority procedure. Preserve the drawings, calculations, opinions, submission receipts and authority correspondence so the final occupancy file reflects what was actually built.

Occupancy approval before moving in
A building that was constructed through a building permit or simple notification generally may be used only after an occupancy permit or an occupancy acknowledgment. The owner applies once the building is fit for its intended use and safe to occupy.
The official guidance contains an exception for certain residential extensions of no more than 300 m². A newly built home is not that cited extension exception, so plan on an occupancy procedure for a new house. Do not schedule a move-in merely because construction work appears finished; the legal right to use the building depends on the applicable occupancy decision.
The occupancy submission should match the completed building and its approved or notified documentation. Unresolved deviations, missing safety-related information or incomplete systems can delay the process. Coordinate the final inspection and document collection with the architect and the authority before the intended handover date.

Practical sequence for a homeowner
- Confirm the parcel. Review ownership, boundaries, access, the local planning status and the municipality’s building and townscape rules.
- Screen special designations. Check heritage, archaeological, World Heritage, nature-protection and agricultural-land status before fixing the design.
- Define the proposed uses. List every room and activity, including any non-residential or commercial function that could affect eligibility.
- Have a Hungarian architect select the route. Apply the area, height, use, neighboring-structure and site tests together; do not use the area threshold alone.
- Prepare the professional package. Assemble the prescribed architectural and technical documentation and any structural material needed for the site conditions.
- Complete local consultation. Obtain the required townscape consultation record, favorable opinion or planning-council or state chief architect opinion where applicable.
- Submit through the correct channel. Use ÉTDR or the permitted in-person electronic-media route for a notification, or file the building-permit application with the competent county or capital authority.
- Wait for legal authorization to start. Observe the notification prohibition and commencement timetable, or wait for a final permit and its conditions.
- Control changes during construction. Ask the design team to check any change that affects regulated dimensions, use, location or neighboring structures.
- Apply for occupancy. Once the home is complete, fit for use and safe, obtain the required occupancy permit or acknowledgment before moving in.
Common mistakes that cause delays
- Treating simple notification as approval-free construction. The route still requires professional plans, local townscape checks and compliance with site protections.
- Using the 35 m² rule by itself. The general trigger must be read with the notification conditions, height limits, use and special rules.
- Checking zoning after design is complete. A local townscape restriction can force changes to placement, roof form, height or materials.
- Ignoring attached or neighboring structures. Foundation reinforcement or party-wall work can move the project into a different permit category.
- Starting during the waiting period. Count the notification timetable from the correct working day and retain proof of receipt.
- Assuming a land-use issue is covered by the building filing. Agricultural-land conversion can require a separate decision.
- Moving in when construction appears finished. A new home normally needs an occupancy permit or acknowledgment first.
What to confirm before signing a construction contract
Ask the architect to state in writing which approval route is proposed and why the project meets its conditions. The design brief should identify the total useful floor area, roof-height measurement, intended uses, neighboring structures and any requested departures from local rules.
Ask who will obtain townscape opinions, heritage or nature-protection decisions, agricultural-land approval and the occupancy authorization. Assigning those tasks prevents a gap between the architect’s filing and the contractor’s start date. Also agree that no design change affecting regulated dimensions or use will be built until its procedural consequences have been checked.
Fees, professional charges and local administrative costs vary by authority and project. The national guidance establishes the route and documents, but it does not provide one universal budget for every Hungarian home. Obtain a project-specific quotation and a written list of included approvals from the professionals you appoint.
