What Permits and Approvals Are Needed to Build a Data Center?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

There is no single nationwide “data center permit.” A project normally needs a coordinated set of local land-use and building approvals, environmental permits tied to its actual impacts, utility and energy-infrastructure approvals, and sometimes federal permits or environmental review. The exact list depends on the parcel, design, electrical load, cooling system, water and wastewater arrangements, generators, and any federal connection.

Start with the site, not the building

The first permitting question is whether the proposed use is allowed on the chosen parcel. City or county planning and zoning authorities control local land-use decisions, while construction departments issue code permits. Iowa’s Department of Natural Resources states that local governments have responsibility for zoning, local ordinances, and land-use decisions; the state agency does not issue one general permit for a data center.

  • Confirmation that a data center is a permitted use in the zoning district.
  • Rezoning, a conditional-use or special-use approval, or a variance.
  • Site-plan, subdivision, or land-development approval.
  • Consistency review against the comprehensive plan.
  • Access, road-opening, traffic, driveway, or right-of-way approvals.
  • Tree removal, land-clearing, grading, and erosion-control approvals.
  • Architectural, landscaping, lighting, noise, or design review.
  • Building, electrical, mechanical, plumbing, fire-code, and elevator permits.
  • Local stormwater, floodplain, utility-extension, and public-works approvals.

These are investigation categories rather than a universal checklist. Some jurisdictions combine them in one development application; others require separate applications and hearings. Ask the planning department for its current application checklist, hearing calendar, completeness requirements, and expiration rules.

Local rules can change during site selection

Local governments may pause or limit approvals while studying data-center impacts. Calvert County, Maryland, reported adopting a six-month moratorium on data-center site-plan approvals on August 18, 2026. The county cited potential effects involving generators, infrastructure, cooling, stormwater, wastewater, noise, heat, and water demand. That action is a local example, not a rule that applies nationally, but it demonstrates why a zoning memo should be refreshed immediately before land acquisition and again before filing.

Environmental permits follow impacts

Environmental agencies generally regulate what the facility emits, withdraws, discharges, stores, or disturbs—not the label “data center.” Iowa and Minnesota guidance identify several recurring impact categories. A permit may be required during construction, during operation, or both.

Air permits for generators and other equipment

Backup generators can trigger air-quality review even when they are intended for emergencies. Iowa DNR notes that a separate construction permit or modification is typically required for nearly every individual generator installed. Minnesota’s Pollution Control Agency also identifies air pollution from emergency backup generators as a permitting issue.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Applicability depends on generator type and rating, fuel, number of units, manufacturer emissions data, expected operating hours, testing schedule, control equipment, and state or local thresholds. Do not order equipment on the assumption that “emergency-only” means exempt. Give the air agency a complete equipment schedule before purchase and ask whether the agency wants one consolidated application, individual permits, or a permit modification for an existing source.

Also evaluate boilers, fire pumps, cooling equipment, fuel-burning heaters, and any temporary construction engines. Keep the permitted configuration aligned with the final design: changing generator size, fuel, stack arrangement, or operating hours can require a revised approval.

Water supply and withdrawal approvals

Identify the source and legal owner of every gallon used by the project:

  • Municipal water service may require a capacity reservation, new service, meter, backflow protection, and local utility approval.
  • Groundwater may require a well permit, construction authorization, registration, or a water-use permit.
  • Surface-water withdrawals can require a state allocation or withdrawal permit.
  • Reclaimed or industrial water may involve separate quality, connection, and treatment requirements.

Iowa lists water use among potential Department of Natural Resources permits. Cooling technology matters: an air-cooled design, closed-loop system, evaporative cooling, and hybrid system can have very different withdrawal and discharge profiles. Submit a water balance showing peak and average demand, makeup water, blowdown, treatment chemicals, and seasonal conditions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Wastewater, cooling blowdown, and sewer connections

Determine where cooling blowdown, water-treatment waste, sanitary sewage, and other process wastewater will go. A discharge to surface water generally requires a federal or state National Pollutant Discharge Elimination System (NPDES) permit. The U.S. Environmental Protection Agency describes NPDES as regulating point-source pollutant discharges to waters of the United States; EPA issues permits in some jurisdictions, while authorized states issue many others.

A discharge to a municipal sewer is not automatically permit-free. The receiving utility’s pretreatment ordinance may require industrial-user approval, discharge limits, sampling, pretreatment equipment, a capacity agreement, and ongoing reporting. Obtain written acceptance from the sewer authority before finalizing the cooling design. A private treatment system, land application, injection, or discharge to another conveyance creates additional, site-specific questions.

Construction stormwater and land disturbance

Large grading operations can require construction-stormwater coverage, erosion and sediment controls, and local stormwater-management approval. Iowa lists stormwater among possible permits, and Minnesota says project-dependent stormwater permits may apply. Check the applicable acreage threshold, whether a general permit or individual permit is required, and which agency receives the notice of intent.

The civil package commonly must show drainage areas, temporary and permanent controls, detention or retention, outfalls, construction phasing, stabilized entrances, inspection procedures, and a responsible person for maintenance. Permit coverage may be needed before earth disturbance, not merely before the building permit is issued. A change in site limits or phasing can require an amended filing.

Floodplains, wetlands, and other waters

A floodplain location may require floodplain-development approval, elevation documentation, compensatory storage, or restrictions on fill. Work affecting wetlands, streams, or other jurisdictional waters can involve state and federal review, including Clean Water Act processes. Iowa identifies floodplain permitting where state criteria are met.

Do not rely on a desktop map alone. Commission a site-specific wetland and waters delineation, verify ordinary high-water or jurisdictional boundaries where relevant, and request agency confirmation before design fixes the building pad, access roads, stormwater outfalls, or utility corridors. The sources available here do not establish current jurisdictional boundaries for a hypothetical site; those must be determined for the actual parcel.

Environmental review may be a separate approval gate

Some states require environmental review before related permits can be issued. Minnesota describes an environmental assessment worksheet followed, in some cases, by a more detailed environmental impact statement. Its guidance says Minnesota Pollution Control Agency permits cannot issue until the applicable state environmental review is complete.

The trigger can depend on project size, public financing, agency discretion, a sensitive resource, or another state-law category. A federal agency action—such as a federal permit, federal land decision, or federal funding—can also create a federal environmental-review process. Ask each potential lead agency early whether it expects to be the environmental-review lead, a cooperating agency, or only a permitting authority. Public notice, comment periods, hearings, and responses to comments can materially change the schedule.

Plan the electrical and fuel infrastructure as its own track

A data center’s electrical service is often a larger permitting program than the building shell. Early coordination should cover the serving utility, transmission or distribution owner, and applicable grid operator. Depending on the load and ownership structure, approvals may include:

  • Utility load studies, service agreements, and construction contributions.
  • Interconnection studies and an executed interconnection agreement.
  • Substation design and approval.
  • New transmission or distribution lines and associated rights-of-way.
  • Easements, road crossings, and vegetation-management permissions.
  • Onsite generation, battery systems, switchyards, and protective equipment.
  • Fuel storage, pipelines, tanks, delivery systems, and fire-code approvals.

Federal, state, and local authorities may regulate different pieces of the same electrical program. The Congressional Research Service has surveyed federal permit requirements affecting data-center energy infrastructure, including transmission, pipelines, substations, and generation. The White House’s Executive Order 14318, issued July 23, 2025, also discusses energy infrastructure serving qualifying projects. None of those materials creates a universal data-center interconnection sequence.

Request the utility’s current large-load process before signing a final site contract. The schedule can depend on available capacity, whether upgrades are network or customer-funded, queue position, generation ownership, and the need for new transmission. Treat utility studies and land-use approvals as linked critical-path items rather than waiting until the building permit is nearly complete.

When federal permits or review can enter the project

Federal involvement is fact-dependent. Potential triggers include federal land, a federal agency decision, federally regulated waters, federal funding, or energy infrastructure subject to federal authority. A federal statutory program does not necessarily mean that EPA or another federal office receives the application directly.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

EPA’s Permitting Authority Map explains that EPA directly administers some programs while states, territories, Tribal governments, and local agencies administer others under delegation, primacy, or authorization, with federal oversight. For every environmental permit, identify the actual receiving authority for the parcel and program, then confirm whether another agency must concur.

The 100-megawatt definition in Executive Order 14318

Executive Order 14318 defines a “Data Center Project” for purposes of that order as a facility requiring more than 100 megawatts of new load dedicated to specified artificial-intelligence activities. The order addresses federal permitting measures for qualifying projects and related covered components. The threshold is a legal definition within that order—not a general permitting threshold for all data centers. Check the order’s current legal status, implementing guidance, and eligibility before relying on it for a live project.

Sequence the approvals with a project permit matrix

There is no nationally correct order. Pennsylvania’s Responsible Infrastructure Development (GRID) requirements provide one example in which local approvals are prerequisites for final environmental-permit review in the circumstances covered by that program. Another state may use a different sequence.

Create a matrix before design development reaches a point of no return. Include these fields:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Matrix field What to record
Approval or permit Exact name used by the issuing agency.
Trigger Activity, threshold, equipment, discharge, acreage, or location that makes it applicable.
Lead and cooperating agencies Who receives the filing and who must review or concur.
Application package Plans, calculations, studies, ownership documents, modeling, and fees.
Public process Notice, hearing, comment period, or appeal opportunity.
Dependencies Approvals, environmental findings, easements, or utility commitments required first.
Construction hold point The work that cannot begin until approval or coverage is effective.
Operating obligations Monitoring, reporting, inspections, renewals, testing, and record retention.

A practical early-stage sequence

  1. Screen the parcel. Confirm zoning, comprehensive-plan status, floodplain and wetland constraints, utility capacity, water source, sewer destination, and access.
  2. Hold a multi-agency pre-application meeting. Bring a concept plan, preliminary load, generator schedule, cooling concept, grading limits, and discharge assumptions.
  3. Lock the impact studies. Commission surveys and modeling for wetlands, traffic, stormwater, noise, air emissions, water demand, wastewater, and cultural or historic resources where applicable.
  4. File local land-use applications. Track hearings, conditions, vesting rules, and any moratorium or interim ordinance.
  5. Advance utility and energy applications. Submit load and interconnection requests, reserve capacity, and secure rights-of-way or easements.
  6. Submit environmental applications in the required order. Obtain construction-stormwater coverage, air approvals, water and wastewater permits, floodplain or waters permits, and fuel-storage approvals as triggered.
  7. Obtain building and trade permits. Make sure the permit drawings match the approved civil, utility, fire, generator, and fuel designs.
  8. Complete inspections and operating authorizations. Schedule electrical, fire, mechanical, plumbing, stormwater, and air-equipment inspections; collect certificates, coverage confirmations, and monitoring procedures before commissioning.

Information agencies will need from the project team

A precise permit determination normally requires, at minimum:

  • Street address, parcel numbers, ownership, and jurisdictional boundaries.
  • Current zoning, proposed use, site acreage, building footprint, and grading limits.
  • Wetland, stream, floodplain, habitat, historic-resource, and geotechnical information.
  • Cooling technology, water source, treatment chemicals, peak demand, and blowdown volume.
  • Sanitary, process, and stormwater destinations and the receiving utility or water body.
  • Generator count, size, fuel, stack data, operating hours, testing plan, and emissions controls.
  • Electrical load, phasing, interconnection point, substation or transmission work, and onsite generation.
  • Fuel tanks, pipelines, battery systems, fire protection, and hazardous-material inventories.
  • Construction schedule, disturbance acreage, contractors, and proposed operating date.
  • Any federal land, federal funding, federal permit, or federal-agency decision involved.

Common failure points and how to avoid them

  • Assuming the building permit covers the whole project: maintain separate tracks for land use, environmental impacts, utilities, and operations.
  • Buying generators before air review: obtain written applicability advice and preserve flexibility in the equipment schedule.
  • Designing cooling before confirming water and sewer capacity: secure written utility conditions and model peak as well as average flows.
  • Disturbing ground before stormwater coverage: define the disturbance boundary and construction phases before mobilization.
  • Ignoring linear infrastructure: include transmission, substations, pipelines, access roads, and easements in the permitting map, not just the campus parcel.
  • Using an old checklist: verify ordinances, agency forms, thresholds, moratoria, and delegated-authority contacts immediately before filing.
  • Leaving permit conditions to commissioning: assign an owner for each inspection, report, renewal, monitoring point, and operating limitation.

Bottom line for a proposed site

Begin with a parcel-specific permit matrix and a pre-application meeting involving planning, building, environmental, utility, and fire authorities. A defensible matrix identifies the trigger, agency, studies, sequence, construction hold point, and operating duty for every approval. Until the address, design, water and wastewater paths, generator program, electrical load, and federal connections are known, no one can responsibly provide a final permit list.
