What Is Permission in Principle (PiP), and When Should You Use It? England Guide (2026)

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

In England, a permission in principle (PiP) application is an early planning consent that asks whether a site is suitable in principle for a defined location, land use and amount of development. It is most useful when you need an answer on those fundamentals before spending time and money on a detailed design. PiP is not permission to start work. You must obtain technical details consent (TDC) before development can proceed.

Permission in principle in one sentence

The Planning Practice Guidance states that “the scope of permission in principle is limited to location, land use and amount of development.” Those three matters are settled at the first stage. Design, appearance, access arrangements, mitigation, drainage, landscaping, construction details and contributions to essential infrastructure are dealt with later through TDC.

The system applies to England. The official term is permission in principle, although people often search for “planning in principle application”. The framework comes from the Housing and Planning Act 2016, the 2017 Permission in Principle Order and national planning guidance, alongside the local development plan used by the relevant local planning authority (LPA).

What PiP decides—and what it does not

Stage Question answered What it does not authorise
Permission in principle Is this location acceptable for the proposed use, and is the proposed amount of development acceptable in principle? Starting construction, fixing the building design, or implementing detailed mitigation.
Technical details consent Are the detailed proposals acceptable, including design, impacts, mitigation and infrastructure matters? Any works beyond the terms of the consent that is actually granted.

Receiving PiP therefore gives you an important planning decision, but it is not a building licence. A developer who starts work after PiP but before TDC risks carrying out development without the required planning permission.

Who can use the application route?

The direct application route is intended for eligible minor housing-led development. The guidance also allows some non-residential development where housing provides the majority of the scheme’s overall floorspace and the other proposed use is compatible with that housing. A scheme that is primarily commercial, industrial or another non-housing use will not fit this route merely because it includes a small number of homes.

Before preparing an application, test the proposal against the statutory eligibility rules and the LPA’s current local development plan. “Minor” is a legal planning category, not simply a description of a small project. If the site or scheme falls outside the permitted category, the LPA may be unable to grant PiP through this route.

The two ways a site can obtain PiP

1. A direct application to the local planning authority

An applicant submits a valid PiP application to the LPA for an eligible minor, housing-led proposal. The authority considers the relevant development plan and other material considerations, carries out the required publicity and consultation, and then decides whether to grant or refuse PiP. The application is deliberately narrower than a full planning-permission submission: the authority considers location, land use and amount rather than determining the detailed design at this stage.

2. The brownfield land register route

LPAs maintain brownfield land registers for previously developed land that may be suitable for housing. The register has two parts. Inclusion in Part 1 does not itself grant permission in principle. A site must pass the applicable process and be entered in Part 2 for PiP to be granted through the register route.

This route is also housing-led and subject to statutory eligibility, consultation and publicity requirements. A landowner should therefore treat a Part 1 listing as an indication that the authority considers the site potentially suitable for the register—not as consent to build or as a substitute for TDC.

What the LPA considers at PiP stage

The LPA must apply relevant development plan policies unless material considerations indicate otherwise. The decision is limited in scope, but it is still a planning decision: the authority can consider the policies and material issues relevant to whether the location, use and amount are acceptable in principle.

Because PiP is not a detailed design approval, the national guidance says an authority cannot require the same level or type of information that it could require for an ordinary full planning-permission application. That does not mean an application can be unsupported. You still need enough information for the authority and consultees to understand the site, the proposed use and the amount of development, and to assess the in-principle planning issues.

Consultation and publicity periods

Both routes involve statutory consultation and publicity. The periods differ depending on whether you submit an application or the site is being considered through the brownfield register.

Route Site notice period described in national guidance Online notice period
Direct PiP application 14 days 14 days
Brownfield register site 21 days 14 days

These are the periods described in the national guidance, not a promise that every local notice will look identical. Check the LPA’s current instructions, notice wording and submission deadlines. Comments need to arrive within the applicable period to be considered as part of the consultation.

When PiP is a sensible choice

You need an early answer on the fundamentals

PiP can be valuable when the main investment decision depends on whether a site can support a particular use and quantum of development. For example, before commissioning a full architectural package, you may need to know whether the authority is prepared to accept housing on the location and whether the proposed number of homes is realistic in principle.

The site has a credible housing-led concept but details are not ready

A staged approach can avoid developing a detailed scheme around an unacceptable use or scale. It is particularly useful where the broad development proposition is clear but the final layout, appearance and technical mitigation will require surveys, design development and consultation.

You can manage two planning stages

PiP creates a separate TDC stage. That can improve certainty about the fundamentals, but it also means another application, another decision and another opportunity to resolve technical issues. Choose it only if your programme, funding and professional team can accommodate that sequence.

When a direct full planning application may fit better

PiP is not automatically faster, cheaper or better than applying for full planning permission. The official materials establish the sequence and scope, not a universal saving in time or cost. A direct full application may suit a proposal whose design is already mature, a project that needs a single comprehensive decision, or a scheme that does not meet the housing-led PiP eligibility rules.

Consideration PiP followed by TDC Full planning-permission application
First decision Location, land use and amount only Detailed proposal and the principle of development are considered together
Construction Not allowed after PiP alone; TDC is required Can proceed only in accordance with the full permission and its conditions
Best fit Early certainty is needed before detailed design, and the scheme is eligible minor housing-led development Design is sufficiently developed or the proposal falls outside PiP eligibility
Process structure Two linked consent stages One principal application covering the detailed scheme

The choice is a project decision, not a guarantee of outcome. Compare the value of early certainty with the work and risk of a second consent stage.

How to prepare a direct PiP application

  1. Confirm the jurisdiction and policy context. PiP in this article is the English system. Identify the LPA, read the adopted local development plan and check any neighbourhood-plan policies, allocations, constraints and current brownfield-register information that affect the site.
  2. Test statutory eligibility. Confirm that the proposal is minor development, housing-led and otherwise within the application route. If it includes another use, establish that housing is the majority of the overall floorspace and that the non-residential use is compatible with the proposed homes.
  3. Define the three in-principle parameters. State the site location, the land use and the amount of development precisely. “Housing on the site” is less useful than a clearly expressed amount and use that the LPA can determine.
  4. Assemble proportionate supporting information. Provide enough material for the authority to understand the site and assess the in-principle issues. Use the LPA’s current application requirements and validation instructions, while remembering that PiP is not the same information exercise as a full detailed application.
  5. Submit a valid application and pay the applicable fee. The exact form, fee and validation route are set by the current national and local requirements. An invalid submission can delay the decision and may not start the authority’s formal processing.
  6. Track consultation and publicity. Check the site notice, online notice and statutory-consultee arrangements. Monitor the LPA’s published timetable and respond promptly if officers request clarification within the scope of the application.
  7. Read the decision wording carefully. If PiP is granted, record exactly the location, use, amount, conditions and any stated limitations. Those terms define the starting point for TDC.
  8. Develop and submit the TDC application. Prepare the detailed design, access, appearance, landscaping, drainage, ecology, transport information, mitigation and infrastructure contributions required for the scheme, then apply for technical details consent before any development begins.

How the brownfield-register route works

  1. Check the LPA’s register and eligibility information. A site must meet the statutory requirements for inclusion, including the housing-led character of the opportunity and the relevant brownfield criteria.
  2. Understand the significance of Part 1. Part 1 is the initial register of brownfield sites considered suitable for housing. It is not permission in principle and does not authorise development.
  3. Follow the Part 2 process. The authority must apply the relevant statutory process, consultation and publicity before a site can be entered in Part 2 with PiP.
  4. Apply for TDC after PiP is granted. Part 2 PiP still leaves the detailed proposal to technical details consent. Construction cannot start merely because the site appears on the register.

Register procedures and the authority’s published information can change. Use the current register and the LPA’s instructions for a live site rather than relying on an old listing or a third-party summary.

Technical details consent: the stage that unlocks development

TDC is where the authority examines the proposal that will actually be built. The validity requirements are the same as those for a full planning-permission application. Expect the detailed submission to address design quality, layout, appearance, access, servicing, environmental effects, mitigation and contributions to essential infrastructure as relevant to the site.

The TDC decision is made in accordance with the PiP, subject to the statutory qualification concerning a material change after the prescribed period. The 2017 Order prescribes a five-year period during which a TDC application must be determined in accordance with the PiP. Check the current legislation and the wording of the specific permission for a live project, especially if policies, infrastructure capacity or site circumstances have changed.

How common is PiP?

In the April–June 2026 statistical release, English LPAs reported 551 permission in principle decisions for minor housing-led development, 34 technical details consent decisions for minor development and 5 technical details consent decisions for major development. The 551 PiP decisions were 79% higher than in the same quarter of 2025.

These are England-wide quarterly decision counts. They show current use of the route, not the probability that a particular site will be approved, the time an individual application will take or the cost of obtaining consent.

Common mistakes and how to avoid them

Calling Part 1 registration “planning permission”

Correct the assumption at the outset: Part 1 is not PiP. Check whether the site has gone through the Part 2 process before describing it as having permission in principle.

Submitting a detailed design but leaving the three parameters vague

Make location, land use and amount explicit. A large amount of architectural detail cannot compensate for an unclear in-principle proposition.

Assuming PiP settles design or mitigation

Plan for TDC work from the beginning. Surveys, drainage, transport, ecology, access, landscape and infrastructure requirements can materially affect the final scheme even after the principle is accepted.

Starting work after PiP

Do not treat the first-stage decision as a commencement consent. Wait for TDC and comply with its conditions and any other required approvals.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Relying on an old timetable or notice

Use the LPA’s current consultation notices, application guidance and register information. The national periods are 14 days for a direct application site notice, 21 days for a brownfield-register site notice and 14 days online for both routes.

Expecting an automatic saving

PiP may reduce wasted design effort by resolving the principle earlier, but the sources do not establish a guaranteed cost or time advantage. Budget for both stages and obtain site-specific planning advice where the decision has significant financial consequences.

A practical decision checklist

  • Is the site in England and within the relevant LPA’s jurisdiction?
  • Is the proposal eligible minor, housing-led development?
  • Does housing provide the majority of floorspace in any mixed-use scheme?
  • Would an early decision on location, use and amount materially improve your investment or design decision?
  • Can you fund and manage a second application for TDC?
  • Have you checked the adopted development plan, neighbourhood policies, constraints and the current brownfield register?
  • Have you planned the surveys, mitigation and infrastructure work that TDC will require?
  • Have you allowed for consultation, publicity and the LPA’s validation requirements?
  • Have you checked the five-year statutory period and the wording of the specific PiP?

Worked example

Suppose a previously developed site is being considered for 18 homes with a small compatible community use. The owner is not ready to fix the final layout and needs to know whether the location, housing use and amount are acceptable in principle. If the scheme meets the minor, housing-led eligibility rules, a direct PiP application could resolve those three questions first. The owner would then prepare the detailed layout, access, drainage, ecology, design and mitigation package for TDC. Inclusion on Part 1 of a brownfield register would not itself allow the owner to build; the site would need the applicable Part 2 process and TDC.

What to check before committing money

For a live proposal, confirm the current legislation, the LPA’s validation checklist, its consultation instructions, the adopted local development plan, any neighbourhood-plan policies and the authority’s brownfield register. The right route depends on the site, the proposed use and amount, the maturity of the design and your willingness to run a two-stage consent process. A planning consultant can advise on site-specific eligibility and evidence, but no route guarantees approval.
