In the United States, a contractor’s requirements depend on the work (such as operating a public water system, building a pipeline, servicing treatment equipment, or working on a private well), the state and local jurisdiction, and the utility’s solicitation and contract. Operator jobs may require a state water-system operator certification. Construction procurements may instead evaluate financial capacity, water and sewer experience, equipment, assigned personnel, bonding, and detailed insurance terms. The solicitation and governing law control; use the framework below to identify what applies before you bid.
Start by defining the work and jurisdiction
“Water utility work” covers several distinct risk and licensing categories. A firm that runs treatment or distribution operations is not evaluated in the same way as one that excavates and installs a transmission main. Well drilling, private-water-system work, meter installation, electrical or controls work, and emergency repair can each trigger different rules.

- Public-system operations: operating, treating, testing, or maintaining a public drinking-water system.
- Water and sewer construction: installing or repairing mains, service lines, pump stations, reservoirs, treatment facilities, and related civil works.
- Specialty services: drilling, private wells, disinfection, laboratory services, equipment installation, or controls and electrical work.
- Support and emergency work: inspection, leak response, traffic control, hauling, vacuum excavation, or temporary facilities.
Then identify the governing location. The U.S. Environmental Protection Agency says operator-certification requirements vary from state to state, because each state administers its own program. A city utility can add registration, prequalification, insurance, safety, or documentation requirements on top of state law. A neighboring state, county, or utility may use different terminology, limits, or approval procedures.

Operator certification: when an individual credential is central
State operator certification is primarily relevant when people will operate or maintain a public water system. EPA describes certification as a way to establish minimum professional standards for operating and maintaining public systems; state programs set the applicable classes, experience, education, examinations, and renewal rules. EPA’s operator-certification page states that, although requirements vary by state, the ultimate goal is treatment and distribution of safe drinking water.

What to verify for an operating contract
- The system classification and treatment or distribution class covered by the contract.
- The certification level required for the chief operator, shift coverage, and any person making operational decisions.
- Whether the named operator’s certificate is current, in good standing, and valid for the facility type.
- Required experience, continuing education, examinations, background checks, or residency rules under the state program.
- Whether the contract requires an on-site operator, a response-time commitment, or a specific number of certified staff.
EPA’s Water Operator Hiring and Contracting Guide is intended to help public-water-system decision-makers hire or contract with a licensed or certified operator. It recommends adapting the guide to the state and system, so it is a planning resource rather than a substitute for the state regulator’s rules or the utility’s contract.
Construction qualifications utilities commonly evaluate
For pipeline and facility construction, the utility may not require the contractor’s field staff to hold a water-operator certificate. Instead, it can assess whether the company and its assigned team can safely and financially deliver the specified work.
Firm experience and references
Prepare project sheets that identify your role, scope, dates, location, owner, pipe sizes or facility type, dollar value if requested, completion status, and an owner contact. The City of Fort Worth’s prequalification process illustrates the level of detail a utility may seek: it asks for at least five references for related work and experience information for both the firm and assigned personnel. A general excavation résumé is not a substitute for evidence of comparable water or sewer work.
Assigned personnel
Utilities may ask for résumés of project managers, superintendents, estimators, safety staff, welders, operators, or other key people. List their relevant projects, responsibilities, licenses, certifications, and availability. If the solicitation names key personnel, obtain written approval before substituting them.

Equipment and technical capacity
An equipment schedule can demonstrate that you can perform the work without relying on uncommitted rental capacity. Include the equipment type, capacity, ownership or lease status, location, and availability dates when requested. The schedule should match the means-and-methods assumptions in your bid: excavation and shoring equipment, pipe handling, dewatering, testing, disinfection, paving, traffic control, and emergency-response capability may all matter.
Financial capacity and bonding
Prequalification can require evidence that the firm can finance payroll, materials, subcontractors, retainage, and potential delays. Fort Worth’s checklist asks for a CPA-signed financial statement prepared within the previous 12 months. A solicitation may also require bid, performance, payment, or maintenance bonds, a bank reference, a surety letter, or a stated bidding limit. These are procurement conditions, not universal thresholds; submit the exact form and date requested.
Licenses, registrations, permits, and training
Confirm business registration, contractor licensing, specialty licenses, excavation or traffic-control credentials, confined-space and safety training, environmental permits, and any utility-specific registration. The required credential belongs to the task and jurisdiction. Do not assume that a general contractor license authorizes water-system operation, electrical work, drilling, or another regulated specialty.

Common policy categories in water-work procurements
- Commercial general liability (CGL): protection for covered third-party bodily injury, property damage, and related claims, subject to the policy and contract terms.
- Automobile liability: coverage for vehicles used in the work, including the limit and whether hired or non-owned vehicles must be included.
- Workers’ compensation and employer’s liability: coverage required by the contract and applicable law for employees engaged in the project.
- Additional project-specific coverage: a utility may require endorsements, pollution or professional liability, builder’s risk, contractor’s equipment, or other coverage when the scope warrants it.
Do not infer a universal limit from one project. For example, Mercer Island’s February 2025 procurement for a new water-supply pipeline specified $3 million of automobile liability per accident, $5 million of CGL per occurrence, and $10 million each for the general aggregate and products-completed-operations aggregate. Those figures are that solicitation’s terms, not a national benchmark.
Endorsements and certificates
The utility may require itself, its officials, or other parties to be named as additional insureds for specified operations, often on a primary and noncontributory basis. It may also require waiver-of-subrogation language, notice provisions, completed-operations coverage, or a particular insurer rating. A certificate of insurance summarizes coverage but does not amend the policy and may not prove that every endorsement is present.
Mercer Island’s terms illustrate the documentation issue: they call for certificates and copies of amendatory endorsements before work begins, as well as evidence that subcontractors carry the required coverage. Ask your broker to provide the exact forms, not only a generic certificate, and check that policy dates extend through the required period.
Subcontractors and lower-tier firms
Flow the contract’s insurance obligations down to every subcontractor whose work can create the stated exposure. Keep certificates, endorsements, renewal evidence, and written indemnity or insurance provisions in the project file. If a subcontractor’s policy uses different limits or exclusions, obtain the utility’s written approval before mobilization rather than assuming your own policy cures the gap.

State-specific registration example: Ohio private water systems
Ohio Administrative Code Rule 3701-28-18, effective January 1, 2020, requires annual registration and proof of at least $500,000 in general business liability insurance for contractors performing the specified private-water-system work covered by that rule, along with its other requirements. This is a defined Ohio registration regime. It does not automatically govern public municipal-water construction in Ohio or similar work in another state. Determine whether your exact activity falls within the rule and confirm current status with the Ohio regulator.

- Map the scope. Write down every task your firm or subcontractors will perform: operation, excavation, pipe installation, testing, disinfection, drilling, electrical work, paving, hauling, or emergency response.
- Identify the authorities. List the state regulator, city or regional utility, licensing boards, and permitting agencies with jurisdiction over each task.
- Read the complete procurement package. Review the solicitation, contract, insurance exhibits, technical specifications, addenda, prequalification forms, and subcontract clauses. Record every deadline and required evidence format.
- Verify credentials. Check firm licenses and registrations, individual operator certificates, specialty credentials, training records, bond capacity, and expiration dates. Arrange renewals before they lapse.
- Request an insurance gap review. Give your broker the contract language. Confirm policy types, per-occurrence and aggregate limits, automobile wording, workers’ compensation, additional-insured endorsements, primary/noncontributory wording, waiver requirements, completed operations, subcontractor coverage, and effective dates.
- Build the qualification package. Gather the requested financial statement, project references, résumés, equipment schedule, organization chart, safety records, and proof of bonding or surety capacity.
- Check consistency. Names, legal entities, addresses, certificate holders, project titles, dates, and stated limits should match across the bid, insurance documents, licenses, and reference sheets.
- Resolve ambiguity in writing. Send questions to the procurement contact before the question deadline. Keep the written answer and any resulting addendum with the final bid.
How to compare water-work opportunities
When evaluating several solicitations, compare the same decision points rather than looking only at the headline insurance limit.
| Decision point | What to extract from each solicitation |
|---|---|
| Work authorization | Required contractor licenses, operator certificates, registrations, permits, and training by task and jurisdiction |
| Insurance | Policy types, per-occurrence or per-accident limits, aggregate limits, endorsements, certificate format, duration, and subcontractor obligations |
| Financial security | Bid, performance, payment, or maintenance bonds; financial-statement date; surety and bidding-capacity requirements |
| Experience | Number and type of references, similarity of pipe or facility work, completion status, owner contacts, and look-back period |
| People and equipment | Named key personnel, required credentials, staffing coverage, equipment schedule, and availability commitments |
| Procurement limits | Prequalification status, bid limits, restrictions, deadlines, required forms, and approval procedures |
Fort Worth publishes a prequalified list with bid limits and restrictions, showing why qualification can affect not only eligibility but also the size of project you may bid. Treat that municipal system as an example of procurement design, not as a national rule.
Common mistakes and how to correct them
Using an operator certificate as a construction license
An operator credential demonstrates competence for the certified operational role; it does not, by itself, authorize excavation, construction, electrical work, or private-well services. Match each task to its own license and permit requirements.

Assuming a certificate of insurance is enough
A certificate may omit or inaccurately summarize endorsements. Have the broker issue the required additional-insured and other amendatory forms, then compare them with the contract before work starts.
Quoting a project example as an industry standard
Mercer Island’s $3 million automobile, $5 million CGL, and $10 million aggregate limits apply to that 2025 pipeline procurement. Ohio’s $500,000 liability requirement applies to the specified registered private-water-system work. Neither figure establishes what every utility or state requires.
Submitting stale financial or reference information
Fort Worth’s example requires a financial statement prepared within 12 months. Other utilities may use a different period or require audited statements. Date every document and refresh it when the solicitation says it must be current.

Ignoring subcontractor compliance
List each subcontractor’s role, confirm its licenses and insurance, and retain the evidence. Ask the utility before bid submission how lower-tier coverage will be reviewed.
Bottom line for contractors
Begin with the exact scope and location, then let the solicitation and governing law determine the checklist. Operators should verify the appropriate state certification and coverage for bodily injury, death, and property damage. Construction firms should be ready to prove comparable water or sewer experience, financial strength, equipment, qualified assigned staff, bonding capacity, and contract-compliant insurance. Confirm every limit, endorsement, expiration date, and subcontractor obligation in writing with the utility and the relevant regulator before submitting or mobilizing.
