The client must obtain approval before covered work starts. It is separate from planning permission: a scheme may need planning permission as well as Gateway 2 approval. BSR uses the application to assess whether the proposed work can comply with building regulations and whether the project will be managed by competent people with effective compliance controls.
What Gateway 2 controls
Gateway 2 is a statutory building-control decision made by BSR. It concerns the technical design, building-regulations compliance and management arrangements for construction work. Planning permission deals with land use and matters such as appearance, access and local impacts; Gateway 2 does not replace it.

For residential buildings, BSR guidance describes an HRB as a building that is at least 18 metres high or at least seven storeys and contains at least two residential units. The height and storey tests are alternatives in the guidance wording, not requirements that must both be met. A qualifying HRB must also be registered with BSR before people live in it.
On a development containing several buildings, BSR will generally control the higher-risk buildings while the local authority or a registered building-control approver deals with buildings outside the HRB definition. The responsibilities and applications for each building should therefore be mapped at the start of the project.

BSR’s current overview of the approval route and HRB definitions is in its building-control approval guidance.
When a housing project needs approval
New higher-risk housing
Construction of a new HRB requires a BSR building-control approval application before work begins. This includes a new tower or a connected project containing multiple towers. BSR allows one application for a single tower or a connected multiple-tower project, provided the application covers the relevant work and buildings.
Work on an existing higher-risk building
Work to an existing building can require approval where it makes the building an HRB, causes it to stop being an HRB, or is otherwise covered work on an existing HRB. The application must identify the type of work accurately. A wrong classification can result in rejection.

Some work is exempt, can be carried out through a competent-person scheme, or is a specified emergency repair. An exempt or scheme element may still need to be described in the wider project application when it forms part of a larger development. Treat the project as a whole when deciding what information BSR needs, rather than assuming an isolated exemption removes the need to disclose the work.
Who must obtain Gateway 2 approval?
The client remains legally responsible for ensuring that approval is granted before covered work starts and that the application information is correct. The client may nominate another person to prepare, submit or manage the application, but delegation does not transfer that legal responsibility.

BSR also expects the project to demonstrate effective compliance management and the competence of the people appointed to design, manage and carry out the work. Agree who owns design coordination, information control, responses to BSR and change management before submission; otherwise requests for clarification can delay the decision.
Choosing the right application route
Single-stage application
A single application can cover a single tower or a connected multiple-tower project. It is suitable where the design information needed for the whole construction scope can be submitted and assessed together.
Staged application
A staged application allows a project to proceed in defined stages, with detailed plans submitted for each stage before work on that stage starts. BSR considers staged applications case by case. No stage can begin until its own application has been approved, so staging does not create permission to start early on later work.
Existing-HRB categories
Applications for work on existing HRBs distinguish Category A from Category B work. Category A includes changes such as altering the building’s external height or width, changing the number of storeys, changing the internal layout or dwelling count, and work affecting active or passive fire safety or escape routes. The detailed category rules and information requirements should be checked against the current BSR guidance for the particular building; selecting the wrong category may lead to rejection.
| Project situation | Route or control point | What the client must plan for |
|---|---|---|
| New HRB | New-building approval application | Approval for the proposed work before construction starts |
| Existing HRB, covered alteration | Existing-building application, with the correct work category | Accurate categorisation and information about the affected building systems |
| Connected multiple-tower project | Single application may be possible | Clear scope showing which connected buildings and work are covered |
| Large project delivered in stages | Staged applications considered case by case | Detailed plans and approval for each stage before that stage begins |
| Mixed HRB and non-HRB development | BSR controls HRBs; local authority or registered approver controls other buildings | Separate approval routes and interfaces in the programme |
What to prepare for the application
Applications are made through BSR’s online building-control service. The exact submission depends on whether the project is new construction, existing-building work, single-stage or staged, and (for existing HRBs) which category applies. BSR’s preparation material should be used for a project-specific checklist; the general approval guidance alone is not a universal document list.

At a minimum, the submission must contain enough reliable information for BSR to assess three things:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- Building-regulations compliance: the proposed design and work must be described in sufficient detail to demonstrate how the regulations will be met.
- Compliance management: the client’s arrangements must show how design and construction information will be controlled, coordinated and kept accurate as the project develops.
- Competence: the appointed organisations and individuals must be suitable for their roles and responsibilities.
Before submitting, reconcile the drawings, specifications, fire-safety information, structural information, programme and responsibility matrix. Inconsistencies are particularly damaging where one document describes a different number of storeys, dwellings, escape route or fire strategy from another. Keep a controlled record of what was submitted so later changes can be assessed against the approved information.
How BSR validates and assesses an application
- Submit online. The client or nominated applicant submits the application through BSR’s building-control service and pays the applicable charge.
- Validation check. BSR checks whether the required information has been provided. It may request missing information or reject the application at this point.
- Technical and management assessment. A valid application is assessed for building-regulations compliance, competence and compliance-management arrangements. Validation is not approval.
- Decision. BSR issues an approval, an approval with requirements, or a rejection.
BSR guidance states an assessment period of up to 12 weeks for a new HRB and up to 8 weeks for an existing HRB, unless an extension is agreed. These are stated assessment periods, not a promise that the complete project will receive a decision within that time. Quality, complexity, requests for information and extensions affect the actual timetable.
How long does Gateway 2 approval take?
Recent performance data illustrates why a development programme should allow more time than the headline guidance periods. BSR’s July–September 2026 data, with underlying data correct as of 5 October 2026, reports the following historical results:
| Application group | Approval rate | Median approval time | Qualification |
|---|---|---|---|
| New higher-risk buildings and conversions | 97% | 23 weeks | BSR quarterly results for July–September 2026; historical group data, not a project guarantee |
| External remediation | 87% | 32 weeks | BSR quarterly results for July–September 2026; historical group data, not a project guarantee |
The broader quarterly report says applications submitted in 2026 were progressing in approximately 22 weeks, while older cases affected overall times. Do not substitute that figure for the statutory guidance periods or present any of these numbers as a prediction for a particular scheme. The source is BSR’s July–September 2026 application data.

What decision can BSR make?
Approval
An approval permits the covered work to proceed, subject to the continuing notices, inspections and change-control duties that apply after approval.
Approval with requirements
BSR can approve an application with requirements. Work covered by a requirement cannot start until BSR is satisfied that the requirement has been met. Work not subject to an unmet requirement can start only to the extent allowed by the decision. Read the decision notice line by line and programme the required submissions or confirmations before mobilising the affected work.
Rejection
BSR says an application should be rejected if it shows the work will not comply with building regulations, does not contain enough detail to demonstrate compliance, or lacks effective compliance-management strategies. A rejected application cannot proceed to construction. The applicant can request a review; if disagreement remains after review, an appeal can be made to the First-tier Tribunal.
Can construction start before Gateway 2 approval?
No, not for covered work. BSR’s guidance states: “You must not start any building work until the building control application is approved.” For a staged project, that prohibition applies separately to each stage. Starting early creates a compliance and enforcement risk and can leave completed work outside an approved design.
Obligations after approval
Gateway 2 approval is not the end of building control. The client must manage the project through construction and completion.

- Obtain building-control approval before work resumes on a part affected by a classified major change.
- Apply for a full or partial completion certificate when the relevant work is complete.
- Register a residential HRB containing at least two residential units with BSR before occupation. A completion certificate is needed for that registration.
Where the building safety levy applies, the collecting authority must confirm payment or issue a valid no-charge notice before BSR can issue the completion certificate.
Fees and the building safety levy
BSR’s management-service page currently lists £195 to apply for building-control approval, £195 for change control and £234 for a full or partial completion certificate. It also lists BSR staff time at £156 per hour, plus any relevant third-party costs. These charges can change, so confirm the live amounts in the BSR application-management service before budgeting or submitting.
A building safety levy may apply to a major residential development creating 10 or more homes, or to purpose-built student accommodation creating 30 new bedspaces. The levy is paid to the local council or other collecting authority, not directly as a Gateway 2 approval fee, and confirmation is required before BSR issues the completion certificate.

- Applying to the wrong authority: confirm which buildings are HRBs and which are handled by the local authority or a registered building-control approver.
- Using the wrong existing-work category: check whether the proposal changes height, width, storeys, layout, dwelling numbers, fire-safety systems or escape routes.
- Submitting conflicting information: align drawings, specifications, schedules and fire-safety descriptions before upload.
- Insufficient compliance detail: explain how the proposed work demonstrates compliance rather than relying on a high-level statement.
- Weak management arrangements: identify who controls information, coordinates design and responds to changes.
- Assuming validation is approval: do not release work after a validation notice; wait for the decision and check any requirements.
- Programming only the guidance period: allow for the longer observed decision times and for requests for further information.
- Missing post-approval notices: assign responsibility for start, commencement, inspection, change-control and completion notifications.
Practical answer for a housing developer
First establish whether each building meets BSR’s HRB definition and whether the proposed work is covered. Then choose the correct new-build, existing-building, staged or category route, assemble coordinated evidence of compliance and competence, and submit through BSR’s online service. Do not start covered construction until approval is granted. Build the five-working-day notices, inspection notifications, change control, completion certification and pre-occupation registration into the programme from the outset. Gateway 2 is therefore both a pre-construction approval and the first formal point in a continuing building-control process that runs through completion and occupation.
