A construction excise tax is a locally enacted charge connected to construction, development, a building permit, or—under a different model—a real-estate transaction. There is no single U.S. construction excise tax: each jurisdiction sets its own taxable event, rate, valuation method, exemptions, payer, collection date, and revenue restrictions.
Portland, Oregon, illustrates a permit-linked construction excise tax. Its current code charges 1% of the value of qualifying commercial and residential improvements, payable before the building permit is issued, and dedicates the net proceeds to affordable-housing programs. Washington illustrates a separate infrastructure-oriented excise tax: local governments may impose up to 0.25% on real-property sales for eligible capital projects such as roads, water systems, parks, and public-safety facilities. That tax is triggered by a sale, not by construction or permit issuance.

What a construction excise tax actually is
An excise tax is a charge on a defined activity or transaction rather than a broad tax on all income or property. In construction, the activity may be the creation, expansion, or improvement of a structure. A local government can calculate the charge from a project’s permit valuation, floor area, sale price, or another measure written into its ordinance.

A permit applicant, property owner, contractor, developer, or buyer may be involved in payment depending on the local law; the ordinance controls who is legally responsible.

Before estimating a project cost, identify six items in the applicable code:
- the taxable event, such as a building permit, improvement, or real-property sale;
- the tax base and valuation method;
- the percentage rate or other formula;
- the person or entity required to pay and the payment deadline;
- thresholds and exemptions; and
- the legally permitted uses of the revenue.
Those details determine whether a particular project owes anything and whether the receipts can support infrastructure, housing, administration, or another purpose.
Why the tax does not have one national rate or purpose
Construction permitting and local capital planning are largely administered through state and municipal law. As a result, the same project type can face different treatment across city or state lines. One jurisdiction may tax the value of a new building, another may exempt public or affordable housing, and another may have no construction excise tax at all.

Portland’s cited program is expressly for affordable housing. Washington’s cited authority is an example of an infrastructure-oriented excise tax, but it applies to real-property sales. Treating the two as the same mechanism can lead to an incorrect budget, an omitted permit payment, or a mistaken assumption about where public money will go.
How a permit-linked tax works: Portland’s example
What projects are covered
Portland City Code Chapter 6.08 establishes a Construction Excise Tax on commercial and residential improvements to provide funding for affordable housing. The code’s concepts of construction and improvement focus on structures requiring permits and work that creates a new structure, additional square footage, or additional living space.

This is a city-specific example, not a rule for every municipality. A project that appears similar may be treated differently elsewhere because the local definition, permit system, or exemption list may differ.
Rate, valuation, and timing
For a qualifying Portland improvement, the current rate is 1% of the improvement’s value. The tax is due before the city issues the building permit. The cited code amendment took effect January 1, 2025.
Portland describes improvement value through the permit valuation process. The code references the International Code Council Building Valuation Data Tables and applies a value per square foot to the relevant area. The permit record, rather than a contractor’s informal estimate, is therefore central to determining the taxable amount.
For illustration, a qualifying improvement with a taxable value of $500,000 would produce a 1% charge of $5,000. That arithmetic example does not establish how another city would value the same work.
Threshold and exemptions
Portland exempts improvements valued at $100,000 or less. The ordinance also lists categories that can qualify for exemption, including:

- public improvements;
- public or private hospitals;
- specified religious facilities;
- agricultural buildings;
- certain nonprofit long-term-care or residential-care facilities and continuing-care retirement communities; and
- mass shelters.
Eligibility is not established merely by describing a project with one of these labels. The code may require evidence, and the city bureau or permit administrator decides whether the documentation supports an exemption. A builder should obtain that determination before assuming the tax is zero.

Who pays and when the permit can move
Applicants for qualifying commercial and residential improvements pay the Portland charge before the building permit is issued. In practical terms, the tax belongs in the pre-permit budget and schedule. A permit package can be technically complete yet remain unissued if the required tax has not been paid or an exemption has not been accepted.
Because the tax is tied to the city’s valuation and permit process, changing the project scope can change the amount. Adding floor area, creating living space, or revising the declared valuation should prompt a check with the administering bureau rather than an assumption that the original calculation still applies.
Where Portland’s receipts go
Portland may retain up to 4% of collections for administration. The allocations below apply to net revenue after that allowance and are set by the city’s code:
| Revenue stream | Allocation or use | Eligible beneficiaries or projects |
|---|---|---|
| Residential net revenue | 15% | Oregon Department of Housing and Community Services homeownership programs |
| Residential net revenue | 50% | Portland Inclusionary Housing Fund for finance-based incentives |
| Residential net revenue | 35% | Affordable-housing production and preservation for households at or below 60% of median family income |
| Commercial net revenue | All remaining revenue after the administrative allowance | Affordable-housing production and preservation for households at or below 60% of median family income |
The allocation shows why “excise tax” does not automatically mean “infrastructure tax.” In this example, the legally dedicated outcome is housing finance, production, and preservation rather than street construction or utility expansion.

How an excise tax can fund infrastructure: Washington’s different model
Washington Revised Code 82.46.010 authorizes a local excise tax on real-property sales. Under the subsection described here, the rate may not exceed 0.25% of the selling price. The taxable event is the sale of real property, so this is not a construction-permit tax even when a local government uses the proceeds for infrastructure.
The local budget must identify capital projects funded in whole or in part with the proceeds and state that the tax supplements other reasonably available funds. Eligible projects listed in the statute include streets, roads, highways, sidewalks, lighting, traffic signals, bridges, water and sewer systems, parks, recreational facilities, libraries, public-safety facilities, and other enumerated capital projects.
For example, a 0.25% rate on a $400,000 sale would equal $1,000 before considering any local rules, exclusions, collection procedures, or other applicable taxes. That example illustrates the sales-price formula; it does not convert the Washington authority into a construction charge.

How to check whether your project owes one
- Identify the jurisdiction. Use the city, county, or other authority that issues the relevant permit or administers the transaction. A neighboring municipality may have a different tax or none at all.
- Find the exact ordinance or statute. Search for the current chapter, effective date, and implementing guidance. Confirm that you are reading the version in force when your permit application or sale occurs.
- Classify the taxable event. Determine whether the charge attaches to a building permit, improvement value, square footage, land or building sale, or another event. Do not infer the answer from the word “excise.”
- Calculate the base using the required method. Follow the jurisdiction’s valuation tables, area definitions, selling-price rules, or prescribed forms. A private estimate may not substitute for the official method.
- Test every threshold and exemption. Review dollar thresholds and project categories separately. Gather affordability covenants, ownership records, institutional status, or other evidence the code requests.
- Confirm who must pay and the deadline. In Portland’s example, the applicant pays before permit issuance. Other jurisdictions may assign responsibility differently or collect at closing.
- Request a written determination when facts are close. Keep the bureau’s response, exemption approval, valuation worksheet, and payment receipt with the permit file.
- Recheck after scope or valuation changes. A revised area, use, valuation, or ownership structure can affect liability even after an initial review.
What the tax means for construction budgeting
Include it before contract pricing is final
A permit-linked charge is an early project cost, not an expense that appears only after construction starts. Put a separate line in the development budget for the excise tax, identify the assumed valuation, and state whether the estimate depends on an exemption. This makes the assumption visible to the owner, design team, lender, and contractor.

Separate tax from permit and impact charges
A construction excise tax can exist alongside permit fees, system-development or impact fees, utility connection charges, plan-review fees, and ordinary property taxes. Each has a different legal basis and payment point. Combining them into one “permit cost” can hide a cash requirement that must be paid before approval.

Because Portland requires payment before permit issuance, an unresolved valuation or exemption question can delay the permit even when drawings and technical reviews are complete. Assign responsibility for the calculation, submit supporting evidence early, and keep proof of payment available for the permit record.
Common mistakes and how to avoid them
- Assuming a national rule: A 1% Portland rate is not a national statistic. Verify the local code.
- Calling every excise tax a construction tax: Washington’s cited charge is based on a property sale, not a building permit.
- Assuming all proceeds build infrastructure: Portland’s cited net revenue supports affordable housing.
- Applying an exemption without documentation: Listed categories can have income, duration, ownership, nonprofit, or facility-specific conditions.
- Using the wrong valuation: Where the code points to official building-valuation tables, a contractor’s rough bid may not be the taxable base.
- Ignoring the effective date: Portland’s cited amendment took effect January 1, 2025; rates and definitions can change.
- Budgeting only the percentage: The dollar result depends on the legally defined base, area, threshold, and exclusions.
Does a construction excise tax improve local infrastructure?
It can, but only when the governing law dedicates the receipts to infrastructure and defines eligible capital projects. A sales-based local excise tax such as the Washington example can provide a designated source for streets, bridges, water and sewer systems, parks, libraries, and public-safety facilities while requiring the budget to identify the projects and treat the revenue as supplemental.
A permit-linked tax may pursue a different public objective. Portland uses its cited charge for affordable housing, including homeownership assistance, inclusionary-housing incentives, and production or preservation. That spending can address a community need associated with growth without paying directly for a road or pipe.

The policy result therefore depends on the statute’s dedication and accountability rules, not on the label alone. To evaluate a proposal in any locality, read the revenue-use section, the required capital plan or budget statement, and the reporting or oversight provisions alongside the rate.
Questions to ask a permit office or tax administrator
- What exact work is considered a taxable improvement?
- Which valuation table, area measurement, or sale-price definition applies?
- Is the threshold tested against the whole improvement or a defined component?
- What documents prove an affordability, public, institutional, agricultural, or nonprofit exemption?
- Who submits the payment, and must it clear before permit issuance or closing?
- How are scope changes, phased permits, demolitions, and canceled projects handled?
- Where are net proceeds deposited, and which projects or programs may receive them?
- What effective date controls if the ordinance changes during design or permitting?
For a real permit decision, rely on the current local code and the administering agency’s written direction. The Portland and Washington examples demonstrate the range of possible designs; they do not establish the rules for every U.S. jurisdiction.
