construction equipment hire

What insurance do you need when hiring construction equipment in the UK?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a UK business hiring construction equipment, start by checking the hire contract and arranging hired-in plant insurance for damage, theft or loss of the machine while it is in your care. You may also need public liability for injury or property damage suffered by other people, and employers’ liability if you employ staff. These covers solve different problems; one does not replace another.

A hire company’s damage waiver can reduce what you owe under its contract, but it is not automatically equivalent to an insurance policy and its cap, exclusions and security conditions vary by supplier. Confirm the exact equipment, value, site, transit arrangements, security measures, excess and continuing hire charges with your insurer or broker before collection.

What cover is relevant to a construction-equipment hire?

This is a UK overview. The correct answer depends on your employment status, the equipment, whether an operator is supplied, where it is used, how it is transported and the wording of your hire agreement and existing policies. There is no general rule in the sources that every hirer must buy hired-in plant insurance, public liability or a damage waiver. A hire company, principal contractor or project contract may nevertheless make particular cover a condition of hire or site access.

The exposures are easiest to separate into four questions:

  • Who pays if the hired machine is damaged, lost or stolen?
  • Who pays if your work injures a member of the public or damages someone else’s property?
  • Who pays if an employee is injured or becomes ill because of work?
  • What contractual reduction, if any, does the hire company offer for damage or theft?

Those questions correspond broadly to hired-in plant insurance, public liability, employers’ liability and a hire-company damage waiver.

Hired-in plant insurance: cover for the machine in your care

Hired-in plant insurance is designed for the hirer’s contractual or legal liability for construction machinery while it is under the hirer’s control. Insurer descriptions commonly refer to accidental damage, theft and loss, and some policies can respond to liability imposed by the hire agreement. Depending on the wording, the policy may also cover continuing hire charges while a damaged item is being repaired or replaced.

What to check in the policy

  • Equipment description and value: confirm that the machine, attachments and accessories are included and that the maximum value is high enough for the actual replacement or repair cost.
  • Hire-period definition: check when cover starts and ends, including collection, delivery, breakdown and any extension agreed with the supplier.
  • Where the machine may be used: the policy may restrict territory, named sites or types of work. A machine moved to another project without notification can create a coverage problem.
  • Transit: establish whether loading, unloading and road transit are insured or require separate arrangements.
  • Excess and exclusions: read the amount you must contribute and exclusions for misuse, unauthorised operators, wear and tear, mechanical breakdown, underground work or other hazardous activities.
  • Theft protections: insurers may require immobilisers, keys to be removed, secure compounds, lighting, tracking or other overnight precautions.
  • Continuing hire charges: do not assume these follow automatically from damage cover; the policy must say so and set any daily or total limit.

The policy schedule, endorsements and full wording control. A product summary is not enough to establish that a particular excavator, telehandler, generator or attachment is insured.

Public liability: cover for third-party injury and property damage

Public liability addresses claims from people outside your business for injury or damage arising from your activities. Examples include a pedestrian injured by a moving machine, a vehicle damaged by falling material, or a neighbouring building affected by excavation work. It is about the consequences of your work, not the value of the hired machine itself.

Check that the policy describes the activities you actually perform, the sites and territories where you work, and any exclusions relevant to construction. A principal contractor or client may specify a liability limit or require evidence of insurance before allowing access. Those contractual requirements are separate from the hire company’s right to recover the cost of its equipment.

Employers’ liability: when employees are involved

GOV.UK guidance states that an employer must get employers’ liability insurance when the requirement applies. The statutory minimum limit is at least £5 million, and the insurer must be authorised. The guidance also sets out exemptions, so status matters: a business with no employees may be treated differently from one employing staff, and the legal position can change when people work under different arrangements.

Employers’ liability responds to compensation claims when an employee is injured or becomes ill because of work. It does not insure the hired machine and does not replace public liability. Keep the certificate available as required by the rules and tell the insurer about the construction activities and equipment operation your staff perform.

Damage waivers offered by the hire company

A damage waiver is a term of the hire contract under which the supplier agrees to reduce or waive specified charges if qualifying loss or damage occurs. It is not a universal insurance product. The cap, contribution, exclusions, reporting deadline and security conditions are set by the individual supplier.

For example, HSS Hire’s published optional waiver describes cover for qualifying repair or loss/theft costs up to £5,000, priced on that page at 16% of the overall hire rate. Its terms also include conditions and exclusions, including a requirement to report theft to the police, obtain a crime reference number and notify HSS within 48 hours. Those figures and conditions apply to that HSS arrangement only; they are not an industry standard and may change.

Questions to ask before selecting a waiver

  • What is the maximum amount the waiver will pay, and who pays any balance above it?
  • Is there an excess, contribution or separate charge for theft?
  • Does negligence, incorrect operation, unauthorised use or breach of site rules cancel the waiver?
  • What locks, storage, alarms, fencing or supervision are required when the equipment is unattended?
  • How quickly must damage or theft be reported, and which evidence is required?
  • Are attachments, accessories, fuel, keys and transport included?
  • Do hire charges continue while the equipment is unavailable?

Compare those answers with your hired-in plant policy. Paying for a waiver and insurance may duplicate some protection, but a waiver can also leave gaps that a policy addresses, or vice versa.

How the four options differ

Cover or option Main exposure addressed Checks before you rely on it
Hired-in plant insurance Your contractual or legal liability for damage to, theft or loss of hired machinery in your care; some policies include continuing hire charges. Equipment and value, site and territory, transit, theft precautions, unattended storage, excess, exclusions and the hire-period definition.
Public liability Third-party injury or property damage caused by your business activities. Covered activities and sites, liability limit, exclusions and any principal-contractor requirements.
Employers’ liability Employee injury or illness connected with work. Whether you are an employer, any exemption, authorised insurer, certificate arrangements and the adequacy of the policy for your workforce.
Hire-company damage waiver A contractual reduction or waiver of specified charges for qualifying loss or damage. Cap, excess or contribution, theft and storage rules, reporting deadlines, exclusions and liability above the cap.

Pre-hire checklist: establish who carries each risk

  1. Read the quotation and hire agreement. Identify clauses covering accidental damage, theft, disappearance, misuse, transport, attachments, inspection, breakdown and continuing hire charges.
  2. Ask the supplier for a plain-language explanation. Ask who pays if the machine is damaged on site, stolen overnight, lost in transit or unavailable after an incident. Request the written waiver terms if one is offered.
  3. Send the contract to your insurer or broker. Ask for confirmation against the actual wording, not just a verbal assurance that you have “plant cover”.
  4. Match the insured value. Include the machine and any hired attachments, and allow for the supplier’s liability basis, such as repair cost, replacement cost or continuing rental.
  5. Confirm locations and movement. Tell the insurer about each site, off-site storage, road movements and any work outside the usual territory.
  6. Set security controls before delivery. Decide where keys are kept, who locks the compound, how the machine is immobilised and how access is recorded.
  7. Check operator arrangements. Establish whether the hire includes an operator, whether your staff may operate the machine and what training or authorisation is required.
  8. Document condition at handover. Photograph existing damage, record meter readings and retain the delivery note, inspection records and accessories list.
  9. Check reporting routes. Save the hire company’s emergency number, your insurer’s claims number and the police contact process for theft.

Contract details that commonly change the answer

Business or consumer hire

The Construction Plant-hire Association publishes different conditions for business and consumer hires, plus supplementary conditions for categories of equipment. Confirm which set applies to your agreement. A business hiring a machine for commercial work should not assume that consumer wording or a generic online summary governs its contract.

Operator supplied by the hire company

An operator arrangement can change responsibility for operation, supervision and damage. It does not automatically transfer every risk: establish who controls the work, who is responsible for the site and what the contract says about loss, negligence and third-party claims.

  • Ventilation channels allow breathability and added protection against fogging.

Attachments and accessories

Buckets, breakers, forks, lifting accessories, cables and control equipment may have separate values or exclusions. List them when requesting cover and check that the hire agreement treats them as part of the machine.

Long or extended hire

A policy or waiver may define a maximum hire period or require notification when the rental is extended. Ask for written confirmation before the original end date rather than allowing cover to lapse while the equipment remains on site.

Theft, storage and incident response

Security requirements are part of the risk transfer, not an administrative detail. Follow the policy and waiver instructions for immobilisation, keys, fencing, lighting and overnight storage. If equipment disappears, report it promptly to the police and hire company, preserve CCTV and access records, obtain the crime reference number when required and notify your insurer within the stated deadline. Do not move or repair damaged equipment unless necessary to prevent further harm or the hire company, insurer or police has authorised it.

For accidental damage, photograph the scene, isolate the machine if it is unsafe, record witnesses and notify the supplier and insurer. Continuing to use equipment after damage can increase the loss and may breach operating or safety conditions.

Safety duties remain even when the machine is insured

Insurance pays covered financial losses; it does not make unsafe use lawful. The Health and Safety Executive’s PUWER overview says that a business using work equipment, or providing equipment for others to use, must manage the risks from that equipment. That includes selecting suitable machinery, maintaining it, providing information and instruction, and ensuring users are competent.

Lifting equipment and examination reports

For hired lifting equipment, HSE says the hire firm usually arranges the thorough examination, but the legal responsibility rests with the user to satisfy themselves at the outset that a current report exists. Ask for the current report before use and check that it covers the equipment and lifting configuration you received. Keep the report with site records and stop work if the examination is overdue or the equipment differs from the documentation.

Training and supervision

Match the operator’s training and authorisation to the machine and task. Provide site induction, exclusion zones, traffic controls and supervision appropriate to the risk. A claim can be affected by unauthorised operation or a failure to follow safety requirements even where a policy appears to cover accidental damage.

How to make a practical decision

  • If the contract makes you liable for the machine: arrange hired-in plant insurance or evaluate a waiver, then check the uncovered balance and exclusions.
  • If people or property could be harmed by your work: verify public liability for the specific construction activity and site.
  • If you employ staff: establish whether employers’ liability is required and keep the required cover and certificate arrangements in place.
  • If the machine will be unattended, transported or used at several sites: confirm security, transit and territorial conditions in writing.
  • If the equipment lifts people or loads: obtain the current thorough-examination report and satisfy the competence and planning requirements before operation.

Ask your insurer or broker to endorse the precise hire agreement, machine value, attachments, locations and security arrangements. Then retain the policy schedule, wording, waiver terms, contract, handover record and examination documents together. That paper trail is what lets you identify a gap before an incident rather than discovering it when the supplier presents a bill.
