If a road project may reach your driveway, find the project contact immediately, ask exactly how access will be staged, and get closure dates, alternate routes, and emergency arrangements in writing. There is no nationwide rule guaranteeing the same notice period or driveway access: requirements depend on the road agency, state and local law, the construction stage, and whether another entrance exists.
Start with the access question, not the paving schedule
A project notice may describe resurfacing, drainage, curb, sidewalk, utility or concrete work without explaining what will happen at your particular entrance. Contact the agency or contractor named on the notice and ask for the access plan for your parcel. Identify every entrance that matters: the main driveway, a garage, a side access, a pedestrian gate and any route used by deliveries or care providers.

Ask for dates tied to construction stages rather than one broad completion date. A driveway may remain open during excavation, narrow to one vehicle at a time during grading, and close entirely when concrete is poured. Request the expected hours of each restriction, how much advance warning the crew will provide, and the name and phone number of the person who can change the plan on site.
TxDOT guidance recommends staging work at access points without alternate access so a property can retain vehicle entry and exit, potentially with only one vehicle passing at a time. When maintaining access is especially difficult, its Roadway Design Manual calls for a written arrangement with the owner. The agency lists possible measures including off-site parking, pedestrian access, service and fire-vehicle access, or total temporary access denial: TxDOT property-access requirements.

TxDOT states: “If maintaining access to a property during construction is extremely problematic then the contractor will need to coordinate with the property owner to implement an agreed plan in writing for offsite parking, pedestrian access, service and fire vehicle access, or total temporary access denial.”
What an access arrangement should cover
Do not treat the word access as meaning only a car can reach the garage. A workable plan addresses vehicles, people on foot, emergency responders, deliveries, waste collection, home-health visits and mobility limitations. Use the comparison below to expose gaps before work begins.
| Arrangement | Vehicle access | Pedestrian and emergency access | What to confirm in writing |
|---|---|---|---|
| Staged work with a narrow opening | Usually retained, sometimes one vehicle at a time; exact width and hours are project-specific. | Ask whether the path is level, lit and separated from equipment; confirm fire and ambulance access. | Stage dates, daily opening hours, flagger or contact, and what happens if the opening is blocked. |
| Off-site parking with a walking route | Not retained at the driveway during the closure. | Pedestrian route, lighting, crossings, snow or mud control, and mobility accommodations must be specified. | Location of spaces, distance, security, access for carers and deliveries, and start and end times. |
| Temporary access denial | No vehicle entry or exit for the stated period. | Separate emergency, service and pedestrian arrangements are essential. | Written dates, emergency procedure, storage or delivery plan, and the person authorized to reopen access. |
| One entrance kept open at a multi-entrance property | Vehicles use the remaining entrance while the other is built. | Confirm that the open route works for fire vehicles, refuse trucks and people with disabilities. | Which entrance stays open during each stage, turning restrictions, signage and notice of switching. |
The distance and safety of an alternate route matter as much as whether one technically exists. A remote parking area may not work for a resident using a wheelchair, a person receiving oxygen, or a delivery that requires a truck. Tell the project team about those constraints before the closure is scheduled; do not wait until equipment is in the driveway.
Put the plan in writing
A phone conversation can be forgotten when crews or subcontractors change. Email the project contact a concise summary and ask for confirmation. Save the notice, plan, photographs and every response in one folder. Your written request should ask:

- Which driveway, curb cut or access point is affected in each construction stage?
- On what dates and during what hours will vehicles be restricted or prohibited?
- Can a car enter and leave continuously, or only at controlled times or one vehicle at a time?
- If parking moves off site, where is it, how far is it, and who maintains a safe pedestrian route?
- How will emergency, fire, medical, delivery, utility and service vehicles reach the property?
- Will the crew provide advance notice before excavation, concrete placement or a daily closure?
- Who is the on-site contact if the agreed route is blocked, muddy, unsafe or unavailable?
- If access is proposed to change permanently, where can you review the written decision, reasons and any review or appeal process?
Request a plan even when the contractor says a closure will last only a short time. A short closure can still disrupt medication deliveries, work schedules, school transport or a home-care visit. The more consequential the interruption, the more important it is to have dates and responsibilities documented.
Prepare your property before crews arrive
Follow the project notice for local instructions. Toledo, Ohio, for example, tells residents to remove personal items from the public right-of-way and clearly mark sprinkler heads. Its guidance says an unmarked irrigation system damaged during construction is the homeowner’s responsibility to repair. Those instructions are local, not a nationwide rule; ask your own agency how it wants private features identified. See the city’s construction FAQ.
Before the first closure, move vehicles, trailers, bins and stored materials out of the work area. Photograph the driveway, edging, drainage, retaining walls, mailbox, irrigation markers and any existing cracks from several angles, with the date recorded. Mark private utilities only as the agency directs; never assume a paint mark or flag makes an unverified line safe to excavate.

- Give the project contact the information needed to coordinate an urgent delivery without posting private medical details publicly.
If you have a medical need or mobility limitation, Toledo specifically directs residents to contact Engage Toledo. Elsewhere, use the service channel printed on your notice and ask that the accommodation be recorded in the project file.
Concrete can make a driveway unusable after the crew leaves
Concrete work creates a different restriction from excavation: the surface may look finished while it is still curing. Toledo says residents will be notified before its crews begin concrete work and warns that a newly poured driveway may be inaccessible for up to seven days. That is Toledo’s local estimate, not a nationwide curing period; weather, concrete specifications and the responsible agency can change the schedule.
Ask when the pour is planned, when foot traffic is allowed, when vehicles are allowed, and what happens if rain or a failed inspection delays reopening. Confirm where you should park before the pour, how a person on foot reaches the home, and who removes the barricade. Do not move cones or drive onto the slab because it appears hard; obtain release instructions from the project team.

Use the number on the current project sign or written notice rather than an old neighborhood flyer. New York City Department of Transportation says its project signs include a project number, estimated duration and a phone number for questions. It directs residents with location-specific concerns to NYC311 or the department: NYC DOT street and roadway construction information. A city, county or state agency elsewhere may use a different service center, so record the project number and quote it whenever you call.

Toledo’s local guidance says residents will be notified before construction begins. It also explains that streets under construction may be closed to through traffic while emergency services and deliveries can access the street. That practice does not promise the same arrangement in another city. Ask whether the restriction applies only to through traffic or also to your driveway, and whether an emergency vehicle can physically reach the property during each stage.
Project durations are estimates. If the sign gives an end date, ask what event controls reopening: final inspection, concrete strength, striping, utility testing or another stage. Request an update when the date changes rather than relying on a general statement that work is nearly complete.

Access rights, driveway permits, notice requirements and compensation rules are controlled largely by state and local law. The Federal Highway Administration explains that states determine abutting owners’ access rights under their own laws and that state and local agencies set many driveway placement, design and permitting requirements. Its overview is useful background, but it does not create a universal entitlement to a particular driveway or notice period: FHWA Access Management (Driveways).

Separate temporary construction staging from a proposed permanent change. A contractor may close an entrance for a pour and reopen it, while an agency may propose relocating, consolidating or removing an approach. The second situation calls for the formal process identified in your jurisdiction, not merely a conversation with a flagger.

Oregon illustrates how specific that process can be. For certain Statewide Transportation Improvement Program highway projects that modify, relocate or remove approaches, the Oregon Department of Transportation describes an Access Management Strategy, engagement with affected owners and an Official Project Access List. Its guidance says a final decision to close, modify or relocate an approach must be sent in a notice letter offering the review options described in the process. Some non-STIP projects may also require notice and an opportunity for review when an approach changes. These procedures apply to the covered Oregon projects, not automatically to other states: ODOT PD03: Access Management in the Project Delivery Process.
If the project proposes a permanent change, ask for the drawing, parcel-specific decision, supporting reasons, deadline for review and the office that accepts comments or appeals. Check the responsible agency’s current rules; do not rely on a neighbor’s experience in another jurisdiction.
If the agreed access fails on site
- Check immediate safety. Keep people and vehicles away from moving equipment, open excavation and unstable surfaces. Call emergency services for an emergency, and tell the dispatcher that normal access is obstructed.
- Call the on-site contact. Give the project number, address, location of the blockage and the access arrangement that was agreed. Ask for a safe, documented correction rather than moving barriers yourself.
- Send a written follow-up. Email the project contact and agency with the time, photographs, missed access and requested remedy. Keep the message factual and retain the response.
- Escalate through the agency’s service channel. Use the number on the sign or notice, such as the local 311 system where applicable. Ask for a case or reference number.
- Protect critical services. Tell medical providers, carers, deliveries and fire or utility services about the temporary route, but do not direct them onto a closed or unsafe surface without agency approval.
When the problem concerns a proposed permanent removal or relocation rather than a missed staging commitment, ask the agency for its written decision and review procedure. The remedy and deadline depend on local law and project documents.
Questions to ask before signing off on the plan
- What exact activity blocks or narrows my access, and what is the earliest and latest date for that stage?
- Can I leave and return at all times, at specified times, or only with a flagger?
- Where will visitors, carers, deliveries and waste collection stop?
- Is the alternate route safe for a wheelchair, walker, child or person carrying supplies?
- Can a fire truck, ambulance and utility vehicle reach the building without moving equipment?
- Who has authority to change the plan, and how will residents receive that change?
- What condition must concrete or another new surface reach before vehicles may use it?
- Is this closure temporary construction staging or a proposed permanent access modification?
Written answers to these questions give you something specific to check when the work reaches your property. They also show the crew what access is essential, instead of leaving each shift to make a different assumption.
