What Homeowners Should Check Before Signing a Construction Contract

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before signing a construction, repair, or remodeling contract, verify the contractor, make the scope and materials specific, confirm the price and payment schedule, understand cancellation and lien terms, and keep a complete paper trail. Do not sign with blanks, rely on verbal promises, or pay the entire price in advance.

This checklist is U.S.-oriented. Licensing, required contract language, deposit limits, cancellation rights, permits, and mechanic’s-lien procedures vary by state and locality, so confirm the rules that apply to your property.

1. Confirm who will perform the work

A polished estimate does not establish that a contractor is licensed, insured, reliable, or financially responsible. Complete these checks before comparing prices.

Verify licensing with the proper authority

Look up the contractor’s license with the state, county, or city authority where licensing applies. Check that the legal business name, license number, classification, and expiration date match the person or company named in the contract. Ask what work the license permits and whether subcontractors need separate licenses. Save a dated screenshot or printout of the lookup for your records.

Request proof of insurance

Ask for current certificates showing the types and limits of coverage relevant to the project, such as general liability and workers’ compensation. A certificate should identify the insured business and policy dates. If the contractor says workers are independent subcontractors, ask who covers injuries and property damage; do not assume your homeowners policy will protect you from every claim.

Check references, complaints, and business identity

Ask for references from projects similar in size and complexity. Speak with recent customers about schedule changes, workmanship, cleanup, communication, and final billing. Search the contractor’s business name with your state or local consumer-protection and licensing agencies for complaints or disciplinary actions. Confirm the legal entity and physical contact information so a contract is not merely with an individual whose identity is unclear.

Obtain more than one written estimate

Get at least two or three written bids when practical. A low headline price can reflect omitted work, cheaper materials, an unrealistic schedule, or an allowance that will later increase. Compare the defined scope, materials, permits, dates, payment schedule, licensing, insurance, and exclusions—not just the total.

2. Make the scope of work precise

The contract should be understandable to someone who was not present for your conversations. It must capture what will be built, repaired, removed, delivered, and finished.

Describe every work item

List demolition, preparation, structural work, installation, painting, trim, cleanup, debris removal, testing, and final inspection as applicable. Identify rooms, elevations, dimensions, quantities, and finish standards. Attach drawings, specifications, engineering reports, or approved selections and label each attachment as part of the contract.

Identify materials and quality

State the manufacturer or product line when it matters, along with model, grade, color, size, quantity, and acceptable alternatives. Specify who purchases materials, who owns them before installation, and who pays for delivery, storage, taxes, and disposal. If an allowance is used, state the allowance amount and explain how an overage or credit will be calculated.

Record promises made outside the document

Put every material promise from calls, texts, site meetings, and estimates into the signed agreement or an attached change order. If the contractor says a feature is included, a date is achievable, or a warranty applies, write it down. A promise that remains only verbal is difficult to prove and easy to misunderstand.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Assign permits and approvals

State who obtains and pays for building, electrical, plumbing, zoning, or other required permits and inspections. Require copies of applications, approvals, inspection results, and the certificate of occupancy or final approval when applicable. Confirm that the planned work complies with local rules before construction starts.

3. Check the core contract terms

The document should identify the parties and set measurable expectations. Use this review table before signing.

Term What to verify
Parties Full legal name, business address, phone, email, license number where applicable, and the homeowner’s correct name and property address.
Scope Detailed work description, plans and specifications, materials, quantities, quality standards, exclusions, cleanup, and responsibility for subcontractors.
Dates Estimated start and completion dates, working hours, milestones, and how weather, supply shortages, owner delays, or approved changes affect the schedule.
Price Total contract price, taxes, allowances, permitted additions, credits, and a clear method for pricing changes.
Payments Deposit, installment amounts, due dates or milestones, retainage if any, acceptable payment methods, receipts, and conditions for final payment.
Changes Requirement for a written change order showing the revised scope, price, and schedule before extra work begins, except for narrowly defined emergencies.
Permits Named party responsible for applications, fees, inspections, corrections, and delivery of final approvals.
Warranty and remedy What is covered, for how long, exclusions, notice procedure, and who pays for correcting defective work.
Termination and disputes Permitted reasons to terminate, notice method, payment for completed work, removal of materials, dispute process, and any applicable attorney-fee or arbitration clause.

Ask the contractor to explain any clause you cannot apply to a real project event. If an explanation changes your understanding, revise the contract before signing rather than relying on the conversation.

4. Compare bids on substance, not the headline price

Place competing proposals side by side and mark every difference. A useful comparison includes the following:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Comparison point Questions to ask
Scope Does each bid include the same demolition, preparation, installation, finishing, testing, and cleanup?
Materials Are brand, grade, dimensions, quantity, and finish equivalent? Are allowances hiding an unknown cost?
Permits Who applies, pays, schedules inspections, and corrects failed inspections?
Schedule What are the estimated start and completion dates, milestones, working hours, and delay provisions?
Price What is fixed, what is an allowance, and what can increase the price?
Payments How much is due at signing, at each milestone, and at completion? Is final payment conditioned on completion and your acceptance?
Credentials Are license and insurance information current and verifiable?
Contract quality Does the written proposal capture your expectations, or does it leave important details to later conversations?

When one bid is substantially higher or lower, ask the contractor to explain the difference in writing. Do not make a selection solely because it is the cheapest.

5. Review deposits and payment controls

Do not pay the entire price upfront

Use a deposit and progress payments tied to agreed milestones rather than paying the full contract price before work begins. Some states limit home-improvement down payments or prescribe payment timing; check your state and local rules before agreeing to an amount. The contract should state exactly what event makes each installment due and what documentation demonstrates that the milestone is complete.

Hold back final payment until completion

Do not make the final payment until the contracted work is complete, required inspections have passed, unresolved punch-list items are addressed, and you are satisfied with the result. If local law or the contract permits retainage, state the amount and release conditions clearly. Avoid withholding an arbitrary amount; use the written contract and applicable law.

Use traceable payment methods

For disaster-repair work, Federal Trade Commission guidance recommends paying by credit card or check and warns against wire transfers, gift cards, payment apps, cryptocurrency, or cash. A traceable method creates a record and may offer dispute options. Obtain a dated receipt for every payment showing the amount, project, and installment or invoice covered.

6. Understand cancellation rights before signing

Read the cancellation section and ask which law governs the transaction. Federal Trade Commission guidance says a written statement of a three-business-day cancellation right should be included when a contract is signed in the homeowner’s home or somewhere other than the seller’s permanent place of business. That rule applies to the specified signing context; it does not mean every construction contract has the same cancellation period.

Check your state’s requirements for cancellation notices, cooling-off periods, emergency-repair exceptions, and the method and deadline for delivering a cancellation. Keep the contract, notices, and proof of delivery. If a salesperson pressures you to sign immediately, refuses to leave a copy, or says cancellation rights do not exist without explaining the applicable law, stop and obtain advice before signing.

7. Protect yourself from mechanic’s liens

Unpaid contractors, subcontractors, or suppliers may have lien rights under state law even when you paid the person you hired. Ask for a mechanic’s lien waiver at the beginning of the project and for each payment phase. The Consumer Financial Protection Bureau describes a waiver as documentation that a contractor has been paid and has no further right to place a lien for an unpaid bill.

State law controls the wording, timing, and legal effect of waivers. Confirm whether the appropriate document is conditional on cleared payment or unconditional, and whether separate waivers are needed from subcontractors and suppliers. Keep waivers with invoices, canceled checks, and payment receipts. A waiver is not a substitute for verifying that the project’s bills are actually being paid.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

8. Eliminate blanks and preserve the record

Complete the document before signing

Every blank should contain a term, “not applicable,” or another clear entry. Draw a line through unused spaces so new language cannot be inserted later. Initial material changes and make sure both parties sign and date the same version.

Keep a complete project file

Save the signed contract and every attachment, estimate, change order, plan, warranty, guarantee, permit, inspection report, invoice, receipt, lien waiver, email, text message, photograph, and progress note. Record dates, who attended site meetings, decisions made, and defects reported. Back up digital copies in a location separate from the job site.

Control change orders

Before extra work starts, require a written change order describing the new work, reason, price increase or credit, material substitution, and schedule impact. Do not approve an open-ended instruction such as “we will sort out the price later.” If concealed conditions require immediate action, document the condition with photographs and obtain the narrowest written authorization practical.

9. Get professional review for a large or complicated project

For a significant financial commitment, the Consumer Financial Protection Bureau says, “If the contract is for a significant amount of money, you may want to have it reviewed by a lawyer.” A construction attorney can identify unfavorable termination, indemnity, arbitration, warranty, payment, or lien language and check state-specific requirements. The cost of a short review can be modest compared with the cost of correcting an ambiguous contract after work begins.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For disaster repairs involving insurance or FEMA funds, keep records of payments, progress, approvals, and communications with the insurer, government agency, contractor, and adjuster. Do not sign an assignment of insurance benefits or a broad release without understanding its effect.

10. Use this final signing-day checklist

  1. Confirm the contractor’s legal name, contact details, license status, and insurance documents.
  2. Read the entire scope, plans, material specifications, exclusions, and cleanup obligations.
  3. Verify who obtains permits and who pays fees and inspection costs.
  4. Check start and completion estimates, milestones, delay rules, and working hours.
  5. Confirm the total price, allowances, taxes, change-order method, and payment schedule.
  6. Make sure no full-price-upfront payment is required and that final payment follows completion and acceptance.
  7. Read cancellation, warranty, termination, dispute, and lien-related provisions.
  8. Fill every blank, attach every referenced document, and remove conflicting drafts.
  9. Sign and date the same final version; obtain a complete copy immediately.
  10. Set up a folder for receipts, progress photographs, permits, inspections, change orders, and lien waivers.

Red flags that justify delaying the signature

  • The contractor will not provide a license number, insurance proof, references, or a written scope.
  • The bid is dramatically lower than others and the contractor cannot explain what is excluded.
  • You are asked for the entire price in cash, by wire, gift card, cryptocurrency, or another untraceable method.
  • There are blank spaces, missing attachments, contradictory prices, or promises that appear only in conversation.
  • You are pressured to sign immediately, discouraged from consulting a lawyer, or denied a copy.
  • The contractor refuses written change orders or will not identify who is responsible for permits.
  • Progress payments are requested even though the related milestone is incomplete or required inspections have failed.

A construction contract should let you answer, in writing, what will be done, with which materials, by whom, when, for how much, and under what payment and remedy rules. If any of those answers is uncertain, postpone signing until the document and the applicable local requirements are clear.

Product prices and availability are accurate as of the date/time indicated and are subject to change. Any price and availability information displayed on Amazon at the time of purchase will apply.
