What Happens When a Developer Delays Construction After Land Approval?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Delaying construction after land approval does not automatically cancel the project, but the approval may lapse when its stated deadline or a required commencement, condition or completion milestone is missed. The legal result depends on the exact approval named on the decision notice, the issuing authority, the jurisdiction, and the conditions attached to it. A developer may need an extension before expiry, a discretionary reinstatement after lapse, or an entirely new approval.

“Land approval” can mean several different legal documents

There is no single legal status called “land approval.” The document may be planning permission, development approval, subdivision approval, site-plan approval, a provisional permission, or another local authorization. Each can have a different validity period and different consequences when work is delayed.

One approval may authorize the land use or subdivision layout without authorizing physical building work. A building permit, construction certificate, engineering approval, environmental clearance or other condition may still be required. Read the exact title on the decision notice and identify the agency that issued it before deciding whether a delay is legally significant.

The approval notice normally provides the most important dates and triggers: when the approval was granted, when it expires or lapses, what must happen before work starts, and whether a later permit or completion milestone controls. A financing delay, a contractor dispute or an empty site does not answer those questions by itself.

What actually determines whether the approval survives

The stated expiry or lapse rule

Some approvals expire on a fixed date measured from the grant. Others lapse unless development begins within a specified period. A condition may require submission of plans, commencement of a defined stage or completion by a deadline. In a staged approval, one part can remain effective while another part lapses.

Do not assume that every permission lasts three years, or that every authority measures time from the same event. The decision notice and the governing legislation control. If the notice is silent, the issuing authority can explain which statutory default applies; a locally qualified planning professional can interpret how it applies to the site.

What the law considers “commencement”

Authorities do not use one universal test for commencement. Applying for finance, submitting a building-permit application, fencing the site, clearing vegetation or carrying out nominal activity may not qualify. Some regimes look for a legally recognized material operation or a defined construction stage. Obtain the authority’s interpretation in writing and preserve dated evidence such as inspection records, permits, contracts, photographs and site reports.

Conditions that must be met first

A permission can be current yet unusable because a pre-commencement condition has not been discharged. Conditions may require drainage designs, access works, environmental surveys, affordable-housing arrangements, infrastructure contributions or approval of detailed drawings. Starting work without satisfying a condition can make the development unlawful and expose it to enforcement, even if the headline permission has not expired.

Related approvals and permits

Planning or development approval may not keep a project alive if a related approval has expired. Check building permits, subdivision plans, road-opening permits, utility approvals, environmental authorizations and any land-sale or registration requirements separately. A later permit may itself be the event that preserves an approval in some jurisdictions.

How different jurisdictions treat delay

The following examples show why a result cannot be transferred from one location to another. They are illustrations of different legal mechanisms, not universal deadlines.

Location and approval pathway Initial time rule Extension or reinstatement Important qualification
Singapore, Urban Redevelopment Authority (URA) Provisional Permission Lapses six months after grant. URA says an extension application should be made two months before expiry. Eligibility and construction-progress requirements apply; no automatic extension.
Singapore, URA Written Permission Lapses two years after grant. For qualifying approved developments that have not started construction and are not affected by public schemes or planning studies, up to two extensions may potentially take validity to six years from grant. Further extension after foundation or piling work depends on sufficient construction progress.
Ontario, draft subdivision approval An approval authority may set a lapse period of at least three years. An extension may be available. In limited circumstances an authority may deem an approval not to have lapsed. The Ontario reinstatement route is discretionary, requires an affidavit or sworn declaration and is subject to statutory restrictions, including a five-year limit from lapse and restrictions involving qualifying land-sale agreements.
Ontario, site-plan approval A municipality may impose a lapsing period. The approval does not lapse if a building permit issues before the specified period ends. This is a separate pathway from draft subdivision approval; the applicable site-plan notice and municipal rules govern.
Queensland, development approval The approval’s currency period and conditions control. A formal extension application may be granted, refused or granted for a different period. The assessment manager must decide within 20 business days unless the period is extended by agreement. Development can lapse to the extent it is not completed within a period required by a condition.
England, planning permission Government guidance describes a usual three-year limit for beginning development, unless a different period is imposed. The permission and applicable planning rules determine whether a further application is possible. Pre-commencement conditions must be discharged; work carried out without complying with them may be unlawful and subject to enforcement.

For Singapore, the Urban Redevelopment Authority’s official wording is direct: “Apply to extend your Provisional or Written Permission before it expires.” Its extension guidance was last updated 12 June 2026. Ontario’s rules come from the current Planning Act and provincial site-plan guidance. Queensland’s rules are in the current Planning Act 2016. The English commencement guidance was revised in 2019.

What to do while the approval is still valid

  1. Identify the document. Copy the exact approval name, reference number, grant date and issuing authority from the decision notice.
  2. Calculate every relevant date. Record the expiry or lapse date, any commencement deadline, deadlines for submitting later plans and any completion period. Use the notice’s stated method of counting time, including business-day rules where applicable.
  3. Map the conditions. Separate conditions that must be discharged before work starts from those that apply during construction or at completion. Ask the authority whether a written discharge, inspection or certificate is required.
  4. Confirm the commencement test. Request the authority’s definition and identify what evidence it accepts. Do not rely on a token site activity unless the governing rule clearly recognizes it.
  5. Check connected permits. Verify that building, engineering, environmental, subdivision, access and utility approvals remain current and consistent with the approved scheme.
  6. Apply for an extension early. Follow the authority’s prescribed form, evidence and fee requirements. Singapore’s guidance calls for an application two months before expiry. Queensland allows an assessment manager to consider any relevant matter and to grant a different period from the one requested.
  7. Keep proof of filing and decisions. Save the complete application, acknowledgment, correspondence, revised conditions and the written decision. An informal conversation does not replace a formal extension or condition-discharge decision.

If the deadline has already passed

First establish whether a lapse occurred

A date in a developer’s spreadsheet is not conclusive. Check the statutory rule, the approval wording, extensions already granted, condition-discharge records and any event that may have stopped or reset the clock. Ask the issuing authority for its position before relying on the approval or carrying out work.

Use an available extension route

Some laws permit an application only while the approval remains in force. Filing after expiry may be rejected as out of time, even where the project is otherwise unchanged. Where a post-expiry application is allowed, the authority may reassess current planning circumstances, infrastructure capacity, environmental constraints and policy changes.

Check for discretionary reinstatement

Ontario illustrates a narrow reinstatement mechanism: an authority may, at its discretion, deem certain approvals not to have lapsed, but statutory restrictions apply. Fewer than five years must have passed since lapse for the described route, qualifying land-sale agreements can disqualify an application, and an affidavit or sworn declaration is required. This mechanism should not be treated as a general right or assumed to exist elsewhere.

Prepare for a fresh application

If no extension or reinstatement is available, the developer may need a new approval. A fresh application can be judged against current zoning, design standards, infrastructure requirements, environmental information and community or public-policy changes. Earlier approval does not guarantee the same result, conditions or timetable.

Do not start construction merely because an application for renewal, reinstatement or a new approval has been filed. Until the authority confirms the legal position, work may be unauthorized and subject to stop-work directions, enforcement or other remedies.

How delay interacts with conditions and completion deadlines

Expiry is only one failure mode. An approval can remain within its headline validity period while a condition causes a narrower lapse. Queensland’s Planning Act, for example, provides that development approval can lapse to the extent development is not completed within a period required by a development condition. A variation approval may have a stated period, an applicant-nominated period or, in certain cases, a default five-year period.

England’s guidance similarly emphasizes pre-commencement conditions. If a condition requires approval of a construction-management plan before development begins, starting excavation first does not cure the breach. The authority can treat the work as unlawful even though the planning permission itself has not reached its ordinary time limit.

For a staged scheme, create a schedule showing which phase is covered by which condition and which deadline. Confirm whether completing foundations, obtaining a building permit, commencing the first dwelling or completing all infrastructure is the relevant milestone. A broad statement that “construction has started” may be legally inadequate.

Financial and project consequences of waiting

  • Redesign exposure: Current standards may require changes to access, drainage, energy performance, parking, density or environmental mitigation if a new approval is needed.
  • Cost escalation: Updated infrastructure contributions, consultant fees, application charges and construction costs can alter the project budget.
  • Financing risk: Lenders and investors may require evidence that the approval remains live and that all pre-commencement conditions are discharged.
  • Contract risk: Land-sale, consultant and contractor agreements may contain dates tied to approval validity or commencement. Review notice, termination and extension provisions.
  • Enforcement risk: Work started without a valid approval or without complying with a condition can lead to stop-work action and remedial requirements.
  • Evidence risk: Missing records can make it difficult to prove timely commencement, condition discharge or a properly filed extension.

A practical file review for a delayed site

Assemble one dated file containing the decision notice, approved plans, all conditions, authority correspondence, extension requests and decisions, building-permit records, inspection reports, photographs, contracts and evidence of site activity. Add a one-page chronology from grant to the present date.

Then ask the issuing authority six focused questions:

  • What is the exact approval type and current status?
  • What date starts the validity or currency period?
  • What event counts as commencement for this approval?
  • Which conditions must be discharged before any work?
  • Is an extension, reinstatement or amendment available, and what is the filing deadline?
  • Which related permits or approvals must also remain current?

Request written answers or a formal status letter where possible. If the project is near expiry or already past it, have a locally qualified land-use planner or property-development lawyer review the actual notice and dates before work resumes.

Common questions about delayed construction

Does planning approval always expire if construction has not started?

No. Some approvals use a commencement deadline, some use a fixed expiry date, and some conditions create separate completion or staging deadlines. The governing approval and local law decide the result.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can a developer extend an expired approval automatically?

No. Extension processes are generally formal and discretionary in the examples above. A post-expiry remedy may be unavailable, limited or treated as a new application.

Does applying for a building permit preserve every approval?

No universal rule applies. Ontario site-plan guidance identifies issuance of a building permit before the specified period as a circumstance in which site-plan approval does not lapse, but that is a specific pathway and cannot be generalized to subdivision, development or planning permissions elsewhere.

Is a small amount of site work enough to prove commencement?

Not necessarily. The sources do not establish a universal definition. Ask the issuing authority what physical work and evidence satisfy the particular approval.

What if the approval is valid but a pre-commencement condition is outstanding?

Do not begin the restricted work. Obtain the required approval or written discharge first; otherwise the work may be unlawful and enforceable even before the permission’s normal expiry date.
