What Happens When a Building Violates Its Approved Plan?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When construction differs materially from the plans and permit conditions approved by the building authority, the authority can order work to stop, require corrections or revised drawings, restrict occupancy, impose penalties for continuing, or revoke or amend the permit. Whether the work can remain as built depends on local law, the size and nature of the change, and its effect on structural, fire and life safety. An owner should follow the written notice, stop the affected work, and ask the issuing authority and the responsible design professional what documentation, inspections and approvals are required before resuming or occupying the building.

What counts as a violation of an approved plan?

An approved plan defines the scope the permit holder is authorized to build. The controlling documents can include stamped drawings, specifications, approved amendments, site plans, energy documents, accessibility details and conditions written on the permit. A field change becomes a compliance issue when the completed or ongoing work no longer matches those documents or fails a permit condition.

Minor changes versus material departures

Not every difference has the same consequence. A change that does not affect code compliance may be handled through a field clarification or a later drawing update in some jurisdictions. A change to a structural member, fire-resistance rating, exit route, sprinkler layout, alarm system, occupancy arrangement or other regulated feature is more likely to be treated as material. The authority, not the owner or contractor, decides whether an existing change is acceptable as built.

Work can be in violation even when it looks complete, passes an informal contractor check or seems safer than the original design. The question is whether the work conforms to the approved documents and the applicable code. Local terminology varies: an agency may issue a notice of violation, correction notice, stop-work order, permit suspension, or another written directive.

What usually happens after an inspector finds the difference?

Enforcement is local and fact-specific, but the process commonly follows this pattern.

1. The authority documents the nonconforming work

An inspector or building official identifies the work that differs from the approved documents. The written record may identify a room, floor, drawing detail, inspection item or code provision. Ask for the exact document and field condition cited; a verbal description is not enough to plan a correction.

2. Work may be stopped in part or in full

A stop-work order can halt the entire project or only the affected portion. New York City lists significant departures involving structure, fire ratings, fire protection, detection, suppression and other life-safety requirements among conditions that can lead to a stop-work order. The order should state what must happen before work resumes.

Continuing after service can create a separate violation or additional penalties. Pennsylvania regulation 34 Pa. Code § 403.81(a) states: “A building code official may issue a written stop work order when the official determines that construction violates the Uniform Construction Code or is being performed in a dangerous or unsafe manner.” The same rule requires the written order to give reasons and conditions for resumption, and Pennsylvania warns that construction continued after service may result in penalties.

3. The permit may be changed or revoked

The authority may require corrected work, revised construction documents, an amended permit, a reissued permit or another authorization. Florida law authorizes permit revocation when construction violates or does not conform to the Florida Building Code. Revocation does not mean every jurisdiction will use the same procedure; the written local notice controls.

4. Inspections and occupancy can be restricted

An open violation can prevent final inspections or delay a certificate of occupancy, letter of completion or comparable close-out document. The authority may require concealed work to be exposed, engineering documentation, special inspections or several follow-up visits before signing off.

How common are plan-conformity stop-work cases?

New York City Department of Buildings data illustrate the type of issue, but they are not national rates. In the agency’s Quarter 2, 2026 published top-ten stop-work-order list, the categories were:

NYC stop-work category Share in Q2 2026 How to interpret it
Work without a permit 21.7% Agency-specific share of that quarter’s listed stop-work orders
Miscellaneous violations 17.6% Agency-specific share; category includes issues not separately listed
Work not conforming to approved construction documents and/or approved amendments 12.6% Agency-specific share, not an estimate of all plan deviations

These figures describe NYC’s published categories for one quarter. They do not predict the probability of enforcement in another city, state or country.

What should an owner do immediately?

  1. Stop the affected work. Follow the order’s scope. If it is unclear whether the order covers the whole site, ask the issuing office in writing before allowing work to continue.
  2. Obtain the complete written notice. Get the violation, stop-work order, inspection report, photographs and any listed code sections. Record the service date because deadlines and penalty periods can run from service.
  3. Identify the approved baseline. Assemble the permit, stamped plan set, approved amendments, specifications and inspection records. Mark the exact drawing detail that differs from field conditions.
  4. Protect people and the site. Make temporary conditions safe, secure excavations and openings, weatherproof exposed work and maintain required fire protection. Do not conceal the disputed work before the authority or design professional has inspected it.
  5. Contact the issuing authority and design professional. Ask what correction, revised-plan, engineering or inspection submittal is required. A licensed architect or professional engineer may be needed, subject to local licensing rules and the project type.
  6. Choose a documented compliance route. Determine whether the work must be removed, can be modified, or may be accepted through revised documents. Obtain the authority’s requirements rather than assuming an as-built drawing will be approved.
  7. Complete required inspections and obtain written release. Keep approved revisions, inspection reports and the final sign-off with the project records. Do not rely on a verbal statement that the issue is closed.

What are the possible ways to resolve the violation?

Authorities do not all offer the same choices. Compare the available route against safety, approval requirements, physical work and schedule before committing funds.

Resolution route When it may fit Questions to ask Typical project effect
Correct the physical work The installed condition can be brought into the approved design and code. Which items must be removed or rebuilt? Are destructive inspections required? Construction cost, debris, redesign of adjacent work and a new inspection sequence.
Submit revised construction documents The change may comply with code if the authority accepts a new design. Must drawings be sealed? Is a structural, fire or accessibility analysis required? Review time and possible construction changes; approval is not guaranteed.
Amend or reissue the permit The jurisdiction has a formal process for changing permit-basis information. Does work remain stopped until issuance? Are new fees or plan reviews required? Work may resume only after the written authorization identified by the authority.
Remove and replace noncompliant work The deviation cannot be approved or creates unacceptable risk. What temporary protection and inspection hold points apply? Longest schedule impact, but it may be the only path to occupancy.

Some jurisdictions may combine these routes. None should be assumed from another location’s practice.

Why structural and fire-safety changes require urgency

Aesthetic or finish changes can still require documentation, but safety-related deviations deserve immediate escalation. Examples include undersized beams, relocated load-bearing walls, altered foundations, blocked or narrowed exits, changed fire separations, unprotected penetrations, relocated sprinklers, modified alarm or detection devices, and changes to the number or arrangement of occupants.

Do not cover or load disputed structural work until the responsible design professional evaluates it. For fire and life-safety systems, preserve temporary protection required by the authority and coordinate any shutdowns with the fire-protection professional and building official. An inspector may require calculations, field testing, special inspection reports or replacement with the approved assembly.

Can the building remain as built?

Sometimes an authority can approve a compliant alternative through revised plans or an amendment. In other cases, the deviation must be corrected or removed. The deciding factors can include the applicable code edition, zoning and accessibility rules, structural capacity, fire-resistance performance, inspection evidence, property use and whether the change affects neighboring units or public safety.

An owner should not treat an as-built drawing as automatic permission. It is a record of what exists; it does not itself legalize work. Ask the authority whether it accepts as-built documentation, a formal revision, a variance, an alternative-method approval or another mechanism, and what professional certification is required.

What happens to occupancy, sale and refinancing?

Open violations can remain consequential after physical construction stops. A jurisdiction may withhold a certificate of occupancy, temporary occupancy approval, letter of completion or final permit closure until corrections and inspections are complete. That can prevent lawful use of the space even if utilities are connected and the building appears finished.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

New York City provides a specific example: active Department of Buildings violations must be corrected before a new or amended certificate of occupancy or letter of completion can be issued. Public violations can also affect a sale or refinancing in NYC. This is a NYC-specific consequence, not a rule for every property market; lenders, title companies and buyers elsewhere may apply different requirements.

How selected jurisdictions describe the authority’s power

New York City

The Department of Buildings uses the concept of work that is significantly different from approved plans and identifies major structural, fire-rating, fire-protection, detection, suppression and life-safety departures as stop-work conditions. Its public violation records and close-out requirements make unresolved conditions visible during some transactions.

Pennsylvania

Under 34 Pa. Code § 403.81, a building code official may issue a written stop-work order for a Uniform Construction Code violation or dangerous or unsafe construction. The order states reasons and conditions for resumption, and continuing after service may bring penalties.

Florida

Florida law authorizes permit revocation when construction violates or does not conform to the Florida Building Code. The statute demonstrates that permit revocation is a possible enforcement tool; it does not establish the procedure or penalty schedule for every Florida project.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ontario

Ontario law requires notice to, filing with and authorization from the chief building official before a material change is made to information on which a permit was issued. A material field change therefore should be raised with the building official before it is treated as final.

What controls cost and schedule?

  • Extent of physical correction: Removing finishes to reach concealed work can multiply labor and restoration costs.
  • Technical review: Structural calculations, fire-engineering analysis, testing and special inspections add professional time.
  • Permit review: A revised submittal may enter the authority’s normal review queue and generate comments.
  • Inspection access: Failed or missed inspections can require reopening work and rebooking inspectors.
  • Downstream work: A changed wall, shaft, exit or service route can affect mechanical, electrical, plumbing and accessibility installations.
  • Occupancy dependency: Delayed close-out can postpone tenant move-in, financing milestones or a transaction.

Because local agencies set their own fees, deadlines and penalty schedules, a reliable budget requires the written notice, the approved plan set and a scope prepared by the project professionals.

Common mistakes that make a violation worse

  • Continuing work after a stop-work order because the remaining tasks seem unrelated.
  • Destroying evidence or concealing disputed work before inspection.
  • Submitting drawings that show the field condition without asking whether formal approval is required.
  • Assuming a contractor’s change order replaces an amended permit.
  • Relying on a different city’s process, a prior project or an informal phone assurance.
  • Waiting to address the issue until a sale, refinance or occupancy application exposes the open violation.

How to prevent plan-conformity problems

Use a written change-control process throughout construction. Require the contractor to flag proposed deviations before installation, have the architect or engineer evaluate code and design effects, and submit amendments before the change is built when local rules require advance authorization. Keep one controlled set of approved drawings on site, record inspection hold points and photograph concealed work before covering it. At project close-out, compare the field condition with the approved set and resolve discrepancies before requesting final occupancy documents.

The practical test is simple: if a proposed change affects structure, fire protection, exits, accessibility, occupancy, site layout or another permit condition, pause and ask the issuing authority what approval is required. Early written clarification is usually less disruptive than discovering the difference after finishes, inspections or financing milestones are complete.
