It is an appraisal conclusion based on a particular scheme, market, policy framework and set of assumptions. Depending on local law and the evidence, the project may be redesigned, phased, supported with grant or tax incentives, renegotiated through an authorised mechanism, delayed or abandoned. An authority may reject the developer’s calculation, require more evidence or use review conditions to recover affordable housing later.
The decisive questions are how development value compares with costs and a reasonable return, whether the assumptions are credible, and what the relevant planning rules and affordability covenants require. England and Washington State illustrate different approaches; neither is a universal rule.

What “not viable” means in a development appraisal
Viability is a financial test, not a legal permission to remove affordable homes. In a residual appraisal, the expected value of the completed development is compared with all relevant costs. The residual is commonly expressed as the value available for land or the developer’s profit after costs.
Homes England’s Financial viability for housing-led projects, published 10 December 2021, describes the calculation in plain terms: “If costs exceed GDV (Gross development value), there is no land value, and the scheme is unviable.” That sentence describes the England guide’s appraisal model; it is not a universal statutory test.

Gross development value (GDV) can include private-sale receipts, affordable-housing value and commercial value. A complete cost plan may include:
- Construction, demolition and abnormal works
- Contamination remediation, ground conditions and infrastructure
- Professional, planning and technical fees
- Planning contributions and other policy obligations
- Marketing, sales and legal costs
- Interest, finance fees and other funding costs
- Land value and an assumed developer return
A scheme can therefore fail because of land price, build-cost inflation, infrastructure, finance, weak market values or an unrealistic profit assumption—not simply because it includes affordable homes. The appraisal must show which input creates the gap and how sensitive the result is to changes.
Why affordable homes can reduce scheme revenue
Affordable rents and sale prices are restricted, so those units generally produce less revenue than comparable market units. Construction, finance, infrastructure and professional costs, however, do not fall in the same proportion. On a scheme with little financial headroom, that lower revenue can contribute to a funding gap.

That relationship does not prove that the affordable-housing requirement caused the entire shortfall. A credible assessment should test, at minimum, the following interacting variables:
- Market sale values or rents and the evidence supporting them
- Affordable rents, prices, service charges and operating assumptions
- Build costs, abnormal works and contingency
- Land price, existing-use value and any landowner premium
- Debt terms, interest rates, timing and finance fees
- Infrastructure costs and planning contributions
- Available grant, tax relief, fee waivers or other subsidy
- Developer return and the risk allowance used
- Phasing, sales rates and the date at which receipts arrive
Homes England’s framework treats all of these as part of the value-and-cost calculation. Removing affordable homes may improve the spreadsheet’s revenue, but it can also conflict with adopted policy, funding conditions or a long-term covenant.

What can happen after a shortfall is claimed?
No single outcome follows from an appraisal labelled “unviable.” The planning authority’s rules, the evidence, the stage of the project and any executed agreement determine what is legally and practically available.
Redesign or change the unit mix
The parties may alter layouts, tenure proportions, dwelling sizes, parking, specification or infrastructure design to reduce costs while retaining affordable homes. A redesign should be tested against design standards, building regulations, accessibility, fire safety and the authority’s housing need—not just the developer’s target return.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsPhase the development
Phasing can spread abnormal works and infrastructure, align borrowing with receipts and defer later affordable units until a later phase. The permission or legal agreement should state the trigger, number, tenure and delivery date for each phase. A vague promise to “review later” gives less certainty than an enforceable schedule.
Reassess land and cost assumptions
Land value is often the largest residual variable. An authority may examine whether the acquisition price reflects policy-compliant development rather than an expectation that policy will be reduced after purchase. It may also test current tender evidence, abnormal-cost reports, finance quotes, sales values and contingency. A high purchase price does not by itself establish that affordable housing is infeasible.
Seek public support or regulatory incentives
Grant, tax relief, reduced fees, parking reductions, density changes or faster approvals can close part of a funding gap. Any support should be quantified as public value foregone and matched to a measurable affordable-housing outcome. Incentives can have their own eligibility rules and affordability periods.

Use a permitted alternative contribution
Some systems allow an off-site project or payment in lieu instead of on-site homes. This is not an automatic developer option: the authority must have legal power, apply its adopted criteria and show that the alternative delivers an equivalent or better result where the law requires it. The agreement should specify how the money or land will produce homes, when it must be provided and what happens if delivery fails.
Delay, renegotiate or stop the project
If no lawful adjustment closes the gap, construction may be delayed while market conditions change, a revised application may be submitted, or the proposal may not proceed. A claim of non-viability does not let a developer remove affordable homes unilaterally from an approved permission or signed agreement.
England: policy, evidence and review mechanisms
England’s national planning guidance defines viability as testing whether the value generated by development exceeds its cost. It identifies GDV, costs, land value, landowner premium and developer return as central elements. Assessments should use appropriate evidence, be proportionate and transparent, and be publicly available. Decision-makers are expected to ask whether conclusions are objective, reasonable and realistic.
There is an important distinction between a plan-level policy and an individual application. At plan stage, affordable-housing requirements should be informed by need and proportionate viability evidence. Policies should be clear enough to be reflected in land prices, so a later purchaser cannot normally assume that an adopted requirement will simply disappear because the site was bought expensively.
Application-stage review mechanisms can address uncertainty over sales values, costs or timing. If an early contribution is below policy level to provide flexibility, the agreement should explain how compliance can be achieved over the project’s life. The purpose is to strengthen the authority’s ability to secure policy compliance, not to guarantee the developer’s return.

A special rule applies to certain Green Belt sites subject to the National Planning Policy Framework’s Golden Rules: site-specific viability assessment should not be used to reduce developer contributions, including affordable housing. That is an England-specific policy context and should not be presented as a general rule elsewhere.
Washington State: incentives, alternatives and long-term affordability
Washington provides a useful example of how a local framework can respond to marginal projects. Department of Commerce guidance describes tools including density and height or bulk bonuses, fee waivers or exemptions, parking reductions, expedited permitting and impact-fee relief subject to statutory funding rules.
Some local incentive programs can require long affordability periods. Under the Washington statute, covered incentive-program units are committed to continuing affordability for at least 50 years, subject to statutory alternatives such as payment in lieu. A jurisdiction may accept payment or property instead of units when it finds that the alternative achieves an equal or better result and the payment does not exceed the approximate cost of producing equivalent units.
Commerce guidance describes certain program renter-income limits as, by default, at or below 50% of county median family income, while owner-occupancy limits are 80%, subject to the applicable statute and local provisions. These thresholds are Washington-specific; they are not nationwide standards.

This is context-specific stakeholder evidence, not a finding that inclusionary housing generally causes underdevelopment.

How to scrutinize a viability claim
Authorities, community groups and project teams can use a disciplined review rather than arguing over a single headline profit number.
- Identify the decision and legal framework. Record the local plan, zoning or planning policy, statutory incentive program, affordability covenant, decision-maker and appeal route.
- Define the scheme being tested. Check the drawings, unit count, tenure mix, phasing, specification, infrastructure and delivery timetable. A different scheme can produce a different appraisal.
- Test GDV. Require evidence for market values, affordable rents or prices, sales rates, voids, service charges and commercial receipts. State the valuation date and geography.
- Audit costs. Reconcile the cost plan to current tenders or benchmarks and identify abnormal works, contingency, finance, fees, contributions and taxes. Explain every material variance.
- Examine land value. Separate existing-use value, benchmark land value, acquisition price and any premium. Do not treat the price paid as proof of the correct policy-compliant land value.
- Check return and finance assumptions. State the developer return, risk allowance, debt rate, loan timing and equity assumptions. A scheme can appear unviable if the return is set above a reasonable market level.
- Model alternatives. Compare redesign, phasing, grant, tax or fee relief, density changes and permitted off-site contributions. Show how each changes affordable output and total supply.
- Set enforceable review terms. Specify triggers, information rights, independent review, deadlines, payment security and remedies if later value improves.
Transparency matters because an appraisal is sensitive to small changes in values, costs and timing. Public availability and proportionate disclosure also allow affected residents and elected decision-makers to test the conclusion.
Comparing possible responses
| Response | Affordable homes | Timing and certainty | Public cost or trade-off | Checks needed |
|---|---|---|---|---|
| Redesign or lower-cost specification | May retain on-site units, but size, tenure or quality can change | Usually quicker if approval is minor; certainty depends on revised permission | Potential design or infrastructure compromises | Cost plan, standards, accessibility and housing-need assessment |
| Phasing with later review | Can preserve the policy total over time | Later delivery is less certain than completed units | Authority carries timing and market risk | Triggers, deadlines, review data and security |
| Grant, tax relief or fee waiver | Can protect on-site depth and tenure | Depends on funding availability and eligibility | Public money or foregone revenue | Quantified subsidy, affordability term and clawback |
| Off-site homes or payment in lieu | Units may move elsewhere; payment must fund equivalent output where required | Delivery depends on a separate site or future spending | Loss of on-site mixed communities; administration cost | Legal authority, valuation, location, schedule and enforcement |
| No project | No affordable or market homes from this proposal | Immediate certainty that this scheme will not deliver | Housing and infrastructure opportunity is lost | Evidence that lawful alternatives were exhausted |
For every option, name the number and depth of affordable homes, whether they remain on site, eligible household income, affordability duration, delivery date, subsidy source, effect on total housing and infrastructure, and the review and enforcement arrangements.

Common mistakes and how to avoid them
- Treating “unviable” as a legal status: It is an appraisal conclusion that must be tested against the applicable rules.
- Blaming affordable housing alone: Land, costs, finance, values, grants and profit assumptions can be equally or more important.
- Using an acquisition price as a fixed fact: The price may reflect expectations that conflict with adopted policy.
- Ignoring public subsidy: Grant, tax relief and fee waivers should be shown as inputs with conditions, not hidden benefits.
- Leaving review terms vague: “Review if viable” needs triggers, information, dates and remedies.
- Confusing a stakeholder concern with a measured rate: No reliable figure establishes how often schemes are abandoned or affordable units removed.
- Assuming one jurisdiction’s remedy travels elsewhere: England’s review guidance and Washington’s 50-year and payment-in-lieu rules depend on their own legal systems.
What this means for a live construction proposal
Before changing a tender, programme or affordable-unit schedule, assemble the appraisal and the legal documents together. Confirm whether the affordable requirement is in a policy, planning condition, section 106 agreement, covenant, funding contract or incentive program. Check who can approve a variation and whether a lender, housing provider or public funder must consent.
For a contractor, the practical issue is often the scope and timing of work rather than the policy debate. A later phase may change procurement packages, preliminaries, inflation exposure, utility works and handover dates. A revised unit mix can alter cores, fire strategy, accessibility details and services. Those consequences should be priced and programmed before a viability variation is requested.
For an authority or housing partner, insist on a version-controlled appraisal, source documents for major assumptions and a clear record of which affordable homes are secured, when they will be completed and for how long they must remain affordable. If the proposal uses payment, land or tax relief instead of on-site units, document the equivalent output and the remedy if it is not delivered.
The practical answer
When a development is not viable, affordable housing may be redesigned, phased, supported, renegotiated through a lawful mechanism or lost if the project does not proceed. It should not disappear merely because a developer asserts that the numbers do not work. The outcome turns on transparent evidence, reasonable assumptions, the local planning framework and enforceable long-term affordability requirements.
