What Happens If You Build Without a Permit? Stop-Work Orders, Fines and How to Fix It

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If you build work that required a permit, the local building authority can order construction to stop, require an application and inspections, impose fines or other enforcement, and sometimes restrict use or occupancy. In New York City, work covered by a stop-work order cannot resume until the permit is issued and the order is rescinded. Delaware law, for example, bars occupancy of an unpermitted building without departmental permission. The exact result depends on the property’s jurisdiction, the type and value of work, applicable exemptions, and what the authority finds on inspection.

Do not assume that a small project is exempt or that an after-the-fact application automatically makes existing work legal. Identify the building department serving the property, pause work if an order has been issued, and ask that office exactly what permits, plans, inspections, corrections and penalties apply.

What can happen immediately?

The first practical consequence is often an order to stop. Seattle says it may issue a stop-work order for a building, addition or remodeling project started without a permit. New York City Department of Buildings (DOB) likewise uses stop-work orders (SWOs) for work being performed without required authorization. Once an order covers the work, continuing can create a separate violation from the original unpermitted construction.

An order can also interrupt contractors, deliveries, financing and scheduled inspections. Treat the notice as controlling: read the scope, date, issuing unit and instructions, then contact the official named on it. Do not rely on a contractor’s assurance that work may continue.

New York City’s explicit restart rule

NYC DOB states that work covered by an SWO cannot resume until a permit has been issued and the order has been rescinded. Its guidance warns: “If you resume work before the SWO has been rescinded, DOB may issue violations carrying additional civil penalties, even though a work permit has been issued.” This is a New York City rule, not a nationwide standard. The agency describes lifting an order as a process that can include correcting cited conditions, requesting reinspection, paying applicable penalties and contacting the issuing unit. See the NYC Department of Buildings stop-work-order guidance.

Why the answer changes by location and project

Permit laws are local and fact-specific. A project can involve several approval systems at once: building, electrical, plumbing, mechanical, gas, zoning, demolition, grading, environmental or flood-hazard rules. The same physical work may be exempt in one jurisdiction and regulated in another, or exempt only when it stays below a specified value and meets documentation requirements.

Seattle’s current municipal guidance lists permits for many projects involving new construction, alterations or remodeling, demolition, changes of use or occupancy, certain work in environmentally critical areas and grading. It says the city may fine an owner or take other enforcement action for unpermitted construction or failure to obtain final inspection approval. Review the city’s Construction Without a Permit guidance for the address-specific rules.

A limited Florida exemption is not a general safe harbor

Florida’s 2026 statute generally requires a permit before covered construction, alteration, repair or demolition. It also requires local governments to exempt some work on a single-family dwelling when the work’s value is below $7,500, but only if the statutory conditions and documentation are met. The exemption excludes, among other categories, electrical, plumbing, structural, mechanical and gas work, and it does not apply to certain property in a flood-hazard area. The current statutory text is in Florida Statutes §553.79 (2026). Have the local authority confirm that every part of the proposed work fits the exemption before starting.

Examples of consequences in four jurisdictions

The examples below show why a national “standard fine” does not exist. They are legal or administrative rules for the named places, not predictions for every U.S. property.

Jurisdiction What the official rule or guidance addresses Amount or condition
Seattle, Washington Many new, altered, remodeled, demolished, rezoned-use, environmentally critical-area and grading projects require permits; the city may issue a stop-work order and take enforcement action. The guidance does not state one universal fine. It says an owner may be fined or face other enforcement for unpermitted work or missing final inspection approval.
New York City An SWO for work without a permit stops covered work. A permit alone does not restart it; DOB must also rescind the order. Violating an SWO can incur $6,000 for a first offense and $12,000 for subsequent offenses under current DOB guidance accessed October 13, 2026.
Florida Permits are generally required before covered construction, alteration, repair or demolition. A limited single-family exemption can apply below a $7,500 work value when statutory conditions are met. The exemption excludes electrical, plumbing, structural, mechanical and gas work and certain flood-hazard property; documentation is required under the 2026 statute.
Delaware Officials may order unpermitted construction discontinued until a permit is obtained. The code also addresses use of an unpermitted building. The statute states a fine of $50–$200 per offense and says an unpermitted building may not be occupied, maintained or used without departmental permission. Verify current applicability.

Can you get a permit after the work is done?

Some authorities accept an application for existing or already-started work, sometimes called a retroactive or after-the-fact permit. Availability, fees, drawings and inspections are local decisions; no jurisdiction-wide promise can be inferred from another city or state.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If an order is posted, an application by itself does not clear it. NYC’s process illustrates the sequence an authority may require:

  1. Stop the covered work. Preserve the site in the condition required by the notice. Do not conceal framing, wiring, plumbing or other work that inspectors need to see.
  2. Read the notice and contact the issuing unit. Ask which violations, permits, plans, licensed professionals and deadlines apply to the specific address.
  3. Prepare the application and supporting documents. The department may require existing-condition drawings, structural calculations, product information, contractor details or proof of ownership. Request the exact checklist rather than guessing.
  4. Expose or correct work as directed. Inspectors may require walls, ceilings or other areas to be opened so concealed work can be evaluated. Unsafe or noncompliant work may have to be changed or removed.
  5. Complete required inspections. Schedule the inspections named by the authority and keep written results. A permit is not the same as final approval.
  6. Pay assessed penalties and request order rescission. NYC says correcting cited conditions, requesting reinspection, paying applicable penalties and contacting the issuing unit are part of lifting an SWO. Resume only after written or system confirmation that the order has been rescinded.

A locally licensed contractor, architect, engineer or permit expeditor may help with complex structural, electrical, plumbing, life-safety or zoning issues. No professional can guarantee that an existing installation will be approved or allowed to remain.

How much is the fine?

There is no reliable nationwide amount. The charge may depend on the jurisdiction, number and duration of violations, whether an order was ignored, the project’s scope and whether a hearing or correction process is involved.

For a concrete example, NYC DOB’s current guidance lists $6,000 for a first violation of an SWO and $12,000 for subsequent violations. Those figures concern violating the order; they are not a general fine automatically imposed on every person who initially builds without a permit. Delaware’s code states $50–$200 per offense, but that range is a Delaware statutory provision and must be checked against the property and current enforcement authority. Seattle describes possible fines and other enforcement without publishing one universal amount in the cited guidance.

Ask the department for a written fee and penalty schedule tied to your case. Distinguish application fees, plan-review fees, inspection fees, civil penalties and daily or repeat-offense charges; they may be assessed under different provisions.

Will the authority make you tear it down?

Demolition is not an automatic nationwide consequence, but neither is approval of existing work. An inspector may require correction, partial removal or complete removal when work cannot be brought into compliance, when required elements cannot be verified, or when the property presents a safety or land-use problem. The decision depends on the local code, the permit category, the condition of the work and the authority’s findings.

Do not cover or finish unpermitted work to make it look complete. Concealment can prevent inspection and increase the amount that must be opened or rebuilt. Before spending more money, obtain the authority’s written direction on what must be exposed, engineered, corrected or removed.

Can an unpermitted building be occupied?

Some jurisdictions restrict use until approval. Delaware’s statute says an unpermitted building may not be occupied, maintained or used without permission from the department. That is a Delaware rule, not a universal U.S. requirement. A local authority may also limit a particular room, addition, change of use or occupancy even when the rest of a property is approved.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask specifically whether anyone may occupy the space while an application or appeal is pending, whether a temporary permission exists, and what inspection or certificate is required before use. Do not treat utility connection, tax assessment or physical completion as proof that occupancy is authorized.

What about selling a house with unpermitted work?

The sources cited here do not establish a general answer about sale disclosure, insurance, mortgage approval or the legal effect of unpermitted work on a transaction. Those issues depend on state law, the contract, the type of defect and the policies of the insurer and lender. Before listing or signing a contract, ask the building department for the property’s permit and violation record and obtain jurisdiction-specific advice from a qualified real-estate attorney or other licensed professional. Do not describe the work as approved merely because it is old or has not yet drawn an enforcement notice.

What to do if you discover unpermitted work

  1. Stop adding to the problem. If work is underway, pause it. If an SWO or similar notice is posted, follow its exact terms.
  2. Identify the authority. Use the property address to find the city, county or state building department with jurisdiction; zoning, fire or environmental agencies may also be involved.
  3. Collect the facts. Record dates, dimensions, materials, contractors, invoices, photographs and any prior permits or inspection reports. Do not alter evidence before an inspector advises you.
  4. Request the official path to compliance. Ask whether an after-the-fact permit is available, what plans and professionals are required, which inspections must be performed, what must be opened, and how penalties are calculated.
  5. Use qualified local help where needed. Structural, electrical, plumbing, gas, mechanical, flood-hazard and life-safety issues often require licensed design or trade professionals familiar with the local code.
  6. Keep a written record. Save the notice, applications, receipts, inspection results, correction lists and confirmation that an order has been lifted or final approval issued.

How to avoid an unpermitted-project problem

  • Describe the full scope to the building department before hiring or starting work, including interior changes, accessory structures, grading, demolition and changes in use.
  • Ask which separate trade, zoning, environmental, floodplain or fire approvals apply.
  • Get the exemption in writing when a rule depends on a dollar threshold, project type or property location.
  • Confirm who will obtain the permit and schedule inspections; put that responsibility in the contract.
  • Do not rely on a previous owner’s permit, a tax record or a neighbor’s project as evidence that your work is exempt.
  • Schedule final inspections and retain the approval record with the property documents.
