What happens if a housebuilder delays completing your new-build home?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If your new-build home is delayed, you cannot assume that you may cancel, demand compensation or automatically recover your deposit. The result depends on the signed sale contract, the contractual long-stop date, the notice period for completion and the consumer code, if any, that covers the builder and your reservation.

Start by asking your conveyancer to identify those clauses in writing. Then obtain the builder’s reason for the delay, a revised estimate and confirmation of whether a contractual deadline is affected. Do not serve a termination notice, refuse to complete or accept a revised date until you understand the contract-specific consequences.

The difference between an estimated date and a long-stop date

New-build paperwork commonly contains an anticipated or estimated completion date. This is the developer’s forecast of when the property should be ready, not necessarily the date on which the contract ends if construction runs late. A missed estimate is therefore not, by itself, proof that you can walk away.

Anticipated completion date

The estimate helps you plan, but the contract should say what happens if it moves. Ask whether the date is expressly contractual, what event starts the delay period, and whether the builder must give a particular notice when the property is ready.

Contractual long-stop date

A long-stop date is a later deadline written into the contract. UK Government home-buying guidance describes it as a date that can allow a buyer to withdraw after a sufficiently long delay. Government material also says new-build contracts generally set out the parties’ rights and responsibilities, including circumstances in which a deposit or other payment is returned.

The long-stop wording matters. It may be tied to exchange of contracts, the anticipated date, a construction stage or another defined event. It may also require you to give notice within a specified period. Only the signed contract and the facts of your transaction establish whether the deadline has passed and what you may do next.

Check the notice period before completion

Even when the house is physically ready, legal completion may not occur immediately. The contract should state how much notice the developer must give before requiring completion and the date on which ownership transfers.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Ask your conveyancer for the exact number of days’ notice required.
  • Confirm how the notice must be served and when the period starts.
  • Check whether the notice can be issued while specified works, certificates or access arrangements remain outstanding.
  • Compare the notice with the mortgage, funding and moving arrangements you have already made.

The New Homes Quality Code requires the contract to explain the completion-notice period and the date ownership transfers. A notice that does not follow the contract may need to be challenged promptly; do not simply ignore it.

What rights might the contract or consumer code give you?

Your sale contract comes first

Read the clauses headed completion, delay, long-stop, termination, rescission, deposit, reservation fee, notice to complete and dispute resolution. They may define an “unreasonable” or “excessive” delay, specify a notice procedure and state whether money is repaid. A general promise to finish by a target date is not a substitute for those provisions.

Consumer Code Scheme, fifth edition

The Consumer Code Scheme’s fifth edition is stated to apply to homes reserved from 1 January 2024. For a covered builder, its Code Requirements page says that when a buyer terminates because of unreasonable delay as defined in the contract, the contract deposit, reservation fee and pre-payments must be repaid in full, without deductions, within 28 calendar days.

That is a scheme rule with conditions, not an automatic remedy for every delayed new-build. Confirm that the builder participates, that your reservation date falls within the relevant edition and that the contract’s definition and termination procedure have been met before relying on it.

New Homes Quality Code

The New Homes Quality Board’s code requires the contract to explain when a customer can cancel, including circumstances involving excessive or unreasonable delay in construction or in sending the notice to complete. It also requires information about what happens if the home will not be ready by the stated date and how deposits are protected.

The code does not replace your contract. It tells you what information and protections the covered developer’s documentation should contain. Check the wording supplied with your reservation and exchange documents rather than relying on a generic summary of the code.

Which consumer code applies?

NHBC explains that builders may adopt either the Consumer Code for Home Builders or the New Homes Quality Code and should tell buyers which scheme applies. A home being newly built does not, on its own, identify the applicable route.

Question Consumer Code for Home Builders New Homes Quality Code
How do you establish coverage? Check the builder’s stated participation and the reservation date against the edition in force. Check that the developer was registered and that your reservation falls within the scheme’s eligibility rules.
What delay information should be in the contract? The contract and applicable edition govern the long-stop, delay and repayment wording. The contract should explain the completion-notice period, ownership-transfer date, cancellation circumstances and readiness arrangements.
What happens if you want to complain? Follow the builder’s complaints process and the dispute route available under the scheme. Follow the developer’s process and check whether you qualify for the New Homes Ombudsman Service.
What must you avoid assuming? Do not assume a code remedy applies without confirming participation and reservation timing. Do not assume registration alone proves that every reservation is eligible.

Keep the builder’s code information, reservation paperwork and registration details with your contract. The applicable scheme can affect the complaint route and the remedies described in the documents.

What to do when the completion date moves

  1. Gather the complete file. Collect the reservation agreement, exchange contract, plans, specification, every completion estimate, notices, emails and text messages. Record when each communication was received.
  2. Ask focused questions in writing. Request the reason for the delay, the best current completion estimate, the construction milestone still outstanding and confirmation of whether the contractual long-stop date or another deadline changes.
  3. Ask your conveyancer to map the dates. Have them identify the anticipated date, long-stop date, event that starts any delay period, notice-to-complete period, termination trigger and repayment wording. Ask for the result in plain language.
  4. Check the code and edition. Confirm whether the builder follows the Consumer Code for Home Builders or the New Homes Quality Code, which edition applies to your reservation and whether any registration-date requirement affects eligibility.
  5. Document financial impact. Keep receipts and dated evidence of costs caused by the delay. The reviewed code material does not establish that such costs are automatically recoverable; whether you can claim depends on the contract and the facts.
  6. Continue the builder’s internal process. If updates do not resolve the issue, make a written complaint using the developer’s published procedure. State the dates, the information you need and the outcome you are requesting.
  7. Check independent escalation. Ask the relevant code body or ombudsman scheme whether your builder and reservation qualify, and follow its time limits and evidence requirements.
  8. Take advice before a decisive step. Obtain contract-specific legal advice before serving a termination notice, refusing to complete, signing a variation or accepting a replacement date.

Can you cancel the purchase?

Possibly, but only if a contractual or applicable code trigger has occurred and you follow the required notice procedure. A missed estimate may not be enough. A long-stop date, an express excessive-delay clause or another defined event may create a termination right.

Cancellation can also have timing consequences. The contract may require notice in a particular form, give the builder an opportunity to remedy a problem or specify what happens to the deposit and other payments. Sending an informal email saying that you are pulling out may not be effective and could create a dispute about whether you breached the contract.

Before acting, ask your conveyancer to confirm:

  • the precise trigger for termination;
  • the date on which that trigger occurred;
  • the method and address for serving notice;
  • the payments that should be returned and the timing;
  • whether termination affects any separate reservation, mortgage or related agreement; and
  • what evidence should accompany the notice.

Can you refuse to complete on the new date?

Refusing to complete is not the same as exercising a valid termination right. If the developer has served a valid notice under the contract and you simply do not complete, the contract may impose consequences. The available material does not establish one universal result, so the wording and circumstances must be reviewed by a conveyancer or property solicitor.

If the home is not ready, identify what “ready” means in your documents. The contract may distinguish practical construction completion from legal completion, certificates, utilities, access, inspection or agreed snagging. Raise defects and missing items through the process specified in the contract and code rather than treating every outstanding item as an automatic right to cancel.

Will you get your deposit and other payments back?

Do not promise yourself a refund based only on the length of the delay. The contract may state which payments are protected and when they are returned. Under the Consumer Code Scheme fifth edition, the qualifying unreasonable-delay termination rule covers the contract deposit, reservation fee and pre-payments, with full repayment without deductions within 28 calendar days. That protection applies only when the scheme, reservation date, contract definition and termination requirements all line up.

Other sums may be treated differently. Ask specifically about reservation money, deposits paid on exchange, upgrades, options, legal costs and any separate payment. If the builder disputes the trigger or the amount, preserve the dispute correspondence and use the applicable complaint and escalation route.

Can you claim temporary accommodation or other delay costs?

You may have incurred rent, storage, removals, loan, travel or other costs, but the reviewed official material does not establish that these are automatically payable. A claim depends on the contract, any applicable code, proof of causation and the legal position in your jurisdiction.

Keep a dated schedule with invoices, receipts and a short explanation linking each cost to the changed completion date. Do not exaggerate or assume that every inconvenience is compensable. Ask your adviser whether the contract contains a damages, compensation or dispute-resolution provision that could apply.

How complaints and ombudsman routes work

Start with the developer. NHBC’s consumer-code guidance directs buyers to raise concerns with the builder and follow its complaints process. Submit a concise chronology, identify the clause or code requirement you believe is relevant and request a written response.

If the builder’s response is unsatisfactory, check the independent route for the code that covers your purchase. The New Homes Quality Board says qualifying customers of registered developers can access the New Homes Ombudsman Service from reservation through two years after legal completion. Eligibility depends on the developer’s registration date and your reservation date, so verify both before relying on that route.

Keep copies of every complaint, acknowledgement, inspection report and proposed resolution. Ombudsman or code procedures may require you to complete the builder’s process first and may impose deadlines.

Historical long-stop examples: useful context, not a current entitlement

A fourth-edition Consumer Code for Home Builders guidance document published in 2017 gave illustrative maximum long-stop periods that varied by property type and construction stage. Where exchange occurred before the roof was complete and weatherproof, it described six months for houses and twelve months for apartments; at a more advanced stage, it described two months for houses and four months for apartments.

Those figures are historical examples from older guidance, not statutory limits and not a safe measure of your current rights. Use them only as context for why contracts distinguish houses, apartments and construction stages. The signed contract and the code edition applicable to your reservation control.

Before you decide: a practical checklist

  • Have you identified the contractual anticipated date and long-stop date?
  • Have you confirmed what event starts the delay period?
  • Do you know the required notice period before legal completion?
  • Have you confirmed which consumer code and edition apply?
  • Is the builder’s registration or scheme participation relevant to your eligibility?
  • Have you received the delay reason and a current written estimate?
  • Have you kept dated evidence of communications and costs?
  • Have you completed the builder’s complaint process?
  • Has a conveyancer reviewed any termination or refusal-to-complete step?

What the government’s expectation means

In a 31 March 2022 written parliamentary answer, the UK Government said it expects housing developers to deliver good-quality homes, deliver them on time and treat buyers fairly. That is a policy expectation, not a standalone promise of compensation or a right to cancel. Your enforceable position still comes from the contract, any applicable consumer code and qualified advice on the facts.
